Abstract

Advocate or attorney is a legal profession which has become the profession of legal experts. Apart from that, the existence of an advocate as a law enforcer has actually been regulated in Article 5 of Law 18 of 2003 concerning Advocates (Advocate Law). However, the existence of article 5 paragraph (1) has not provided an explanation regarding the concrete form of advocates as law enforcers, this makes the existence of advocates as law enforcers still lacking clarity, especially in their role as one of the components in the criminal justice system in Indonesia. Based on this research, there are four urgencies for an advocate's position in the criminal justice system, namely: (a) advocate as a legal service provider and legal aid provider, (b) advocate as a supervisor and guardian of judicial integrity, (c) an advocate as a counterweight to the dominance of the enforcer. law, (d) advocate as a defender of human dignity. With the existence of four urgencies, the position of an advocate as law enforcer. It is hoped that this writing will be able to emphasize and strengthen the role of advocates as one of the components in the criminal justice system in Indonesia and all components of the law, further changes need to be made to Advocate regulations, especially regarding the problem of the judicial mafia and a concrete explanation of the role of advocates as law enforcers in Indonesia.

Abstract

Penal code in the formulation of criminal law is currently only fixated on the provisions of criminal acts and crimes without including the goals and principles of punishment. Therefore, criminal law is currently considered rigid and inhumane in its application in small cases that are deemed to require social justice. Formulations which do not have objectives and principles in criminal guidelines will not produce effective law, now there is an idea that is Rechterlijk Pardon as one of the concepts in criminal reform that has been used by various countries implementing civil law systems. The results of the analysis in this study found 6 (six) articles relating to the value of forgiveness in the current formulation of the Kuhp but not the pure forgiveness value and the discovery of 5 (five) criminal justice applications that already have forgiveness values but still cannot be applied properly because they are not properly applied the existence of forgiveness formulations in the current criminal. The formulation of the judge's forgiveness idea "Rechterlijk Pardon" will make the criminal law system in Indonesia to come to be more integral, flexible, humanist, progress and nationalist. The criminal justice system desperately needs significant reforms such as the inclusion of criminal law goals and principles so that an effective criminal justice system in Indonesia is realized.

Abstract

AbstractThe local government is an extension of the central government to run the government in order to achieve the purpose of the state. In order to realize effective regional governance and harmonious required local regulations in line with the substance of the material, human rights, public interest and does not conflict with other regulations thereon. Until the end of 2016 recorded over 3000 local regulations that was rejected by the Minister of the Interior, where the process of making regulations clearly very nominal spending of state finances. There are forms of relationship communication, consultation, clarification drafts are applied between Government agencies with the authorities in the area for less than effective, in addition to the optimization of the minimal role of the Governor and Members of the Board in developing and overseeing the regional administration is one of the factors that make local regulation do not have a clear substance and in accordance with usefulness. Disharmony between central government and local governments are also an important factor which the step coaching is done by the agency Centre for local government apparatus in the preparation of the Regulation is still said to be not optimal and equitable then not their frame of reference is clear to the area of the administration of the harmonization of the draft law as an instrument important in order to maintain the harmonization of laws with other regulations. Law No.12 of 2011 has had signs which point to the importance of harmonization of rules including local regulations. Article 5 defines a rule that is considered good if it has met the principle of legislation such as clarity of purpose, the fit between the type and material content, usefulness and clarity of the formulation. The draft local regulation harmonization with other rules above areas should be supported by clear and firm rules and to always be integrated as a formal requirement of drafting local regulations as stipulated in Presidential Regulation No. 61 of 2005 which regulates the process of harmonization, rounding, and stabilization of the conception of the regulation draft in Indonesia. Keywords: Consistency Local Regulation, Hierarchy Regulatory and Political of Law. AbstrakPemerintah daerah merupakan perpanjangan tangan dari pemerintah pusat untuk menjalankan roda pemerintahan guna mencapai tujuan bernegara. Dalam mewujudkan pemerintahan daerah yang efektif dan harmonis diperlukan peraturan daerah yang sejalan dengan substansi materi, hak asasi manusia, kepentingan umum dan tidak bertentangan dengan peraturan lain diatasnya. Sampai akhir 2016 terdata lebih dari 3000 Perda yang ditolak oleh Menteri Dalam Negeri dimana proses pembuatan perda jelas sangat menghabiskan nominal keuangan negara. Terdapat bentuk hubungan komunikasi, konsultasi, klarifikasi Raperda yang diterapkan antara instansi Pemerintah dengan aparat di daerah yang selama ini masih kurang efektif, selain itu optimalisasi yang minim dari peran Gubernur dan Anggota Dewan dalam membina dan mengawasi penyelenggaraan pemerintahan kabupatan/kota adalah salah satu faktor yang menjadikan Perda tidak memiliki substansi yang jelas dan sesuai dengan kemanfaatannya. Disharmonisasi antara pemerintah pusat dan pemerintah daerah juga merupakan faktor penting di mana langkah pembinaan yang dilakukan oleh instansi pusat kepada aparatur pemerintah daerah dalam penyusunan Perda masih dikatakan belum optimal dan merata serta tidak adanya kerangka acuan yang jelas bagi daerah mengenai tata laksana harmonisasi Raperda sebagai salah satu instrumen penting dalam rangka menjaga harmonisasi Perda dengan Peraturan lainnya. UU No.12 Tahun 2011 telah memiliki rambu-rambu yang mengarahkan pada pentingnya harmonisasi PUU termasuk Perda. Pasal 5 UU tersebut menentukan PUU dinilai baik apabila telah memenuhi asas peraturan perundang-undangan seperti kejelasan tujuan, kesesuaian antara jenis dan materi muatan, kedayagunaan dan kejelasan rumusan. Harmonisasi Raperda dengan PUU perlu didukung oleh aturan yang jelas dan tegas serta senantiasa dintegrasikan sebagai syarat formal penyusunan Perda sebagaimana tertuang dalam Peraturan Presiden No. 61 Tahun 2005 yang mengatur proses mengenai pengharmonisasian, pembulatan, dan pemantapan konsepsi pada draft rancangan undang-undang di Indonesia. Kata kunci: Konsistensi Peraturan Daerah, Hierarkhi Perundang-undangan, dan Politik Hukum

Abstract

Indonesia is a plural or pluralistic society, which includes a variety of awareness both personal and group. In the development of the legal system in Indonesia, which became an important part of cultural and community awareness is very influential in the development. Indonesia is a culture and awareness of the law is no single or uniform, although in principle there are various similarities in the pluralistic society. Existing equation should be used to formulate a legal union, although many different cultures in Indonesia. Pancasila is the philosophical basis for the formation of the unitary state of Indonesia, therefore, for the realization of national unity in enacting a national law in Indonesia must be based on Pancasila and the 1945 Constitution as the supreme norm. The objective of this study will clarify that the law enacted at this time still does not reflect the values of Pancasila and impressed liberalism, as the law is currently drafted and enforced on the basis of normative thinking less backed up to a statement of the case and the plural society , namely empirical thinking. Methodology This study will explain the values of Pancasila and culture in the development of legislation that affects the development of the other, which can be reviewed comprehensively in this paper. Thus for the sake of the welfare of the nation and public awareness of the law, the results of this study will explain the need for the development of legal systems that systemic and continuously keeping with the character of the Indonesian nation, namely the development of legislation based on the Pancasila.

Abstract

Substansi Buku 1 Kuhp saat ini merupakan pedoman induk dalam sistem pemidanaan di Indonesia, namun pedoman dalam perumusan pidana saat ini hanya terpaku pada ketentuan adanya tindak pidana dan kesalahan tanpa memasukan tujuan dan asas dari pemidanaan.Oleh karena itu hukum pidana saat ini dirasa kaku dan tidak berkemanusiaan dalam aplikasinya pada kasus-kasus kecil yang dipandang memerlukan keadilan sosial. Rumusan sistem induk yang tidak memilki tujuan dan asas dalam pedoman pemidanaan tidak akan melahirkan hukum yang efektif, saat ini telah hadir sebuah ide yaitu Rechterlijk Pardon sebagai salah satu konsep dalam pembaharuan pidana yang telah digunakan oleh pelbagai negara yang menerapkan civil law sistem. Penelitian ini bertujuan untuk menganalisis ide Rechterlijk Pardon dalam tahap formulasi dan aplikasi yang ada pada saat ini dan dalam formulasi sistem induk pidana yang akan datang di Indonesia. Metode pendekatan yang digunakan penulis adalah penelitian hukum kualitatif normatif, yaitu dengan pendekatan perundang-undangan (statute appproach), pendekatan konseptual (conceptual approach), Pendekatan kasus (case approach) dan pendekatan perbandingan (comparative approach). Analisis kualitatif normatif terhadap data yang disajikan secara kuantitatif, berpijak pada analisis deskriptif dan prediktif. Hasil analisa pada penelitian ini ditemukannya 6 (enam) pasal yang berkaitan dengan nilai permaafan dalam formulasi kuhp saat ini namun bukanlah nilai permaafan yang murni dan ditemukannya 5 (lima) aplikasi peradilan pidana yang telah memiliki nilai permaafan namun masih belum dapat diterapkan dengan baik karena tidak adanya formulasi permaafan dalam pidana saat ini. Diformulasikannya ide permaafan hakim “Rechterlijk Pardon” dengan memasukannya tujuan dan asas pemidanaan dalam syarat pemidanaan yaitu pada Pasal 55, 56 dan 72 RUU KUHP 2015, nantinya akan menjadikan sistem hukum pidana di Indonesia yang akan datang dapat lebih integral, fleksible, humanis, progress dan nasionalis. Disarankan kepada anggota Parlemen untuk dapat membuat dan melegitimasi rancangan perumusan sistem hukum pidana yang telah ada sampai sekarang. Mereformasi sistem hukum pidana merupakan bagian penting dalam perkembangan sistem peradilan pidana di masa depan. sistem peradilan pidana sangat membutuhkan reformasi yang signifikan seperti masuknya tujuan dan asas hukum pidana sehingga terwujudnya sistem peradilan pidana yang efektif di Indonesia.

Abstract

Indonesia adalah masyarakat majemuk atau pluralistik yang meliputi ragam kesadaran baik pribadi maupun kelompok. Dalam perkembangan sistem hukum di Indonesia yang menjadi bagian penting adalah dari budaya dan kesadaran masyarakat sangat berpengaruh dalam pembangunan. Persamaan yang ada harus digunakan untuk merumuskan suatu kesatuan hukum, meskipun banyak budaya yang berbeda di Indonesia tetapi setiap kebijakan harus berdasarkan kostitusi dan ideologi negara Indonesia. Tujuan penelitian ini akan memperjelas bahwa kebijakan yang berlaku saat ini masih belum mencerminkan nilai-nilai Pancasila dan terkesan liberalisme. Metodologi Kajian ini akan menjelaskan nilai-nilai Pancasila dan budaya dalam perkembangan peraturan perundang-undangan yang mempengaruhi perkembangan lainnya, yang dapat diulas secara komprehensif dalam tulisan ini. Hasil penelitian ini akan menjelaskan perlunya pengembangan sistem hukum yang sistemik dan berkesinambungan dengan karakter bangsa Indonesia yaitu pembangunan perundang-undangan berdasarkan Pancasila. Kesimpulan penulisan ini bahwa Pancasila merupakan landasan filosofis bagi pembentukan negara kesatuan Indonesia, oleh karena itu untuk perwujudan persatuan bangsa dalam menegakkan hukum nasional di Indonesia harus berdasarkan Pancasila dan Undang-Undang Dasar 1945 sebagai norma tertinggi.

Abstract

Electronic trials represent a radical innovation within the judicial system, viewed as a means to simplify and facilitate access to justice for those seeking it. However, electronic criminal trials continue to present both legal and technical challenges. This writing aims to explore the development of electronic criminal trials in Indonesia and compare them with several other countries. It also outlines the issues and challenges involved, while proposing future measures to ensure electronic trials function as intended. The approach used in this paper is based on statutory and comparative methods. The findings indicate that radical innovations, particularly in electronic trials, highlight the need for sustainability, but also reveal legal and technical challenges. The legal aspect concerns the level of regulation within the Supreme Court Regulations, which ideally should be elevated to the level of the Criminal Procedure Code. There is also ambiguity regarding the criteria for implementing electronic criminal trials. Compared to the United States, where clear criteria are established, Indonesia lacks such clarity. On the technical aspect, challenges such as unequal access to the internet, network disparities, and limited human resources need to be addressed. For the future success of electronic criminal trials, it is necessary to establish clear regulations at the level of the Criminal Procedure Code; provide equal network access to ensure electronic trials can be conducted in all courts across Indonesia; improve the quality of electronic trial services, especially for vulnerable groups (such as the elderly and people with disabilities); and enhance data security systems to protect personal information, as demonstrated by Kyrgyzstan.

Abstract

In an era marked by the algorithmic mediation of human affairs, the pursuit of justice can no longer be disentangled from the architecture of digital systems that sustain it. The criminal justice system, long rooted in analog procedures and institutional inertia, faces an existential imperative: adapt or risk obsolescence. Within this context, digital transformation is not merely an administrative upgrade—it is a normative challenge to the principles of due process, transparency, and equality before the law. Indonesia’s hesitant transition toward e-criminal justice reveals a complex interplay of structural, legal, and epistemic limitations. This study aims to analyze the development of e-criminal justice in Indonesia by conducting a comparative assessment of successful digital judicial systems in the United States, the United Kingdom, and Singapore. Employing a normative legal research approach with a comparative legal method, this study examines primary and secondary legal sources to identify regulatory gaps, procedural challenges, and strategic solutions. The findings reveal that Indonesia’s legal framework remains insufficient in addressing key procedural safeguards, digital evidence authentication, and cybersecurity risks. Additionally, disparities in digital access, resistance from legal practitioners, and inadequate technological infrastructure hinder the effective implementation of e-criminal justice. Comparative analysis suggests that successful digital transformation requires a robust regulatory foundation, secure and interoperable digital platforms, structured judicial training programs, and policies ensuring digital inclusivity. To optimize its e-criminal justice framework, Indonesia must adopt a context-sensitive and adaptive strategy, balancing technological advancements with fundamental principles of procedural fairness and judicial integrity. Future research should explore the long-term impact of digitalization on judicial decision-making, the role of AI in legal processes, and the effectiveness of cybersecurity mechanisms in safeguarding judicial independence. This study contributes to the broader discourse on the intersection between technology and justice, providing recommendations for a sustainable and equitable digital transformation of Indonesia’s criminal justice system.

Abstract

Perpetrators of crimes today, are not only adults, and it cannot be denied that children also commit crimes. This shows that the perpetrator of a crime can be committed by anyone regardless of the age of the person who committed the crime. The main issues discussed in the writing of this law are why children commit the crime of molestation, how to resolve the child perpetrators of the crime of committing torture with deversion and what is the basis for the judge's consideration in imposing the criminal offense against the child perpetrator of the crime of torture to attend job training (verdict study number: 27 / Pid.susanak / 2020 / PN.Gns). The research method used in writing this law is a normative juridical approach, the research used is descriptive, the type of data used is secondary data, secondary data that are still relevant to the problem, namely primary legal materials, secondary legal materials and tertiary legal materials, and techniques. data collection is in the form of literature study. Based on the results of research and discussion, legal protection for children in the juvenile criminal justice system can be seen from the national legislation on children. The basis for the judge's consideration used by the judge in imposing a conviction is juridical and non-juridical considerations. The conclusion from the writing of this law is that the government, society, and parents should take part in the socialization on child issues and child judges should attend trainings in order to know the latest laws and regulations
