Abstract

Pengabdian Kepada Masyarakat ini bertujuan untuk memberikan pemahaman kepada masyarakat terutama kepada jamaah Majelis Taklim An Nur Masjid Al Fitrah Jaya Asri terkait faktor-faktor penyebab terjadinya pernikahan dini dan memberikan pemahaman mengenai bagaimana mencegah terjadinya pernikahan dini dan dampak yang ditimbulkan akibat pernikahan dini ditinjau dari undang-undang perkawinan. Kegiatan ini menggunakan pendekatan true experimental pretest-postest design dengan menggunakan metode ceramah, diskusi dan tanya jawab sehingga dapat mengetahui tingkat pengetahuan dan pemahaman dari peserta baik sebelum dimulainya kegiatan dan setelah kegiatan selesai dilaksanakan. Terjadinya peningkatan pengetahuan dan pemahaman dari pretest ke postest bermakna pada peserta dan menjadi tolok ukur keberhasilan kegiatan ini. Metode evaluasi kegiatan dinilai dari pre-test ke post-test. Dari hasil post-test diketahui bahwa terjadi peningkatan pemahaman dan pengetahuan peserta penyuluhan sebanyak 98% mengenai pernikahan dini dan akibat yang ditimbulkan serta bagaimana mencegah terjadinya pernikahan dini. Kata kunci: Penyuluhan hukum, pernikahan dini. ABSTRACT This Community Service aims to provide understanding to the community, especially to the congregation of the Majlis Taklim An Nur Al Fitrah Jaya Asri Mosque regarding the factors that cause early marriage and provide an understanding of how to prevent early marriage and the impacts caused by early marriage in terms of the law. marriage law. This activity uses a true experimental pretest-posttest design approach using lecture, discussion and question and answer methods so that it can determine the level of knowledge and understanding of the participants both before the activity starts and after the activity is completed. The increase in knowledge and understanding from pretest to posttest is meaningful for participants and is a benchmark for the success of this activity. The activity evaluation method is assessed from pretest to posttest. From the posttest results, it is known that there has been an increase in the understanding and knowledge of counseling participants by 98% regarding early marriage and its consequences and xhow to prevent early marriage. Abstract

The practice of concurrent positions carried out by the Board of Directors in the management of a PT does not yet have a legal basis regulated explicitly in Law Number 40 of 2007 concerning Limited Liability Companies (UUPT). Concurrent positions lead to legal loopholes that can cause potential losses to the company. This research aims to analyze the practice's suitability with the law's provisions and compare it with policies in the United States. This research uses a normative method with conceptual and statutory approaches and secondary data from relevant regulations. The results show that concurrent positions can cause conflicts of interest, weaken management, and undermine corporate governance. Legislation changes are needed in Indonesia to limit the number of positions a director can hold and impose more severe sanctions for violators. In conclusion, a law revision is needed to strengthen the regulation of concurrent positions to promote better corporate governance.

Abstract

Kegiatan Pengabdian Kepada Masyarakat ini bertujuan untuk memberikan pemahaman kepada Keluarga Besar Usman di Kota Jayapura terkait dengan pentingnya kesadaran hukum. Kegiatan ini menggunakan metode ceramah serta diskusi dan tanya jawab. Melalui ceramah peserta akan diberikan penjelasan dan informasi mengenai gambaran peningkatan kesadaran hukum. Pemateri yang ahli dibidangnya akan memberikan wawasan yang komperhensif sehingga diharapkan dapat memberi pengetahuan dan pemahaman tentang aturan hukum yang berlaku ini akan membawa kesadaran hukum ke tingkat yang lebih tinggi.

Abstract

Pencatatan perkawinan menjadi penting bagi keabsahan perkawinan, selain itu karena perkawinan yang dicatatkan akan memberikan kepastian dan perlindungan hukum bagi suami, isteri dan anak-anak, serta memberikan jaminan dan perlindungan terhadap hak-hak tertentu yang timbul karena perkawinan antara lain hak untuk mewaris, hak untuk memperoleh akta kelahiran, hak atas nafkah hidup, dan lain sebagainya. Perkawinan siri dianggap tidak sah menurut hukum negara,serta memiliki dampak negatif bagi status anak. Status anak yang dilahirkan dianggap sebagai anak tidak sah. Tujuan dilaksanakan penyuluhan hukum ini  agar masyarakat Kampung Nolokla mendapatkan kepastian hukum dengan mencatatkan status perkawinannya agar perkawinan dianggap sah, anak memiliki garis keturunan dari ayah serta anak dan ibu berhak atas nafkah dan warisan. Penyuluhan Hukum ini dilakukan dengan metode dialog interaktif. Penyampaian materi dilakukan melalui peresentasi pemaparaan materi - materi yang ditampilkan pada layar infocus berupa format power point. Agar warga kampung Nolokla lebih memahami tentang penyuluhan hukum ini, diberikan materi berupa print out. Hasil penyuluhan ini menunjukan sebanyak 21 warga kampung Nolokla ikut berpartisipasi dan memberikan respon positif serta aktif selama kegiatan ini berlangsung.

Abstract

This study aims to analyze the concept of customary land customary law, as well as to examine the protection of indigenous peoples in a customary land forest. The type of research in this writing is a normative juridical research method. The approach used in this study is a Statute Approach and a case approach. The results showed customary forests, sometimes referred to as customary forests, are forests within the territory of customary law communities. To be designated as customary Forest, local customary law communities can apply to the Minister of Environment and Forestry. Customary Forests, before Indonesian law is, protected as the legal protection of customary land. This legal protection is a form of concrete action from the state in implementing the mandate of the Constitution of the Republic of Indonesia Constitution of 1945 contained in Article 18b. Moreover, in this case, the government has issued a decree of the Minister of Environment and Forestry to establish customary forest areas and the rights and obligations of Indigenous Peoples.

Abstract

Cartels, or secret deals among competitors to set prices, limit production, or divide markets, pose a significant challenge to healthy competition and market integrity around the world, including in Indonesia. This study examines the use of indirect evidence, such as economic data and communication patterns, in uncovering such covert operations under the Indonesian Competition Law (Law No. 5 of 1999), using the normative juridical approach. The study uses statutory analysis to understand the legal framework, case analysis to explore the use of indirect evidence in law enforcement, and conceptual analysis to enhance theoretical understanding. This study analyzes the decisions of the KPPU and District Courts, KPPU regulations, and relevant legal frameworks to understand the applicability and challenges of using circumstantial evidence in legal proceedings. The results of the study make it clear that, despite its important role, the study identifies legal uncertainty and the need for corroborating evidence as the main obstacles to the effectiveness of indirect evidence. It reveals a significant gap in the acceptance and interpretation of indirect evidence between the KPPU and the judiciary, highlighting the need for clarity and consistency in the law. This review recommends the revision of Law No. 5 of 1999 and related procedural laws to include provisions for the acceptance and utilization of circumstantial evidence, improving the adjudication process of both the KPPU and the courts. This research contributes to Indonesia's understanding of competition law enforcement and promoting fair business practices.

Abstract

This diversion of cash back for consumer spending often occurs in supermarkets, minimarkets and small stalls and has become a phenomenon in society, consumers are on the weak side because they accept the candy as a replacement for their cash back without any other choice. Even though this seems trivial, consumers feel uncomfortable with this action and it is possible that consumers still need their money back and not everyone likes or needs this candy. The phenomenon that occurred was consumer complaints regarding the actions of shop, supermarket and minimarket businesses who replaced their change with candy. The change that is replaced with candy is change worth hundreds of Rupiah. This often happens because the value of hundreds of dollars is considered to have little material value so consumers don't pay much attention to it. The actions of shop, supermarket and minimarket businesses who replace change with candy constitute a violation of consumer rights. Consumer rights are regulated in Law no. 8 of 1999 concerning Consumer Protection (hereinafter referred to as UUPK). Candy is not a legal means of payment in Indonesia. Article 2 paragraph (2) Law No. 23 of 1999 which was then changed to Law No. 3 of 2004 which was then changed again to Law No. 6 of 2009 concerning Bank Indonesia (hereinafter referred to as UUBI) states that: "Rupiah currency is a legal means of payment in the territory of the Republic of Indonesia".
