Abstract

Indonesia saat ini telah memiliki Kitab Undang-Undang Hukum Pidana (selanjutnya disebut “KUHP”) Nasional yang secara yuridis positif akan diberlakukan pada tanggal 2 Januari 2026. Pasal 2 KUHP Nasional memberlakukan Hukum Yang Hidup Dalam Masyarakat (selanjutnya disebut “HYHDM”), kemudian tata cara dan kriteria penetapan HYHDM tersebut diatur dalam Peraturan Pemerintah. Rancangan Peraturan Pemerintah (selanjutnya disebut “RPP Tata Cara Kriteria HYHDM”) ini akan dijadikan sebuah rujukan bagi Pemerintah Daerah untuk menetapkan hukum adat yang ada di wilayah daerah tersebut dalam sebuah Peraturan Daerah (selanjutnya disebut “Perda”). Penulis berangkat dari sebuah kekhawatiran, bahwa Perda yang akan dibentuk, sarat akan kepentingan politik, minimnya partisipasi bermakna yang melibatkan kelompok rentan, dan menimbulkan kriminalisasi mengatasnamakan moral yang berdampak pada kelompok rentan. Adapun tujuan dari Penelitian ini, yakni memberikan masukan kepada Pemerintah di dalam RPP tentang Tata Cara dan Kriteria Penetapan HYHDM yang nantinya akan digunakan oleh Pemerintah Daerah untuk membuat Rancangan Perda atau Peraturan Kepala Daerah yang anti Diskriminatif bagi kelompok rentan. Beberapa rumusan masalah dalam Penelitian ini adalah, pertama apa urgensi RPP Tata Cara dan Kriteria Penetapan HYHDM memberikan perlindungan hukum bagi kelompok rentan dan kedua bagaimana mekanisme perumusan RPP Tata Cara dan Kriteria HYHDM yang ideal. Metode yang dipakai dalam Penelitian ini adalah penelitian hukum doktrinal dengan pendekatan normatif yuridis dan studi kepustakaan. Adapun hasil dari penelitian ini adalah memberikan dorongan kepada pembentuk kebijakan yang berlandaskan asas partisipasi dan keadilan bagi masyarakat adat, kesetaraan gender, transparansi, kemanusiaan, kepentingan nasional dan lingungkan. Kemudian, dalam mekanisme pembentukan Perda yang anti-diskriminatif harus melalui proses identifikasi, validasi dan verifikasi agar rancangan Peraturan Pemerintah tersebut sesuai dengan nilai-nilai sebagaimana yang diatur dalam Pasal 2 ayat (2) KUHP Nasional.

Abstract

Legal Protection of the Right to Self-Defense for Members of the Indonesian National Police Tried in Code of Ethics Hearings with a Dishonorable Discharge Verdict,” examines the tension between Polri’s disciplinary mechanisms and Indonesia’s criminal justice system. In practice, police personnel accused of criminal offenses are frequently subjected to Dishonorable Discharge (PTDH) through code of ethics hearings before a final criminal judgment (inkracht van gewijsde) is issued. This raises questions about the protection of the right to self-defense, the presumption of innocence, and the principle of justice. The study aims to (1) analyze how legal protection for self-defense should be guaranteed in Polri’s code of ethics hearings, and (2) assess whether PTDH imposed prior to a binding criminal verdict is consistent with the principles of Indonesian law. Findings indicate that, while regulations mandate adherence to audi et alteram partem, the presumption of innocence, and procedural safeguards under the Penal Code and Code of Criminal Procedure, in practice PTDH is often applied prematurely, undermining legal certainty and fairness. Case comparisons, including Brigadier Andriansyah (pre-inkracht) and Bripka Yuswindra (post-inkracht), highlight inconsistent practices within the institution. The research concludes that PTDH should only be executed after a final criminal judgment, thereby ensuring substantive justice, legal certainty, and the protection of fundamental rights. Recommendations include harmonizing disciplinary and criminal justice processes and revising internal Polri regulations to align with constitutional and criminal law principles.

Abstract

Neurolaw is an interdisciplinary field that combines law and neuroscience to enhance the understanding of human behavior, decision-making, and their legal implications. This approach is gaining global attention and has potential for application in Indonesia's criminal law system. Neurolaw sheds light on how factors related to the brain and nervous system like impulsivity, mental health issues, and environmental influences can affect criminal behavior and personal accountability. This research, using normative legal method, finds that neurolaw could be valuable in Indonesia's justice system for evaluating testimony, truth, and fairness. Techniques like brain scans and neuropsychological tests offer scientific support for statements made by defendants and witnesses, helping to ensure legal decisions are more objective and just. While neurolaw offers potential advancements for criminal law, it faces challenges in Indonesia. Neuroscience is a complex field that requires specialized knowledge, yet Indonesia currently has few experts in this area. Additionally, the required infrastructure such as brain scanning technology, advanced laboratories, and research funding is limited.

Abstract

The offense of blasphemy is complex and confusing due to its three distinct definitions: offense according to religion, offense against religion, and offense related to religion. This lack of clarity results in no clear boundaries for defining what constitutes blasphemy. This article explores the legal interpretation of blasphemy through an analysis of various court decisions and the opinions of religious leaders. Utilizing normative research methods complemented by field data from interviews with religious leaders, the study reveals that Article 156a of the Criminal Code lacks a precise definition of blasphemy, leading to broad and varied interpretations. The subjectivity of determining blasphemy is evident, as it often depends on the identity of the offended party. Additionally, resolving blasphemy cases, such as those involving deviant sects, necessitates theological dialogue rather than immediate recourse to punitive measures. The article notes that judicial decisions in blasphemy cases frequently rely on the testimony of religious experts, sometimes without sufficient consideration of the expert’s qualifications or the quality of their explanation of blasphemy.

Abstract

The phrase “minor nature of the act” in the concept of rechterlijk pardon as regulated in Law No. 1 of 2023 has not yet been accompanied by interpretative guidelines. This situation may result in biased interpretations, leading to legal uncertainty and inconsistency in future law enforcement. This study examines the ideal regulation of the phrase “minor nature of the act” in rechterlijk pardon to ensure harmony with the principle of legality. The research employs normative legal methods, utilizing statutory, conceptual, case, and comparative approaches. The findings indicate that the phrase “minor nature of the act” should be limited to specific criminal offenses eligible for pardon, as exemplified in Portugal, in order to prevent multiple interpretations that could result in discrimination in law enforcement.

Abstract

The absence of a clear definition and limitation of blasphemy can threaten justice in law enforcement in Indonesia. This has an impact on the process of resolving the blasphemy cases. Thus, the settlement of the penal or the courts in the settlement of blasphemy cases is considered ineffective. Based on that background, the problems that will be raised in this research are: How is the criminal law reform related to blasphemy in Indonesia based on the concept of restorative justice? How can the Prosecutor's Office play a role in the reformulation of blasphemy based on the concept of restorative justice? This study uses a descriptive normative research method with a qualitative approach. The research approach used is the statutory approach.The results of the study show that law enforcement in blasphemy tends to lead to pros and cons. This is due to problems with the regulation of blasphemy in Indonesia. There is no concrete definition of blasphemy and limitation on blasphemy in various laws in Indonesia. Therefore, there is a need for reformulation of blasphemy in Indonesia, one of which is through non-penal ways based on the concept of restorative justice by Law Enforcement Officials in Indonesia, one of which is the Prosecutor's Office. The reformulation is by: reforming legal regulations and provisions in the National Criminal Code and Draft of Criminal Procedure (RKUHAP); reformulation of administrative sanctions; and reformulation through penal mediation. Abstract

Pre-trial procedure serves as a control mechanism over the authority of law enforcement officers, particularly in assessing the legality of coercive measures undertaken by investigators. In practice, courts have granted pre-trial applications in several cases and ordered compensation to be paid to applicants. However, a pre-trial decision does not automatically establish the state’s obligation to provide compensation; it must first be proven that the loss is real, measurable, and directly caused by unlawful actions. In general, such compensation is borne by the state through the national budget. Indonesian criminal procedural law does not explicitly regulate mechanisms for imposing compensation liability directly on investigators or other responsible state officials. Nonetheless, outside the criminal procedure framework, state financial law provides a mechanism for holding public officials accountable for losses resulting from negligence through administrative and financial liability systems. This study examines the potential application of cost internalization within the framework of economic and legal analysis to strengthen investigator accountability. By internalizing the costs arising from unlawful investigative actions, the burden of compensation may be shifted, at least partially, from the state to the responsible officials. The findings indicate that cost internalization represents an optimization of accountability, encouraging greater prudence and professionalism among investigators. Therefore, it is recommended that this concept be explicitly regulated in the Draft Criminal Procedure Code to enhance legal protection and institutional responsibility.
