Abstract

This article reviews sexual violence against women found in the narrative of the yellow book, especially in the context of Islamic law and customs. Although Islam emphasizes the safety, peace, and respect for women, there is an ambiguity in the meaning of the holy text that can trigger interpretations that support violence. This is exacerbated by some scholars who have conservative views on the role of women, which are then immortalized in the yellow book. This article also highlights that violence against women is often supported by biased interpretations of the verses of the Qur'an and hadith. In conclusion, the yellow book, as a reference for Islamic teachings in Islamic boarding schools, needs to be reviewed to eliminate the narrative of violence and ensure respect for women in accordance with the true teachings of Islam.

Abstract

Salah satu topik perbincangan yang sedang aktual di berbagai media adalah masalah moderasi beragama. Moderasi beragama harus menyentuh seluruh aspek kehidupan, termasuk di dalamnya kehidupan akademik. Saluran moderasi beragama di perguruan tinggi dapat melalu pembelajaran. Pembelajaran Agama Islam merupakan suatu rangkaian materi mata kuliah yang eksistensinya sudah diakui di pentas akademik dan sudah terintegrasi dengan beberapa mata kuliah yang diajarkan di Perguruan Tinggi. Namun persoalannya, sudah sejauh mana moderasi beragama mampu mewarnai pembelajaran agama di perguruan tinggi. Seberapa kuat civitas akademik mampu membentengi diri dari dari gempuran kelompok-kelompok ekstrem yang akhir-akhir ini sudah banyak merambah ke dunia kampus. Kemudian, langkah antisipatif apa saja yang harus dilakukan untuk membentengi para mahasiswa dari incaran sebagai “penganten” ekstrem, serta solusi pemecahannya bagi mereka yang sudah terpapar paham ekstrem. Moderasi pembelajaran agama di perguruan tinggi menjadi topik bahasan dalam tulisan ini, dan akan diuraikan secara sistematis. One of the current topics of discussion in various media is the issue of religiousmoderation. Religious moderation must touch all aspects of life, including academic life. The channel of religious moderation in universities can be through learning. Islamic Religious Learning is a series of subject matter whose existence has been recognized on the academic stage and has been integrated with several courses taught in universities. But the problem is how far has religious moderation been able to color religious learning in universities. How strong the academic community is able to fortify themselves from the onslaught of extreme groups that have recently penetrated the campus world. Then, what anticipatory steps must be taken to fortify students from being targeted as extreme "brides", as well as solutions for those who have been exposed to extreme ideas. Moderation of religious learning in higher education is the topic of discussion in this paper, and will be described systematically.

Abstract

The practice of unregistered marriages (nikah siri) in traditional Muslim communities is often seen as non-compliance with state regulations. However, this behaviour cannot be understood without considering the influence of kiai (local religious leader) in the public sphere. This article explores the dynamics of unregistered marriage practices within the Madurese Muslim community of Kubu Raya, West Kalimantan, Indonesia. Employing a socio-legal research framework, the study collects data through in-depth interviews with 25 key informants, including widowed couples engaged in unregistered marriages, kiai, village officials, and community leaders. Drawing on Peter L. Berger’s theory of the social construction of reality, this article analyses the relationship between those involved in unregistered marriages and the hegemony of kiai. The study finds that unregistered marriages in the Madurese Muslim community are influenced by the kiai’s view that a marriage contract meeting the conditions of Islamic jurisprudence (fiqh) is valid without registration at the local Religious Affairs Office. This practice represents a social reality legitimised by religious authority. For the Madurese Muslim community, the religious legitimacy conferred by the kiai serves as a basis of faith, prompting them to engage in unregistered marriages despite this practice conflicting with state law. The article highlights the dominant role of kiai in shaping social realities that may diverge from compliance with state law in traditional Muslim communities. [Praktik perkawinan yang tidak dicatatkan (nikah siri) pada komunitas muslim tradisional sering kali dinilai sebagai ketidakpatuhan mereka terhadap regulasi administratif yang diatur oleh negara. Namun, perilaku tersebut tidak dapat dipisahkan dari pengaruh hegemoni para kiai di ruang publik. Artikel ini mengkaji dinamika praktik nikah siri yang dilakukan oleh komunitas muslim Madura di Kubu Raya, Kalimantan Barat, Indonesia. Artikel ini merupakan penelitian sosio-legal dengan menggunakan teknik pengumpulan data melalui wawancara mendalam terhadap 25 informan kunci yang terdiri dari para pasangan nikah siri yang berstatus sebagai duda dan janda, kiai, perangkat desa, dan tokoh masyarakat. Dengan menggunakan teori konstruksi sosial atas kenyataan dari Peter L. Berger untuk mengeksplorasi hubungan dialektis antara pelaku nikah siri dan hegemoni kiai, artikel ini menemukan bahwa nikah siri yang dipraktikkan oleh komunitas muslim Madura dipengaruhi oleh pandangan kiai bahwa akad nikah yang telah memenuhi syarat dan rukun perkawinan dalam fikih adalah sah, tanpa perlu mencatatkannya di kantor urusan agama setempat. Praktik ini merupakan bentuk kenyataan sosial yang telah mendapatkan legitimasi keagamaan dari kiai. Bagi masyarakat muslim Madura, legitimasi keagamaan yang diberikan oleh kiai menjadi modal keyakinan bagi mereka untuk melakukan nikah siri, meskipun perilaku tersebut bertentangan dengan hukum administrasi negara. Temuan ini menunjukkan bahwa hegemoni kiai yang dominan dalam kehidupan sehari-hari masyarakat muslim tradisional dapat mengonstruksi kenyataan sosial yang tidak taat terhadap hukum negara.]

Abstract

This article is the result of research related to the Calculation of Refractive Correction in Determining the Height of the Sun at the Beginning of the Asar Prayer Time" This research is a Research and Development approach research, by producing a product in the form of a refractive calculation for the height of the Sun at the beginning of the Asar prayer time. The primary data source used is the article Impact of Atmospheric Refraction on Asr Time by Abdurrahman Ozlen, the book Mechanics of Celestial Bodies. The method of data collection in this study is documentation. The data analysis method used in this study is qualitative descriptive analysis, which is obtained from the results of the refractive correction calculation in determining the height of the Sun at the beginning of the Asr prayer time. The results of this study conclude. First, the calculation of the refractive correction in determining the height of the Sun at the beginning of the Asar prayer time is to calculate the angle of the Sun's height that appears at the time of the Sun reaches the culmination point, then calculate the height of the Sun visible at the beginning of the Asar time, calculate the height of the true Sun at the beginning of the Asar time which has been corrected by refraction, and finally is to calculate the entry of the beginning of the Asar prayer time

Abstract

This study examines the role of the taysir manhaji method in the development of Islamic economic law in Indonesia through the fatwas of the National Sharia Council–Majelis Ulama Indonesia (DSN-MUI). Taysir manhaji refers to a methodological approach that facilitates legal decision-making with ease and flexibility, allowing Islamic legal rulings to adapt to changing economic realities. By applying fiqh principles, DSN-MUI has issued fatwas addressing contemporary financial practices, including wadiah, mudarabah, currency exchange, and Islamic hedging. This research employs a qualitative approach, combining document analysis and interviews to explore the practical implementation of taysir manhaji in DSN-MUI fatwas. The findings reveal that this method serves as a bridge between classical fiqh and modern financial practices while upholding maqasid al-shari‘ah (the objectives of Islamic law). Its flexibility enables practical solutions, as exemplified by DSN-MUI fatwas No. 1, 5, 18, and 22, without compromising fundamental Islamic legal principles. The study underscores the taysir manhaji method's significant contribution to the evolution of Islamic economic law, demonstrating its ability to accommodate modern economic demands while preserving the integrity of shari‘ah principles. Furthermore, it highlights the necessity of adaptability in Islamic legal thought to address the complexities of the global economic landscape.
