Abstract

This research is entitled legal protection of victims of sexual violence after the enactment of Law Number 12 of 2022 concerning criminal acts of sexual violence. Formulation of the problem of how the legal protection for victims of sexual violence and how the effectiveness of legal protection for victims of sexual violence after the enactment of Law Number 12 of 2022 on criminal acts of sexual violence. With normative juridical methods. Sexual violence against women and children is a serious problem in every country. In the city of Makassar, cases of sexual violence against children have increased significantly during 2021. Makassar City DPPPA recorded a surge of 302 cases in the last three years, compared to 52 cases in 2020. In 2019, the number of cases of sexual violence against children even reached 127 cases. These incidents of sexual violence are generally carried out by the closest people, with the family environment being the place where the most cases occur

Abstract

This study is entitled criminal act analysis of Illegal Logging in forest areas with special purpose without legal permission: Case Study Decision No. 141/Pid.B/Lh/2021 / Pn.Mii. With the formulation of the problem of how the application of material crime in Illegal Logging in forest areas with special purposes without legal permission and how the basis for the judge's consideration in Decision No. 141/Pid.B/Lh/2021 / Pn.Mii. Using normative juridical methods. Conclusion b. Based on decision number: 141 / Pid.B/LH/2021 / PN.Mii, accused Arman Alias Maman Bin H. Muhammad Jaya was found legally and convincingly guilty of committing a criminal offense in the forestry sector in accordance with alternative charges. In this case, the perpetrator is given a criminal sanction in the form of confinement/prison and is also subject to a fine in accordance with Article 82 paragraph (1) letter B Jo Article 12 letter b of the Indonesian Law No. 18 of 2013 on the Prevention and Eradication of forest destruction. In the verdict given by the panel of judges, the perpetrator was sentenced to imprisonment for 1 year and 4 months and a fine of Rp500, 000, 000.00. If the fine is not paid, it will be replaced by imprisonment for 1 month.

Abstract

Penelitian ini membahas perlindungan hukum bagi dokter dalam praktik medis terutamanya berdasarkan UU 17/2023, dalam hal ini yang menjadi sorotan adalah dilema kompleks yang dihadapi oleh profesi ini. Fokusnya mencakup risiko diskriminasi, tuntutan hukum, dan kendala komunikasi antara dokter dan pasien. Dengan menggali mekanisme hukum, penelitian ini menekankan relevansi Pasal 189 UU Kesehatan dalam membagi tanggung jawab komunikasi antara rumah sakit dan pasien. Paradigma kesehatan yang menggeser tanggung jawab pasien, serta perlindungan hukum seperti Pasal 310, diperdebatkan untuk menciptakan lingkungan kesehatan yang optimal dan saling mendukung, memahami keterbatasan dokter, dan meningkatkan komunikasi dalam praktik medis.

Abstract

A mortgage is a security right over land or buildings granted to a creditor as collateral for a debt owed by the debtor. In practice, the elimination of mortgage rights is a frequently encountered problem. One way to eliminate mortgage rights is through the roya process, a request for a roya determination due to the creditor's inability to provide a certificate of settlement, which is one of the main obstacles in the process of releasing mortgage rights over collateral objects. The expected objectives of this study are to determine and analyze the procedures for implementing a roya determination for the elimination of mortgage rights, as well as to determine and analyze the legal implications of a roya determination without a Certificate of Settlement. This study is expected to provide a clearer picture of the obstacles, both from a legal and administrative perspective, that may exist. In addition, it is also expected to contribute to the development of mortgage law in Indonesia in general. The research method used is Normative Juridical with a case analysis approach as one of its instruments and a normative approach method that focuses on normative legal analysis. It was found that the Court's decision ordering the National Land Agency to remove roya was to ensure the restoration of the Debtor's rights to the collateral submitted to the Creditor, the obstacles faced by the Debtor in the process, and provided recommendations to improve the effectiveness of the implementation of the court's authority to ensure legal certainty for Debtors who had paid off their debts. The results of the study indicate that although the court has the authority to handle roya applications, delays in the legal process and administrative obstacles at the National Land Agency often slow down the provision of legal certainty needed by Debtors.
