Abstract

Mahkamah Konstitusi memiliki wewenang untuk melakukan judicial review pengujian materil undang-undang terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Mahkamah Konstitusi dalam menguji undang-undang terhadap Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 berfungsi sebagai pembatal norma (negative legislator). Melalui Putusan No. 112/PUU-XX/2022 (Uji Materi Pasal dalam UU KPK). Mahkamah Konstitusi Mengabulkan secara keseluruhan gugatan pemohon tentang permohonan uji materi materi Pasal 29 Huruf e), Pasal 34 UU KPK dalam Perkara Nomor No. 112/PUU-XX/2022 Tujuan penelitian ini untuk a) Menganalisis Urgensi Mahkamah Konstitusi Menjalankan Wewenang Sebagai Positif Legislator Dalam Putusan No. 112/PUU-XX/2022 dan menganalisis akibat hukum dari putusan tersebut. Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Sumber bahan hukum yang digunakan berupa bahan hukum primer, sekunder, dan bahan tersier. Hasil dari penelitian ini adalah tidak adanya urgensi mahkamah konstitusi untuk menjalankan wewenang sebagai positif legislator karena alasan pemohon tidak memenuhi syarat untuk mahkamah konstitusi untuk bersifat positif legislator. serta mahkamah konstitusi harus mempertimbangkan pemisahan kekuasaan menurut asas trias politika Kata Kunci: Mahkamah Konstitusi, kewenangan, positif legislator

Abstract

Objective: The mechanism for dismissing the President and/or Vice President in Indonesia is regulated by the 1945 Constitution. This process is initiated by the House of Representatives submitting a proposal to the People's Consultative Assembly, stipulating that the President and/or Vice President has violated the provisions in Articles 7A and 7B, and this must be proven first by the Constitutional Court through examination and proof. If it is proven that the President and/or Vice President has violated these provisions, the results of the Constitutional Court trial will be submitted to the People's Consultative Assembly. Subsequently, the People's Consultative Assembly is obliged to hold a trial to decide whether the President and/or Vice President will be impeached. Article 7A of the 1945 Constitution of the Republic of Indonesia regulates the impeachment of the president and the provisions related to the presidential office in Indonesia. Method: According Mahmud Marzuki, this normative legal research, as it is defined entails the process of finding, comprehending and solving legal problems embracing the practice rather its theory. This work in particular focuses on the way in which the House of Representatives can investigate and possibly remove the President and Vice President from their offices. Result: Some of the author's findings related to the essence of impeachment in the Indonesian constitution are, first, to maintain a system of checks and balances in the presidential office through oversight. Second, the direction of the presidential impeachment regulations needs to be improved by clarifying the reasons and mechanisms for impeachment, aiming to avoid dismissing the president for political rather than legal reasons. Novelty: The present study also analyzes the Indonesian Constitution of 1945 about presidential removal from office, stressing the weak legal rationale as well as the appropriate procedure to remove a president to avoid the potential manipulation for political gains. This calls for regulatory improvement to improve checks and balances in order to prop up a better legal framework of fair and constitutional presidential accountability.

Abstract

Abstrak Penelitian ini bertujuan untuk mengetahui mengenai pengaturan ambang batas (presidential threshold) sebagai kebijakan hukum terbuka (open legal policy) dalam pasal 222 UU Pemilu serta menjawab problema yang terjadi di masyarakat tentang implikasi hukum dari presidential threshold dalam pemilihan presiden dan wakil presiden. Penelitian menggunakan metode yuridis normatif dengan pendekatan statute approach dan conseptual approach. Perundang-Undangan sebagai bahan hukum primer dan buku, jurnal, desertasi sebagai bahan hukum sekunder. Mengangkat permasalahan mengenai pengaturan Presidential threshold sebagai Open legal policy, sedari UU Pemilu diundangkan sudah menimbulkan gejolak di masyarakat terutama terkait penerapan pasal 222 UU Pemilu yang mensyaratkan Pemilihan Presiden dan wakil presiden menggunakan ambang batas suara. Hasil penelitian ini menunjukan bahwa salah satu putusan MK termasuk didalamnya Putusan MK No. 14/PUU-XI/2013 MK tidak berani menafsirkan presidential threshold beserta besaranya dan hitungannya secara matematis, hal ini menimbulkan kecurigaan atas pembuat undang-undang. Dari segi konstitusionalitasnya pasal 222 UU No. 7 Tahun 2017 banyak pihak mengatakan bertentangan dengan norma pasal 6A ayat (1) dan pasal 22E UUD 1945 dan lebih khusus dihubungkan pada putusan MK No. 14/PUU-XI/2013. Perumusan norma pada pasal 222 dibentuk pembentuk undang-undang dalam hal ini DPR dan presiden didasarkan pada kewenangan Open legal Policy, yang diberikan oleh pasal 6A ayat (5) dan juga pasal 22E ayat (6) UUD NRI 1945. Pasal 6A ayat (2) UUD 1945 tidak mengatur mengenai ambang batas, Ambang batas ini menyebabkan hilangnya hak partai politik untuk bisa mengusulkan pasangan calon calon presiden dan wakil presiden Kata Kunci: Presidential Threshold, Open Legal Policy, Hak Dipilih dan Memilih, Pemilu.

Abstract

Penelitian  bertujuan untuk mengetahui praktik mengenai proses permohonan Tanggal 15 Agustus 2023 menjadi hari bersejarah bagi Indonesia dengan disetujuinya Putusan Mahkamah Konstitusi yang memperbolehkan berkampanye di lingkungan pendidikan oleh Mahkamah Konstitusi.Usulan perubahan Putusan Mahkamah Konstitusi Nomor 65/PUU-XXI/2023 pertama kali dikemukakan oleh Ong Yenny dan Handrey Mantiri, anggota DPRD DKI Jakarta. Mahkamah Konstitusi memperbarui Mahkamah Konstitusi tersebut dengan  alasan mendorong pemahaman demokrasi, hak asasi manusia, dan keterampilan berpikir kritis lebih relevan dari membawa arena politik ke dalam ruang pendidikan. Namun Putusan Mahkamah Konstitusi Nomor 65/PUU-XXI/2023 ini sebaiknya dikaji ulang dengan mempertimbangkan dampak jangka panjangnya terhadap tujuan utama pendidikan dan perkembangan karakter siswa dan siswa. Penelitian ini termasuk jenis penelitian yuridis normatif, atau disebut dengan pendekatan konsep dan pendekatan Undang - Undang. Penelitian yuridis normatif dilakukan dengan cara meneliti bahan pustaka atau bahan sekunder sebagai bahan dasar untuk diteliti dengan cara mengadakan penelusuran terhadap peraturan - peraturan dan literatur - literatur yang berkaitan dengan masalah yang diteliti.Menurut pemohon putusan MK Nomor 65/PUU-XXI/2023 bertentangan dengan UU Nomor Nomor 7 Tahun 2017, khususnya Pasal 280 ayat (1) huruf (H) dan di Penjelasannya justru melengkapinya dengan syarat diundang oleh penanggung jawab dan tanpa atribut kampanye Adanya 2 (dua) ketentuan yang mengatur secara berbeda itu (walaupun Penjelasan Pasal bukanlah norma namun mengandung rumusan norma) telah mengakibatkan norma hukum menjadi tidak pasti. Permasalahan yang terjadi pada Pasal 280 ayat (1) huruf h UU No.7 Tahun 2017 bukan didasarkan pada norma konflik, melainkan adanya perbedaan dalam penerapan hukum dengan penegakan hukum sehingga mengakibatkan ketidakadilan dalam penyelenggaraan pemilu.

Abstract

Background: Regional regulations (Perda) in Indonesia often face issues of overlap and inefficiency. Specific Background: The Omnibus Law method, known for simplifying and harmonizing regulations, has been applied nationally but remains underexplored locally. Knowledge Gap: Its practical application at the regional level, including challenges and opportunities, lacks sufficient research. Aims: This study examines the legal reconstruction of Perda using the Omnibus Law to improve regulatory efficiency and alignment with national laws. Results: The method streamlines regulations, enhances coherence, and boosts legal certainty but faces challenges such as stakeholder resistance and capacity limitations. Novelty: The research highlights the method's transformative potential for resolving Indonesia's regulatory complexities. Implications: It advocates for capacity-building, participatory processes, and effective oversight to achieve cohesive and responsive governance. Highlights: Regulatory Simplification: The Omnibus Law integrates overlapping regional laws into a single, cohesive framework. Abstract

This study analyzed the Reformulation of the Legal Status of the Indonesian Dentist Association Professional Organization with the Enactment of Law Number 17 of 2023 concerning Health. The existence of Law Number 17 of 2023 concerning Health has significant implications for the legal status of professional organizations, including the Indonesian Dentist Association (PDGI). Before the enactment of this law, PDGI as a professional organization had a strong position in regulating and supervising dental practices in Indonesia. However, with the enactment of the new Health Law, there has been a change in the governance of the medical profession which has a direct impact on the legal status of PDGI. With the enactment of Law Number 17 of 2023 concerning Health, the absence of various roles and functions of professional organizations that were previously contained in laws and regulations. In the future, the various roles of these health professional organizations will be carried out by the government, or institutions under the authority of the government. Therefore, this study is juridical-normative research using statute, conceptual and comparative approaches.

Abstract

This study analyzes human rights in legal development to ensure that fundamental human rights are not neglected. Human rights are inherent to every human being, derived from religious, moral, and noble cultural values. Everyone is part of society, consisting of individuals with fundamental rights. Human rights-based development planning becomes a benchmark in development planning so that it does not sacrifice human rights but is used as a tool to achieve goals in enforcing the right to development. However, this becomes a challenge that needs to be faced to prioritize human rights without neglecting the public interest. This study aims to develop development strategies based on the close relationship between strategies and development processes with efforts to promote respect for human rights. The study method uses a normative juridical approach. Data were collected through legal literature and legal materials, namely primary, secondary, and tertiary legal materials. The research results show that development law is important to address increasingly complex social changes and ongoing development agendas. The state must prioritize and ensure that business and development align with the fulfillment of the right to a good and healthy living environment rather than opening up space for environmental destruction. The manifestation of the legal development model is to pay attention to the human dimension as the main goal of development, which provides citizens with access to participate in decision-making in various fields of life. The law allocates greater authority to citizens for their self-realization as subjects, not objects shaped and controlled by other subjects.

Abstract

This study examines how digital labor structures and automation technologies are reshaping the conditions for vertical social mobility, particularly among informal workers and young professionals. Through a qualitative literature-based approach, the research explores how gig platforms, algorithmic labor markets, and technological displacement are transforming traditional trajectories of advancement. The findings reveal that the erosion of stable employment, the rise of opaque performance metrics, and the spread of precarious digital work have significantly weakened conventional pathways to economic elevation. Informal workers face structural barriers intensified by algorithmic governance, while young professionals encounter diminishing returns from educational investment. The promise of flexibility and entrepreneurial independence often masks the persistence of inequality and institutional inertia. The study demonstrates that new determinants of social status—digital reputation, access to technology, and platform fluency—have emerged, but remain unevenly distributed. These dynamics call for a reevaluation of how mobility is conceptualized in the context of digitally mediated capitalism. By synthesizing insights from labor sociology, political economy, and technology studies, this research contributes to a more nuanced understanding of social stratification in the twenty-first century.

Abstract

Perlindungan hukum bagi dokter di Indonesia dalam menghadapi sengketa medis masih menghadapi berbagai tantangan, meskipun telah ada regulasi yang mengatur seperti Undang-Undang No. 29 Tahun 2004 tentang Praktik Kedokteran. Latar belakang penelitian ini adalah untuk mengevaluasi seberapa efektif perlindungan hukum terhadap dokter dan mengidentifikasi tantangan yang dihadapi dalam kasus sengketa medis. Tujuan dari penelitian ini adalah untuk menganalisis peran dokumentasi medis dan informed consent dalam melindungi dokter serta untuk menilai efektivitas dukungan dari organisasi profesi seperti Ikatan Dokter Indonesia (IDI) dan Majelis Kehormatan Disiplin Kedokteran Indonesia (MKDKI). Metode yang digunakan termasuk wawancara dengan dokter yang terlibat dalam sengketa medis, observasi praktik di rumah sakit, dan analisis data mengenai kepatuhan dokumentasi medis serta pelaksanaan informed consent. Hasil penelitian menunjukkan bahwa ketidakpastian hukum, kurangnya dukungan dari institusi kesehatan, dan pelaksanaan informed consent yang tidak optimal menjadi tantangan utama. Dokumentasi medis yang baik dan informed consent yang komprehensif berhubungan dengan penurunan risiko sengketa medis. Selain itu, dukungan hukum dari organisasi profesi seperti IDI dan MKDKI terbukti penting namun seringkali terhambat oleh birokrasi dan keterbatasan sumber daya di daerah. Penelitian ini merekomendasikan peningkatan edukasi hukum untuk dokter, perbaikan dukungan internal dari institusi kesehatan, serta reformasi dan penguatan peran organisasi profesi untuk meningkatkan perlindungan hukum terhadap dokter dalam sengketa medis.
