Abstract

This research describes the implementation of the fatwa issued by the Indonesian Council of Ulama (MUI) regarding the position of transgender individuals, gender reassignment surgery, and genital perfection in Pangkep regency, South Sulawesi, Indonesia. The research employs a qualitative methodology through interviews and a literature review. The research results show the implementation of the MUI fatwa on the position of transgender individuals is hindered by several factors. Firstly, the recognition of human rights as regulated in the law emphasizes that basic human rights and freedoms are inherent rights that should be protected, respected, and upheld for the improvement of human dignity, welfare, happiness, intelligence, and justice. Secondly, the MUI fatwa is not legally binding in the concept of the Indonesian state. Thirdly, the fatwa cannot be fully implemented in areas where transgender individuals are recognized. The researchers concluded that the implementation of genital perfection provides legal status for transgender individuals with dual genders or genital anomalies.

Abstract

The halal certification process in Indonesia is crucial in meeting the needs of both domestic Muslim consumers and the international market. This study examines the perspectives of regulators and industry practitioners on halal certification in Indonesia, focusing on regulatory complexity, procedural challenges, and market-driven compliance. Using a descriptive qualitative approach, the study identifies key issues, including the overlap of responsibilities among regulatory bodies, the impact of digital transformation, and the importance of government-industry collaboration. Findings reveal that regulatory complexity often creates procedural confusion, hindering compliance. BPJPH’s digital initiatives present opportunities to streamline certification but face accessibility challenges, particularly for SMEs in rural areas. Additionally, strong consumer demand for halal products pressures companies to prioritize halal certification as part of their competitive strategy. This study’s implications suggest a need for an integrated approach in Islamic studies involving religious, policy, and business disciplines to develop a responsive Sharia-based economy. Enhancing collaboration between regulators and industry is critical to support the growth of Indonesia's halal sector and strengthen its position in the global halal market.

Abstract

The post-1980 dominance of neoliberal economics has exacerbated structural inequalities, while socialism failed to address efficiency challenges. In this context, M. Umer Chapra’s ideas on distributive justice and the state’s role offer a value-based Islamic alternative. This article critically examines Chapra’s framework through qualitative library research, employing content analysis of his seminal works (Islam and the Economic Challenge, The Future of Economics). The study reveals that Chapra rejects the capitalism-socialism dichotomy and proposes an Islamic economic system anchored in: (1) preventive-curative justice (via zakat, equitable taxation, and prohibition of riba); (2) the state as an ethical facilitator in market regulation and wealth redistribution; and (3) the integration of maqasid al-shariah (higher objectives of Islamic law) as a policy blueprint. These ideas remain relevant to contemporary crises, including global inequality and ecological degradation, yet their implementation requires bold institutional reforms. By elucidating the practical dimensions of Chapra’s thought, this article advances Islamic economics literature beyond theoritical discourse toward actionable policy design.

Abstract

The growing demand for ethical and inclusive economic frameworks has renewed scholarly interest in maqasid al-shariah as a foundational paradigm in Islamic economics. As the higher objectives of Islamic law, maqasid seek to protect religion (din), life (nafs), intellect (aql), lineage (nasl), and wealth (mal). This study employs a qualitative-descriptive approach using structured library research to analyze fifteen academic sources published between 2019 and 2025, focusing on how maqasid principles are conceptualized and implemented in Islamic finance, social policy, and cooperative systems. The findings reveal that while there is growing theoretical engagement with maqasid, practical applications remain limited by formalistic interpretations and insufficient institutional adaptation. Notable progress exists in areas such as mudharabah, takaful, and zakat-waqf integration, but broader reform is needed to shift from legal compliance to maqasid-oriented innovation. This research contributes to the theoretical advancement of Islamic economic thought by offering a synthesized and critical review of contemporary maqasid applications, and recommends the systemic integration of maqasid into policy-making, institutional governance, and economic design.
