Abstract

Salah satu permasalahan dalam persaingan usaha di Indonesia adalah berkenaan dengan proses pengadaan barang atau jasa pemerintah. Dalam proses pengadaan barang dan jasa pemerintah banyak dijumpai praktek persekongkolan untuk menentukan pemenang dalam sebuah tender. Penelitian ini memiliki rumusan masalah bagaimana pertimbangan-pertimbangan hakim dalam putusan Komisi Pengawas Persaingan Usaha nomor 05/KPPU-L/2018 tentang persekongkolan dalam tender tender preservasi rekonstruksi jalan dan pemeliharaan rutin di Provinsi Kalimantan Tengah dan benarkah putusan Komisi Pengawas Persaingan Usaha nomor 05/KPPU-L/2018 telah sesuai dengan ketentuan pasal 22 Undang-Undang Nomor 5 Tahun 1999. Tujuan penelitian ini untuk menjelaskan pertimbangan-pertimbangan hakim dalam putusan Komisi Pengawas Persaingan Usaha nomor 05/KPPU-L/2018 dan menganalisisnya dengan ketentuan dalam Pasal 22 Undang-Undang Nomor 5 Tahun 1999.

Abstract

The Practice of Mut’ah Marriages in Indonesia in the Review of Islamic Law and the Law of Marriage. Mut’ah marriage is marriage performed by a certain time limit which in Indonesia known as the marriage contract. Sunni Muslim tend to forbid the practice of mut’ah marriage while Syi’ah allow it. The practice of mut’ah marriage has been rife in some areas in Indonesia where the Sunni is majority so many people who protest and regard it as deviant behavior or forbidden. Laws marriage prohibits the practice of mut’ah marriage as Law Number 4 of 1974 and Government Regulation Number 9 of 1975 although there is a part of society who gives a different interpretation of the legislation.DOI: 10.15408/ajis.v14i1.1246

Abstract

The Marriage law in Indonesia sets the marriageable age at which a person is allowed to marry is 19 (nineteen) years old for men and 16 (sixteen) years old for women. This study focuses on legal decisions and judges’ consideration in establishing the application for marriage dispensation at the Religious Court of South Jakarta due to extramarital pregnancy. This study shows that the Court decision to grant the application for marriage dispensation at the Religious Court due to extramarital pregnancy is primarily based on the argument to avoid harmfulness. Using case study research, three court decisions stipulated by the Religious Court Decision Number: 056/Pdt.P/2010/PA.JS, Decision Number: 219/Pdt.P/2011/PA.JS and Decision Number: 197/Pdt.P/2011/PA granting the application for marriage dispensation due to extramarital pregnancy were analysed. The legal consideration formulated by the Panel of Judges is to avoid harm and is not contrary to the legislation. This means the judge’s consideration in determining the marriage dispensation due to extramarital pregnancy is not only based on the provisions stated in Article 7 paragraph (2) of the Law No. 1/1974 concerning Marriage jo. Article 15 paragraph (2) of the Compilation of the Islamic Law, but also on the consideration made by the Panel of Judges as the harms might occur if the application for marriage dispensation is refused. In determining this consideration of harms, it appears that they are influenced by their religious views and the social consequences.

Abstract

This study focuses on the problem of the extent to which human rights and islamicity (Islamic law norms) are accommodated within Indonesian anti-terrorism law (Law No. 5 of 2018). The study uses a qualitative approach with a documentary study in data collection. The result shows that Law No. 5 of 2018 has threatened human rights in some issues. This is indicated by certain matters including arrest, detention, capital punishment, interception, and revocation of citizenship. Meanwhile, the islamicity of Law No. 5 of 2018 is open to interpretation and reinterpretation. The study of measuring human rights and islamicity of Law No. 5 of 2018 has a significant contribution to the substantive implementation of  Islamic criminal law in the context of Indonesianness, as well as modernity, which also means the implementation of Islamic law and human rights at once.

Abstract

This study aims to look at the impact of the COVID-19 pandemic on divorce rates in Indonesia. Few months after the outbreak, the media reported the increasing rate of divorce. Some authorities and researchers have taken this information for granted; therefore, their responses can be misleading. This socio-legal study confronts the media reports with the statistical data on divorce case numbers received by the Religious (Islamic) Courts and the Religious Courts judges’ explanation about the issue. This study finds out that the one-year period (2020) of the COVID-19 pandemic has not influenced the rates of divorce cases submitted to the court. Social mobility restrictions and the inadequate use of the E-Court facility to enhance courts’ performance are among the causes of the crowding of divorce applicants. This implies that the current COVID-19 pandemic has little impact on divorce dynamics despite its significant influence on households’ economic instability and the increasing of domestic violence cases. With a more careful response to the media report, the authorities will be able to address the real issues faced by many households and the judiciary.

Abstract

This study aims at analyzing Islamic and positive laws in Indonesia regarding the obligation of zakat for the Goverment Employee (ASN). This is Important for finding the basis for the state in goverming zakat regulation for Muslim ASN with a payroll cut of 2.5 percent by the Ministry of Religius Affairs as well as for getting arguments in terms of islamic law and politics of law as well as their relation to these regulations. The method used in this study is a qualitative research with a statutory approach with data in the form of zakat laws and regulations enforced in Indonesia, both in terms of religious and state norms. The findings of this study indicate that there are important issues from this regulation in the perspective of Islamic law and politics of law: First, the regulation of zakat obligations for the goverment employees is not in accordance with Islamic law; Second, the method of determining muzaki (zakat payers) by the state is still biased because it declares that all the Muslim goverment employees are Muzaki; Third, the basic calculation for compulsory zakat has not calculated the gross basic needs of the goverment employees and the expenditure of basic needs (hajah ashliyyah) yet.

Abstract

In deciding joint property cases, religious court judges apply the provisions of Article 97 of the KHI with the division of 1/2–1/2 part of joint assets. However, in the decision No. 70/Pdt.G/2002/PA.Mrk, No. 330/Pdt.G/2004/PA.Tgrs, and No. 278/Pdt.G/2005/PA.Bkt, the judge of the religious court did not make a decision based on this provision. The Merauke PA decides the joint property case in a 4/10–6/10 division, the Tigaraksa PA 20%-80%, and the Bukittinggi PA 1/4–3/4. This study looks at the considerations and perceptions of the religious court judges in deciding joint property cases. The method used in this research is normative juridical which is qualitative in nature, using a comparative approach. As a result, the panel of judges in the 3 religious courts deviated from the applicable legal provisions, considering several factors. There are 5 factors that are considered by the panel of judges in deciding joint property cases, including: contribution factors, legal arguments, a sense of justice, legal arguments, origins of joint assets, and contextual understanding of a legal provision.

Abstract

Meningkatnya jumlah kasus perceraian dari tahun ke tahun, khususnya cerai gugat, baik di tingkat nasional maupun lokal di Jakarta Selatan, merupakan masalah yang cukup serius jika dihubungkan dengan tujuan perkawinan. Hasil penelitian menunjukkan bahwa penyebab tingginya angka cerai gugat disebabkan banyak faktor, diantaranya karena pemahaman perempuan terhadap hak-hak mereka sebagai isteri, semakin terdidiknya perempuan, informasi yang semakin mudah diakses, kemandirian ekonomi, dan kepedulian berbagai lembaga terhadap kaum perempuan. Faktor utama pemicunya adalah karena ketidakharmonisan, yang disebabkan karena tidak terpenuhinya kebutuhan hidup, kekerasan fisik/psikis, krisis akhlak, gangguan pihak ketiga, dan poligami tidak sehat. Selain itu ada beberapa faktor lain, namun tidak dominan. Solusi untuk mengatasinya adalah pembekalan generasi muda, terutama yang akan menikah, dengan bekal pengetahuan dan penanaman nilai-nilai agama yang cukup.

Abstract

The settlement of joint property, after husbands and wives divorced, is a crucial issue in the Religious Courts of Indonesia. According to the provisions of the Islamic Law Compilation (KHI) and Marriage Law No. 1/1974, a joint property should be divided equally if done peacefully. This research analyzes the joint property settlement after divorce in the Religious Court of South Jakarta and compares it with a number of cases in other similar institutions. This study finds out that the rules as stipulated both in the KHI and Marriage Law No. 1/1974, was not rigidly applied by the judges. Instead, the judges at the Religious Court of South Jakarta took a flexible and casuistic solution for the disputes over the sharing of joint property between divorced couples. The settlement methods used by the judges vary, depending on the case that occurs empirically. The peaceful settlement was also pursued by the Religious Court of South Jakarta, although in general, it was unsuccessful.
