Abstract

Malpraktik kedokteran yang dilakukan tanpa memperoleh informed consent dari pasien merupakan bentuk pelanggaran terhadap hak-hak pasien dan menjadi permasalahan serius dalam praktik medis di Indonesia. Penelitian ini bertujuan untuk mengkaji kualifikasi tindakan dokter yang dapat dikategorikan sebagai malpraktik, serta menganalisis bentuk pertanggungjawaban pidana dalam kasus tindakan medis yang dilakukan tanpa persetujuan pasien. Metode yang digunakan dalam penelitian ini adalah yuridis normatif, dengan pendekatan peraturan perundang-undangan, studi doktrin, dan analisis kasus konkret. Hasil penelitian menunjukkan bahwa tindakan medis yang dilakukan tanpa persetujuan pasien, kecuali dalam keadaan gawat darurat, merupakan pelanggaran terhadap prinsip otonomi pasien dan dapat menimbulkan pertanggungjawaban pidana berdasarkan Pasal 359 dan 360 KUHP. Selain itu, ketentuan dalam UU No. 17 Tahun 2023 tentang Kesehatan secara tegas mengatur pentingnya persetujuan dalam tindakan medis sebagai bentuk perlindungan hukum bagi pasien. Oleh karena itu, setiap dokter wajib menjalankan prosedur informed consent sebagai bagian dari standar profesi dan kode etik kedokteran, agar tidak berujung pada konsekuensi hukum pidana akibat kelalaian atau kesengajaan.

Abstract

Criminal sanctions against perpetrators of corruption crimes require extraordinary breakthrough according to the penal objectives, which is not only to provide a deterrent effect for the perpetrators, but also to provide benefits to the community by optimizing the competencies held by the perpetrators, since perpetrators of corruption are competent either in the aspects of social, economics and politics. The current criminal sanctions do not lead to the utilization of the potential possessed by the perpetrators of criminal acts. The focus still leads to deter the perpetrators only by providing severe criminal sanctions, namely by accumulating criminal sanctions in prison and fines, as well as other additional sanctions that focus on perpetrators, not on to interests of the state and society. The result of the research is to conceive the concept of social work sanctions that utilize the competence/expertise of the perpetrators to be able to provide great benefits to the community directly which implementation is based on the values ​​contained in Sundanese customary law, so that the objectives of the punishment are not only to correct the conduct of the perpetrators, but also to restore state financial losses, and to provide great benefits for the community. Abstract

Legal education is one of the efforts made to provide legal awareness for the community, this needs to be done because it sees the phenomenon of increasingly rampant legal problems carried out by the community. If you look at the data on violations of the law released by the National Police, namely 276,507 crimes that occurred in Indonesia throughout 2022, and increased by 7.3% compared to the previous year, so it is estimated that crimes occur every 2 minutes when calculated every hour. Looking at the data, it can be seen that legal education that continues to be built and provided as if there is no benefit, no impact, so that it is as if legal education does not have any impact on changing people's behavior. How to strengthen legal education as an effort to provide legal awareness for the community, and how to model the right educational collaboration so that legal compliance by the community can be achieved. This study is the result of legal research using the legal approach and the norm approach as the basis of philosophy. Legal awareness is the awareness that exists in every human being about that law, a certain category of our lives by distinguishing between legal and non-law. Awareness of what law is means awareness that law is the protection of human interests, because law is a rule that has a function to protect human interests.

Abstract

In Indonesia’s current criminal justice practice, the resolution of criminal acts can be pursued through two main approaches: retributive justice, as regulated by the Indonesian Criminal Procedure Code (KUHAP), and restorative justice, which has gradually been adopted through various regulations at the stages of investigation, prosecution, and adjudication. Restorative justice emphasizes restoration rather than retribution by involving the offender, the victim, their respective families, and community figures in a collaborative process to reach a fair resolution. This study aims to examine the fundamental principles of restorative justice within the Indonesian criminal justice system and to propose a conceptual framework that promotes an integrative approach to resolving criminal cases by balancing the interests of all parties. Using a normative juridical method and a qualitative approach, the study finds that restorative justice is based on the principles of restitution, reconciliation, and social reintegration. To support its effective implementation, the concept should include the strengthening of legal norms concerning victims’ rights, the authority of law enforcement institutions, and the development of a justice system that embraces restorative values. Ultimately, the application of restorative justice is expected to shape a criminal justice system that is not only repressive but also ensures a balanced consideration of the interests of victims, offenders, and society as a whole.
