Abstract

Penelitian ini merupakan analisis terhadap fatwa DSN-MUI nomor 101 tahun 2016 tentang akad al-ijarah al-mausufah fi al-żimmah (IMFŻ). Akad IMFŻ, dapat dikatakan akad gabungan dari dua akad, yaitu akad ijarah (sewa) dan akad salam (pesanan). Akan tetapi landasan hukum akad IMFZ ini masih menimbulkan pertanyaan, “apakah harus didasarkan pada akad ijarah atau akad salam?”. Hemat penulis hal ini menarik dan penting untuk diteliti. Metode dalam penelitian ini menggunakan metode penelitian pustaka (library research), yakni dengan mengkaji peraturan-peraturan perjanjian hokum Islam dan hokum perjanjian positif Indonesia. Hasil penelitian ini menyimpulkan bahwa jika ditinjau dari hukum Islam, secara umum telah sesuai dengan ketentuan yang ada dalam teori akad syariah, meski termasuk ke dalam akad gabungan (murakab). Walaupun demikian DSN-MUI tetap perlu mempertimbangkan salah satu redaksi dalam fatwa tersebut, agar akadnya tidak terjadi maukuf. Ditinjau berdasarkan perspektif hukum positif Indonesia (KUHPerdata), akad IMFZ adalah jenis akad (perjanjian) tidak bernama yang muncul dari asas kebebasan berkontrak. Perjanjian IMFZ juga telah sesuai dengan syarat-syarat sah dalam perjanjian sbagaimana tertuang dalam KUHPeradata Pasal 1320. Akibat hukum yang ditimbulkan dalam perjanjian IMFŻ yaitu adanya hak dan kewajiban bagi mereka yang telah melaksanakan perjanjian.

Abstract

Departing This research is based on an agreement that is still very rarely understood even though in practice, this agreement is often carried out and even carried out every day by the community. This agreement usually occurs through the object of buying and selling something which is usually related to movable or immovable goods. In this study, the authors provide opinions and some ideas related to the Istishna contract in everyday life. In addition, the drafter of this contract concept also compares its validity from two points of view, namely from the point of view of fiqh muamalah and the view of civil law as positive law that applies in Indonesia. Penelitian ini didasarkan pada suatu perjanjian yang masih sangat jarang dipahami walaupun secara praktik, perjanjian ini sering dilakukan bahkan dilaksanakan setiap hari oleh kalangan masyarakat. Perjanjian ini biasa terjadi melalui objek jual beli sesuatu yang biasanya terkait barang bergerak maupun barang tidak bergerak. dalam penelitian ini penyusun memberikan pendapat dan beberapa gagasan terkait akad Istishna dalam kehidupan sehari-hari. Selain itu, Konsep akad ini juga penyusun bandingkan keabsahan nya dalam dua sisi sudut pandang yakni dalam sudut pandang fikih muamalah dan pandangan hukum perdata sebagai hukum positif yang berlaku di indonesia.

Abstract

Puwon Hamlet is one of the seven hamlets in Wonosari Village, Patebon Subdistrict, Kendal Regency. Various cultural activities from each hamlet in Wonosari Village still exist today. This research uses a field research method by going directly to the graves of Kyai and Nyai Cablik located in Puwon Hamlet, precisely RT 5 / RW 6 and stands on land not far from the public cemetery with land conditions higher than residents' houses. The results of this study when analyzed with Emile Durkheim's mechanical solidarity theory are the discovery of several types of traditional social life that still exist in Wonosari Village.

Abstract

Waste that is not properly processed can cause environmental pollution. In Bangunrejo Village, problems were found in waste management. The emergence of problems in waste management is caused by various factors such as lack of public awareness and supporting facilities and infrastructure. The accumulation of waste in Bangunrejo Village has a significant negative impact on the environment, including soil and water pollution, as well as health problems for local residents. This study aims to analyze the factors causing waste accumulation, negative impacts on the environment, and handling efforts that can be carried out in Bangunrejo Village. The results of the study indicate that active participation between village communities and support from the village government are the keys to success in creating a clean and healthy environment in Bangunrejo Village.

Abstract

The health seminar is one of the work programs of UIN Walisongo Semarang community service students (KKN), designed and presented during the work program seminar, and later implemented during KKN activities. The seminar aims to provide insights to the community, especially in Bangunrejo Village, about stunting and its prevention efforts. The target audience includes mothers of toddlers and village health cadres in Bangunrejo Village, chosen due to the lack of awareness among residents about stunting and its prevention. The seminar was held on Monday, August 13, 2024 ,and utilized a counseling method in the form of a seminar with the theme "Counseling and Prevention of Stunting." This seminar successfully provided knowledge to the community about stunting, its risks, and preventive measures. A noticeable improvement in community understanding of stunting before and after the seminar indicates an increased awareness following the event. Keywords: Seminar, Stunting, Health, Community.

Abstract

Shopee is an application that has been available in Indonesia since 2015, providing a variety of features for its users. These include the Shopee Mall, the introduction of ShopeePay, and the launch of Shopee Live, along with rewards in the form of Shopee Coins for loyal customers. These coins can be used as discounts when purchasing products through the Shopee app. However, from the perspective of Islamic legal theory, these features are considered new and require an examination of their validity, including an analysis of the terms and conditions and the identification of the underlying mechanisms. This article focuses on exploring and describing the legal aspects of acquiring and using Shopee Coins. The research conducted for this article is based on library research methods. The author carefully examines and analyzes the information to achieve objective conclusions. The findings indicate that, firstly, the transactions involving Shopee Coin services are permissible and valid, as they meet the necessary terms and conditions. In muamalah jurisprudence, the acquisition of Shopee Coins falls under the Ju'alah contract. Secondly, the expiration period for using Shopee Coins does not impact the validity of obtaining them, since it lacks elements that could invalidate the Ju'alah contract. Nonetheless, Shopee should communicate the expiration provisions for these coins on its application page, ensuring that users are informed and do not feel disadvantaged by the policy.
