Abstract

This article discusses the deficiency of the Indonesian criminal law with regard to the criminalization of hate crimes. Taking into consideration the fact that Indonesia faces a high incidence of social conflict due to rising intolerance and discrimination targeting minority groups.  The combination of (racial-ethnic-religious) discrimination and hatred against minority groups in most cases results in various forms of common crimes which generally is known as hate crimes. Using a comparative law method, by and between Indonesian criminal law and the criminal law of other countries experiencing hate crimes, the author highlights options for eradicating hate crimes. One important finding is the tendency of a number of countries to perceive hatred or prejudice which motivate the perpetrator of hate crimes as aggravating factor and not to as as separate substantive offence.

Abstract

Makar dalam praktik penegakan hukum pidana di Indonesia sering kali ditafsirkan terlalu luas dan karenanya menjangkau perbuatan yang tidak selayaknya dikategorikan sebagai tindak pidana yang mengancam keselamatan negara. Tulisan ini hendak menelusuri kembali pemaknaan dua konsep penting dalam Kitab Undang-Undang Hukum Pidana Indonesia (Wetboek van Strafrecht Nederlands-Indie; WvSNI), yaitu aanslag maupun aanslag tot en feit. Metoda yang digunakan adalah metode penemuan hukum dan perbandingan hukum. Temuan terpenting adalah adanya kekeliruan penerjemahan istilah aanslag dan aanslag tot en feit secara otomatis sebagai makar dalam berbagai pasal KUHP. Koreksi terhadap itu seharusnya dilakukan agar penegakan hukum pidana tidak memunculkan ketidakadilan dalam wujud reaksi negara yang tidak proporsional dengan kadar kesalahan.  The Problematical Meaning of Aanslag-Aanslag tot en feit: Comparison of Treason in the Translated Version of the Indonesian Criminal Code and the Dutch Version AbstractTreason as a crime threatening the state’s security has been inappropriately applied to facts which does not in any way can be categorized as such. This article purports to retraceing two key concepts: aanslag (onslaught/attack) and aanslag tot en feit (commit) found in the Criminal Code. Method used in this article is legal finding and law comparison. The author’s main finding is that these concepts had been wrongly translated into treason with all the consequence thereof.Therefore, correction of the translation should avoid injustice in the form of state reaction not proportional to the wrong doing. DOI: https://doi.org/10.22304/pjih.v4n3.a3

Abstract

Adanya kewenangan melaksanakan penuntutan tersebut sejatinya menjadikan Kejaksaan sebagai lembaga yang parsial untuk mewakili kepentingan korban tindak pidana atau negara, sementara itu, Kejaksaan bertujuan untuk menjatuhkan nestapa pada pelaku tindak pidana. Penghukuman pelaku tindak pidana merupakan prestasi bagi Kejaksaan. Pada akhirnya, kewenangan dalam melakukan penuntutan tersebut menjadi tidak sejalan dengan prinsip-prinsip yang ditekankan dalam mediasi penal yang pada pokoknya menuntut imparsialitas dan profesionalitas dalam penyelenggaraannya. Penelitian ini bertujuan untuk mengkaji penerapan mediasi penal yang memenuhi asas imparsial selaku mediator sekalipun berfungsi pula sebagai penuntut dalam sistem penanganan perkara pidana. Metode Penelitian ini menggunakan metode penelitian yuridis normatif yang didukung dengan data sekunder dengan menggunakan pendekatan perundang-undangan, pendekatan konsep dan pendekatan kasus. Data yang digunakan adalah data primer dan data sekunder yang selanjutnya akan dianalisis secara kualitatif. Hasil penelitian ini adalah Penerapan mediasi penal oleh Kejaksaan Republik Indonesia dapat dilakukan apabila memenuhi syarat sebagaimana yang diatur dalam Perja 15 Tahun 2020. Dalam pelaksanaan mediasi penal, apabila dilihat dari teori pemidanaan maka tujuan pemidanaan yang bersifat pembalasan dan /atau pencegahan telah mengalami perkembangan, dimana tujuan dari pelaksanaan mediasi penal adalah memperbaiki diri pelaku dan memulihkan hak korban. Selanjutnya, Imparsialitas dari kewenangan Kejaksaan Republik Indonesia sebagai mediator pada perkara pidana telah merubah posisi jaksa sebagai penuntut umum dalam sistem peradilan pidana yang merepresentasikan kepentingan korban kejahatan. Hal ini terjadi dikarenakan kejaksaan juga bertanggung jawab untuk mengefektifkan proses penegakan hukum dengan memperhatikan asas peradilan cepat, sederhana, dan biaya ringan secara independen demi keadilan berdasarkan hukum dan hati Nurani.

Abstract

Constitutional Court verdict have big impact for laws development including criminal law. In criminal law, the verdict caused change in norm both arranged inside Criminal Law Code and outside Criminal Law Code. Futhermore, this issue is interesting to study when it is connected with expansion authority of Constitutional Court from negative legislator to positive legislator. Constitutional Court verdict form as ‘conditional’ verdict either constitutional or conditional inconstitutional are example of the transformed Constitutional Court authority from negative legislator to positive legislator. As known, criminal law is basing on legality principle. Thus, the verdict especially ‘conditional’ verdict raises polemic in its implementation because not all the verdict can be followed by changing criminal law formally. This situation can inflict various difference in criminal law enforcement. Constitutional Court verdict evoke changing criminal law norm by decriminalization, depenalisation, offense transformation or interpretation criminal law elements that impact on material criminal law or formal criminal law. Without any follow up by changing criminal legislation, espesially when it is related with legalty principle, law enforcement officer can rule out Constitutional Court verdict. The inconsistency of law enforcement can provoke law uncertainty and violate citizen rights

Abstract

Electronic trials represent a radical innovation within the judicial system, viewed as a means to simplify and facilitate access to justice for those seeking it. However, electronic criminal trials continue to present both legal and technical challenges. This writing aims to explore the development of electronic criminal trials in Indonesia and compare them with several other countries. It also outlines the issues and challenges involved, while proposing future measures to ensure electronic trials function as intended. The approach used in this paper is based on statutory and comparative methods. The findings indicate that radical innovations, particularly in electronic trials, highlight the need for sustainability, but also reveal legal and technical challenges. The legal aspect concerns the level of regulation within the Supreme Court Regulations, which ideally should be elevated to the level of the Criminal Procedure Code. There is also ambiguity regarding the criteria for implementing electronic criminal trials. Compared to the United States, where clear criteria are established, Indonesia lacks such clarity. On the technical aspect, challenges such as unequal access to the internet, network disparities, and limited human resources need to be addressed. For the future success of electronic criminal trials, it is necessary to establish clear regulations at the level of the Criminal Procedure Code; provide equal network access to ensure electronic trials can be conducted in all courts across Indonesia; improve the quality of electronic trial services, especially for vulnerable groups (such as the elderly and people with disabilities); and enhance data security systems to protect personal information, as demonstrated by Kyrgyzstan.

Abstract

Abstrak Pro-kontra akibat janji ganti rugi, penolakan kegiatan tambang oleh masyarakat di areal tambang, dan lainnya kerap terjadi di bidang pertambangan. Pasal 162 UU Minerba secara spesifik mengatur mengenai ancaman pidana bagi orang-orang yang “merintangi atau mengganggu” kegiatan usaha pertambangan yang memiliki izin dan telah melaksanakan kewajiban pembebasan lahan. Pada kenyataannya, tindakan merintangi atau mengganggu yang dilakukan oleh masyarakat tersebut memiliki latar belakang yang lebih kompleks. Penelitian ini bertujuan untuk menganalisa, Pasal 162 UU Minerba dan implementasinya melalui pendekatan yuridis-normatif dan yuridis-empiris dengan menggunakan teori kriminologi posmodern dan marxis. Hasil penelitian menunjukkan bahwa terdapat isu ekonomi dan penguasaan bahasa yang kental dalam pembentukan dan penerapan pasal ini yang menyebabkan tendensi penerapan pasal yang menyudutkan masyarakat, terutama masyarakat di sekitar area pertambangan.

Abstract

In an era marked by the algorithmic mediation of human affairs, the pursuit of justice can no longer be disentangled from the architecture of digital systems that sustain it. The criminal justice system, long rooted in analog procedures and institutional inertia, faces an existential imperative: adapt or risk obsolescence. Within this context, digital transformation is not merely an administrative upgrade—it is a normative challenge to the principles of due process, transparency, and equality before the law. Indonesia’s hesitant transition toward e-criminal justice reveals a complex interplay of structural, legal, and epistemic limitations. This study aims to analyze the development of e-criminal justice in Indonesia by conducting a comparative assessment of successful digital judicial systems in the United States, the United Kingdom, and Singapore. Employing a normative legal research approach with a comparative legal method, this study examines primary and secondary legal sources to identify regulatory gaps, procedural challenges, and strategic solutions. The findings reveal that Indonesia’s legal framework remains insufficient in addressing key procedural safeguards, digital evidence authentication, and cybersecurity risks. Additionally, disparities in digital access, resistance from legal practitioners, and inadequate technological infrastructure hinder the effective implementation of e-criminal justice. Comparative analysis suggests that successful digital transformation requires a robust regulatory foundation, secure and interoperable digital platforms, structured judicial training programs, and policies ensuring digital inclusivity. To optimize its e-criminal justice framework, Indonesia must adopt a context-sensitive and adaptive strategy, balancing technological advancements with fundamental principles of procedural fairness and judicial integrity. Future research should explore the long-term impact of digitalization on judicial decision-making, the role of AI in legal processes, and the effectiveness of cybersecurity mechanisms in safeguarding judicial independence. This study contributes to the broader discourse on the intersection between technology and justice, providing recommendations for a sustainable and equitable digital transformation of Indonesia’s criminal justice system.

Abstract

This paper discusses the impact of the regulation of gross violation of human rights in the Penal Code 2023 on the validity of the principles stipulated in Act Number 26, 2000 as the special law. The method used is normative research with data collection through literature study. The findings show that regarding the Article 187 and Article 620 of the Penal Code 2023, it can be said that these articles have actually provided a ‘guarantee’ to ensure that the existence of the Penal Code 2023 will not reduce or have any impact on the special principles in Act Number 26,2000. This is then strengthened by the provisions of Article 622 paragraph 1 letter m which only revokes several articles from the Act, namely Articles 8, 9, 36-40 on criminal offenses and sanctions for gross violation of human right. By using the theory of codification & the amendment of Article 3 of the Penal Code 2023, it was revealed that the regulation on gross violation of human right in the Penal Code 2023 is potentially to create new problems, from the issue of conflict of principles to of multiple interpretations. Different interpretations of Article 187, Article 620, and Article 3 of the Penal Code 2023 can actually lead to the inapplicability of special principles stipulated in Act Number 26, 2000, therefore, the provisions of gross violation of human right, in the future, are very likely to be subject to the general principles contained in Book I of the Penal Code 2023.
