Abstract

In 2019 the number of poor people ini Medan Citywas 183,790 people with a percentage of the population receiving PBI health insurance of 29,60% based on data from the Central StatisticsAgency. PBI JK participants are people who are classified as poor and cant’t afford whosecontributions are paid by the Government in the amount of Rp. 420.000. In 2091 the Ministry of Social Affairs issued Decree No. 70 0f 2019 sixthphase concerning policies against deactivating PBI JK participants. This is what becomes a polemic ini a society that can’t afford it. The deactivation of thin Center certainly affects PBI participants who hold the Medan Sehat Card in the city of Medan, which provide health protectionbenefits for Medan city residents.The research method uses a normative-empirical research type. The 1945 constitution explicitly stated that the state is obliged to provide health facilities for the poor and is obliged to develop a Social Security System, hence Law no 40. 0f 2004 concerning the National Social Security System and Law no. 24 of 2011 concerning Sosial Security Administering Bodies. Responbility ofthe Medan City Government in collaboration withBPJS Health, the social service and the Medan City Government Hosipital provide and coordinate in carrying out their socialresponbilities for PBI recipients whose assistancehas been stopped by the Minsitry of Social Affairs. BPJS Health as an institution managing guarantees of free health servicer to the poor must coordinate with the Medan city social service as an extension of the government to provide information related to community povertydata ini terms of data management. This coordination is to create order between institutions and the public in the use of law whichfunctions as legal certainty. Abstract

Tanah menjadi alat produksi paling vital di dalam masyarakat, yang  menghasilkan kebutuhan primer. Ketika  masyarakat kehilangan tanahnya maka peluang untuk jatuh ke dalam jurang kemiskinan dan kesenjangan sosial semakin terbuka lebar.  Di Indonesia tidak sedikit konflik agraria, terkhusus konflik tanah yang bermasalah seperti Di Desa Bah Damar, Kecamatan Dolok Marawan dimana tingkat kesadaran hukum masyarakat dalam kepemilikan tanah sangat minim sehingga tanah yang dilindungi dirampas oleh pihak luar. Kepemilikan sertifikat sebagai bukti penguasaan hak atas tanah telah menjadi hal yang sangat penting untuk terus dilakukan sosialisasi sebagai upaya penyadaran terhadap masyarakat. Bahwa kepemilikan sertifikat tidak sekedar terpenuhinya syarat administrative, dan bukti formil, namun sebagai jaminan kepastian hukum. Tujuan Pengabdian Kepada Masyarakat ini untuk memberi kesadaran hukum pentingnya mempertahankan hak milik tanah dan memberi pengetahuan kepada masyarakat tentang perlindungan hukum hak atas tanah dalam melindungi kepemilikan tanah. Pengabdian ini dilaksanakan secara empiris dengan interaksi secara langsung kepada masyarakat dengan pendekatan sosialisasi hukum. Hasil pelaksanaan pengabdian berjalan baik dengan antusias masyarakat yang begitu besar, dimana masyarakat sudah memahami dan sadar dalam melindungi hak milik atas tanah berdasarkan Undang-Undang No. 5 Tahun 1960 tentang Pokok Agraria. Pengabdian ini diharapkan dapat meningkatkan ilmu dan memberi kesadaran masyarakat sejak dini atas hak milik tanah yang mengacu pada peraturan perundang-undangan.

Abstract

Online buying and selling transactions are carried out by some Indonesian people through e-commerce platform whice are a technological development. Online purchasing transactions are carried out to save time and make things easier for buyers. However, there is a phenomenon in online purchases in the form of consumer complaints regarding dissatisfaction with the goods purchased which do not match  the information provided by the seller. The identification of the research problem is how consume law is protected in the civil code and consumer protection law and the responsibility of business actors for consumer losses. The aim of the research is to determine consumer legal protection and the responsibilities of business actors towards consumers. The research uses normative juridical research, a statutory regulation approach and is analysed qualitatively. Consumer protection is regulated in the civil code and consumer protection law number 8 of 1999 which regulates the protection and replacement of goods if the goods received by the consumer do not conform to what was agreed in the sale and purchase transaction. The responbility of business actors for consumer losses is to provide compensation for demage, replacement of goods and/or refunds

Abstract

The palm oil industry in Indonesia, as one of the country’s major economic sectors, contributes significantly to the national economy. However, this sector faces various challenges, particularly related to legal uncertainty that hinders the creation of a conducive investment climate. This study aims to analyze the legal protection for investors in the palm oil plantation sector, focusing on Empus Village, Langkat Regency. The research explores legal issues related to land ownership, social conflicts with local communities, and policy changes that are poorly coordinated. The method used is a descriptive qualitative approach with triangulation techniques, integrating data from in-depth interviews, field observations, and policy document analysis. The study finds that unclear land ownership and fluctuating policies are the primary obstacles to investment. Additionally, the lack of policy socialization by the government has caused legal uncertainty that disadvantages both investors and local communities. Existing policies, such as Minister of Agriculture Regulation No. 26/2017, do not provide clear and consistent legal protection. Therefore, the study recommends enhancing policy socialization, revising legal protection for investors, and enforcing stronger legal frameworks to create a more conducive and sustainable investment climate. This research contributes to the formulation of more inclusive policies and supports the sustainability of the palm oil plantation sector.

Abstract

Lecturers are not only teachers, but also have a role as researchers and implementers of community service. Therefore, lecturers are entitled to receive a decent wage in accordance with minimum standards. The employment relationship between lecturers and Private Higher Education Institutions (PTS) is outlined in the form of an employment agreement that includes concise provisions regarding rights and obligations, one of which is the right to Lecturer Wages. In practice, there are several lecturers in the Private Higher Education environment who have not enjoyed their wage rights optimally. They receive wages below the minimum standard, paid according to per credit unit of teaching, which is not in accordance with the lecturer employment agreement and laws and regulations. This raises issues regarding the legality of the lecturer employment agreement system in PTS and the legal protection of lecturers against substandard wages. This study aims to determine the wage system of lecturers' employment agreements with private universities (PTS) and analyze legal protection against wage practices that do not comply with regulations. The research method used is normative juridical with a statutory approach and literature review. The results of the study indicate that the implementation of fixed-term employment agreements between lecturers and private universities does not comply with the provisions of Articles 90 and 91 of the Manpower Law, which state that wages below the Provincial Minimum Wage (UMP) are invalid. This violation has legal consequences in the form of default and administrative sanctions. Legal protection for minimum wages is affirmed in Government Regulation No. 36 of 2021 concerning Wages, which regulates the wage scale structure, and Regulation of the Minister of Education, Culture, Research, and Technology No. 53 of 2023
