Abstract

Tanah merupakan sumber daya alam yang krusial dalam mendukung kesejahteraan rakyat. Namun, permasalahan seperti keterbatasan lahan, sengketa kepemilikan, dan spekulasi tanah menjadi hambatan dalam pemanfaatan tanah secara optimal. Untuk mengatasi hal tersebut, pemerintah membentuk konsep Bank Tanah dalam Undang-Undang Cipta Kerja. Penelitian ini mengkaji urgensi pendirian Bank Tanah secara yuridis dan filosofis, serta mengevaluasi dasar hukum, peran, dan fungsi Bank Tanah dalam konteks hukum pertanahan di Indonesia. Kajian ini menggunakan pendekatan yuridis normatif dengan menganalisis peraturan perundang-undangan terkait Bank Tanah, seperti UUD 1945, UUPA 1960, dan Undang-Undang Cipta Kerja. Bank Tanah memiliki urgensi yuridis dan filosofis dalam mengoptimalkan pemanfaatan tanah untuk kemakmuran rakyat sesuai amanat konstitusi. Sebagai instrumen pelaksanaan Hak Menguasai Negara, Bank Tanah berperan dalam distribusi pemilikan tanah yang adil, penyediaan tanah untuk perumahan dan pertanian, serta alokasi strategis demi kesejahteraan rakyat. Namun, pelaksanaan Bank Tanah harus memperhatikan kepastian hukum, keadilan, dan kemanfaatan bagi masyarakat luas. Diperlukan sosialisasi luas, regulasi yang jelas, tata kelola yang baik, dan pengawasan yang ketat dalam implementasi Bank Tanah. Prioritas diberikan kepada masyarakat yang membutuhkan, dengan melibatkan partisipasi masyarakat dalam proses pengadaan tanah. Kajian mendalam terkait dampak sosial dan politik juga perlu dilakukan.

Abstract

The app-based transportation sector, such as Gojek and Grab, has rapidly developed in Indonesia, yet it still faces significant challenges regarding the legal regulations governing the partnership between platform providers and driver partners. The lack of clear legal norms has led to uncertainty regarding the rights and obligations of both parties, which ultimately reduces legal protection for both drivers and consumers. This study aims to analyze how Indonesia's legal system regulates this partnership and evaluate the extent to which existing regulations provide adequate protection for drivers and consumers. The main research questions address how Indonesia's legal system governs partnerships in this sector and to what extent the regulations support the principle of justice. The research method used is normative legal research, employing legislative, conceptual, and theoretical approaches. The findings show that Indonesia's legal system has not provided sufficient legal certainty in these partnerships. Protection for both drivers and consumers remain limited, particularly regarding labor rights and dispute resolution mechanisms. This study suggests the need for clearer and more detailed regulatory reforms to create a more equitable and transparent relationship between companies, drivers, and consumers.

Abstract

This research is motivated by the need to adjust online transportation regulations in Indonesia with technological developments and rapidly changing societal dynamics. The main issue raised is how the regulatory framework of online transportation in Indonesia is and how it compares to several ASEAN member countries. The discussion shows that regulations in Indonesia still use a conventional approach that is less adaptive to online transportation innovation, often causing legal vacuums and uncertainty for stakeholders. The conclusion of this study states that existing regulations need to be updated to be more comprehensive and responsive to changes. The advice given is that the government should adopt best practices from other ASEAN countries to create more effective regulations, including paying attention to fairness, safety, and welfare aspects for both users and service providers.

Abstract

The development of hire-purchase agreements in Indonesia has shown a significant increase; however, the bargaining position of consumers remains weaker than that of business operators, resulting in contractual imbalances, particularly in standard clauses that disadvantage consumers. This article examines the legal protection of consumers in hire-purchase agreements under Indonesian civil law and its practical implications. The research addresses two main questions: how consumer legal protection is regulated in hire-purchase agreements under Indonesian civil law, and what shortcomings exist in protecting consumers against unfair standard clauses. Using a normative legal research method with a literature study and qualitative analysis of relevant legal regulations, this study finds that although civil law upholds the principle of freedom of contract, consumer protection remains inadequate in practice. The most frequent violations of consumer rights are found in standard clauses that unilaterally shift risks to consumers, limit or exclude the liability of business operators, impose disproportionate penalties in cases of default, and restrict consumers’ rights to dispute resolution. These practices significantly weaken consumers’ legal position in hire-purchase agreements. Therefore, stricter supervision of standard clauses is necessary, along with more specific and clearer regulations to prevent abusive contractual practices. This study recommends strengthening regulatory frameworks to balance the bargaining position between consumers and business operators and enforcing stricter oversight of standard clauses in hire-purchase agreements.

Abstract

The debate about capital punishment from classical to modern times is still a debate that has not found a dialogue point. From the Beccaria era which stated that capital punishment was not effective in tackling crime, many killings occurred and will continue to occur until today the pros and cons of capital punishment still maintain their respective arguments. In answering the problems regarding the pros and cons of capital punishment against narcotics crime, this study uses a qualitative analysis method with a type of normative legal research. The data used in normative legal research is, of course, secondary data obtained through library research. In Indonesia, the debate about capital punishment against narcotics criminals reappears to the public when the provisions of the threat of capital punishment in the Narcotics Law are submitted to a judicial review or judicial review to the Constitutional Court which is considered to conflict with the most basic human rights namely the right to life guaranteed by the 1945 Constitution. Whereas if the death penalty is investigated for narcotics crimes and other crimes in general as long as it is firmly regulated in statutory regulations it does not contradict the right to life that humans have from birth.
