Abstract

This study aims to analyze the conflict between customary law and state law as well as the challenges of enforcing justice within indigenous communities. A qualitative approach was employed through in-depth interviews, participatory observation, and document analysis. The findings reveal that customary law persists due to its strong social legitimacy, rooted in local values and its effectiveness in maintaining social harmony. Conversely, state law holds formal legitimacy based on statutory regulations, yet often creates tensions when applied without considering customary contexts. The most prominent conflicts occur in land disputes, customary marriages, and resource ownership, reflecting differences in principles and justice orientation. The results indicate the need for context-based integration through hybrid mechanisms that combine customary procedures with state legal principles. Theoretically, this study enriches the legal pluralism literature with empirical evidence of asymmetric legal coexistence. Practically, the findings provide recommendations for policymakers in designing fair and inclusive dispute resolution strategies for indigenous communities.

Abstract

E-procurement has benefits for agencies or system developers as well as for all providers of goods/services and the wider community who want to know the implementation process, they can get prices for multiple offers and the process uses simple administration. On the other hand, providers of goods/services can also reduce administrative costs, increase opportunities for companies, encourage healthy competition, and can make business opportunities available to everyone. Apart from that, e-procurement is considered capable of providing easier management, faster buying and selling processes, and reducing transaction costs, good coordination, and also increasing collaboration between providers of goods/services. Information technology can make costs better and the public procurement system more diverse.

Abstract

This study aims to evaluate the effectiveness of law enforcement against human trafficking cases in Indonesia, focusing on the implementation of Law Number 21 of 2007 concerning the Eradication of Criminal Acts of Human Trafficking (UU PTPPO). Using a qualitative approach through case studies, data were collected from interviews with law enforcement officers, victims of human trafficking, and analysis of legal documents. The results of the study indicate that the effectiveness of the PTPPO Law is hampered by limited resources, lack of training for law enforcement officers, and poor coordination between government agencies and non-governmental organizations. Protection for victims is also suboptimal, with difficulty in accessing rehabilitation and support services. The implications of these findings emphasize the need for reforms in resource allocation, training, and improved coordination. This study recommends that the government increase efforts in training law enforcement officers, improve coordination between agencies, and increase public awareness of human trafficking. Further research is expected to explore the role of technology and international comparative studies in handling human trafficking cases.
