Abstract

A solid and responsible execution of construction management is referred to as good governance. Understanding the ideals behind good government is the secret to understanding it. A calculation of a government's success can be obtained by starting with the ideals in the philosophy of governance. As we enter the age of globalization and the introduction of regional sovereignty, the government's roles and obligations grow in tandem with the community's growing demand for fast, convenient, cheap, and decent services. The public wants the government to pay serious resources to fighting graft, collusion, and nepotism (KKN) in order to build a prosperous future. In this paper, a descriptive qualitative methodology is used with the aim of making it easier for writers to describe, analyze, and understand about Good Governance and Leadership.Keywords: Good Governance, Leadership, Governance  AbstrakDalam konsep governance, pemerintah hanya menjadi salah satu actor dan tidak selalu menjadi aktor yang menentukan. Good Governance adalah suatu peyelegaraan manajemen pembangunan yang solid dan bertanggung jawab. Kunci utama memahami good governance adalah pemahaman atas prinsip-prinsip di dalamnya. Bertolak dari prinsip-prinsip dalam konsep governance akan didapatkan tolak ukur kinerja suatu pemerintahan. Memasuki era globalisasi dan pelaksanaan otonomi daerah, tugas dan tanggung jawab pemerintah kian meningkat sesuai dengan menguatnya tuntutan masyarakat untuk memberikan pelayanan yang cepat, mudah, murah,dan baik. Masyarakat menuntut agar pemerintahmemberikan perhatian yang sungguh-sungguhdalam menanggulangi korupsi, kolusi, dan nepotisme (KKN), sehingga tercipta pemerintahanyang bersih dan mampu menyediakan good pub-lic services sebagaimana yang diharapkan. Dalam tulisan ini, penulis menggunakan metodologi kualitatif deskripsif dengan tujuan agar memperudah penulis dalam menjabarkan, menganalisa dan memahami mengenai Good Governance and Leadership.Kata Kunci:  Good Governance, Leadership, Pemerintahan

Abstract

Efforts to eradicate drug crimes present a law that has criminal sanctions, namely Law Number 35 of 2009 concerning Narcotics (abbreviated as the Narcotics Law) that criminal sanctions in the Narcotics Law are one of them with a death penalty. The Narcotics Law regulates the policy of criminal sanctions for drug abusers which are divided into two categories, namely the perpetrators as “Users” and/or “Dealers”. It is possible for perpetrators as dealers to be subject to the most severe criminal sanctions in the form of capital punishment as regulated in Article 114 paragraph (2). The method of legal discovery (rechtsvinding) that is often used by judges is the method of interpretation or interpretation. The results of the study state that the interpretation of the provisions that have been stated expressly must not deviate from the intent of the legislators. The judge has the authority to interpret the law if the content of the article used is unclear or incomplete. Analytical interpretation in the field of criminal law is prohibited insofar as it makes a formulation of the offense to be expanded. Analogous interpretation is permitted if it is used to fill the voids contained in the law because it has not been regulated in the provisions of the law.Keywords: Disparity; Judge; Drugs AbstrakUpaya untuk memberantas kejahatan narkoba menghadirkan sebuah Undang-Undang yang memiliki sanksi pidana yaitu Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika (disingkat UU Narkotika) bahwa Sanksi Pidana dalam Undang-Undang Narkotika salah satunya adalah sanksi pidana mati. Undang-Undang Narkotika mengatur mengenai kebijakan sanksi pidana bagi pelaku penyalahguna narkoba yang dibagi kedalam dua kategori yaitu pelaku sebagai “Pengguna” dan/atau “Pengedar”. Terhadap pelaku sebagai pengedar dimungkinkan dikenakan sanksi pidana yang paling berat berupa pidana mati seperti yang diatur dalam Pasal 114 ayat (2). Metode penemuan hukum (rechtsvinding) yang sering digunakan hakim yaitu metode interpretasi atau penafsiran. Hasil penelitian menyatakan bahwa Penafsiran terhadap ketentuan yang telah dinyatakan dengan tegas tidaklah boleh menyimpang dari maksud pembentuk Undang-Undang. Hakim mempunyai kewenangan untuk melakukan penafsiran hukum apabila isi pasal yang digunakan tidak jelas atau kurang lengkap. Penafsiran secara analogis di dalam lapangan hukum pidana terlarang sejauh ia membuat suatu rumusan delik itu menjadi diperluas.  Penafsiran secara analogi diizinkan apabila digunakan untuk mengisi kekosongan-kekosongan yang terdapat di dalam Undang-Undang karena belum diatur dalam ketentuan Undang-Undang tersebut.Kata Kunci: Disparitas; Hakim; Narkoba

Abstract

Perubahan dan perkembangan dalam setiap instansi baik dari sektor Pemerintahan maupun swasta mengalami perubahan atau pembaharuan tentu tidak bisa dihindari lagi. Bagaimana cara mengoptimalkan agar perubahan tersebut tidak begitu mengagetkan pihak-pihak instansi tertentu juga bukanlah hal yang mudah. Dalam hal ini tentu juga membutuhkan kebijakan-kebijakan dalam sebuah organisasi agar semua kepentingan umum semua pihak bisa teroptimalkan.

Abstract

Bureaucracy is a modern organization that by default enforces the division of labor in its work process. The realization of good governance in Indonesia cannot be separated from the success or failure of the performance of the bureaucracy. The concept of governance simply refers to the decision-making process and its implementation. The realization of good governance or the effectiveness of local government can be seen from its ability to realize programs related to public services. During the new order, the bureaucracy had a big hand in the development process. In the public sector, the concept of bureaucracy is defined as processes and systems that are created rationally to ensure regular, definite and easy-to-control work mechanisms and systems. The role of the bureaucracy in providing services to the community is still not in accordance with the expectations and desires of the community. Bureaucracy develops in line with the political and economic development of a society. In this paper, the author uses a descriptive qualitative methodology.Keywords: Bureaucratic Culture; Good Government; Public AbstrakBirokrasi merupakan organisasi modern yang secara baku memberlakukan pembagian kerja dalam proses kerjanya. Terwujudnya good governance di Indonesia tidak dapat dilepaskan dari berhasil tidaknya kinerja birokrasi. Konsep governance secara sederhana merujuk pada proses pembuatan keputusan dan dan implementasinya. Realisasi good governance atau efektivitas pemerintah daerah dapat dilihat dari kemampuannya dalam mewujudkan program-program yang berkaitan dengan pelayanan publik. Selama orde baru, birokrasi memiliki andil besar dalam proses pembangunan. Dalam bidang publik konsep birokrasi di maknai sebagai proses dan sistem yang diciptakan secara rasional untuk menjamin mekanisme dan sistem kerja yang teratur, pasti dan mudah di kendalikan. Peran birokrasi memberikan pelayanan kepada masyarakat masih belum sesuai dengan harapan dan keinginan masyarakat. Birokrasi berkembang sejalan dengan perkembangan politik maupun ekonomi suatu masyarakat. Abstract

Human resource investment significantly impacts the economic growth and development of a nation, including Indonesia. It is believed that education expenditures affect worker productivity in Indonesia. Theoretically, education expenditures will contribute to an improvement in worker productivity. Several factors, including a comparison of the competitiveness of domestic workers to the competitiveness of international workers, can be used to determine the effect of education investment on the rise in worker productivity. Empirically, productivity is a function of worker skills. The quantity of a worker's salary might be used to gauge their competitiveness and productivity. At the national level, it is simple to identify the productivity of various economic sectors, such as agriculture, services, and manufacturing. Due to the lack of trained people required by the labour market, conditions in Indonesia have prevented the three sectors mentioned above from achieving their full potential for productivity growth. This condition directly manifests some concerns, notably Indonesia's investment in education and worker productivity, which impacts economic growth. This study employs qualitative research methodologies of the normative research type. This study's research objectives will be satisfied by the study model. This study will answer how education investment affects worker productivity in Indonesia. The study's findings indicate that it is not accurate to assert that the education policy in Indonesia has a good effect on enhancing workers' abilities. Therefore, the issue of worker productivity must still be handled seriously to compete with workers from other nations.

Abstract

In Indonesia, the criminal law system is the one that decides the appropriate punishment for crimes and other legal transgressions. The use of the death sentence is still permitted under Indonesia's Criminal Code (KUHP), as well as some extra-criminal provisions. A translation of the Wetboek van Strafrecht voor Nederlandsch-Indie, which has been in effect in the Dutch East Indies (now known as Indonesia) since 1918 under the administration of the Dutch colonial government, can be found within the articles of the Criminal Code that govern the use of the death penalty. However, the Netherlands did away with the death sentence in 1870. Instead, a literature-based approach is used employing a qualitative research method currently being used. The study's findings indicate that significant crimes and the use of the death penalty throughout the history of criminal Law are two aspects of the problem that are strongly related. The legal system reserves the death penalty for those who have committed the most severe crimes. Therefore, many believe that the death penalty is the most severe punishment.

Abstract

The right to justice, and human rights more generally, requires the filing of a judicial review (PK) in Indonesia. A judicial review (PK) can be requested by an individual who believes that his rights have been infringed or that the court's judgment is incorrect. The cassation decision can be challenged in court by either the convicted person or the prosecution if they believe it violates basic principles of fairness and legal certainty. However, the Constitutional Court can in its decision revoke the prosecutor's authority to submit a judicial review (PK) because it is considered contrary to human rights, especially in terms of recognition, guarantees, protection and fair legal certainty and equal treatment before the law. This study used a qualitative research method with a statutory and literature approach. The results of the study stated that it was very important for the prosecutor to have the right to submit a judicial review (PK) on the cassation decision of the Supreme Court which was deemed not to have fulfilled legal certainty and justice for the victim and the state. If this is omitted, it will cripple law enforcement. The reason for submission, guarantee, protection and legal certainty for the convict cannot be fully recognized, because there are still rights to guarantee, protection and legal certainty for the victim and the people of Indonesia which must also be maintained and respected.
