Abstract

Pengabdian ini dilakukan dengan judul Penyuluhan Hukum Tentang Pentingnya Kepemilikan Sertifikat Hak Milik Hak Atas Tanah Untuk Menjamin Kepastian Hukum Di Kampung Asei Besar Distrik Sentani Timur Kabupaten Jayapura, kegiatan yang dilakukan kepada mitra dikarenakan adanya kasus dari mitra tentang ketidakpahaman mengenai prosedur pembuatan sertifikat hak milik atas tanah sehingga dengan keahlian yang dimiliki pengabdi dapat melakukan penerapan IPTEKS tersebut guna agar mitra dapat mengetahui status kepemilikan tanah mereka dan cara pengurusan sertifikat hak milik atas tanah pada Kantor Pertanahan Kabupaten Jayapura untuk menjamin kepastian hukum. Metode pelaksanaan pengabdian ini dilakukan dengan cara melalui ceramah dan diskusi yang dilaksanakan pada hari sabtu, tanggal 27 juli 2024 yang dilaksanakan di Balai Kampung Asei Besar. Kegiatan ini di awali dengan persiapan dan koordinasi, kemudian pemaparan materi dengan memberikan pengetahuan kepada mitra mengenai prosedur pengurusan sertifikat hak milik atas tanah. Adapun luaran dari pengabdian ini adalah memberikan pemahaman kepada mitra tentang status kepemilikan hak-hak atas tanah, pendaftaran tanah, prosedur pengurusan sertifikat hak milik atas tanah dan juga memberikan pendampingan hukum pra ajudikasi dalam proses pengurusan sertifikat pada Kantor Pertanahan Kabupaten Jayapura. Selain itu juga target luaran berikutnya pengabdi akan publikasikan kegiatan ini kedalam jurnal nasional pengabdian masyarakat.

Abstract

The title of this community service program is "Marriage Registration Assistance According to Law No. 1 of 1974 on Marriage," which was held on August 25, 2024, at the Sidang Jemaat Allah Efesus Church in Jayapura Regency, with 28 (twenty-eight) congregants in attendance. The activity utilized counseling and interactive discussion methods to provide a comprehensive understanding of the importance of official marriage registration according to the law. Participants were given a step-by-step guide on the marriage registration process and informed about the legal rights obtained after the marriage is registered. The outcome was an increased awareness among the congregants about the significance of official marriage registration, with several participants expressing interest in registering their marriages in accordance with applicable legal provisions.

Abstract

The practice of concurrent positions carried out by the Board of Directors in the management of a PT does not yet have a legal basis regulated explicitly in Law Number 40 of 2007 concerning Limited Liability Companies (UUPT). Concurrent positions lead to legal loopholes that can cause potential losses to the company. This research aims to analyze the practice's suitability with the law's provisions and compare it with policies in the United States. This research uses a normative method with conceptual and statutory approaches and secondary data from relevant regulations. The results show that concurrent positions can cause conflicts of interest, weaken management, and undermine corporate governance. Legislation changes are needed in Indonesia to limit the number of positions a director can hold and impose more severe sanctions for violators. In conclusion, a law revision is needed to strengthen the regulation of concurrent positions to promote better corporate governance.

Abstract

The capacity building of employees at the Regional Revenue Agency (Bapenda) of Jayapura Regency in understanding and implementing Law Number 1 of 2022 on Financial Relations between the Central Government and Regional Governments is crucial for optimizing regional financial management. This new regulation brings significant changes in the mechanisms of fund transfers, as well as tax and regional retribution management, requiring deep understanding and technical skills from the employees. The purpose of this community service is to enhance the understanding and skills of Bapenda Jayapura Regency employees in drafting academic papers and regional regulations (Raperda) related to taxes and retributions. Thus, it is expected to improve the effectiveness and efficiency of regional revenue management in accordance with the provisions of the new law. This community service is conducted using lecture and mentoring methods. The lecture method is used to provide theoretical understanding of Law Number 1 of 2022 and its implications for regional governments. Meanwhile, the mentoring method is used to assist employees in directly drafting academic papers and Raperda, ensuring that these documents comply with legal principles and local needs. The results of the community service show a significant increase in employees' understanding of the new financial regulations. Bapenda Jayapura Regency employees successfully drafted academic papers and Raperda on taxes and retributions in accordance with the provisions of Law Number 1 of 2022. Additionally, this activity also encouraged collaboration and interactive discussions that enriched the practical and theoretical understanding of the employees.

Abstract

Pengabdian ini dilakukan dengan judul Penerapan IPTEKS Tentang Cara Penyelesaian Sengketa Tanah Ulayat Perspektif Peraturan Menteri Negara Agraria/KBPN Nomor 5 Tahun 1999 Di Kampung Asei Besar Distrik Sentani Timur Kabupaten Jayapura, kegiatan yang dilakukan kepada mitra dikarenakan adanya kasus dari mitra tentang ketidakpahaman mengenai penyelesaian sengketa tanah ulayat berdasarkan peraturan perundang-undangan yang berlaku dan dimana para pihak yang bersengketa tidak ada yang mau mengalah atau mau menang sendiri sehingga dengan keahlian yang dimiliki pengabdi dapat melakukan penerapan ilmu pengetahuan dan teknologi tersebut guna agar para pihak yang bersengketa dapat mengetahui tentang adanya peraturan perundang-undangan yang mengatur dalam penyelesaian masalah hak ulayat masyarakat hukum adat. Metode pelaksanaan pengabdian ini dilakukan dengan cara penerapan IPTEKS melalui ceramah dan diskusi yang dilaksanakan pada hari sabtu, tanggal 7 Desember 2023 yang dilaksanakan di Balai Kampung Asei Besar dengan memberikan pengetahuan kepada mitra tentang pedoman penyelesaian masalah hak ulayat masyarakat hukum adat. Adapun luaran dari pengabdian ini adalah memberikan pemahaman kepada mitra tentang hal-hal yang menyebabkan sengketa tanah ulayat antar kampung yang satu dengan kampung yang lain dan melakukan pendampingan hukum kepada mitra untuk penyelesaian sengketa batas tanah ulayat didalam masyarakat hukum adat berdasarkan peraturan perundang-undangan yang berlaku. Selain itu juga target luaran berikutnya pengabdi akan publikasikan kegiatan ini kedalam jurnal nasional pengabdian masyarakat.

Abstract

This research aims to determine, analyze and explain the role of banking institutions in empowering small businesses of Indigenous Papuans in Jayapura Regency and the role of KADIN and KAPP Papua in empowering small businesses of Indigenous Papuans in Jayapura Regency. The type of research used is empirical legal research because it is motivated by the idea that law cannot be separated from people's lives in the form of values and attitudes/behavior carried out, so that the study of law does not only involve normative aspects, but law can be studied from its empirical aspect, namely how the law is. in fact in people's lives. The results of the research reveal that after the implementation of special autonomy for the Papua Province, the empowerment of small businesses of the indigenous Papuan community has not been carried out optimally by the Provincial, Regency and Jayapura City Governments, so it is not in accordance with the application of the theory of justice which emphasizes that justice is fairness and should always be fought for through correlation. and improving social institutions, economic institutions and other institutions through agreements that are used as a legal basis to be directed towards justice for all interested parties. Likewise, the role of banking institutions is not yet optimal, because loans in the form of MSME credit and KUR are hampered by collateral problems. Specific forms of empowerment for small businesses have not yet been regulated, so the Regency/City Government needs to make a Regional Regulation (PERDA) regarding small businesses of the indigenous Papuan community so that they have access to sources of financing and guarantees in an effort to empower small businesses of the indigenous Papuan community.

Abstract

This research aims to determine the application of the principle of delimitation contradiction at the Jayapura City Land Office and to determine the resolution of land disputes resulting from the non-implementation of the principle of delimitation contradiction at the Jayapura City Land Office. The research method used is normative juridical and empirical, namely an approach that refers to statutory regulations, library materials, written regulations or other secondary legal materials and looks at their application through field research. The results of this research reveal that the application of the Delimitation Contradiction Principle at the Jayapura City Land Office can actually work well, but if it is related to technical problems in previous maps such as old registration maps that have been lost or have been damaged, there are often overlaps or overlapping plots of land and also what often happens in the field is that the bordering party is not present so BPN entrusts a sheet to fill in the measuring drawings, automatically this is where the application of the Delimitation Contradictory Principle does not work properly and the resolution of land disputes due to not implementing the Delimitation Contradiction Principle is where the BPN facilitates mediation between the two parties rather than having to go to court. If it is still not resolved, a procedural team is created whose members are from the structural work unit in accordance with the procedures for handling land disputes regulated in the Minister of State for Agrarian Affairs/KBPN Regulation No. 5 of 1999. The task of the work team is to receive and resolve land disputes that come to local work environment. So that the resolution of land disputes does not necessarily take place directly through litigation.

Abstract

The research with the title: The Position of Islamic Law in Indonesian Positive Law (Analysis of the Application of Islamic Law Provisions in the Marriage Aspect Through a Systems Approach aims to determine and explain the position of Islamic Law which is integrated in Indonesian positive law, especially the application of Islamic law provisions in the Marriage legal aspect in Positive Law in Indonesia.This research is a normative legal study, which uses a normative juridical approach, which is an approach to conducting a study and study of the provisions of Islamic law and positive law that applies in relation to the issue of Islamic law in the provisions of Indonesia's positive law in the aspect of marriage.The research results show that the position of Islamic Law in Indonesian Positive Law can be seen from the development of law and the constitution in Indonesia, where the provisions of Islamic law which are adhered to by the majority of the Indonesian population have become a source of law for the development of national law. Several provisions of Islamic law have been integrated into positive law in the Indonesian legal system and have been implemented in a formal juridical manner, including provisions relating to family/marriage law regulated in Law Number 1 of 1974 concerning Marriage, provisions regarding waqf regulated in Law Number 41 of 2004 concerning Waqf, as well as the existence of Religious Court institutions regulated in Law Number 7 of 2004 1989 which was amended by Law Number 3 of 2006, as an institution authorized to resolve problems related to marriage, inheritance and waqf for citizens who embrace the Islamic religion. Furthermore, through a legal system approach, the enactment of Islamic law provisions in positive law is carried out in a formal juridical manner through the formation of legislation that accommodates the provisions of Islamic law. The position of Islamic law in positive law through a legal system approach can be seen in the provisions of Islamic law which have been integrated into positive law in the Indonesian legal system as a national legal system. The provisions of Islamic law in positive law are included as a substantial component, namely provisions that are guided by citizens, especially those who embrace the Islamic religion. As a structural component, it is seen in the existence of the Religious Courts as an institution that has the authority to resolve problems in family law. and the cultural component (legal culture) is the behavior and high legal awareness of the community, especially citizens who embrace the Islamic religion. These three components of the legal system determine the position of Islamic law in the applicable Positive Law.

Abstract

Customary constitutions in Indonesia are scattered in various regions at the village, sub-district, district, city, province, and even archipelago levels.  The codification and unification of laws are increasingly undermining the existence of customary constitutions in Indonesia.  The existence and position of the customary constitution are increasingly unclear in the regulatory framework in Indonesia. Maintaining the customary constitution is crucial as it can serve as a spirit and guide in the formation of national law.  To remind the nation again about the spirit of being cultured and to give the nation confidence in the nation's civilization, it is necessary that the customary law be placed in an equal position with the existing and recognized statutory order in Indonesia. For this reason, it is necessary to provide a separate place for the growth and development of customary law as part of the nation's wealth and as a reference in the formation of national law so that in every formation of statutory regulations, it always reflects values. is contained in the nation's customs, especially those related to basic law, namely the customary constitution in Indonesia. This paper uses a sociological normative writing method, which will provide an overview of the position and status of the customary constitution in the Indonesian legal system. So it is hoped that through writing this journal, it can provide an understanding of how important the position of the customary constitution is in the development of law in the modern era.Keywords:Position of the Customary Constitution, Indonesian Legal System
