Abstract

Notaries are currently allowed to certify electronic documents. This authority is contained in Article 15 paragraph (3) of Law Number 2 of 2014 concerning the position of a notary. A part from ratifying the deed, a notary can also save files in the form of file. But not a few notaries are still reluctant to use technology to make and ratify a deed due to conflicts between articles both in the notary office law itself and with articles in other laws. This study aims to determine whether the deed that uses information technology has the strength of proof like an authentic deed and whether the electronic certification carried out by a notary is in line with the duties and positions of the notary. The research method used is the type of normative legal research conducted by reviewing library materials on secondary data using a legal approach and a conceptual approach. This study focuses on the deed of the extraordinary general meeting of Shareholders of PT. Lippo Karawaci Tbk which was conducted via video conference on October13 2021. There was disagreement from several shareholders over the certification which was carried out electronically because it was considered to be able to make the deed a private deed. In addition to the conflict between the articles, this is also due to the absence of implementing regulations regarding the making of deeds through information technology by a notary so that there is a need for a review of the relevant Laws and the making of special implementing regulations for cyber notaries.

Abstract

Restructuring is an effort to save non-performing loans because debtors have difficulty in fulfilling their obligations (default). The government through the Financial Services Authority Institution has asked banks to carry out an inventory of debtors affected by Covid-19 and provide a credit restructuring policy during the Covid-19 pandemic, which aims to enable the public, especially debtors, to apply for waivers in making credit payments. Restructuring is provided by creditors to help debtors from debt problems because the debtor has defaulted on the bank credit agreement. The purpose of this study is to determine the implementation and implementation of bank credit restructuring as an effort to rescue non-performing loans during the Covid-19 pandemic. In this study, the author uses a normative juridical research method sourced from a literature study by analyzing the provisions of the legislation. The debtor has the right to apply for credit restructuring if in fact the debtor is in default in making debt payments. However, there are still many applications for credit restructuring, which are carried out by debtors who do not have good intentions on the pretext of being affected by the Covid-19 pandemic even though they still have the ability to fulfill obligations. The success of the implementation of restructuring lies in the intentions and desires of the parties, namely debtors and creditors, must have good intentions in resolving non-performing loans.

Abstract

Pengalihan hak tanggungan atas tanah dan bangunan melalui mekanisme cessie telah menjadi praktik umum dalam dunia perbankan, terutama saat terjadi kredit macet. Namun demikian, praktik ini kerap menimbulkan permasalahan hukum, khususnya terkait perlindungan hukum bagi penerima cessie yang menerima hak tagih atas objek jaminan. Penelitian ini bertujuan untuk menganalisis kewenangan hakim dalam menetapkan balik nama hak tanggungan kepada debitur baru serta meninjau kedudukan hukum penerima cessie dalam perspektif perlindungan hukum dan kepastian hukum. Penelitian ini menggunakan metode yuridis normatif dan yuridis empiris melalui pendekatan studi kasus pada Putusan Pengadilan Negeri Semarang Nomor 362/Pdt.G/2022/PN Smg. Hasil penelitian menunjukkan bahwa pengalihan hak tanggungan tanpa persetujuan debitur lama dapat menimbulkan ketidakpastian hukum, dan putusan pengadilan yang menyetujui balik nama sertifikat tanpa keterlibatan debitur lama dinilai tidak sejalan dengan prinsip legalitas dan perlindungan hukum yang diatur dalam Undang-Undang Hak Tanggungan. Oleh karena itu, diperlukan regulasi yang lebih tegas serta kehati-hatian hakim dalam memutus perkara serupa.

Abstract

Kepolisian Negara Republik Indonesia adalah alat negara yang bertugas memelihara keamanan dalam negeri, dibutuhkan kehidupan keluarga personil yang harmonis dan serasi guna mendukung pelaksanaan tugasnya. Namun adakalanya terjadi perceraian yang dalam penyelesaiannya diatur dalam Perka Kapolri No. 9/2010 dan SEMA RI No. 10/2020, pada intinya mengharuskan adanya Surat Izin Cerai dan apabila tidak terpenuhi maka hakim menunda persidangan selama 6  bulan. Penelitian ini bertujuan untuk menganalisis teori keadilan dalam penerapan Perka Kapolri No. 9/2010 dan SEMA No. 10 Tahun 2020 pada perceraian Anggota Polri. Penelitian ini adalah penelitian hukum doktrinal/normatif dengan pendekatan perundang-undangan. Studi kepustakaan, dianalisis secara kualitatif. Hasil Penelitian mendeskripsikan Perka Kapolri No. 9/2010 dan SEMA RI No. 10/2020 tidak dapat dipersamakan dengan Undang-Undang yang dibentuk oleh Lembaga legislatif yang mempunyai kekuatan hukum mengikat secara langsung dan umum, penerapan sebagai suatu keharusan dapat menjadi sebab tidak terpenuhinya rasa ketidakadilan terutama bagi istri yang mengajukan perceraian akibat tidak terpenuhinya nafkah baik nafkah materi dan non-materi lebih khusus akibat suami melanggar taklik talak.

Abstract

Cryptocurrency has emerged as a disruptive and revolutionary asset in the global financial landscape, transforming how individuals and organizations conduct financial transactions. In Indonesia, cryptocurrency is prohibited as a means of payment but is permitted as a digital asset (crypto asset) that can be traded. Crypto assets operate through a decentralized system that lies outside the control of the government and centralized authorities. As of October 2024, the number of crypto asset consumers in Indonesia reached 21.27 million, and throughout 2024, it has contributed to the development of the digital financial services sector, with transactions amounting to IDR 650.61 trillion. Volatility, illegal crypto asset traders, hacking, and scamming are among the key issues in crypto asset trading. This research is a doctrinal/normative legal study using a statutory approach. It is based on a literature review and analyzed qualitatively. The findings show that the Ijtima Ulama of the National Fatwa Commission VII in 2021 and OJK Regulation (POJK) No. 27 of 2024 indicate that the government is getting involved in crypto asset trading. However, several weaknesses in the POJK, including the unclear position of individual consumers and the absence of mandatory risk mitigation requirements for traders, may result in the lack of security guarantees for consumer crypto assets.
