Abstract

Regarding the critical nature of trademark reform, Indonesia participated in the World Intellectual Property Organization's approval of the International Trademark Agreement (WIPO). The 1992 Trademark Law was updated in 1997 by Law No. 10 Resolution No. 14 of 1997, which takes into account the provisions of the International Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS-GATT). This clause protects the origin and geographical indicators of products. Additionally, the provision modifies the former in the preceding law. With regards to trademarks in Indonesia Each user has the ability to trademark his or her name. According to Article 3 of Law No. 20 of 2016 on Marks, trademark rights are granted to registered trademark owners, indicating that the brand system in Indonesia is a constitutive (active) system, with registered trademark owners being trademark rights holders. The registered mark's owner, as the mark's holder, either uses the mark himself or grants authorization to others to do so. Additionally, Article 40 of Law No. 20 of 2016 on Marks and Geographical Indications provides that trademark rights may be transferred in accordance with the Act's provisions.

Abstract

The purpose of this study is to evaluate and explain how business partners are protected and compensated during a company's bankruptcy. This study employs both a normative juridical and a legislative methodology. The study's findings indicate that attempts to safeguard and settle the law can be made in two ways: (1) by submitting to the bankruptcy institution in order to produce justice; and (2) by referring to Bankruptcy Law No. 37 of 2004. The bankruptcy research findings are a manifestation of the debtor's failure to run the business. Thus, the best course of action is to prioritize legal protection for MSMEs as business partners. The government must pay attention to the business partners of bankrupt companies, as business partners are only a subset of small and medium businesses that exist to fill the needs of these companies, so that when the company goes bankrupt, the small and medium businesses that are also a subset of the company's activities do not have to go bankrupt as well.

Abstract

Landowners affected by land acquisition initiatives in the public interest, especially for the government's benefit, frequently have trouble receiving compensation, as government and private sector property purchases are common. On the land, there was an overlapping ownership dispute, which delayed the land acquisition because it had to be resolved in court. This study's objective is to examine and appraise techniques for resolving overlapping land ownership disputes and the legal certainty of property rights for which land acquisition is to be done. The author uses normative and empirical legal methods in this study. Because normative legal research focuses on law or norms, the author uses a normative technique. Rules include legal principles, value rules, and legal restrictions. Legally normative study involves legal theory, the legal system, and vertical and horizontal synchronization. Due to overlapping land ownership generated by the buying and selling of land rights, the legal certainty of land rights for which land acquisition is to be done has not been adequately accomplished. The Camat who served as PPAT in the aforementioned case acquired the same block of land, which was not in the public's best interest.

Abstract

Dalam penelitian ini digunakan teori kepastian hukum yang dikemukakan Gustav Von Radburch, yang menyatakan kepastian hukum "that law should be certain, that it could not be interpreted and applied in one way today and in another tomorrow, in one way here and in another way there.” Yang artinya (Hukum itu harus pasti, bahwa itu tidak dapat ditafsirkan dan diterapkan dalam satu cara hari ini dan dengan cara lain besok, dalam satu cara di sini dan dengan cara lain di sana). Jenis Penelitian yang dipergunakan dalam penelitian ini yaitu penelitian hukum yuridis normatif, dimana penelitian hukum yuridis normatif adalah penelitian hukum yang dilakukan secara meneliti bahan Pustaka atau data sekunder saja. Penelitian ini disebut juga dengan penelitian hukum kepustakaan. Sedangkan yang menjadi hasil dari penelitian ini adalah agar dalam pembentukan maupun perbaikan peraturan terkait jual beli saham mengharuskan dibuatnya akta pemindahan hak termasuk jual beli saham, agar dibuat dengan akta otentik yang dibuat oleh pejabat yang berwenang melakukan pembuatan akta otentik yaitu Notaris, guna meminimalisir terjadinya sengketa dalam jual beli saham akibat akta/perjanjian yang dibuat adalah akta/perjanjian yang dibuat dengan akta dibawah tangan.
