Abstract

Corruption is an extraordinary crime, so extraordinary methods are also needed to prevent and eradicate this crime. The imposition of serious crimes is one of the ways needed to eradicate them, then new punitive breakthroughs are also needed in order to provide a sense of deterrence and fear to both the perpetrators and the community. Several cases that have been decided during the trial of corruption at the first level, among others, are on behalf of the accused, Inspector General. Djoko Susilo in the corruption case of the procurement of a driving license (SIM) simulator tool, the KPK Public Prosecutor demanded additional crimes of revoking the right to vote and vote in general elections and public office (political rights), and the panel of judges granted the demands at the appeal level. This additional punishment is regulated in article 35 of the Criminal Code in conjunction with article 18 paragraph (1) of Law Number 31 of 1999 in conjunction with Law Number 20 of 2001 concerning Corruption. This research uses normative legal research methods, supported by primary, secondary and tertiary legal sources. With descriptive qualitative analysis.The problem with this additional punishment for depriving political rights is how to apply this additional punishment for depriving political rights in the prevention and eradication of corruption, because of course the KPK has strong reasons why this additional punishment is included as a punishment for perpetrators of corruption.

Abstract

Ketentuan mengenai asas legalitas seperti yang tercantum dalam KUHP berlaku untuk tindak pidana yang diatur di luar KUHP termasuk juga tindak pidana narkotika dan psikotropika. Pelaku tindak pidana narkotika dan psikotropika ini diancam dengan sanksi pidana penjara seperti yang ada di dalam Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika dan didalam Undang-Undang Nomor 5 Tahun 1997 tentang Psikotropika. Selain diancam dengan sanksi pidana penjara para pelaku penyalahgunaan narkotika dan Psikotropika dapat dikenakan sanksi tindakan, yaitu rehabilitasi. Di Indonesia saat ini sudah ada peraturan yang menyebutkan bahwa pengguna narkotika dan Psikotropika dapat dikirim ke panti rehabilitasi untuk menjalani perawatan sebagai ganti hukuman kurungan, yaitu didalam Undang-Undang tentang Narkotika dan Psikotropika . Adapun permasalahan yang akan dibahas pada penelitian adalah bagaimanakah pelaksanaan sanksi tindakan rehabilitasi pelaku penyalahgunaan narkotika dan Psikotropika di Provinsi Sumatera Selatan, Kendala apa yang dihadapi dalam pelaksanaan sanksi tindakan rehabilitasi pelaku penyalahgunaan narkotika dan Psikotropika di Provinsi Sumatera Selatan? Metode yang digunakan adalah metode penelitian empiris. Penelitian ini merupakan penelitian Yuridis Empiris (Field Research) atau Penelitian sosiologis yang tujuan dari penelitian ini . Penelitian ini akan dilakukan dengan pendekatan Empiris didukung dengan data normatif dan diperkaya dengan pendekatan sosiologis.Rehabilitasi pada BNN OI terdiri dari 2 yaitu Regabilitasi rawat jalan dan Rehabilitasi Rawat Inap. Pada rehabilitasi rawat inap kegiatan rehabilitasi dibagi menjadi beberapa tahapan yaitu assesmen awal, rencana terapi, assesmen lanjutan.Dalam pelaksanaannya rehabilitasi di pengaruhi faktor pendukung dan faktor penghambat. Maka berdasarkan latar belakang tersebut diatas maka peneliti akan melakukan penelitian tentang ”Pelaksanaan Sanksi Tindakan Rehabilitasi Pelaku Penyalahgunaan Narkotika dan Psikotropika di BNN Ogan Ilir”.

Abstract

The decision of the Bandung District Court sentenced the Ministry of Women's Empowerment and Child Protection of the Republic of Indonesia to be paid to 13 child victims of Defendant Herry Wirawan's rape. The decision was controversial in the community, then the public prosecutor filed an appeal at the Bandung High Court with a decision. This research aims to criticize the issue of imposing restitution on the state and legal protection for children against perpetrators of sexual violence who are unable to pay restitution. The type of research used is normative legal research with a statute approach using descriptive-qualitative analysis. The research results show that Bandung District Court Decision Number 989/Pid.Sus/2021/PN.Bdg was fallacious in considering terminology differences between restitution and compensation. On the other hand, Article 33 of Sexual Violence Crime Law reveals the state is obliged to provide compensation for the remaining amount of Restitution owed to Victims following a court decision through victim assistance funds. The study results are recommended in the victim and witness protection enforcement, although it should still refer to examination in the court.

Abstract

Cases of obscenity are currently rife in indonesia. the victims in these crimes are often childrenthe causative factor is that this act of same-sex abuse begins with a sexual deviance experienced by an individual who likes same-sex sexual or in other words is driven by homosexual behavior. (for fellow women to be called lesbians) is emotional attraction (affection, emotional connection) and/or erotically, either more prominently (predominantly) or solely (exclusively), towards people of the same sex. the same, with or without physical (physical) intercourse. the regulation or legal basis governing obscene acts is regulated in chapter xiv of the criminal code (kuhp) concerning crimes against decency, namely in articles 289 to article 296 of the criminal code. article 289 of the criminal code contains obscene acts with violence or threats of violence, while articles 290 paragraphs (2) and (3), 292, 293, and 294 paragraph (1) of the criminal code contain the crime of obscenity with the criminal code contains the criminal act of obscenity with child victims.

Abstract

Chemicall calstraltion is calrried oult by introdulcing alnti-alndrogen chemicalls, either vial pills or injections, into al person's body to wealken the testosterone hormone. In simple terms, chemicalls thalt alre pult into the body will redulce or even eliminalte libido or sexulall desire. The chemicall calstraltion alction formullalted in Alrticle 81 Palralgralph (7) of Lalw no. 17 of 2016 is not in alccordalnce with hulmaln rights. Abstract

Corruption is a major challenge in national development that negatively impacts the economy, political stability, and the welfare of society. This research analyses the effectiveness of anti-corruption policies in Indonesia, particularly in handling corruption cases in the public sector. This study uses a qualitative approach with secondary data analysis, including reports from anti-corruption agencies, legal studies, and government documentation. Anti-corruption policies in Indonesia significantly reduce corrupt practices, but they are not yet fully effective. The main obstacles include weak law enforcement, a lack of competent human resources, and insufficient coordination between the involved agencies. Moreover, the still strong culture of corruption and political influence often hinders the consistent implementation of policies. This research suggests increased transparency, stronger regulations, and deep institutional reforms to make anti-corruption policies more effective. With the synergy between agencies and community support, it is hoped that the efforts to eradicate corruption in Indonesia can increase public trust and create good governance in the public sector.

Abstract

Penelitian menganalisis Penerapan Metode Scientific Crime Investigation pada Tindak Pidana Pembunuhan Hasil penelitian ini menunjukkan bahwa penerapan ilmu pengetahuan melalui metode Scientific Crime Investigation (SCI) adalah sebagai terobosan dalam proses pembuktian dalam penanganan tindak pidana. Perbedaan pembuktian secara ilmiah dengan pembuktian secara langsung terhadap tersangka ataupun saksi, yang mana saksi itu manusia, cenderung memberikan keterangan palsu, berbeda dengan pemeriksaan secara Scientific Crime Investigation (SCI) yang berbasis ilmu pengetahuan Pembuktian perkara pidana secara Scientific Crime Investigation (SCI) tidak lepas dari bantuan pihak Laboratorium Forensik yang menjadi tempat pengecekan barang bukti menggunakan ilmu pengetahuan. Serta, terdapat Kendala belum adanya Produk UU terkait Metode SCI,Penyidik yang kurangnya Pengalaman, sarana dan Prasarana tidak memiliki pemeriksaan pengujian tes DNA dan keluarga korban yang tidak mengizinkan dilakukannya autopsi.

Abstract

Legal Protection of the Right to Self-Defense for Members of the Indonesian National Police Tried in Code of Ethics Hearings with a Dishonorable Discharge Verdict,” examines the tension between Polri’s disciplinary mechanisms and Indonesia’s criminal justice system. In practice, police personnel accused of criminal offenses are frequently subjected to Dishonorable Discharge (PTDH) through code of ethics hearings before a final criminal judgment (inkracht van gewijsde) is issued. This raises questions about the protection of the right to self-defense, the presumption of innocence, and the principle of justice. The study aims to (1) analyze how legal protection for self-defense should be guaranteed in Polri’s code of ethics hearings, and (2) assess whether PTDH imposed prior to a binding criminal verdict is consistent with the principles of Indonesian law. Findings indicate that, while regulations mandate adherence to audi et alteram partem, the presumption of innocence, and procedural safeguards under the Penal Code and Code of Criminal Procedure, in practice PTDH is often applied prematurely, undermining legal certainty and fairness. Case comparisons, including Brigadier Andriansyah (pre-inkracht) and Bripka Yuswindra (post-inkracht), highlight inconsistent practices within the institution. The research concludes that PTDH should only be executed after a final criminal judgment, thereby ensuring substantive justice, legal certainty, and the protection of fundamental rights. Recommendations include harmonizing disciplinary and criminal justice processes and revising internal Polri regulations to align with constitutional and criminal law principles.
