Abstract

This article aims to analyze the practice of hybridcontract in rice field pawn contracts based on an emic perspective. The research method used is qualitative and the data source is taken from interviews with the parties involved in pawning. The type of data in this research is qualitative data. Data collection techniques were carried out through observation and interviews with the parties involved in pawning rice fields. The data analysis technique is carried out by explaining the implementation of pawning rice fields and then analyzing it using an emic approach. Based on research conducted, it shows that hybridcontracts in rice field pawning take place when the pawned rice field is then managed by the rice field owner, then the harvest obtained is divided between the rahin and murtahin based on the agreement at the beginning of the contract. This practice contains two contracts, namely a pawn contract and a rent or maro contract. This aims to protect the rights of the pawnbroker as the holder of the margin. The implementation of gadai maro provides benefits for rahin and murtahin, which is fairer for both parties according to the pawn actor.

However, major challenges are still faced related to standardization, infrastructure quality, human resource quality, global competition, and cybersecurity risks. Overcoming these challenges requires a collaborative strategy between the government and the private sector, utilization of technology for efficiency and safety, improving the quality of human resources, and more intensive promotion in both domestic and international markets. With the implementation of this strategy, Indonesia's halal tourism sector can develop optimally, strengthen the country's economy, and meet global market demand.

Abstract

Several Muslim-majority countries endowed with abundant natural resources (NR) continue to face persistent development stagnation and severe social inequality, raising critical questions about the paradox of resource wealth. This study aims to qualitatively examine how institutional dysfunction influences wealth distribution and development trajectories in these contexts. Employing a qualitative approach with a case study design, the research focuses on resource-rich Muslim-majority countries, using Indonesia as a primary case due to its substantial natural resources and Muslim population exceeding 80%. Data were collected through policy document analysis and triangulated with media reports to ensure validity. Findings reveal that weak institutional capacity, entrenched corruption, and the dominance of political-economic elites are key drivers of persistent inequality and developmental inertia. These structural deficiencies prevent resource wealth from translating into broad-based prosperity, instead reinforcing elite capture and social disparity. The study contributes to the literature on resource governance by demonstrating that natural resource abundance, without robust institutional frameworks, intensifies the resource curse in Muslim-majority contexts. Practical implications underscore the urgency of institutional reform and the design of governance models tailored to socio-cultural and political realities, aiming to achieve inclusive and sustainable development. This research advances understanding of the intersection between institutional quality, resource wealth, and inequality, offering policy insights for governments and international development agencies operating in similar contexts.

Abstract

This article aims to analyze the urgency of the wakalah bil ujroh contract in business transactions in the digital era. The research method in this article uses a qualitative method with literature study as the approach. The data source is in the form of library publications. The type of data is in the form of written narratives or documents contained in publication sources. Data collection techniques are carried out by tracking the sources of these publications. The data analysis technique is descriptive. Based on the research conducted, it was found that the wakalah bil ujroh contract can be one of the contracts used in business transactions in the digital era. This is because the use of the contract can prevent business transactions from elements that contain usury and garar. Wakalah bil ujroh contract is a representative contract made by a person to another person to carry out an action or transaction accompanied by a reward for the action or transaction. Based on this understanding, rewards that are included with payments for a transaction or reward for a need are allowed in Islamic economics and are not included as riba but as wages or ujroh.
