Abstract

Penguasaan teknologi menjadi salah satu kunci bagaimana sebuah negara memiliki posisi daya saing dalam percaturan global. Artikel ini bertujuan untuk menganalisis politik hukum (arah kebijakan) pengaturan berkaitan dengan penguasaan teknologi di Indonesia. Metode penelitian yang digunakan merupakan penelitian hukum dengan menggunakan pendekatan perundang-undangan, konseptual, dan sejarah yang kemudian dilakukan analisis preskriptif. Hasil dalam penelitian menunjukkan bahwa dinamika politik hukum penguasaan teknologi di Indonesia relatif masih mengalami pergerakan ke arah yang makin baik. Meski demikian pasca diundangkan UU Cipta Kerja, semangat penguasaan teknologi menjadi “lumpuh” karena telah dicabut ketentuannya.Mastery of technology is one of the keys to how a country has a competitive position in the global arena. This article aims to analyze the legal politics of regulations relating to the mastery of technology in Indonesia. The research method used is legal research using a statutory, conceptual, and historical approach which is then carried out with prescriptive analysis. The results of the study indicate that the dynamics of legal politics of technological mastery in Indonesia are still relatively moving in a better direction. However, after the enactment of the Cipta Kerja Act, the spirit of mastering technology has disappeared because the provisions have been revoked.

Abstract

Objective: The mechanism for dismissing the President and/or Vice President in Indonesia is regulated by the 1945 Constitution. This process is initiated by the House of Representatives submitting a proposal to the People's Consultative Assembly, stipulating that the President and/or Vice President has violated the provisions in Articles 7A and 7B, and this must be proven first by the Constitutional Court through examination and proof. If it is proven that the President and/or Vice President has violated these provisions, the results of the Constitutional Court trial will be submitted to the People's Consultative Assembly. Subsequently, the People's Consultative Assembly is obliged to hold a trial to decide whether the President and/or Vice President will be impeached. Article 7A of the 1945 Constitution of the Republic of Indonesia regulates the impeachment of the president and the provisions related to the presidential office in Indonesia. Method: According Mahmud Marzuki, this normative legal research, as it is defined entails the process of finding, comprehending and solving legal problems embracing the practice rather its theory. This work in particular focuses on the way in which the House of Representatives can investigate and possibly remove the President and Vice President from their offices. Result: Some of the author's findings related to the essence of impeachment in the Indonesian constitution are, first, to maintain a system of checks and balances in the presidential office through oversight. Second, the direction of the presidential impeachment regulations needs to be improved by clarifying the reasons and mechanisms for impeachment, aiming to avoid dismissing the president for political rather than legal reasons. Novelty: The present study also analyzes the Indonesian Constitution of 1945 about presidential removal from office, stressing the weak legal rationale as well as the appropriate procedure to remove a president to avoid the potential manipulation for political gains. This calls for regulatory improvement to improve checks and balances in order to prop up a better legal framework of fair and constitutional presidential accountability.

Abstract

Economic globalization has heightened tensions between national sovereignty and international trade obligations. This study compares constitutional review mechanisms in Indonesia, Thailand, and India, representing civil law and common law systems. Using normative legal methods with statute and comparative analysis, it finds that Indonesia applies ex post review of ratification laws, Thailand uses preventive ex ante review, and India employs substantive, precedent-based judicial review. Effectiveness varies: India achieves high substantive effectiveness through judicial activism, Thailand excels procedurally, and Indonesia remains limited to formal review. The study concludes that constitutional review effectiveness depends on institutional design, legal tradition, and the ability to balance constitutional supremacy with international commitments.

Abstract

Qanun Jinayat Aceh sebagai peraturan daerah berbasis syariat telah menimbulkan berbagai kritik dari kalangan akademisi, lembaga HAM, dan masyarakat sipil yang menilai penerapannya melanggar prinsip Hak Asasi Manusia, khususnya terkait perlakuan terhadap perempuan, non-Muslim, serta kelompok minoritas dan marginal. Penelitian ini bertujuan untuk menganalisis kesesuaian norma Qanun Jinayat Aceh serta potensi disharmoninya dengan prinsip HAM sebagaimana diatur dalam UUD NRI 1945 dan UU No. 39 Tahun 1999 tentang Hak Asasi Manusia, serta mengkaji implikasi yuridis keberadaan Qanun Jinayat Aceh terhadap konsep negara hukum. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, serta dianalisis melalui metode kualitatif. Hasil penelitian menunjukkan bahwa ketentuan dalam qanun tersebut tidak sejalan dengan jaminan konstitusional tentang HAM dalam UUD NRI 1945, UU No. 39 Tahun 1999, serta regulasi HAM lainnya yang dapat menimbulkan praktik diskriminatif dan stigmatisasi sosial terhadap perempuan, kelompok minoritas dan marginal, serta non-Muslim yang tinggal di Aceh, sehingga berimplikasi pada pelemahan prinsip persamaan di hadapan hukum, perlindungan hak dasar warga negara, dan supremasi hukum sebagai pilar negara hukum. Temuan ini menegaskan perlunya harmonisasi regulasi daerah dengan standar HAM nasional serta evaluasi normatif terhadap keberlakuan Qanun Jinayat dalam sistem hukum Indonesia.
