Abstract

Penelitian ini dimaksudkan untuk mendeskripsikan tentang kerangka hukum pengaturan hukum siber dan mekanisme pengamanan transaksi online di Malaysia. Pendekatan analisis adalah perundang-undangan mengenai konsep perlindungan dan proteksi transaksi online. Secara komprehensif pembahasan dilakukan dengan melihat secara historis perjalanan hukum siber di Malaysia sampai pada perkembangan mutakhir. Hasil kajian ini menunjukkan bahwa kemajuan sistem hukum siber Malaysia diarahkan untuk mendukung Visi global 2020 untuk menjadikan Malaysia sebagai salah satu kekuatan dunia dalam kemajuan teknologi informasi, sehingga berbagai produk hukum dibidang teknologi informasi diarahkan menuju tercapainya visi tersebut.

Abstract

Abstract

This study examines the strategies implemented by several pesantrens (Islamic boarding schools) in Madura to curb the proliferation of radical Islam. It aims to uncover the various approaches these Islamic boarding schools employ to combat the rise of radical Islam, which has recently gained traction in the region. Utilising empirical legal research methodologies with socio-legal and anthropo-legal frameworks, the study reveals that pesantrens are proactive in teaching students—the Santri—to reject religious radicalism. Furthermore, these institutions foster religious communities, such as koloman, kamrat, and Majelis Shalawat, which have been effective in resisting radical influences in Madura. The success of these pesantrens can be attributed to their pivotal role in enhancing legal awareness among the community, steering them away from radical ideologies. This strategic influence is anchored in their capacity to modify legal behaviours through organisational structure, social control, and cultural integration. The findings affirm the critical role of pesantrens in promoting a secure, peaceful, and religiously tolerant Indonesia, highlighting their tangible contributions to national stability.

Abstract

Transportation plays a vital role in national development and public welfare. However, regulating ride-hailing in Indonesia encounters significant challenges, particularly regarding legal certainty and fairness. This study investigates the complexity of legal uncertainty and inequality within the partnership framework of ride-hailing services. Using a normative legal approach comprising legislative, conceptual, and comparative methods, the study finds that overlapping laws, lack of uniform operational standards, and inconsistent law enforcement create legal ambiguity. Moreover, it identifies systemic inequalities in the ride-hailing partnership model, where drivers are in a structurally weaker position than platform companies. These imbalances are inadequately addressed under the current Civil Code, resulting in unfair fare systems, insufficient driver protection, and unequal licensing practices. The main findings indicate the need for clear and cohesive legal instruments that ensure equal legal standing for all stakeholders. The study contributes to legal scholarship by proposing a revised partnership model rooted in legal certainty and social justice principles. It recommends regulatory harmonization, restructuring the partnership framework to reflect equitable legal positions, and implementing responsive legal standards. These steps are essential for developing a fair, sustainable, and inclusive transportation ecosystem in Indonesia.

Abstract

This research aims to investigate the issues encountered by parliamentary institutions in Indonesia, focusing specifically on the disproportionate power of the first chamber the (Dewan Perwakilan Rakyat / DPR) People’s Representative Council, relative to the second chamber, the (Dewan Perwakilan Daerah / DPD) Regional Representative Council throughout the legislative process. This research presents normative-conceptual proposals for a reconstruction formula aimed at equilibrating the legislative functions of the two chambers, in alignment with the principles of balanced or robust bicameralism. This study utilises a doctrinal legal research framework, involving the analysis of primary and secondary legal sources in the literature. This study incorporates constitutional, theoretical, and statutory/normative techniques. This study applies a general qualitative descriptive analysis technique, focusing on interpreting legal texts and normative content in a structured manner to identify patterns, meanings, and implications in the legislative relationship between DPR and DPD. The research findings reveal that the legislative authority of the two chambers (DPD & DPR) in legislation making, as delineated in the 1945 Constitution of the Republic of Indonesia and statutory rules, remains disproportionate. This results from the DPD's limited authority to propose draft legislation and discuss proposals without final approval. The DPD continues to be acknowledged as a co-legislator or supplementary power in the legislative process, unlike the unrestricted authority of the DPR. Therefore, the relationship between the two chambers as representative entities must be redefined based on robust or equitable bicameralism. To execute rebuilding plans, it is essential to amend several parts of the Constitution and revise other legislative rules. The two chambers are expected to collaborate and meet the ambitions of both national and local governments to produce high-quality legal documents; however, this study is limited in scope to normative and doctrinal analysis, and further empirical research is needed to assess practical implementation.

Abstract

This study rigorously examines the practical implementation of participatory village autonomy, a linchpin for inclusive governance in Indonesia. Despite formal recognition by Law No. 6 of 2014 and its 2024 amendment , significant  hurdles persist, including elite domination, financial mismanagement, limited community engagement, and insufficient institutional capacity. Employing a normative legal methodology, this inquiry  identifies effective models of community engagement and application for the Indonesian context. Findings  affirm that village autonomy's democratization requires comprehensive legal reform, institutional strengthening, transparent administration, and active citizen involvement. Beyond mere electoral procedures, true democratization  demands cultural adaptation, community empowerment, and robust accountability mechanisms to prevent elite capture.  Synergistic collaboration among central, regional, and village governments is paramount for genuinely responsive local governance. Lessons from diverse precedents  underscore the necessity of community-driven planning and legally mandated public participation for sustainable village development. This research  concludes that empowered village autonomy can substantially foster an equitable and resilient Indonesian governance landscape, contingent upon holistic systemic reforms and diligent application of innovative engagement models.
