Abstract

The Act Number 1 Year 1974 on Marriage stipulates the minimum ages requirement to enter into a marriage, which are 19 years for men and 16 years for women. It is expected that at that ages, each party has a mature soul and physic to enter into a marriage life. However, it is possible for those who have not reached the age to enter into marriage if there is a dispensation granted by the courts or other official designated by the parents of each party in the marriage. In 2012, a judicial review was filed to the Constitutional Court against the provisions of the minimum age limit in the Act Number 1 Year 1974 on Marriage to raise the limit of minimum age for women from 16 to 18 years. However, the Constitutional Court considered the provisions is constitutional. Then in 2017, the same provision of Marriage Law is submitted for the second time by different applicant to be reviewed again by the Constitutional Court. On the other hand, Indonesia has participated in the formulation of a variety of international human rights instruments which have an impact on children, and is a party to a number of them, including the CRC and the CEDAW. This paper elaborates the stipulation on minimum age requirement to enter into marriage and the conformity of Indonesian Marriage Act to the principles and provisions on the international human rights instruments. Abstract

Instrumen Hukum Internasional dan peraturan perundang-undangan telah mengatur mengenai pemenuhan hak atas pendidikan anak buruh migran Indonesia di Malaysia. Namun, adanya kebijakan yang absen dari Indonesia dan Malaysia menyebabkan permasalahan mengenai pemenuhan hak atas pendidikan masih menjadi polemik untuk segera diselesaikan. Tipe penelitian yang digunakan dalam penelitian ini adalah doctrinal research dengan pendekatan konseptual dan perundang-undangan dari sudut pandang hak asasi manusia. Penelitian ini menunjukkan bahwa permasalahan anak buruh migran Indonesia di Malaysia adalah masalah yang kompleks. Sehingga pemenuhan hak atas pendidikan anak buruh migran Indonesia di Malaysia adalah tanggung jawab bersama kedua belah negara yaitu Indonesia dan Malaysia yang harus segera diselesaikan.

Abstract

The Convention on the Rights of the Child (CRC) is the most comprehensive human rights treaty and legal instrument for the promotion and protection of children’s rights. Unfortunately, while the other international human rights instruments ratified by Indonesia through an Act; CRC is the only international human rights instrument which ratified by Indonesia through a Presidential Decree. The CRC ratified by Indonesia through Presidential Decree Number 36 Year 1990. The use of a Presidential Decree as the instrument to ratify the CRC has delivered some critiques. This research examines the powers of the president on the formulation of the presidential decree on the ratification of the international legal instrument. In the second case, it analyses the position of the Presidential Decree Number 36 Year 1990 in the systems of laws and regulations in Indonesia. The findings of this study indicate that Indonesia has to consider the possibility of strengthening the instrument of ratification of the CRC from a Presidential Decree to an Act since in terms of its legal position, a Presidential Decree is not an appropriate instrument as the instrument of ratification of a treaty which subject matter involves human rights.

Abstract

As many other countries in the world, Indonesia has serious problems with child pornography. The problems linked with the child pornography exist in Indonesia, involving both male and female children. In 2008, Law Number 44/2008 on Pornography was enacted. With regard to the widespread distribution and accessibility of child pornography through the Internet, Indonesia also has Law Number 11/2008 and its revision on Electronic Information and Transaction. At the international level, Indonesia has ratified the Convention on the Rights of the Child (CRC). Furthermore, in 2012, Indonesia ratified the Optional Protocol to the Convention on the Rights of the Child on the Sale of Children, Child Prostitution and Child Pornography (OPSC). However, based on data from the Indonesian Child Protection Commission (Komisi Perlindungan Anak Indonesia/KPAI) from 2011 to 2016 there were 1709 cases of child pornography and cybercrime. The cases of child pornography are still increasing and seems impossible to stop. This paper will scrutinize how the existing Indonesian law concerning prohibition of child pornography protects the children. It will also examine whether the law are in compliance with the OPSC. This paper is a doctrinal research using statute, conceptual and comparative approaches. The existing Indonesian law will be compared with the OPSC. The study will show some of the compatibility issues of Indonesian respective national law with the OPSC. On the basis of the findings, the last part of the study will provide recommendations on how Indonesia shall enhance the fight against child pornography.

Abstract

UU No. 62/1958 dan UU No. 12/ 2006 pada prinsipnya tidak mengenal adanya kewarganegaraan ganda. UU No. 12/ 2006 memperbolehkan kewarganegaraan ganda terbatas pada anak-anak dalam kaitannya perlindungan terhadap hak anak. Namun, seiring dengan perkembangan dalam dunia modern, tuntutan diaspora Indonesia terhadap Pemerintah RI untuk juga memberikan status kewarganegaraan ganda bagi orang dewasa terus bergulir. Penelitian ini mengangkat dua isu hukum. Isu hukum pertama mengenai ratio legis tidak diperbolehkannya kewarganegaraan ganda dalam UU No. 62/1958 dan UU No. 12/2006. Isu hukum kedua adalah dampaknya terutama dalam bidang hukum apabila kewarganegaraan ganda diberlakukan di Indonesia. Penelitian ini merupakan penelitian hukum yang menggunakan pendekatan perundang-undangan, pendekatan konsep serta pendekatan sejarah. Tujuan penelitian ini adalah untuk melakukan analisis terhadap isu hukum yang telah diajukan. Berdasarkan penelitian ini, kedua undang-undang tersebut tidak terlepas dari filosofi kewarganegaraan yang didasarkan pada doktrin “kesetiaan abadi” (perpetual allegiance). Kedua undang-undang tersebut mengatur bahwa bentuk kesetiaan WNI kepada negara nya adalah dengan tidak mempunyai kewarganegaraan ganda. Sedangkan dampaknya dalam bidang hukum apabila kewarganegaraan ganda diberlakukan di Indonesia diantaranya adalah perubahan ketentuan- ketentuan dalam peraturan perundang-undangan terutama yang berkaitan dengan kepemilikan properti, hak politik, kewarganegaraan dan Imigrasi. Penelitian ini memberikan saran bahwa tuntutan kewarganegaraan ganda dari komunitas diaspora Indonesia perlu direspon oleh Pemerintah Indonesia dengan dicermat dengan melakukan pengkajian dan penyusunan pertimbangan yang melibatkan berbagai instansi terkait.
