Abstract

Motorcycle vehicles at this time are one of the primary vehicles used by the majority of people in daily activities. So that a motorcycle vehicle that is safe and suitable for use is a great hope of the community, especially in the frame which is the most important part of a vehicle. Lately cases that are rife in the community are damage to the eSAF frame resulting in broken and porous Honda brand vehicles, several incidents of broken motorcycles in the middle of the road, this is what attracts the author's attention to examine more deeply about what causes it and how Ibn Taymiyah's perspective and the Consumer Protection Law on this problem. This research is qualitative research with an empirical normative approach method using a type of research approach, namely library research. The results of this study show that there are rampant cases of damage to Honda motorcycle frames because they use eSAF type frames that are not good from previous types of frames, while from AHM explained that every product they market has been checked and is suitable for use. According to Ibn Taymiyyah in the principle of buying and selling is not justified this practice, because the frame is in the vehicle and not visible, there should be liability for damage suffered by consumers. And in terms of consumer protection, precisely in article 7 letters a-g has not been effectively applied in this broken frame problem

Abstract

This paper aims to explain the concept of justice in inheritance law from an Islamic perspective. The first knowledge that was lost among Muslims was the knowledge of inheritance, as conveyed by the Prophet Muhammad PBUH. Not only that, there is an attempt to undermine the order of inheritance law in Islam. In the Quran, it is explained that the distribution of inheritance property has 2 provisions, namely mitslu hadzl al-untsayain (two to one) and furudhul al-muqaddarah with numbers 1/2, 1/3, 1/4, 1/6, 1/8, 2/3, this provision is part of the principle of justice. In Islamic legal philosophy, the concept of justice is formulated in maqashid al-syari'ah formulated by al-Syatibi, that the law based on justice is determined by maslahat which is divided into three, namely dharuriyyat, hajiyyat, and tahsiniyyat. This indicates that Islam is very concerned with the issue of justice. The conception of justice will continue to develop in line with social development.  This type of research is library research, which is a research that focuses on literature by analyzing the content of some literature related to research from both primary and secondary sources. Then analyze how the concept of justice in the distribution of inheritance from the perspective of Islamic legal philosophy. The result of the discussion is that the meaning of justice in Islamic inheritance law must follow the provisions of Allah swt. not equal distribution. Behind the distribution of inheritance in Islam contains justice that is universal in terms of theology, economics, social, and economic.

Abstract

The purpose of this study is to find out the legal use of TBDSP funds for financing Bank Sumut Syariah Kcp Marelan Raya in the perspective of MUI Fatwa No.123/DSN-MUI/XI/2018. This investigation makes use of qualitative data and methods for describing phenomena. In this investigation, we combined data from both primary and secondary sources. Methods of gathering information via direct observation, interviews, and written records. According to the findings of this research, TBDSP money is used in a used for benevolence funds and bank operational financing. Bank of North Sumatra does not have a special storage for current accounts or deposits, and non-halal TBDSP funds. The special shelter for funds is only income from financing customer fines that are used for policy funds. Meanwhile, the income from the funds channeled to financing is used for the operations of the Islamic Bank of North Sumatra. The law on the use of TBDSP funds for operational financing of Islamic banks if it is associated with MUI Fatwa No. 123/DSN-MUI/XI/2018 this is not in accordance with the fatwa because the Islamic banks of North Sumatra still use these funds for benevolence funds and operational financing of Islamic banks. Abstract

The importance of this research can be seen from the perspective of Wahbah Az-Zuhaili who emphasizes justice and moral values ??in Islamic law. By integrating Az-Zuhaili's views as study material, this research can provide a holistic evaluation of oil palm harvesting practices. A qualitative approach in this research was used to gain an in-depth understanding of the practice of handling stolen palm oil and its impact on farmers in Sei Rakyat Village. By applying a qualitative approach to explore the practice of handling stolen palm oil and its impact on farmers in Sei Rakyat Village. Through in-depth interviews, participant observation, and document analysis, this research succeeded in providing an in-depth understanding of this phenomenon. The principle of compensation is that if you damage other people's property and the like, whether it is destroying objects, stealing or confiscating property from someone, you must return it with the same or similar item as long as the item is still there. If the item is difficult to find, you can replace it in the form of money in accordance with nominal loss figure. Wahbah Az-Zuhaili emphasized the need to resolve compensation actions through mutual consent and agreement between the parties involved, referring to the principles of consensual commerce. The results of this research state that oil palm farmers should compensate for losses in a similar form to the compensation requested by oil palm farmers.

Abstract

Penelitian ini bertujuan untuk menganalisis pengaturan perlindungan data pribadi dalam e-commerce menurut perspektif maqashid syariah, dengan menggunakan studi kasus marketplace Facebook. Perlindungan data pribadi dalam konteks e-commerce menjadi semakin penting seiring dengan perkembangan teknologi informasi dan komunikasi yang pesat. Maqashid syariah, sebagai konsep utama dalam Islam yang berhubungan dengan tujuan-tujuan syariah, dapat memberikan landasan etika dan moral dalam mengatur perlindungan data pribadi. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan menggunakan analisis konten terhadap kebijakan privasi dan ketentuan penggunaan marketplace Facebook. Data yang diperoleh dari penelitian ini akan dianalisis secara deskriptif dan interpretatif untuk mengidentifikasi bagaimana Facebook mengatur perlindungan data pribadi dalam e-commerce. Hasil penelitian menunjukkan bahwa Facebook memiliki kebijakan privasi dalam ketentuan penggunaan yang mengatur perlindungan data pribadi pengguna dalam konteks e-commerce. Namun, terdapat beberapa aspek yang perlu diperhatikan untuk memastikan perlindungan data pribadi yang lebih efektif sesuai dengan prinsip-prinsip maqashid syariah. Aspek-aspek tersebut antara lain adalah transparansi informasi, kontrol pengguna terhadap data pribadi mereka, keamanan data, dan tanggung jawab sosial platform terhadap kebajikan umum. Penelitian ini bertujuan untuk mengeksplorasi nilai-nilai prinsip maqashidu al-syari’ah pada perlindungan data pribadi dalam e-commerce diIndonesia. Penelitian ini dilakukan melalui metode kajian normative dan kepustakaan. Berdasarkan hasil penelitian dari secara normatif perlindungan hukum ini mengedepankan aspek dar’u al-mafasid dengan melindungi kepentingan dharuriyah konsumen secara komprehensif dari mulai hifzh al-din, hifzh al-nafs, hifzh al-‘aql, hifzh al-nasl, hifzh al-maal.

Abstract

Determination of the marriage age limit through Law No. 16 of 2019 reflects progressive steps in protecting children's rights and preventing the negative impacts of early marriage. This study aims to analyze the relevance of maqashid sharia in supporting this policy, especially in maintaining the five main principles: protection of religion (hifz al-din), soul (hifz al-nafs), reason (hifz al-'aql), descendants (hifz al-nasl), and property (hifz al-mal). With a normative approach and qualitative analysis of Islamic legal literature and related legal documents, this research reveals that a higher marriage age limit is in line with the Sharia goal of ensuring the welfare of individuals and society. Apart from that, the implementation of Law No. 16 of 2019 is faced with challenges, such as cultural resistance and lack of legal awareness, which require educational strategies and strengthening regulations. This study provides practical recommendations for policy makers to align maqashid sharia with the implementation of the law, to support quality and sustainable family development.

Abstract

It is a necessity that information technology with the power of digitalisation is experiencing accelerated development. Its application also penetrates into various fields. On the other hand, the potential of cash waqf in Indonesia is also very large. The purpose of this paper is to describe the potential of cash waqf developed through digital mechanisms, by utilizing computing technology. The institutionalization of the spirit of digital-based waqf is the focus of attention in this study. The method used is descriptive qualitative with a literature review approach. The data taken are secondary data derived from scientific journals, academic papers, books that are compatible with this study. Digital artifacts of digital waqf institution platforms are also a relevant and main source of study in this discourse. The study found that the development and transformation of digital cash waqf began in 2012 when the Indonesian Ulema Council issued a fatwa on cash waqf. The study also found that cash waqf began to grow in the community and was amplified by the presence of digital instruments in the implementation of cash waqf payments. Many waqf institutions build digital platforms through various applications, websites and other social media.

Abstract

This research aims to find out why business actors exchange cellphone spareparts. How responsibility of business actors in the practice of exchanging mobile phone spare parts without the customer's knowledge, review Fatwa number 112/DSN-MUI/IX2017. This research uses empirical juridical methods or also commonly called sociological juridical. The responsibility of mobile phone counter business actors regarding the exchange of mobile phone spare parts from the perspective of fatwa number 112/DSN-MUI/2017 is compensation for repairing cellphone spareparts which should not have been exchanged but were exchanged by the cellphone counter because the manufacturer tried to break the agreement at the beginning of the transaction.

Abstract

This study aims to analyze the accountability/responsibility of the Sharia Supervisory Board (DPS) in overseeing the operations of Sharia accommodations, with a specific focus on Sharia hotels in Medan City. The primary question addressed in this research is how the DPS fulfills its responsibility in ensuring the compliance of Sharia hotel operations with the principles outlined in DSN-MUI Fatwa No. 108 of 2016 on Sharia Tourism. This study employs a qualitative approach using a case study method. Data were collected through interviews, direct observations, and analysis of relevant documents. Interviews were conducted with DPS members, Sharia hotel management, and other related stakeholders to gain a deep understanding of DPS oversight implementation. The findings reveal that DPS plays a crucial role in monitoring the implementation of Sharia principles in Sharia hotels. However, challenges such as limited resources and uneven understanding among DPS members hinder effective oversight. The study highlights the need for capacity building and better coordination between DPS, hotel management, and other stakeholders to enhance accountability and ensure compliance with DSN-MUI fatwas. Effective DPS oversight can improve service quality, public trust, and the sustainability of Sharia hotel operations.

Abstract

This study aims to examine the legal consequences of tadlis in the quality of e-commerce products, especially on the Shopee platform, from the perspective of the National Sharia Council of the Indonesian Ulama Council (DSN MUI) Fatwa Number 146 of 2021. Tadlis, as a form of fraud in buying and selling transactions, is prohibited in Islam because it contradicts the values of honesty and justice. A qualitative method with a normative juridical approach is used in this research to analyze the DSN MUI fatwa and the legal articles related to product quality in e-commerce. The results of the study show the importance of honesty and justice in online transactions, the obligation of sellers to guarantee product quality, and the legal implications of violations of these principles.
