Abstract

This research discusses customary criminal law in Article 2 of Indonesia's new Criminal Code (KUHP), which reflects the country's social and cultural diversity. Customary criminal law, with its unique characteristics rooted in the values and social norms of indigenous communities, offers a different approach to conflict resolution compared to formal criminal law. It enriches the criminal justice system with aspects of restorative justice and creates space for the recognition of living law within society. However, this integration poses challenges, particularly regarding legal certainty and the principle of legality, considering that customary criminal law is often unwritten and variable. The method used is normative, involving legal research conducted through the study of literature or secondary data. The research is descriptive-analytical, focusing on the existence of customary law within national criminal law. Using a qualitative juridical approach, the analysis is based on legal principles and norms, studying legislation, literature, and scholarly writings. This study shows that the recognition of customary criminal law in Article 2 of the new Criminal Code presents challenges and opportunities for Indonesia's criminal justice system. This integration supports restorative justice and reflects the country's cultural diversity, but it also requires careful handling of legal certainty and the principle of legality. The need for clear conflict resolution mechanisms and additional regulations is crucial to maintaining a balance between customary legal traditions and the requirements of modern criminal law.

Abstract

This study examines the pluralism of criminal sanctions between blue-collar crime and white-collar crime from a justice perspective, focusing on the disparities in law enforcement in Indonesia. Blue-collar crimes, typically committed by individuals from lower socioeconomic classes, such as theft or violence, often receive harsh penalties like imprisonment. In contrast, white-collar crimes, perpetrated by individuals of higher socioeconomic status, such as corruption or embezzlement, tend to receive lighter sanctions, such as fines or probation. This disparity raises questions about substantive justice and the principle of equality before the law. Employing a normative juridical approach, this study analyzes relevant legislation, including the 1945 Constitution, the Criminal Code, and Law No. 39 of 1999 on Human Rights, alongside case studies such as the Nenek Asyani case, the Bank Century scandal, and the HM tin corruption case. The findings reveal that law enforcement for blue-collar crimes is often swift and retributive, while white-collar crimes are frequently hindered by power dynamics, political connections, and legal impunity, undermining deterrence and social justice. Grounded in Pancasila’s justice theory and punishment theories (absolute, relative, and combined), this study highlights the need for balanced sentencing reforms, prioritizing restorative justice for blue-collar crimes and proportional sanctions for white-collar crimes. It recommends strengthening the independence of law enforcement, implementing mediation for minor cases, and adjusting criminal policies to ensure fair punishment proportional to the crime’s impact. Thus, this study contributes to the discourse on inclusive and responsive criminal justice in addressing social dynamics.

Abstract

The number of cases of sexual violence that is currently occurring is getting higher and more extreme. It occurs due to the inability to handle the case. The researcher used a normative juridical research method with a qualitative juridical approach; namely, the obtained data was analyzed using a legal theory approach, legal principles, and a statutory approach. She conducted library research and field research. She conducted interviews with experienced victim advocates with a victim's perspective at the Legal Aid Institution of the Indonesian Women's Association for Justice Jakarta. She analyzed the problem of legal aid for victims of criminal acts of sexual violence using approaches to legal theory, legal principles, and statutory regulations. The legal materials used to analyze the issue were primary legal materials, secondary legal materials, and tertiary legal materials through scientific journals, statutory regulations, and other relevant legal literature. The research results indicated that there are many serious obstacles and challenges faced by victims of sexual violence, such as law enforcement, lack of understanding by law enforcement officials regarding victims' rights, criminalisation of victims, and difficulties for victims in accessing support services. Therefore, assisting victims of sexual violence is very important to increase the understanding and awareness of law enforcement officials regarding victims' rights as well as providing adequate safe space for victims in dealing with their cases.

Abstract

Malpraktik kedokteran yang dilakukan tanpa memperoleh informed consent dari pasien merupakan bentuk pelanggaran terhadap hak-hak pasien dan menjadi permasalahan serius dalam praktik medis di Indonesia. Penelitian ini bertujuan untuk mengkaji kualifikasi tindakan dokter yang dapat dikategorikan sebagai malpraktik, serta menganalisis bentuk pertanggungjawaban pidana dalam kasus tindakan medis yang dilakukan tanpa persetujuan pasien. Metode yang digunakan dalam penelitian ini adalah yuridis normatif, dengan pendekatan peraturan perundang-undangan, studi doktrin, dan analisis kasus konkret. Hasil penelitian menunjukkan bahwa tindakan medis yang dilakukan tanpa persetujuan pasien, kecuali dalam keadaan gawat darurat, merupakan pelanggaran terhadap prinsip otonomi pasien dan dapat menimbulkan pertanggungjawaban pidana berdasarkan Pasal 359 dan 360 KUHP. Selain itu, ketentuan dalam UU No. 17 Tahun 2023 tentang Kesehatan secara tegas mengatur pentingnya persetujuan dalam tindakan medis sebagai bentuk perlindungan hukum bagi pasien. Oleh karena itu, setiap dokter wajib menjalankan prosedur informed consent sebagai bagian dari standar profesi dan kode etik kedokteran, agar tidak berujung pada konsekuensi hukum pidana akibat kelalaian atau kesengajaan.

Abstract

Criminal sanctions against perpetrators of corruption crimes require extraordinary breakthrough according to the penal objectives, which is not only to provide a deterrent effect for the perpetrators, but also to provide benefits to the community by optimizing the competencies held by the perpetrators, since perpetrators of corruption are competent either in the aspects of social, economics and politics. The current criminal sanctions do not lead to the utilization of the potential possessed by the perpetrators of criminal acts. The focus still leads to deter the perpetrators only by providing severe criminal sanctions, namely by accumulating criminal sanctions in prison and fines, as well as other additional sanctions that focus on perpetrators, not on to interests of the state and society. The result of the research is to conceive the concept of social work sanctions that utilize the competence/expertise of the perpetrators to be able to provide great benefits to the community directly which implementation is based on the values ​​contained in Sundanese customary law, so that the objectives of the punishment are not only to correct the conduct of the perpetrators, but also to restore state financial losses, and to provide great benefits for the community. Abstract

Legal education is one of the efforts made to provide legal awareness for the community, this needs to be done because it sees the phenomenon of increasingly rampant legal problems carried out by the community. If you look at the data on violations of the law released by the National Police, namely 276,507 crimes that occurred in Indonesia throughout 2022, and increased by 7.3% compared to the previous year, so it is estimated that crimes occur every 2 minutes when calculated every hour. Looking at the data, it can be seen that legal education that continues to be built and provided as if there is no benefit, no impact, so that it is as if legal education does not have any impact on changing people's behavior. How to strengthen legal education as an effort to provide legal awareness for the community, and how to model the right educational collaboration so that legal compliance by the community can be achieved. This study is the result of legal research using the legal approach and the norm approach as the basis of philosophy. Legal awareness is the awareness that exists in every human being about that law, a certain category of our lives by distinguishing between legal and non-law. Awareness of what law is means awareness that law is the protection of human interests, because law is a rule that has a function to protect human interests.

Abstract

In Indonesia’s current criminal justice practice, the resolution of criminal acts can be pursued through two main approaches: retributive justice, as regulated by the Indonesian Criminal Procedure Code (KUHAP), and restorative justice, which has gradually been adopted through various regulations at the stages of investigation, prosecution, and adjudication. Restorative justice emphasizes restoration rather than retribution by involving the offender, the victim, their respective families, and community figures in a collaborative process to reach a fair resolution. This study aims to examine the fundamental principles of restorative justice within the Indonesian criminal justice system and to propose a conceptual framework that promotes an integrative approach to resolving criminal cases by balancing the interests of all parties. Using a normative juridical method and a qualitative approach, the study finds that restorative justice is based on the principles of restitution, reconciliation, and social reintegration. To support its effective implementation, the concept should include the strengthening of legal norms concerning victims’ rights, the authority of law enforcement institutions, and the development of a justice system that embraces restorative values. Ultimately, the application of restorative justice is expected to shape a criminal justice system that is not only repressive but also ensures a balanced consideration of the interests of victims, offenders, and society as a whole.

Abstract

Children are important national asset who require special protection from all forms of violence, including sexual crimes. Although Indonesia has established legal framework at both national and international levels, sexual violence against children remains a persistent problem. The imposition of severe criminal sanctions, including chemical castration, has not sufficiently addressed the problem and produced an optimal deterrent effect. Consequently, child protection continues to face various challenges, particularly in relation to post-sentencing supervision of offenders, low public awareness, and limited access to victim assistance services. The research questions of this study are: how effective is the legal protection for child victims of sexual violence, and what constitutes an effective supervisory model for offenders after serving their sentences in order to prevent recidivism? This study employs legal research with a socio-legal approach, combining normative juridical analysis with perspectives from information technology and social sciences. The findings indicate the need to strengthen post-sentencing supervision through the development of a Three-Pillar Supervision Model that integrates legal, technological, and societal dimensions. This model includes the optimization of technologies such as GPS tracking and public databases, the strengthening of regulatory frameworks, and the societal involvement in early detection mechanisms. The implementation of this model is expected to reduce the risk of recidivism and strengthen sustainable protection for children. Accordingly, reform of the child protection system must be carried out in a collaborative, preventive, and sustainable manner to ensure justice and security for future generations.
