Abstract

ABSTRAKPada dasarnya, putusan berkekuatan hukum tetap adalah obyek dari eksekusi, akan tetapi terhadap hal ini akan menghadapi persoalan hukum jika pihak yang dihukum lewat putusan itu adalah sebuah yayasan yang sebenarnya tidak berbadan hukum, yang sehingga oleh karenanya menurut ketentuan undang-undang tidak diperbolehkan menggunakan kata “yayasan” di depan namanya. Terhadap putusan seperti ini tentu akan menimbulkan pertanyaan mengenai kekuatan eksekusi putusan dan mengenai pertanggungjawaban yayasan yang tidak berbadan hukum atas perbuatan hukum yang dilakukan oleh organ yayasan dimaksud. Dua pertanyaan diatas menarik penulis untuk melaksanakan penelitian, dimana hasil penelitian penulis mengungkapkan bahwa putusan berkekuatan hukum terhadap yayasan yang tidak berbadan hukum akan tetapi tetap menggunakan kata “yayasan” di depan namanya tetap dapat dilaksanakan eksekusi, dan bahwa anggota organ yayasan secara hukum harus dianggap sebagai pihak yang potensial untuk  mempertanggungjawabkan perbuatan hukum yayasan yang merugikan pihak ketiga.Kata Kunci: Putusan Pengadilan, Eksekusi, Pertanggungjawaban Hukum,Yayasan, Badan Hukum.

Abstract

Background: Land acquisition is a way to acquire land for development for the public good. Article 18 of the Agrarian Constitution number 5 of 1960 states that: "for the public interest, including also for the benefit of the nation and the state as well as the common interests of the people, the right to land can be revoked, by providing appropriate compensation and by the manner regulated by the Law, then judging from the principle of land rights that has been stated in Article 6, namely land has a social function. Objective: The government initiated the concept of Land Banking which aims to record, collect, and distribute land that is appropriate to its circumstances and nature and can be included in the Land Bank. Methods: Research methods use normative legal research methods. The establishment of the Land Bank is inseparable from the efforts of the government which seeks to provide land for development and the public interest so that the land is not controlled by the land mafia that afflicts the people. Result: A supporting legal tool that can be in the form of a law that specifically regulates land banks, then the implementation of land banks in Indonesia will run according to their functions appropriately and effectively to obtain large results. This condition will improve the welfare of each individual and society in general and by the mandate of the constitution which aims to realize the greatest prosperity of the Indonesian people. Conclusion: Full management of land assets that have been controlled and aimed at realizing an equitable economy is the authority of the land bank. Government asset land is different from state land, government asset land is land controlled by Government agencies, both central and local governments. Currently, there is an area of 25,000 ha of land that has been determined to be the initial capital of the Land Bank and has been prepared by the Ministry of Agrarian and Spatial Planning / National Land Agency (ATR / BPN).

Abstract

Penelitian ini bertujuan untuk mengetahui pengakuan tanah ulayat olehlembaga adat desa Budaya Pampang kota Samarinda ditinjau dariPeraturan Menteri Agraria dan Tata Ruang/Kepala Badan PertanahanNasional Nomor 10 Tahun 2016 Tentang Cara Penetapan Hak KomunalAtas Tanah Masyarakat Hukum Adat dan Masyarakat Yang Beradadalam Kawasan Tertentu. Penelitian ini merupakan penelitian hukumnormatif yang bersumber dari bahan hukum sekunder dan bahan hukumprimer. Hasil penelitian menunjukan bahwa pengakuan tanah ulayat olehlembaga adat Desa Budaya Pampang Kota Samarinda sampai saat inimasih hanya didasarkan pengakuan dari Lembaga Adat belummendapatkan penetapan dari pemerintah kota Samarinda. Sehinggadisarankan Lembaga Adat Desa Budaya Pampang Kota Samarinda bisamengajukan permohonan untuk penetapan tanah ulayat di desa BudayaPampang tersebut agar memperoleh kekuatan hukum dari PemerintahKota Samarinda.

Abstract

In recent decades, the phenomenon of disobedience or even 'harassment' of the law has been rife. Both in terms of action and giving court decisions are often considered unwise because they do not provide satisfaction to people who are experiencing legal problems. The judge is considered to no longer give a fair verdict on the initial process to the end of the ongoing trial, including due to court procedures that are not in accordance with legal provisions. As stated by Bismar Siregar, currently many cases are decided based on certain 'orders' through cooperation between law enforcement officials (oknum) and perpetrators of law violations who with their intelligence are able to distort the meaning of the rule of law with the opinion of judges. Researchethode is a type of normative legal research or research using the rules in existing laws and regulations and research carried out by collecting data directly in the field from competent parties related to the object studied because it is in the form of secondary data such as legislation and literature books. A judge's decision that reflects justice is not easy to find a benchmark for disputing parties. Because fair to one party is not necessarily fair to the other. The duty of the judge is to uphold the acidity in accordance with the trash made at the head of the judgment which reads "For Justice Based on the One and Only Godhead". Legal considerations are basically constructed in a judge's decision as a process of deduction, which means the process of applying relevant legal regulations to assess these legal facts.

Abstract

Changes in spatial use arise as a result of changes in the balance between the number of inhabitants and the available land area. The population continues to increase from time to time, while the available land area never increases. The Economic Of Law Analysis approach plays an important role in the policies of the Regional Government. Qualitative descriptive research method, with a normative approach. A normative approach, namely an approach taken by collecting and studying applicable legal regulations that are closely related to research issues which include laws and other laws and regulations, official documents, and other sources that are closely related to the problems studied. the economic of law analysis approach plays an important role in the policies implemented by the Samarinda City Government in terms of spatial use. Definitively, urban areas are areas that have the main activity of arranging the functional arrangement of areas as places for urban settlements, concentration and distribution of government services, social services, and economic activities. The Samarinda City Spatial Planning through the Samarinda City Regional Regulation Number 2 of 2014 in addition to regulating the Spatial Planning in Samarinda City also provides an overview of the spatial use of the Samarinda City area for the next 20 years.

Abstract

Supreme Court Regulation Number 1 of 2019 or herein after abbreviated as PERMA Number 1 of 2019 is a revision of the previous Supreme Court Regulation, namely: Supreme Court Regulation Number 3 of 2018 concerning the Administration of Cases in Electronic Courts. service needs that are easier, cheaper, and more efficient. This service requirement is difficult to achieve without the support of information technology. Especially during a pandemic like now, the presence of PERMA is expected to be one of the answers to several problems faced by the community.The formulation of the problem in this study is what is the legal basis for the application of e-court by advocates in the settlement of civil cases in the general court in the city of Samarinda and how is the application of e-court by advocates in the settlement of civil cases at the Samarinda District Court. The type of research conducted by researchers is research that uses empirical juridical research methods where researchers can collect data through interviews.From the results of this study, it can be concluded that the e-court that occurred at the Samarinda District Court has met the effectiveness and is based on the law in a case that is more effective and efficient. Indicators of the effectiveness of e-court in this case can be seen from the fulfillment of a judicial institution that is simpler, faster, and cheaper when compared to the ordinary legal process. In litigation cases through e-court, both parties seeking justice and the court concerned get better benefits than litigation in the usual way, which can be seen from a simpler process, faster time so that from both cases the costs incurred are also more. spent. easier for justice seekers and also easier for advocates in the judicial process.

Abstract

UUK dan PKPU sudah mengatur tentang kepailitan BUMN namun hal tersebut masih terbatas pada BUMN yang bergerak dibang kepentingan publik. Pengertian BUMN yang bergerak dibidang kepentingan publik hampir sama dengan pengertian Perum. Terlepas dari hal tersebut, BUMN Persero sangat berbeda dangan Perum. BUMN Persero sebagimana disebutkan dalam Pasal 1 angka 2, adalah BUMN yang berbentuk Perseroan Terbatas yang modalnya terbagi dalam saham yang seluruhnya atau paling sedikit 51% sahamnya dimiliki oleh negara yang tujuan utamanya mengejar keuntungan. Rumusan masalah dalam penelitian ini, bagaimana landasan yuridis terkait dengan permohonan pailit terhadap perusahaan BUMN yang berbentuk Perseroan Terbatas dan bagaimana akibat hukum jika perusahaan BUMN yang berbentuk Perseroan Terbatas dipailitkan. Metode penelitian yang penulis gunakan merupakan jenis penelitian yuridis normatif. Hasil penelitian menunjukan bahwa bila BUMN tersebut berbentuk Persero adalah tidak harus Menteri Keuangan yang mengajukan permohonan pailit akan tetapi dapat oleh debitor itu sendiri atau kreditornya sebagaimana ketentuan Pasal 2 Ayat (1) UUK dan PKPU. Akibat hukum yang timbul dari kepailitan adalah debitor kehilangan hak menguasai kekayaannya tetapi terhadap perbuatan hukum dalam bidang keperdataan tidak berhenti.

Abstract

An auction is a form of creative buying and selling transaction, where one party commits to give up ownership of goods and the other party agrees to pay the agreed price. This research aims to analyze the legal certainty and protection given to buyers of auction goods, as well as to understand how the auction mechanism can protect the rights of buyers from third party claims. This research uses a normative juridical approach, namely assessing and evaluating formal legal regulations relating to auctions. This method is carried out by analyzing positive legal norms and regulations governing the auction process in Indonesia. The results showed that legal protection for auction buyers is guaranteed through provisions in the Auction Regulations which state that goods purchased through auctions are free from third party claims. Auction buyers have absolute rights to the auction goods they buy, which can be defended from the demands of any party. Preventive legal protection is guaranteed by applicable regulations, which provide legal evidence in the form of auction minutes as the basis for the transfer of ownership rights. This is important to reduce legal risks and ensure fairness in auction transactions. Legal certainty for auction buyers is essential to ensure that the goods purchased are protected from third-party claims

Abstract

A music concerts are business prospects int the filed of entertainment, which can be held in various places because of promising business oportinity in there. A music concert Music concerts require careful planning, good organization, and implementation in accordance with the schedule that has been determined, therefore the organizers are obliged to fulfill their rights and obligations to consumers or in this case music concert goers. In this study the authors will raise two problems, namely how the legal protection of consumers who buy tickets online, and how the problem resolution efforts by the organizing committee of the music concert to the audience who buy tickets online. This study using normative legal research, of whom the data used in this study are library material, namely material that contains new or cutting-edge scientific knowledge, or a new understanding of facts that are known or about Ideas (Ideas), in this case covering books, journals, dissertations or theses and other legal materials. This study of normative legal materials fully uses premier legal materials and secondary legal materials. This study concludes that online concert ticket buyers have the right to get goods and/or services, specifically the ability to access the musical venue in accordance with the claimed exchange value, conditions, and guarantees. The concert organizer's failure to allow online ticket buyers into the musical venue constitutes a breach of contract for which restitution can be sought through either litigation or non-litigation procedures.
