Abstract

Scholars of hadith have mentioned that da'if (weak) hadiths can be used for Fadail Al-A'mal (virtuous actions), but it is uncertain which type of da'if hadith can be used as evidence. Although previous researchers have conducted numerous studies on this topic, this paper aims to discuss the validity of using da'if hadiths as evidence for Fadail al-a'mal by examining the types, conditions, and replacement hadiths of da'if narrations. The conclusions presented in this paper are based on the opinions of hadith scholars, taking into account both the advantages and disadvantages. The researcher employs an analytical study method, focusing on the da'if hadiths compiled in the book "Targhib wa At-Tarhib" in the chapter on Thaharah (purification). The findings of this study indicate that Syadid al-da'ifi refers to a category of hadith that cannot be rectified. Within the Thaharah chapter of the Kitab At-Targhib and At-Tarhib, there are 118 hadiths categorized as follows: 43 authentic hadiths, 16 hasan (good) traditions, 7 da'if traditions, and 52 traditions for which al-Hafizh al-Mundhiri (the author of the book) does not mention their authenticity. Researchers have attempted to identify da'if hadith substitutes to remove the prohibition on using da'if hadiths as evidence for Fadail Al-A'mal. Consequently, out of the seven hadiths, five da'if hadiths can be replaced. The first, third, fourth, and sixth hadiths, however, do not require replacement as they are not weak.

Abstract

The purpose of this paper is three. First, to describe the phenomenon of the Sakinah family in Sumber Pendidikan Mental Agama Allah (SPMAA) Islamic boarding school. Second, it explains the efforts of the executors and participants of the Rahmat Pura wedding tradition in creating a Sakinah family. Third, explain the challenges and solutions the organizers and participants face in realizing this goal. The aspiration for a harmonious family is a shared desire among married couples, including those in arranged marriages. One particular tradition that exemplifies this phenomenon is the Rahmat Pura wedding tradition, which takes place within the context of a pesantren. By applying a phenomenological approach, this article concludes two things. First, the phenomenon of the Sakinah family at SPMAA adheres to the concept of the Sakinah of the Prophets, which is synonymous with the simplicity and struggle of God's religion. Second, among the implementing efforts is to provide providers with pre-marital activities and create a family feeling in the pesantren environment. Meanwhile, the efforts of the participants are to support each other and remind the couple that the purpose of their marriage is the struggle for Allah's religion.

Abstract

The method of criticism of Hadith (Naqd Hadith) was developed by Hadith experts to prove whether a Hadith can be categorized as coming from the Prophet or not. Hadith scholars tend to use the method of sanad criticism (Naqd al-Sanad) in determining the authenticity of Hadith.  Over time the Hadith scholars began to come up with new methods in an effort to determine the authenticity of hadith in accordance with its scientific tendencies, one of these methods was the Kashf method. This method is widely known among Sufis, but has not been widely used in the context of hadith criticism. One of the Sufi figures who had a focus on the Kashf method was Ibn Arabi. This study is a literature review by analyzing documents derived from Ibn Arabi and experts related to the Kashf method. Data is analyzed by applying descriptive analytical methods and using philosophy of science to determine the validity of the Kashf Method as a method of criticism of Hadith. This study shows that the Kashf method is a mu'tabar (authoritative) method for Sufi scholars and is also recognized by some Hadith experts. According to Zabid al-Jabiri in the treasures of Islamic philosophy, there are three models of methodology of thought, namely bayani, burhani, and irfani. Kashf method includes the irfani model. irfani can be interpreted as the disclosure of knowledge obtained through irradiation of essence by God to His servant (Kashf) after doing spiritual practice (riyâdlah) done on the basis of love.  Therefore, the Kashf method is one of the valid methods for determining the validity of hadith.

Abstract

Islam has provided detailed regulations on marriage, from the marriage proposal (akad), agreement (akad), to the fulfillment of rights and obligations between husband and wife. All these statements are based on the Quran and Hadith. One of the husband's obligations towards his wife is to provide a living (support payments). Fiqh scholars unanimously agree that livelihood is the responsibility of the husband, regardless of his wealth, poverty, or middle ground. However, Imam Ibn Hazm has a unique and different viewpoint from the consensus of the scholars. He argues that the responsibility of providing a living actually shifts to the wife due to the husband's incapability. Based on this unique perspective, this research aims to analyze "How is the concept of livelihood understood in the perspective of Imam Ibn Hazm and the istidlal method used in that concept?" In this research, a qualitative analysis method with a literature review approach will be used. Data will be collected through the analysis of relevant works by Imam Ibn Hazm concerning the concept of livelihood, as well as through the analysis of works by other scholars and related literature. The istidlal method will be applied to understand the arguments and viewpoints of Imam Ibn Hazm regarding the concept of livelihood. The main findings of this research will summarize Imam Ibn Hazm's perspective on the concept of livelihood and the role of istidlal in supporting his viewpoint. The research will identify the main arguments used by Imam Ibn Hazm to support his viewpoint, as well as the implications of his viewpoint on the understanding of the concept of livelihood in Islam. This research will conclude that Imam Ibn Hazm's perspective on livelihood and the use of the istidlal method to support his viewpoint make significant contributions to the understanding of the concept of livelihood in Islam. The implications of Imam Ibn Hazm's perspective on contemporary Islamic family law thinking will also be discussed.

Abstract

The issue of women in leadership has been a longstanding topic of debate among classical Islamic jurists, eliciting diverse responses from mainstream Islamic organizations in Indonesia. This article presents a comparative analysis of fatwās (Islamic legal opinions) issued by the Forum of Bahtsul Masail (FBM) at two Nahdlatul Ulama (NU)-affiliated Islamic higher education institutions: Ma’had Aly Hasyim Asy’ari Tebuireng, which prohibits female leadership, and Ma’had Aly Salafiyah Syafi’iyah Situbondo, which permits it. Through a combination of literature-based and empirical approaches, the article highlights a significant contrast in the istinbāṭ al-aḥkām (derivation of legal rulings) employed by these two FBMs. FBM Ma’had Aly Hasyim Asy’ari Tebuireng adopts the qawlī (literal) method, adhering to the majority views of classical Islamic jurists. In contrast, FBM Ma’had Aly Salafiyah Syafi’iyah Situbondo employs a manhājī (methodological) approach, incorporating minority opinions and reinterpreting texts within the context of modern societal changes. These contrasting fatwās reflect a broader tension between taqlīd (adherence to precedent) and adaptation to evolving social contexts. Furthermore, this article argues that the educational backgrounds of the FBM actors, as well as the curricula taught in their respective pesantren (Islamic boarding schools), contribute to the differences in fatwās. These differences reflect the internal dynamics within the fatwā production process in NU. [Isu kepemimpinan perempuan telah lama menjadi topik perdebatan di kalangan ahli hukum Islam klasik yang telah memicu beragam respons di kalangan organisasi masyarakat Islam arus utama di Indonesia. Artikel ini menganalisis secara komparatif fatwa dari Forum Bahtsul Masail (FBM) di dua ma’had aly yang berafiliasi dengan Nahdlatul Ulama (NU): Ma’had Aly Hasyim Asy’ari Tebuireng, yang melarang perempuan menjadi pemimpin, dan Ma’had Aly Salafiyah Syafi’iyah Situbondo, yang memperbolehkannya. Artikel ini, dengan mengombinasikan pendekatan kepustakaan dan empiris, menemukan bahwa kedua FBM menggunakan metode penggalian hukum (istinbāṭ al-aḥkām) yang berbeda. Abstract

Pesantren have historically been recognized as key institutions in shaping moderate Islamic thought in Indonesia. However, recent shifts in certain pesantren reveal the emergence of more rigid and radical orientations, prompting the need to revisit their intellectual and theological foundations. This study investigates the genealogical roots of pesantren’s wasatiyah (moderate) orientation as it developed in the sixteenth century. Employing a qualitative method, this research is grounded in a literature-based analysis of scholarly works on Islamic education and pesantren traditions. Textual sources were selected for their relevance to the development of moderate Islamic thought in Indonesian contexts. The findings reveal three interrelated factors that underpin the emergence of moderation in pesantren: the dialectical engagement between local culture and Islam; a dialogical approach embedded in their manhaj thinking; and the theological grounding in Ahlus Sunnah wal Jama‘ah. Together, these factors form a framework that supports pesantren as enduring institutions of balanced and inclusive Islamic education. Reaffirming this genealogy is essential in addressing contemporary deviations from pesantren’s original ethos.

Abstract

The different methods of scholars in determining the status of traditions have a significant impact on the formulation of Islamic law. This study discusses the disputed hadiths in Bidāyat al-Mujtahid, especially in the book of al-Nikāḥ, and their implications for the law of marriage guardians and the minimum standard of dowry. This research uses the literature review method by tracing and analyzing the hadiths of disputed status. The results show that there are two main hadith that are disputed by scholars. while the standard minimum dowry hadith is also rejected by the majority of scholars due to the weakness of its narrators. These differences have implications for Islamic law, particularly in the regulation of marriage guardians and dowries in various Muslim countries. This study contributes to understanding the role of hadith criticism in the formulation of Islamic law. However, this study is limited to an analysis of Bidāyat al-Mujtahid and has not examined the implementation of the law in various Muslim countries. Further studies are needed to explore the application of hadith criticism methodology in contemporary legal systems. [Perbedaan metode ulama dalam menilai keabsahan hadis berdampak signifikan terhadap formulasi hukum Islam. Penelitian ini mengkaji perbedaan penilaian ulama terhadap dua hadis dalam Bidāyat al-Mujtahid, khususnya dalam kitab al-Nikāḥ, serta pengaruhnya terhadap hukum wali nikah dan standar minimal mahar. Kajian ini menggunakan metode kajian kepustakaan dengan pendekatan analisis isi (content analysis), menelusuri serta menganalisis hadis-hadis yang diperdebatkan statusnya. Hasil penelitian menunjukkan bahwa terdapat dua hadis utama yang diperselisihkan derajatnya oleh para ulama. Hadis pertama tentang kewajiban wali dalam pernikahan dinilai lemah oleh Mazhab Hanafi, sedangkan hadis standar minimal mahar juga ditolak oleh jumhur ulama karena kelemahan perawinya. Perbedaan ini berdampak pada hukum Islam, khususnya dalam regulasi wali nikah dan mahar di berbagai negara Muslim. Kajian ini berkontribusi dalam memahami peran kritik hadis dalam formulasi hukum Islam. Namun, penelitian ini terbatas pada analisis Bidāyat al-Mujtahid dan belum mengkaji implementasi hukum di berbagai negara Muslim. Studi lanjutan diperlukan untuk mengeksplorasi penerapan metodologi kritik hadis dalam sistem hukum kontemporer.]
