Abstract

Cyberbullying has become a worrying phenomenon inthe last decade, especially among students. Cyberbullying is anew form of bullying that involves the use of electronic media.Difference other forms of bullying, cyberbullying reaches a muchwider audiences at great speed, transcending physical andpersonal boundaries of time and space. The impact ofcyberbullying cases is more devastating than traditionalbullying, because it leaves digital records such as photos, videos,and writings so that the memory and shame for the victim willcontinue as long as the digital footprint is accessed by people.Therefore, the importance of prevention efforts in order to avoidand not fall into the dangers and impacts of cyberbullying andthe legal aspects that govern it. Activities carried out amongstudents in the form of counseling through webinars arepreventive measures that need to be carried out by students inorder to avoid the dangers and impacts of cyberbullying as wellas legal aspects that regulate if cyberbullying occurs. Thepurpose of this activity is to increase knowledge andunderstanding of students of SMK Industri Nasional 1, SetuBekasi , in order to avoid cyberbullying, both as perpetrators andvictims.

Abstract

However, these assets can cause conflicts in thehousehold because husband and wife do not understand theposition of property in marriage in the event of divorce anddeath. The position of property is regulated in Law Number 1 of1974 concerning Marriage which recognizes 3 (three) kinds ofassets, namely joint property, inherited property and acquiredproperty. Joint property is property acquired during marriage,while inheritance and acquisition are the innate property of eachhusband and wife. The property obtained by husband and wife asa gift or inheritance is under the control of each as long as theparties do not specify otherwise. The existence of legal provisionsregarding inherited and acquired assets but can be used as jointproperty by making a marriage agreement. The communityservice team at the Faculty of Law, Bhayangkara Universitycarried out legal counseling activities at the Citra VillaMangunjaya Housing, Tambun Selatan District, Bekasi regencywhich directly interacted with the community, especially thewomen in Rukun Warga 028. The purpose of this activity was toincrease public knowledge and understanding regardingownership and position of property. property in marriage, candistinguish joint property and innate property so that they knowthe rights and obligations of each towards their property. Theresults of the activities are made and documented in the form ofimplementation reports and published in scientific journals inorder to provide benefits in the academic field and at thepractical level.

Abstract

The news of a valid marriage or a series marriage is often controversial, resulting in uncertainty of the marriage status, which has a negative impact on the parties involved, both wife, husband and child. Where it is explicitly stipulated in the Compilation of Articles 5 and 6 that marriages must be recorded before the Marriage Registrar (PPN) and registered with the KUA. The Law No. 1 of 1974, concerning Marriages, provides that every marriage shall be recorded according to the law in force, because it shall be performed in accordance with the terms and conditions in force which shall be confirmed before the law by the marriage record. The study aims to identify and analyze the phenomenon of online series weddings in Jakarta in particular and various legal issues arising from online series wedding practices and to study the series wedding using the wedding service provider that is distributed through social media. The aim of this study is to give thought to the development of legal science especially in the field of marriage law. Based on the conclusion, the author suggests the need for public awareness to be able to understand that whatever the reason, the negative impact of serial marriages is greater than the benefits. The issue of legal marriage or serial marriage is often a controversy that leads to uncertainty about the status of the marriage, which has a negative impact on the parties involved, both wife, husband and child. Abstract

Medical confidentiality is a patient's right that must be protected in the administration of health services. Good relations between doctors or hospitals with patients occur because they are based on trust. There is a doctor's obligation to keep the patient's medical secret. During the Covid-19 pandemic, the disclosure of medical secrets became a controversial issue among the public. Doctors have an obligation to pay attention to the limitations in keeping secret and disclosing medical secrets to the public and must be based on the laws and regulations in Indonesia. This study uses normative juridical legal research, namely legal research conducted by researching library materials by analyzing various statutory provisions and data contained in the literature. The results of the study, show that medical secrets for Covid-19 patients can be opened on the basis of public interest, one of which is due to extraordinary events or outbreaks of infectious diseases. In fact, the disclosure of data on patients infected with Covid-19 is not an embarrassing situation so that Covid-19 patients will not be stigmatized and discriminated against from the public. This is done to reduce the spread of Covid-19.

Abstract

A guardian is a person who is given the authority to carry out a legal act in order to protect the interests of a child who does not have both parents or both parents are incapable of carrying out legal actions. The guardian's responsibility for the person and property of the child under his guardianship until the child is an adult and capable of performing legal actions. The research method that the author uses is normative juridical, namely library research by examining laws and regulations related to legal problems or issues being faced. The results of the author's research that children's assets under guardianship are in the form of permanent objects such as land and buildings and the ownership of land rights is still in the name of the guardian, so when the trust ends or the child is declared an adult the guardian is obliged and responsible for handing over all of the child's assets by transferring rights in the form of grants which must be made a grant deed before the Land Deed Making Officer (PPAT) through the correct legal procedures. Then, the recipient of the grant must arrange the process of transferring land rights to the office of the National Land Agency so that the status of the grant becomes his property.

Abstract

Pemerintahan yang berdaulat merupakan salah satu syarat terbentuknya sebuah negara. Indonesia sebagai negara demokratis yang menganut sistem pemerintahan Presidensial dan dalam pelaksanaan pemerintahannya berlandaskan atas Undang-Undang Dasar 1945. Untuk menentukan pemerintahan berdaulat, Pemilihan Umum merupakan sarana pelimpahan wewenang yang dimiliki masyarakat dengan memilih pemimpin untuk menjalankan pemerintahan secara sah dan bertanggung jawab. Pemilihan umum sebagai hajatan demokrasi lima tahunan harus dilaksanakan secara langsung, bebas, rahasia, jujur dan adil oleh semua lapisan masyarakat Indonesia, termasuk pemimpin negara sebagai eksekutif. Namun, ada yang menarik pada pemilihan umum 2024 kali ini, eksekutif terlihat turut campur (cawe-cawe) dalam gelaran pesta demokrasi tersebut. Dengan menggunakan metode penelitian normatif yang dilakukan dengan fokus pada penelaahan bahan pustaka atau data sekunder yang menggunakan pendekatan Perundang-Undangan (Statute Approach) dan pendekatan konseptual (Conseptual Approach) dengan tujuan untuk mengetahui peraturan apa saja yang dapat dilanggar atas turut campurnya eksekutif dalam pemilihan umum 2024 dan seberapa besar dampaknya. Hasil dari penelitian ini yaitu: Pertama, bahwa dengan kekuasaan dan hak kewenangan prerogatif yang melekat di Presiden sangat mempengaruhi tatanan pelaksanaan pemerintahan di Indonesia. Presiden bisa saja dengan sadar maupun tidak, dapat melakukan penyimpangan atau penyalahgunaan kekuasaannya (abuse of power). Selain itu, fasilitas-fasilitas negara dapat menguntungkan bagi salah satu kelompok tertentu dan merugikan kelompok lainnya. Kedua, pelanggaran terhadap asas Pemilu terkhusus adil, jujur dan bebas atas turut campurnyaeksekutif dalam Pemilihan Umum 2024 yang disertai dengan penyalahgunaan kekuasaan dan kewenangan yang dimiliki menjadi preseden buruk hingga pada level yang paling bawah sekalipun. Pemilu akan berjalan tanpa adanya keadilan bagi peserta, kejujuran seluruh pihak yang terlibat patut dipertanyakan dan hilangnya kekebasan masyarakat dalam memberikan hak suara akibat mendapatkan tekanan.

Abstract

Skincare is a skin care product that is popular among the majority of female consumers. One way to obtain skincare products is through online purchases, which, despite its advantages, also has disadvantages such as not meeting expectations (cheap prices but containing harmful substances) and being prone to fraud. The aim of this research is to understand the regulations regarding online buying and selling and consumer protection for skincare products using the online buying and selling system, particularly in terms of negative impacts on consumer health. This research is a doctrinal study that utilizes primary, secondary, and tertiary legal sources. The results of this research are as follows: Firstly, the online buying and selling of skincare products through marketplaces, as stipulated in Articles 1457 and 1458 of the Civil Code, utilize electronic contracts that include the identification of the parties involved, object and specifications, requirements for electronic transactions, pricing and costs, cancellation procedures, rights of aggrieved parties, and dispute resolution. Online buying and selling is recognized as a legitimate and accountable electronic transaction based on Government Regulation Number 71 of 2019 on the Implementation of Electronic Systems and Transactions. Online buying and selling is also regulated by the fatwa of the National Sharia Council of the Indonesian Ulema Council, No. 05/DSN-MUI/IV/2000, which provides provisions regarding payment, goods, parallel salam, goods delivery, cancellation, and disputes. Secondly, consumers of skincare products through online buying and selling are protected by the state both preventively through legislation (Consumer Protection Law No. 8 of 1999, Health Law No. 36 of 2009, Law No. 19 of 2016 on Amendments to Law No. 11 of 2008 on Electronic Information and Transactions, Civil Code, and Criminal Code) and repressively (compensation by businesses; non-litigation through the Consumer Dispute Settlement Board (BPSK); litigation through the courts).

Abstract

The rapid advancement of technology and the emergence of various applications encourage everyone to take advantage of electronic-based services that aim to provide convenience for users. Everyone can access the information needed anywhere. Likewise in the land sector which has undergone digital transformation and implemented electronic-based land services in the form of electronic documents by imposing electronic land certificates regulated in the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 1 of 2021 concerning Electronic Certificates. This study aims to provide legal certainty regarding the importance of changing documents proving ownership of land rights through digitalization because of the large number of multiple certificates and the land mafia which results in land disputes. To analyze this research, the writer uses a normative juridical approach that uses a document study search from statutory regulations. The results of the research from the author that the application of electronic land certificates is carried out in stages to meet the needs of the people in Indonesia. It is hoped that electronic certificates can provide protection and legal certainty to land rights holders and be able to provide resolution to land disputes.

Abstract

Indonesia is a country that has a thousand islands that have a wide diversity of arts and culture and are rich in ethnic, ethnic, national and religious diversity. The wealth of art and culture is a national potential that must be protected. Intellectual works of artistic and cultural property that can and need to be protected by law. Because this protected artistic and cultural wealth can increase the welfare not only for its creators but also for the nation and state. This study aims to see how the implementation of Law No. 28 of 2014 on Copyright and what legal remedies are if the songwriter does not get his economic rights. This research uses juridical-normative research which is carried out by tracing or analyzing and analyzing theoretical matters concerning principles, conceptions, legal doctrines and norms, library materials or document materials. The results of this study indicate that the implementation of Law Number 28 of 2014 concerning Copyright is still far from good, because there are still many songwriters who do not get royalties from the songs they create, so many songwriters take legal efforts to get royalties from songs. which he created. There is also a need for socialization to songwriters and owners of entertainment venues in order to make it easier to implement this regulation so that it can provide justice for songwriters.

Abstract

The emergence of the Covid-19 pandemic had a wide impact on various economic sectors, one of the largest sectors being the aviation and tourism sectors. The government has taken a policy of limiting air transportation activities that have an impact on canceled flights. The case that arises is that the canceled tickets are replaced with vouchers, this raises the question of what form of consumer protection is for airline passengers whose tickets are canceled. The method of this research is normative using the approach of laws and regulations from the point of view of the rules in Indonesia and the European Union. From the research conducted by the author, it was found that the consumer protection of airplane passengers has been reduced due to the Covid-19 pandemic.
