Abstract

Article 46 Law no. 44 of 2009 stated that "Hospitals are legally responsible for all losses incurred due to negligence committed by health workers at the Hospital". Hospital responsibilities in providing health care are based on professional, ethical, civil, administrative and criminal aspects. The hospital law provides protection and guarantees for patients and medical personnel involved in health services. And also provide certainty in the hospital to maximize management functions, regulate and control various things that are the responsibility of the hospital so that it can minimize various things that can certainly harm patients. Obstacles are the difficulty in finding evidence related to medical negligence committed by medical personnel against patients which causes harm to patients so that it is difficult for hospitals to prove the existence of medical negligence committed by medical personnel against patients. The solution is for the hospital to form a team to deal with acts of negligence that occur, accredit professional and health workforce resources, evaluate the performance of medical personnel, and improve hospital management. Conduct accreditation of professional and health workforce resources.

Abstract

Social media is regarded as the fifth pillar of democracy. The role of the mass media as the controller of governance and democracy is increasingly recognized and is now regarded as the fourth pillar of the democratic system. However, along with the opportunities that exist, the digital age also poses a serious challenge to democracy. This spread of disinformation can confuse people, empower voters and influence their choices. Another challenge is black campaign attacks of false information or hoaks, insults and slander aimed at political opponents to knock each other down, carried out through social media. Starting from the issue, the author tried to analyze and describe further about the blocking of the spread of black campaign content through social media. This research is conducted in a normative jurisprudence, that is, by looking at the problem through the legal principles contained in Indonesian law. In article 280 (1) letter c of the Election Act, which regulates the prohibition of campaigns in elections, the rules on black campaigns on social media are not comprehensively written and do not have a clear definition. According to Article 40 (2) of the Electronic Information and Transactions Act, the Government is obliged to prevent the dissemination and use of Electronic information and/ or electronic documents that have a prohibited load in accordance with the provisions of the regulations of the laws. However, this blockage can only be made against Electronic info and/or electronic documents which have illegal content, and does not include the termination of Internet network access as a whole. To offset the possibility of Internet abuse, the government has established a Internet Restriction Policy. By limiting the use of media, i.e. blocking and filtering websites or social media, surveillance, forced deletion of content, thorough blocking of social media on platforms and other communications information technologies.

Abstract

The placement program for Indonesian workers abroad is one way to overcome the problem of unemployment. The government's role in this aspect is focused on the aspect of coaching, as well as protection and providing various facilities to related parties, especially Indonesian Migrant Workers and placement service companies concerned. How is the Digitalization of the Bureaucracy related to PMI Oversight mechanisms in the context of the State's role as a Protector for its citizens. This type of research is normative juridical law, namely research that refers to legal norms contained in laws and regulations and court decisions as well as norms that live and develop in society. The E-KTKLN itself is mandatory for all prospective Indonesian Migrant Workers and Indonesian Migrant Workers who are placed abroad, the personal data of the Prospective Indonesian Migrant Workers is inputted into a system called SISTOKTKLN or Computerized Overseas Worker Card System. To protect Indonesian migrant workers, the Indonesian government offers two types of protection to foreign migrant workers. First, preventive/educational protection, which can be pursued, among other things, through the creation of legal instruments, including protecting migrant workers, such as laws and implementing regulations governing migrant workers, bilateral or multilateral agreements governing the mechanism for the placement of migrant workers and their protection for the wearer.

Abstract

Salah satu program yang dicanangkan pemerintah adalah Bantuan Operasional Sekolah (BOS), yang bertujuan untuk meningkatkan kualitas pendidikan, termasuk pemerataan sarana dan prasarana. Hal ini sesuai dengan amanat Pancasila, "Keadilan Sosial Bagi Seluruh Rakyat Indonesia", yang merupakan Sila Kelima Landasan Ideologi Nasional. Semua program anggaran sangat rentan terhadap korupsi, jadi perlu ada pengawasan yang ketat untuk memastikan bahwa program tersebut dilaksanakan dengan benar. Menurut Undang-Undang Nomor 15 Tahun 2006 tentang BPK, pemeriksaan keuangan terhadap laporan keuangan dilakukan dengan tujuan memberikan keyakinan yang memadai atau keyakinan yang wajar bahwa penyajian laporan telah dibuat secara wajar terkait semua hal material dalam substansinya, sesuai dengan prinsip-prinsip umum keakuntansian, seperti Laporan Keuangan Pemerintah Pusat. Tiga prinsip evaluasi harus dipatuhi: prinsip kontinuitas (kontinuitas), prinsip menyeluruh (komprehensif), dan prinsip objektivitas. Situasi sebagaimana diungkapkan diatas membuat pentingnya dilakukan analisis lebih lanjut mengenai Bagaimana pengaturan mekanisme pertanggunga jawaban Dana BOS berdasarkan prinsip akuntabilitas? Dan Bagaimana mekanisme pengawasan oleh BPK sebagai pihak yang berwenang untuk setiap program pemerintah terkait anggaran?

Abstract

Partai politik adalah kumpulan orang-orang yang memiliki kesamaan nilai, afiliasi, dan tujuan yang bekerja sama untuk memenangkan dan mencapai tujuan politik dan sosial mereka. Namanya berasal dari kata Yunani "pars", yang berarti "bagian" atau "bagian dari keseluruhan". Menurut Pasal 1 Ayat (1) Undang-Undang No. 2 Tahun 2011, partai politik didefinisikan sebagai organisasi yang bersifat nasional yang dibentuk secara sukarela oleh sekelompok warga negara Indonesia atas dasar kesamaan kehendak dan cita-cita untuk memperjuangkan dan membela kepentigan politik anggota, masyarakat, bangsa, dan negara, serta untuk memelihara keutuhan Negara Kesatuan Republik Indonesia berdasarkan Pancasila dan Undang-Undang Dasar Negara Kesatuan Republik Indonesia. Dari uraian diatas maka dirumuskan dua hal yaitu Pertama, pengaturan penyaluran bantuan sosial dalam hukum positif dan Kedua, pengaturan hukum yang mampu menjerat dalam hal terjadinya korupsi dana bantuan sosial politik yang terbukti bersumber dari APBN. Penelitian ini menggunakan pendekatan yuridis normatif, yang berfokus pada penelitian kepustakaan untuk mempelajari aspek ilmiah dan implementasi hukum. Pendekatan yuridis normatif melibatkan penelitian terhadap prinsip-prinsip hukum dan tingkat sinkronisasi hukum, atau penelitian yuridis normatif. Penelitian ini mencakup penelitian kepustakaan dan pengumpulan data sekunder seperti bahan hukum primer dan sekunder dan tersier. Juridis kualitatif, yang bersandar pada hukum positif, menggunakan analisis data. Hasil penelitian diolah secara kualitatif untuk menggambarkan kesimpulan dari data dan menjelaskan elemen yang tidak dapat diukur dengan angka. Metode ini menggunakan referensi acuan, dan validitas dan keandalan instrumen ditunjukkan dengan hasil pengujian dan interpretasi. Hasil penelitian menunjukkan bahwa Bantuan Sosial merupakan salah satu cara yang digunakan oleh pemerintah untuk mewujudkan kesejahteraan adalah dengan mempercepat proses mewujudkan kesejahteraan dan Tindak pidana korupsi memerlukan tindakan khusus karena termasuk dalam kategori tindak pidana khusus. Sebagai perubahan dari Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi, yang telah diubah dengan Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi.

Abstract

The disharmony between Laws and the Regulations of Balinese cultural tourism’s regulation and policy is still exist, specifically in terms of tourism management’s purpose and authority. The clarity of the purpose and the scope in the setting of Balinese cultural tourism Laws and Regulations need to be conducted comprehensively and structured, so the substantial dynamic that included and stated in the law will not be partial. According to the analysis of regulation content of laws and regulation for the application of Tri Hita Karana (THK) in Balinese culture tuorism’s operation, there are numerous disharmonisation that happened between Undang-undang Nomor 10 Tahun 2009 about tourism, as the Laws and Regulations that organizes the tourism, and sectoral Laws and Regulations that organizes limited tourism (whether forest, marine, and culture tourism). Although the disharmonisation already harmonized through Undang-undang Cipta Kerja (Laws of Work Creation), the comprehensive and structured clarity of purpose is still achieved yet, so the substantial dynamic that included and stated in the law will not be partial.
