Abstract

Penelitian ini bertujuan untuk menganalisis dampak stres berat yang dialami oleh hakim dalam proses persidangan terhadap putusan terdakwa dalam perkara tindak pidana umum pada acara pemeriksaan biasa. Stres yang dialami oleh hakim dapat berpengaruh signifikan terhadap kualitas putusan yang dihasilkan, serta dapat memengaruhi kesejahteraan dan kesehatan mental hakim itu sendiri. Metode penelitian yang digunakan adalah penelitian kualitatif dengan pendekatan studi kasus. Data diperoleh melalui wawancara mendalam dengan hakim yang terlibat dalam proses persidangan perkara tindak pidana umum pada acara pemeriksaan biasa. Data yang terkumpul dianalisis dengan menggunakan teknik analisis isi. Hasil penelitian ini diharapkan dapat memberikan pemahaman yang lebih baik tentang faktor-faktor yang menyebabkan hakim mengalami stres berat dalam proses persidangan, seperti beban kerja yang tinggi, tekanan publik, dan tingginya tuntutan profesionalisme. Selain itu, penelitian ini juga diharapkan dapat mengidentifikasi strategi dan tindakan yang dapat diambil untuk mengurangi stres hakim dalam proses persidangan, seperti dukungan psikologis dan pengaturan waktu yang lebih baik.

Abstract

The purpose of doing this research is to analyze first, How is the measure of violating the public interest as a reason for the attorney to dissolve a limited liability company; and secondly, what are the legal steps for a limited liability company that was filed for dissolution by the Attorney General's Office on the grounds that it violated the public interest. First Research Results because the definition of public interest is still dynamic and keeps up with the times and in UUPT does not explain the definition of public interest in detail. then the measure of violating the public interest is taken from the law which provides a definition of public interest in the Land Law, the Prosecutor's Law, the State Administrative Court Act. So that if a Limited Liability Company violates the understanding of a public interest as described in the law, the Limited Liability Company will automatically violate the Public Interest. Second: The legal steps taken are filing an objection in court on the basis that the dissolved Limited Liability Company can still carry out re-management and improve the company even better so that it can operate again in accordance with applicable regulations.

Abstract

Arrangements for the transfer of land rights are regulated in the provisions of Article 37 Paragraph (1) and Paragraph (2) of Government Regulation Number 24 of 1997 concerning Land Registration. In this case the meaning of "Certain Circumstances" according to the concept of Article 37 Paragraph (2) of Government Regulation No. 24 of 1997 concerning Land Registration and the authority of the Head of the Land Office in registering the transfer of land rights even without being proven by the deed of the Land Deed Making Officer (PPAT). This study uses normative legal methods, with the approach of statutory regulations and other library materials. Based on the results of the author's research that "Certain Circumstances" does not have a clear meaning and uniformity, causing multiple interpretations. As for the authority of the head of the office in carrying out land registration according to the provisions of Article 37 Paragraph (2) has discretionary authority in making policies regarding the transfer of land rights that are not proven by a PPAT deed. Thus, it is necessary to synchronize the laws and regulations governing the registration of land rights by the National Land Agency, especially in the registration of land rights based on deeds that are not made by the PPAT. It would be better if the "Certain Circumstances" referred to were detailed in the body/explanation section so as not to cause multiple interpretations which could become an opportunity for abuse of authority.
