Abstract

This study aims to determine the background of the filing of the Constitutional Court case lawsuit Number 30 / PUU-XVI / 2018 and understand the influence of the Constitutional Court decision Number 30 / PUU-XVI / 2018 on the Institutional Council of Regional Representatives. The research method used in this research is juridical normative with a statutory approach, a historical approach, and a conceptual approach obtained from data collection techniques through literature study through the statutory regulatory approach that refers to the 1945 Constitution, the Law, and the Constitutional Court Decisions. related to the theme of the discussion. The results of the study show that the background for filing a lawsuit against the Constitutional Court Decision Number 30 / PUU-XVI / 2018 is that there is no clear meaning to the phrase “other work” in Article 182 letter I of the Election Law that has provided space for political party functionaries as candidate members DPD. In addition to the impact of the decision of the Constitutional Court Number 30 / PUU-XVI / 2018 is the issuance of the Final List of Candidates (DCT) for DPD candidates issued by the General Elections Commission (KPU) as a follow-up to implementing the Constitutional Court Decision in which the KPU has crossed out the candidates. DPD members who still serve as functionaries of political parties.

Abstract

Penelitian ini bertujuan untuk mengetahui implementasi perlindungan negara terhadap kebebasan beragama dalam ketatanegaraan Indonesia berdasarkan analisis Undang-undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia. Secara khusus penelitian ini mencoba mendalami tentang bentuk implementasi perlindungan yang negara berikan kepada warga negaranya dalam hak asasi manusia terkhusus dalam ruang lingkup hak kebebasan beragama. Disamping itu skripsi ini juga mencoba meneliti tentang perlindungan yang negara berikan terhadap nilai-nilai kebebasan beragama dan meneliti perlindungan kebebasan beragama dalam Undang-undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia. Penelitian ini merupakan penelitian yuridis normatif melalui pendekatan peraturan perundang-undangan (statue approach). Penelitian ini menggunakan metode pengumpulan berupa studi pustaka. Melalui metode inilah penyusun mengumpulkan dokumen dan data yang kemudian diolah menggunakan analisis isi. Hasil dari penelitian menunjukan bahwa bentuk implementasi perlindungan kebebasan beragama dalam ketatanegaraan Indonesia berdasarkan analisis Undang-undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia yaitu dengan ditetapkannya kedudukan aspek ketuhanan dalam setiap nafas peraturan perundang-undangan dalam konstitusi yang berlaku dan negara memiliki tanggungjawab untuk bersikap adil atas perlindungan kepada segenap agama yang ada dalam menetapkan batasan dan larangan dalam melaksanakan ajaran agama yang diyakininya guna menjaga persatuan bangsa dan menghindari perpecahan yang mengatasnamakan agama tertentu. Kata Kunci: Implementasi Kebebasan Beragama, Hak Asasi Manusia, Perlindungan.

Abstract

Abstrak: Presiden Non-Muslim di Negara Muslim: Diskursus Politik Islam dalam Konteks Politik Indonesia Kontemporer. Artikel ini secara spesifik dimaksudkan untuk membahas secara kritis pendapat  para cendekiawan Muslim Indonesia  tentang  kemungkinan non-Muslim menjadi presiden di Negara Republik Indonesia yang merupakan negara  berpenduduk  Muslim  terbesar  di dunia. Hingga  detik  ini, wacana  Islam klasik tentang masalah ini cenderung terjebak dalam model analisis  normatif  yang  terkesan  rigid  dan  tidak toleran. Wacana ini, sampai batas tertentu,  kurang dapat menghargai kondisi  sosial, budaya, sejarah, dan  kompleksitas politik  masyarakat  Muslim. Oleh karena itu, diskursus klasik mengenai masalah ini oleh banyak cendekiawan Indonesia kontemporer dipandang telah  gagal merespons  dinamika sosial-politik  saat ini,  terutama  bila dilihat dari  sudut  pandang multi-kulturalisme dan demokrasi. Artikel ini membahas  dimensi penting  mengenai kepemimpinan non-Muslim di Indonesia yang  sering  dilupakan  atau  sangat jarang didiskusikan.Kata Kunci: Islam di Indonesia, Presiden Non-Muslim, Otoritas Tuhan, Piagam Jakarta.Abstract: A Non-Muslim President in a Muslim State: Islamic Political Discourse in Contemporary Indonesia. This article charts the political discourse amongst Islamic leaders regarding the possibility of a non-Muslim becoming President in Indonesia, the world’s most populated Muslim state, an important issue but one that is only seldom discussed in an academic context. Until recently, classical Islamic discourse on this issue, which has generally rejected this possibility, had tended to be trapped in a normative model of analysis which today seems intolerant and rigid. This article contends that this discourse, to some extent, does not properly appreciate the complex social, cultural, historical and political realities of the Muslim community today. Indeed, many other contemporary scholars view this mode of discourse as failing to respond to the current social-political dynamic, especially those scholars coming at it from a multicultural democratic perspective. Perhaps most importantly, the legal reality—even though there is a reasonable degree of controversy surrounding it—which is that there is no criterion that the President has to be Muslim, is also rejected by this discourse.Keywords: Islam in Indonesia, Non-Muslim President, God’s Authority, Jakarta CharterDOI: 10.15408/ajis.v12i1.971

Abstract

This study focuses on the problem of the extent to which human rights and islamicity (Islamic law norms) are accommodated within Indonesian anti-terrorism law (Law No. 5 of 2018). The study uses a qualitative approach with a documentary study in data collection. The result shows that Law No. 5 of 2018 has threatened human rights in some issues. This is indicated by certain matters including arrest, detention, capital punishment, interception, and revocation of citizenship. Meanwhile, the islamicity of Law No. 5 of 2018 is open to interpretation and reinterpretation. The study of measuring human rights and islamicity of Law No. 5 of 2018 has a significant contribution to the substantive implementation of  Islamic criminal law in the context of Indonesianness, as well as modernity, which also means the implementation of Islamic law and human rights at once.

Abstract

This article specifically discusses the important issues on physical health requirements for presidential candidates in Islamic and Indonesian perspectives. This article presents two important conclusions as follows: first, in the Islamic perspective, the majority of scholars argue that a person whoi s physically less or unhealthy cannot be elected as president. The result of comparison analysis of Islamic perspective and Indonesian perspective shows some similarities. First, the importance of a presidential candidate meets the criteria of physical health. Second, the disease is a serious illness that isallegedly able to disrupt the implementation of his/her duties and obligations as president. DOI: 10.15408/ajis.v17i1.6230

Abstract

Masalah dan Solusi Patologi Sosial di Kota Tangerang Selatan Dalam perspektif Islam, patologi sosial dipandang sebagai sesuatu yang sangat urgen untuk dibersihkan dari  tengah kehidupan umat Islam. Adanya beberapa aturan dalam kitab suci al-Qur’an dan hadits Nabi Muhammad saw yang secara eksplisit mengharamkan umat Islam untuk mendekati zina,  mengonsumsi minuman yang memabukan, dan berjudi, sangat  jelas membuktikan adanya kepedulian Islam yang begitu tinggi terhadap upaya pencegahan dan penanggulangan  berbagai penyakit sosial dari tengah kehidupan publik.  Kata Kunci: Patologi sosial, Kota Tangerang Selatan, vaksin sosial. Abstract: Problem and Solution of Social Pathology in South Tangerang City In Islamic perspective, social pathology is seen as something very urgent to be cleaned from the lives of Muslims. The existence of multiple rules in the the Koran and and Hadith that  explicitly forbids Muslims to approach adultery, consuming alcoholic beverages, and gamble, clearly proving  of the  high of Islamic awareness on the need of prevention and control of various of social pathologies from the  public life. Keywords: Patologi sosial, Kota Tangerang Selatan, vaksin sosial.

Abstract

Abstract: In the second trial BPUPKI, both nationalist and Islamic groups consensual that the future of Indonesia's independence will be based on the principle "godhood by running Shari'ah obligation for adherents". The consensus seems to be built on the foundation is not solid. Therefore it is not surprising that one day after the proclamation of independence, the agreement re-questioned. That same day, PPKI held a hearing to review the deal. As a result, the clause contained in the Preamble of the 1945 Constitution was changed to "Based on Belief in God Almighty". After the issuance of a Presidential Decree, began the debate about the existence of the spirit of the Jakarta Charter in 1945 which is applicable in the context of Indonesian politics in this contemporary age.  Abstrak: Spirit Piagam Jakarta dalam Undang-Undang Dasar 1945 Pasca Lahirnya Dekrit Presiden 5 Juli 1959. Pada sidang kedua Badan Penyelidik Usaha-Usaha Persiapan Kemerdekaan Indonesia (BPUPKI / Dokuritsu Zyunbi Tyosakai) yang berlangsung sejak tanggal 10 hingga 16 Juli 1945, baik golongan nasionalis maupun golongan Islam berkonsensus bahwa masa depan Indonesia merdeka akan didasarkan pada sila "Ketuhanan dengan kewajiban menjalankan syari'at Islam bagi pemeluk-pemeluknya".  Penting dicatat, konsensus tersebut agaknya dibangun di atas landasan yang tidak kokoh. Karena itu, tidak aneh bila satu hari setelah proklamasi Kemerdekaan RI, tepatnya tanggal 18 Agustus 1945, kesepakatan tersebut kembali dipersoalkan. Pada hari itu juga, Panitia Persiapan Kemerdekaan Indonesia (PPKI) yang dibentuk tanggal 7 Agustus 1945 dan diketuai oleh Soekarno, menyelenggarakan sidang untuk meninjau kembali kesepakatan tersebut. Dalam sidang tersebut, anak kalimat  yang terdapat dalam Pembukaan UUD 1945 (Piagam Jakarta), yakni: "Berdasarkan kepada Ketuhanan, dengan kewajiban menjalankan syari'at Islam bagi pemeluk-pemeluknya" diubah menjadi "Berdasar atas Ketuhanan Yang Maha Esa".  Setelah penerbitan Dekrit Presiden 5 Juli 1959, dimulailah perdebatan yang masih terus berlanjut hingga detik ini, mengenai ada atau tidak adanya semangat Piagam Jakarta dalam UUD 1945 yang berlaku dalam konteks politik Indonesia di masa kontemporer ini.  DOI: 10.15408/jch.v4i1.3568

Abstract

The majority of commentators (jumhûr al-mufassirîn) argued that the reference of riba is a gift (al-‘athiyyah) of one person to another, not with the aim of reaching Allah's pleasure. However, riba was just to get a mere worldly rewards. The Qur'an did not explicitly mention the prohibition of riba. Therefore, the scholars differ on what is really meant by riba in Qur'an verses. Abstract

Religious moderation is an important concept in maintaining harmony and social stability in Indonesia, a country with a very wide diversity of religions and cultures. This study aimed to examined the concept of religious moderation in Indonesia. Using a literature review approach, this paper analyzed various sources of religious moderation literature. The results of the study concluded that religious moderation in Indonesia is driven by several main factors, including the values of Pancasila, the role of religious figures and organizations, and government policies through the Ministry of Religious Affairs. Religious moderation is considered a solution to prevent radicalization, promote tolerance between religious communities, and maintain social cohesion. Religious moderation in Indonesia must continue to be supported by various parties, including the government, community organizations, and religious leaders, through inclusive policies, moderate religious education, and constructive interfaith dialogue.
