Abstract

Lapas Warung Kiara Kelas II B Sukabumi merupakan salah satu Unit Pelaksana Teknis (UPT) Pemasyarakatan yang berada dalam wilayah kerja Kantor Wilayah Kementerian Hukum dan Hak Asasi Manusia Jawa Barat. Dalam penelitian ini, penelitian empiris, penelitian empiris yaitu penelitian yang dilakukan melalui observasi atau penelitian secara langsung ke lapangan, yang dimana bertujuan untuk mengetahui implementasi program rehabilitasi sosial terhadap penyalahguna narkotika di Lapas Warung Kiara Kelas II B Sukabumi dan serta untuk mengetahui dampak dari program tersebut terhadap penerima manfaat. Program yang dijalankan seperti assement & screening, sesi psikoedukasi napza, konseling group, seminar, dan sesi edukasi. Hasil temuan dari penelitian juga menunjukkan dampak positif yang dirasakan oleh klien (penerima manfaat) setelah menjalani program rehabilitasi sosial dengan menjadi pribadi yang lebih baik, rajin beribadah, tata nilai dan norma sosial yang lebih baik, dan serta memiliki usaha dalam pengembangan dirinya sendiri yang dikembangkan di sekitar lingkungan Lapas Warung Kiara Kelas II B Sukabumi.

Abstract

A Justice Collaborator is a perpetrator who works with law enforcement to help uncover a case by providing important information in a criminal act. A Justice Collaborator receives threats from various parties, therefore a Justice Collaborator needs to get adequate legal protection to ensure his safety and security. The protection of Justice Collaborators is regulated in Law Number 31 of 2014 concerning the Protection of Witnesses and Victims. This study aims to analyze the protection mechanism given to justice collaborators in the disclosure of premeditated murder cases, both in terms of existing regulations and their implementation in the field. The results of the study show that even though there are regulations regulating the protection of justice collaborators, its implementation still encounters various obstacles. Some of the factors that affect the effectiveness of these protections include a lack of coordination between law enforcement agencies, limited resources, and threats to the safety of justice collaborators from parties involved in criminal acts. This study suggests improvements in the justice collaborator protection system through increased coordination between institutions, adequate resource allocation, and the application of strict sanctions for protection violations. Thus, the role of justice collaborators in the disclosure of premeditated murder cases can be more optimal and make a significant contribution to law enforcement in Indonesia.

Abstract

Traffic is a crucial part of public mobility, allowing people to move from one point to another, and also plays a significant role in economic growth, including both human and goods transport services. With the advancement of technology, however, transportation has also had adverse effects on human life, such as accidents that claim many lives. Therefore, the operation of motor vehicles is regulated by Law No. 22 of 2009 concerning road traffic and transportation. This regulation is now enforced not only manually but also through the ETLE electronic system, demonstrating that the police are also keeping pace with technological progress. The aim of this study is to examine whether the implementation of Article 106, paragraph 1, through the ETLE system is functioning effectively or, perhaps, otherwise.

Abstract

This study discusses the implementation of legal protection of the constitutional rights of customary law communities (MHA) based on Sukabumi Regency Regional Regulation Number 7 of 2024 which applies in the Ciptarasa Traditional Village. Although recognition of MHA has been affirmed in Article 18B paragraph (2) of the 1945 Constitution, in reality, many indigenous communities still face gaps in obtaining administrative recognition, access to public services, and participation in the policy-making process. The purpose of this study is to examine the extent to which the regional regulation is able to provide effective and fair legal protection to indigenous peoples, as well as identify inhibiting factors and solutions that can be offered. The research method used is empirical juridical, with a qualitative approach. Data was obtained through document studies, interviews, and field observations in Ciptarasa Village. The analysis was conducted based on the theory of legal protection from Philipus M. Hadjon and the theory of social justice from John Rawls. The results of the study show that although the regional regulation has provided formal recognition of the existence of Kampung Ciptarasa as an indigenous community, substantive protection of their rights has not been fully realized. The main obstacles include the lack of socialization of regional regulations, limited population administration services, lack of budget, and weak participation of indigenous peoples in policy formulation. Therefore, it is necessary to strengthen the role of customary institutions, integrate community-based public services, as well as budget commitments and periodic evaluations so that this regional regulation is not only symbolic, but truly guarantees the constitutional rights of customary law communities in real terms.

Abstract

This study discusses the implementation of legal protection for children victims of sexual violence in the family environment, which is a form of gross violation of children’s rights. Although there have been various regulations such as Law Number 35 of 2014 concerning Child Protection and the Criminal Code, in practice legal protection has not been fully effective. Cultural factors, social pressure, lack of legal assistance, and fear of victims and families often hinder the reporting and enforcement process. This study uses an empirical normative juridical approach to analyze the extent to which legal rules run in the field. The results of the study show that the role of law enforcement officials, child protection institutions, and family support greatly determines the success of protection for victims. Therefore, it is necessary to increase legal education, psychological assistance, and strengthen synergy between legal institutions and the community in preventing and dealing with sexual violence against children in the family

Abstract

This study aims to analyze the problems in the application for tourism service permits in the Situgunung conservation area from the perspective of the State Administration Law (HAN), with reference to Law Number 32 of 2024 concerning the Conservation of Biological Natural Resources and Their Ecosystems. This study focuses on the practice of implementing motorcycle taxi services as part of the use of environmental services which should be subject to the provisions of valid licensing from the government and/or local governments as stipulated in Article 34 paragraph (4) of the Law. However, in its implementation, it was found that the activities of motorcycle taxi services in Situgunung ran without a legal licensing basis, and escaped administrative supervision that should be carried out by the relevant authorities. This problem shows that there is a discrepancy between legal norms and administrative practices, weak enforcement of the principle of legality, and the lack of effectiveness of bureaucratic supervision in the implementation of the risk-based licensing system through OSS. Using a normative juridical approach and a field study, this study seeks to provide a critical evaluation of the existing permit application mechanism, as well as formulate the urgency of improving the licensing system to be in line with the principles of good governance, legal certainty, and administrative order in the sustainable management of conservation areas.

Abstract

The Role of the National Narcotics Agency of Sukabumi Regency/City in Law Enforcement Against Narcotics Crimes According to Undang-Undang Narkotika Number 35 of 2009. This study discusses the role of the National Narcotics Agency of Sukabumi Regency/City in law enforcement against narcotics crimes in accordance with Undang-Undang Narkotika Number 35 of 2009. The research aims to analyze the effectiveness and obstacles faced by the National Narcotics Agency of Sukabumi Regency/City in handling narcotics abuse and illicit trafficking. Using normative juridical and empirical juridical methods, data were collected through document studies and interviews with key informants. The results show that law enforcement efforts have not been optimal due to limitations in budget, authority, human resources, and legal framework. The study concludes that strengthening preventive measures, increasing the capacity of human resources, and optimizing coordination between law enforcement agencies are needed to improve the effectiveness of narcotics crime eradication in Sukabumi Regency/City.

Abstract

This study examines legal protection for the fulfillment of transgender rights that have obtained permanent legal status in Indonesia. The phenomenon of transgender individuals, as part of global social dynamics, faces complex challenges in legal recognition and human rights protection. With an estimated transgender population of 43,100 people in Indonesia, they continue to experience systematic discrimination in various aspects of life. This research employs a normative-empirical method to analyze the legal aspects that support transgender protection as well as the challenges in its implementation. The findings reveal that although there is a legal basis in the 1945 Constitution and Law No. 39/1999 on Human Rights, as well as court decisions such as the Rohmah case in Cibadak District Court, the implementation of legal protection still encounters structural obstacles in the form of social discrimination and the absence of specific regulations. This study provides recommendations for strengthening a more inclusive and comprehensive legal framework to protect the rights of transgender individuals in Indonesia.

Abstract

Tenaga kesehatan dalam prakteknya seringkali menimbulkan polemik, seperti halnya lalai atau melakukan kesalahan dalam menjalankan tugas ketika menangani pasien, dalam pertanggungjawabannya seorang tenaga kesehatan seringkali menghindar dari tanggungjawab atas apa yang telah diperbuatnya, maka dari itu seperti apa bentuk pertanggungjawaban yang harus ditanggung oleh tenaga kesehatan yang melakukan tindakan Malapraktik dan seperti apa pula penegakan hukum di Indonesia terhadap tindakan Malapraktik medis ini. Penelitian ini menggunakan metode penelitian kualitatif, dengan metode ini penulis dapat menganalisa dan memberikan penjelasan dalam menerapkan suatu peraturan perundang-undangan. Berdasarkan penelitian yang peneliti lakukan menunjukan kesimpulan bahwa dalam penegakan hukum pidana terhadap tindak pidana Malapraktik masih kurang dalam penanganannya, karena peraturan yang mengatur tentang tindakan Malapraktik ini belum diatur secara spesifik dan belum adanya liminatif yang memberikan suatu batasan dalam tindakan Malapraktik. Pertanggungjawaban pidana diawali dengan adanya suatu kesalahan, baik disengaja maupun karena kelalaian, dalam hal ini menjadi acuan bahwa ada tidaknya pertanggungjawaban yang telah diperbuat oleh tenaga kesehatan, pertanggungjawaban pidana terhadap tenaga kesehatan terdapat dalam Undang-Undang Nomor 36 Tahun 2014 Tentang Tenaga Kesehatan. Maka dari itu perlu adanya perhatian lebih dari pemerintahan terhadap kasus malapraktik medis dengan melakukan sosialisasi, dan dibuatnya regulasi baru khusus malapraktik medis.

Abstract

Crime in society, including identity and document forgery, is regulated by Articles 263-276 of the Criminal Code. This research uses the juridical-normative method to assess the application of Articles 263, 266, and Article 97 of the Civil Administration Law in cases of identity and certificate forgery involving married individuals, focusing on police report LP/B/123/III/2023/POLRES SUKABUMI/POLDA WEST JAVA. Findings show that forgery laws are often not enforced when the parties are married, despite the potential for legal action. Additionally, village officials and KUA employees involved in such cases continue in their roles despite ethical breaches, raising concerns about future violations.
