Abstract

Background. Non-formal education organized for people who need provision of knowledge, skills, life skills, and attitudes to develop themselves, develop a profession, work, independent business, and / or continue their education to a higher level. Purpose. This thesis aims to analyze the legal consequences and legal processes that Courses and Training Institutions are one form of unit taken from carrying out unlicensed job training institutions in Bali. Method. This research is conducted with normative legal research method, namely through literature study of laws and regulations related to vocational training institutions and their operational licenses. Results. The results of this research are expected to provide a clear understanding of the legal consequences that can arise from misusing the work training institute license given by the Government to the work training institute in Bali, where the discussion of legal consequences and what legal process will be taken when the parties feel harmed as a result of the work training institute carrying out activities without a license in Bali. Conclusion. As well as knowing how to seek permission to legalize the operational license of a vocational training institution so that the training institution can be said to be legal. And can be a job training institution for people who need provision of knowledge skills and life skills, to develop themselves, develop their profession, work independently. Job Training Institutions also function as educational services that function as substitutes, additions, or complements to formal education in order to support education in school.Where in Government Regulation Number 5 of 2021 concerning this PP, regulates Business Licensing based on the level of risk of business activities.

Abstract

Hak atas bantuan hukum merupakan salah satu hak yang terpenting yang dimiliki oleh setiap warga negara, Negara Republik Indonesia mengenal dua jenis bantuan hukum yang pertama adalah bantuan hukum Prodeo dan yang kedua adalah bantuan hukum Pro Bono. Permasalahan dimasyarakat begitu banyak termasuk adanya persoalan tentang hukum yang mereka alami, masih banyak masyarakat miskin yang mengalami permasalahan hukum, ketika menghadapi permasalahan hukum mereka menjadi bingung bagaimana mereka harus menyelesaikan permasalahan tersebut, sehingga kehadiran pemerintah sangat dibutuhkan dalam membantu masyarakat miskin, dalam Penyelenggaraan Bantuan Hukum di daerah khususnya Provinsi Bali Kantor Wilayah Kementerian Hukum dan HAM Bali mempunyai peranan yang sangat penting. Dalam Penyelenggaraan Bantuan Hukum, peranan Kantor Wilayah Bali sangatlah penting, adapun peranan Kantor Wilayah antara lain : menyusun rencana anggaran program bantuan hukum yang didasarkan pada jumlah dan akreditasi dari organisasi/ lembaga bantuan hukum, membentuk dan menetapkan Panitia Pengawas Daerah yang terdiri dari unsur Biro Hukum Setda Provinsi Bali, Kepala Divisi Pelayanan Hukum dan HAM, Kepala Divisi Pemasyarakatan, Pengelola Bantuan Hukum, melaksanakan verifikasi dan akreditasi calon pemberi bantuan hukum, Melakukan pengawasan, pelaksanaan pemberian bantuan hukum oleh organisasi/ lembaga bantuan hukum, yang dilaksanakan di kantor organisasi/ lembaga bantuan hukum, Lembaga Pemasyarakatan, Rumah Tahanan Negara dan Rumah penerima bantuan hukum; dan Mengusulkan rekomendasi terkait dengan kinerja dan pelaksanaan anggaran organisasi/lembaga bantuan hukum kepada Badan Pembinaan Hukum Nasional terhadap hasil laporan dari Panitia Pengawas Daerah ; dan melakukan sosialisasi terkait program bantuan hukum kepada masyarakat.

Abstract

One of the problems that occurs in developing countries like Indonesia is social inequality, or the increasingly widening gap in income distribution between groups, between urban and rural areas. This high poverty rate has a direct impact on the poor standard of living of people who choose to live on the streets as beggars (sprawl). As stated in regional regulations that seek to provide a deterrent effect, the Badung Regency Government continues to strive to improve supervision and control of sprawl. The government is fighting against sprawl in areas that commonly occur and disrupt public permits by carrying out efforts to prevent sprawl in Badung Regency through the Civil Service Police Unit. Based on the findings of this research, it can be said that Regional Regulation Number 7 of 2016 concerning Public Order and Community Peace is the basis for eradicating sprawl in the Badung Regency area which is very difficult to implement and is not yet functioning well. This requires support from various related parties, all levels of society in Badung Regency, as well as tourists who come to the Badung area itself.

Abstract

The objectives of this study include the regulation of foreigners' residence permits in Indonesia based on the Law on Immigration and how sanctions for foreigners who violate residence permits in Indonesia or what is commonly called Overstay. This research uses descriptive normative method. The results of this study are “Immigration is a matter of traffic in people entering or leaving the territory of the Republic of Indonesia and Supervision of foreigners in Indonesia.” Referring to the Immigration Law, there are two important regulatory elements, namely 1) regulations regarding all matters relating to the traffic of people leaving and entering and staying in the territory of the Republic of Indonesia, 2) regulations relating to all matters concerning the supervision of foreigners in the territory of Indonesia. Sanctions that can be implemented for cases of foreign nationals (WNA) who violate the abuse of residence permits are in the form of administrative immigration sanctions (TAK) or criminal sanctions. Administrative sanctions are sanctions given by immigration officials to foreigners outside of the judicial mechanism. While criminal sanctions are a mechanism that runs on a network where there is involvement from law enforcement.ABSTRAKTujuan penelitian ini meliputi pengaturan izin tinggal WNA di Indonesia berdasarkan Undang-Undang tentang Keimigrasian dan bagaimana sanksi bagi WNA yang melanggar izin tinggal di Indonesia atau yang biasa di sebut dengan Overstay. Penelitian ini menggunakan metode deskriptif normative. Hasil dari penelitian ini yaitu “Keimigrasian adalah hal ihwal lalu lintas orang yang masuk atau keluar wilayah Negara Republik Indonesia dan Pengawasan orang asing di Indonesia.” Mengacu pada UU Keimgirasian ada dua unsur aturan penting yaitu 1) aturan mengenai semua hal yang bekaitan dengan lalu lintas dari orang yang pergi dan masuk serta tinggal di wilayah Republik Indonesia, 2) peraturan yang berkaitan dengan segala hal tentang pengawasan untuk orang asing di wilayah Indonesia. Sanksi yang bisa diimplementasikan untuk kasus Warga Negara Asing (WNA) yang melanggar penyalahgunaan izin tinggal yaitu dalam bentuk sanksi administrative keimigrasian (TAK) atau sanksi pidana. Mengenai sanksi administrative yaitu sanksi yang diberikan Pejabat Imigrasi untuk WNA di luar dari mekanisme peradilan. Sedangkan sanksi pidana yaitu sebuah mekanisme yang berjalan pada sebuah jaringan dimana ada keterlibatan dari penegak hukum.

Abstract

The purpose of this paper is to find out how international law views immigration actions, namely deportation and what efforts are made by immigration in maintaining national security through the deportation of foreigners. The type of research used in this research plan is normative legal research which is legal research conducted by studying, reviewing legislation and literature as well as legal materials related to the regulation of residence permits. A country has the right to deport foreign nationals who are in its territory. However, although deportation is a forced action, its implementation must not exceed humanitarian values and human rights. Article 9 of Law Number 6 Year 2011 on Immigration also emphasizes that every person who enters or exits the territory of Indonesia must go through an examination conducted by an Immigration Officer at an Immigration Checkpoint. To realize this, Immigration cooperates with the ranks of the Indonesian National Police (Polri), the Indonesian National Army (TNI) to be embraced in the framework of law enforcement.ABSTRAKTujuan dari penulisan ini adalah untuk mengetahui bagaimana hukum internasional memandang tindakan keimigrasian yaitu deportasi dan upaya apa yang dilakukan imigrasi dalam menjaga keamanan nasional melalui tindakan pendeportasian Orang Asing. Jenis penelitian yang digunakan dalam rencana penelitian ini adalah penelitian hukum normatif adalah penelitian hukum yang dilakukan dengan cara mempelajari, mengkaji peraturan perundang-undangan dan literatur serta bahan-bahan hukum yang berhubungan dengan pengaturan ijin tinggal. Suatu negara berhak untuk melakukan tindakan deportasi kepada Warga Negara Asing yang berada di wilayah negaranya. Namun, walaupun deportasi merupakan suatu tindakan paksa, tetapi implementasinya tidak boleh melewati nilai-nilai kemanusiaan dan hak asasi manusia. Pada Pasal 9 Undang – Undang Nomor 6 Tahun 2011 tentang Keimigrasian juga menegaskan bahwa setiap orang yang masuk atau keluar wilayah Indonesia wajib melalui pemeriksaan yang dilakukan oleh Pejabat Imigrasi di Tempat Pemeriksaan Imigrasi. Untuk mewujudkan hal tersebut, Keimigrasian melakukan kerjasama dengan jajaran Polisi Republik Indonesia (Polri), Tentara Negara Indonesia (TNI) untuk dirangkul dalam rangka penegakan hukum.

Abstract

The purpose of the research in this paper is to analyze the arrangements for fulfilling the rights of visiting services for prisoners before and after the new normal era and the obstacles faced at the Women's Correctional Institution Klas IIA Kerobokan. This research uses empirical legal research. The research method used is descriptive by using qualitative data analysis techniques. The data required are primary data and secondary data. Primary data includes the results of observations, distribution of questionnaires to prisoners, and interviews with the Head of the Prison Security Unit (Ka.KPLP), Head of Minkamtib Section, Head of Binadik Section and prisoners related to the fulfillment of the rights of visiting services for prisoners in the Women's Prison Klas IIA Kerobokan. While secondary data is data sourced from library materials intended to help complement various legal concepts in primary legal materials. The results showed that the fulfillment of the right of visiting services for prisoners in the new normal era at the Klas IIA Kerobokan Women's Prison has been carried out in accordance with applicable regulations, however, due to the COVID-19 pandemic which requires adjustments to the rules of face-to-face visiting services to online visiting services during the pandemic and limited face-to-face visiting services in the new normal era, the fulfillment is felt to be less than optimal by prisoners.ABSTRAKTujuan penelitian dalam penulisan ini untuk menganalisis pengaturan pemenuhan hak layanan kunjungan narapidana sebelum dan sesudah era normal baru serta kendala yang dihadapi di Lembaga Pemasyarakatan Perempuan Klas IIA Kerobokan. Penelitian ini menggunakan jenis penelitian hukum empiris. Metode penelitian yang digunakan adalah deskriptif dengan menggunakan teknik analisa data secara kualitatif. Data yang diperlukan adalah data primer dan data sekunder. Data primer meliputi hasil observasi, pembagian kuesioner kepada narapidana, dan wawancara terhadap Kepala Kesatuan Pengamanan Lapas (Ka.KPLP), Kasi Minkamtib, Kasi Binadik dan narapidana terkait pemenuhan hak layanan kunjungan narapidana di Lapas Perempuan Klas IIA Kerobokan. Sedangkan data sekunder merupakan data yang bersumber dari bahan-bahan kepustakaan yang ditujukan untuk membantu melengkapi berbagai konsep hukum pada bahan hukum primer. Hasil penelitian menunjukkan pemenuhan hak layanan kunjungan narapidana pada era normal baru di Lapas Perempuan Klas IIA Kerobokan sudah dilaksanakan sesuai dengan aturan yang berlaku, akan tetapi akibat pandemi COVID-19 yang mengharuskan adanya penyesuaian aturan layanan kunjungan tatap muka menjadi layanan kunjungan online pada masa pandemi serta layanan kunjungan tatap muka terbatas pada era normal baru dalam pemenuhannya dirasakan kurang maksimal oleh narapidana.

Abstract

Praktik hak angket sering mengalami kendala, sehingga banyak yang menilai belum ada tujuan dan skema pelaksanan yang jelas. Hak angket seharusnya dapat mendukung fungsi legislasi, anggaran, dan pengawasan DPR, namun seringkali hak angket lebih sering digunakan untuk kepentingan politik. Tujuan penelitian ini adalah untuk mendeskripsikan, memahami, dan menganalisis pengaturan hak angket DPR dalam pengawasan kebijakan pemerintah, serta mekanisme pengajuan dan penerapan hak angket. Metode penelitian ini menggunakan studi hukum normatif yang mengkaji aturan hukum formal, termasuk undang-undang dan literatur teori yang relevan. Teknik analisis yang digunakan adalah deskriptif analitis dan analisis argumentasi hukum. Hasil penelitian menunjukkan bahwa pengajuan hak angket diperlukan minimal 25 anggota parlemen lebih dari satu fraksi, diikuti dengan penyampaian permohonan rinci dan pertimbangan di sidang paripurna sesuai Pasal 177 UU Nomor 27 Tahun 2009. Hak angket DPR diatur dalam Pasal 20A ayat (2) UUD 1945 dan diperkuat dalam Pasal 79 ayat (3) UU Nomor 42 Tahun 2014. Hak ini memungkinkan DPR untuk menyelidiki pelaksanaan undang-undang atau kebijakan pemerintah yang dianggap bertentangan dengan peraturan. Dapat disimpulkan bahwa prinsip check and balance harus tetap dijunjung agar tidak melemahkan fungsi independensi lembaga.

Abstract

The regulation of electronic evidence in trials is governed by the Electronic Information and Transactions Law. Article 5, paragraph (1) of the Electronic Information and Transactions Law states that electronic information, electronic documents, and/or printouts are valid legal evidence. This means that evidence produced or stored in electronic form is admissible. In its implementation, electronic trials at the Denpasar District Court are regulated by Supreme Court Regulation Number 1 of 2019 and its amendments, as well as Supreme Court Regulation Number 7 of 2022, concerning Electronic Case Administration and Trials in Court. This system allows case registration, payment of court fees, summons, and trials to be carried out electronically through the e-Court application. There are several obstacles in the implementation of electronic evidence at the Denpasar District Court, including a lack of public understanding of electronic evidence, difficulties in ensuring the authenticity and integrity of electronic documents, limited laws and regulations that specifically regulate electronic evidence, and technical obstacles.

Abstract

This research employs a normative-empirical legal research method to analyze the implementation of the principle of nationalism in land law for Indonesian citizens who enter into mixed marriages without prenuptial agreements in relation to land ownership rights in Bali Province. The empirical component involved in-depth interviews with five officials from the Regional Office of the National Land Agency (Badan Pertanahan Nasional or BPN) of Bali Province, eight notaries experienced in mixed marriage documentation, twelve legal practitioners specializing in agrarian law, and case study analysis of 25 mixed marriage property disputes processed through Bali courts from 2019 to 2024. Research objectives include analyzing the application of nationalism-based land law to Indonesian citizens in mixed marriages without property separation agreements and examining the legal consequences. The study reveals that Indonesian citizens are constitutionally entitled to land ownership rights under Article 33(3) of the 1945 Constitution. Main findings demonstrate that the principle of nationalism (grondverponding verbod) in Indonesian land law creates legal complications for mixed marriages. Indonesian citizens who acquire land rights after mixed marriage without property separation agreements face mandatory relinquishment within one year under Article 21(3) of the UUPA, or the land reverts to the state. However, Government Regulation No. 103/2015 provides solutions through court-determined property separation agreements, enabling Indonesian citizens to maintain land ownership rights while married to foreign nationals. The research concludes that urgent legal amendments are needed to balance the principle of nationalism with the constitutional rights of Indonesian citizens in mixed marriages, particularly regarding inheritance and protection of property rights.
