Abstract

Domestic violence is a social phenomenon that has lasted a long time in most households in Indonesia. Domestic violence cases dominating against women in Sukabumi. The number of domestic violence cases that occurred in Indonesia is a reflection of the failure of a family to build and maintain a household conditions conducive and comfortable for each family member who took refuge in it. People still think that domestic violence is not a form of crime, is still considered taboo, and is a private matter that should not be to tell. the role performed by the College in providing education to rural communities Padaasih Cisaat about domestic violence and also how the socialization of the Law of the Republic of Indonesia No. 23 Year 2004 concerning the Elimination of Domestic Violence.

Abstract

Nowadays marine pollution become a serious problem in the world espesially in Indonesia. Marine scientists have found harmful impact of marine pollution to marine environment, ecosystem and humans, there-quarter of all marine debris is plastic, a persistent and potentially hazardous pollutan. Plastic can be chemically harmful to wildlife, either because themselves potentially toxic or other toxic pollutan, the situation become worse when it come to marrine pollution caused by micro plastic, micro plastic is very dangerous for the ecosystem and the human in the world. Public awaarness to participate in maintaining the marine environment is decreasing day by day. Some people do not realise that microplastic are so danger to marine environment because most plastics in the ocean break up into very small particles, plastic is one of the kind of marine debris and it can come in all shapes and size, but those that are less than five millimeter in length. Indonesia is the second-biggest-contributor to ocean after China, with some estimates suggesting it is source of about 10% of global plastic pollution, if this problem can not be solved, there could be more plastic than fish in the ocean. Unfortunetly up to present we do not have any effective methode to clean up the ocean, the only thing that we can do is reduce the use of plastic in daily life. Marine pollution is become global problem so that is why we need some strategies to solved this problem, based on internatinal frame work Indonesia and others contries should do cooperation with others country and based on national legal frame works government should make special regulation to protect marine environment. Pollution from land-based sources, either direcly by urban or argiculuture discharger or indirecly through water. Keyword: Marrine, Pollution, ASEAN

Abstract

Violence against children can always occur in situations and conditions at any time and thing this can be caused by conflicts that occur both within the family and community environment. In the family sphere, conflicts usually occur within the household committed by husbands and wives whose effects can lead to an outlet of violence against children that have a negative impact on physical, psychological, mental, which contrary to Law No. 35 of 2014 concerning Child Protection. 1 Likewise, in the community environment, problems often arise violence against children as a result of wrong relationships and the environment of that society itself which is not good, which is done by irresponsible people, namely sexual violence against children. So it needs protection by the state and society, which aims to provide a sense of security to children as victims as well as crack down on the culprit. Higher education as an institution that can spread values the value of kindness and understanding of the enforcement of cases of child abuse and also from the college will produce human resources who have competence to handle cases of child abuse, as well as being able to provide input and improvement of laws and regulations and policies relating to legal protection for children who are victims of violence.

Abstract

Para korban yang awalnya ingin memperbaiki kehidupan perekonomian mereka, namun dalam kenyataannya mereka hanya dijadikan budak. Perbudakan manusia terhadap manusia telah berjalan berabad-abad lamanya. Tetapi, para ahli sejarah tidak dapat menentukan kapan permulaan perbudakan itu dimulai. Seba- gian ahli sejarah berpendapat, bahwa perbudakan itu dimulai bersamaan dengan perkembangan manusia, karena sebagian manusia memerlukan bantuan tenaga dari sebagian manusia lainnya. Karena sebagian manusia merasa mempunyai kekuatan, maka lahirlah keinginan menguasai orang lain dan terjadilah perbudakan manusia atas manusia dan perdagangan manusia (trafficking). Islam yang dibawa Nabi Muhammad Saw, mengajarkan adanya per- samaan antara sesama manusia. Tiada bangsa yang lebih mulia dari bangsa lainnya, tiada suku yang lebih mulia dari suku lainnya. Bahkan, tiada orang yang lebih mulia dari orang lain kecuali hanya takwanya kepada Allah Swt. Karena itulah Islam beru- saha untuk membebaskan manusia dari perbudakan di bumi ini, sebab perbudakan itu melahirkan kesengsaraan bagi para dhu’afa (orang-orang lemah atau para kaum miskin).

Abstract

Background.  Human trafficking is a contemporary version of slavery, ensuring the rights of victims to feel safe is crucial to create an efficient judicial process. Purpose. This research aims to identify the mechanisms of legal protection for TPPO victims in Sukabumi City and the supporting and inhibiting factors that influence them. The research methodology used is normative law with data sources including interviews, observations, and literature studies. Method. The data is processed using qualitative analysis, conducted at the Regional Technical Service Unit for Women and Children Protection. Results. The mechanisms of legal protection provided include the complaint process, victim outreach, case management, temporary shelter, and mediation. The supporting factors include collaboration among legal institutions. Conclusion. The inhibiting factors include limited budget and lack of Safe Houses (Shelters) or Trauma Centers.

Abstract

In the context of employment, legal protection is essential to ensure workers' rights are met, including equal treatment and opportunity without discrimination. Based on Law Number 13 of 2003 concerning Manpower, every worker is entitled to fair remuneration, especially for those who work beyond the stipulated working hours. The research method used is a qualitative approach with descriptive analysis, which involves interviews and direct observation at the Al-Ma'tuq Islamic Boarding School. The results of the study show that even though there is an overtime policy, its implementation is not fully in accordance with the applicable legal provisions. This study recommends the need for policy revisions and improved communication between management and workers to create a fairer and more transparent work environment.

Abstract

This study analyzes Indonesia's legal efforts against the violation of diplomatic immunity due to the wiretapping of the Embassy of the Republic of Indonesia (KBRI) in Yangon, Myanmar in June 2004. The incident violated Article 22 and Article 27 of the 1961 Vienna Convention, as eavesdropping devices were found in the Ambassador's office and diplomatic communication cables, which undermined the principles of inviolability and freedom of communication. This study uses a descriptive qualitative research method used with a juridical-normative approach based on literature studies from primary, secondary, and tertiary legal materials. The findings show that Myanmar has neglected to carry out its diplomatic protection obligations, so the recipient country is obliged to be held internationally responsible through compensation, apologies, or improvement of security procedures in accordance with the provisions of the International Law Commission Draft Articles on State Responsibility and the Principle of Responsiveness The Indonesian State chooses a settlement through peaceful diplomatic channels, including formal negotiations and protests, in accordance with the spirit of ASEAN and Article 33 of the UN Charter. However, its effectiveness depends on Myanmar's good faith to improve the protection system of diplomatic facilities and provide assurance that similar incidents do not recur. This study confirms the importance of strengthening international legal mechanisms in maintaining the integrity of bilateral relations and the reputation of global diplomacy.

Abstract

Pembajakan e-book merupakan salah satu tantangan utama dalam perlindungan hak kekayaan intelektual di era digital, yang berdampak negatif terhadap pencipta, penerbit, dan industri kreatif secara keseluruhan. Penelitian ini bertujuan untuk menganalisis secara yuridis ketentuan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta terkait perlindungan e-book serta mengevaluasi efektivitas penegakan hukum terhadap pelanggaran hak cipta e-book di Indonesia. Rumusan masalah dalam penelitian ini meliputi bagaimana perlindungan hukum yang diatur oleh Undang-Undang Hak Cipta terhadap e-book, kendala apa saja yang dihadapi dalam penegakan hukum terhadap pembajakan e-book, serta bagaimana peran pemerintah dalam menanggulangi pembajakan tersebut. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan studi kepustakaan sebagai sumber utama data, serta pengumpulan data tambahan melalui wawancara dengan penulis dan penerbit yang berpengalaman serta informasi dari sumber daring. Analisis dilakukan secara kualitatif deskriptif dengan membandingkan ketentuan hukum dengan fakta empiris terkait pelanggaran hak cipta e-book. Hasil penelitian menunjukkan bahwa Undang-Undang Nomor 28 Tahun 2014 sudah memberikan perlindungan yang memadai terhadap hak cipta khususnya e-book, termasuk hak moral dan hak ekonomi pencipta serta sanksi pidana bagi pelanggar. Namun, implementasi hukum masih menghadapi berbagai hambatan seperti lemahnya pengawasan di platform digital, keterbatasan sumber daya penegak hukum, serta rendahnya kesadaran masyarakat dalam melaporkan pelanggaran. Peran pemerintah, terutama Direktorat Jenderal Kekayaan Intelektual, sangat penting dalam penguatan penegakan hukum dan edukasi publik. Penanggulangan pembajakan e-book memerlukan sinergi antara pemerintah, pelaku industri, platform digital, dan masyarakat agar perlindungan hak cipta dapat berjalan efektif dan berkelanjutan.

Abstract

Tujuan penelitian ini adalah untuk mengkaji kedudukan World Trade Organization (WTO) yang memiliki peran penting dalam penyelesaian sengketa perdagangan internasional, termasuk sengketa bijih nikel yang melibatkan Indonesia. Yang mana sengketa ini bermula sejak 1 Januari 2020, Indonesia melarang ekspor bijih nikel mentah melalui Peraturan Mentri Energi dan Sumber Daya Mineral (ESDM) No.11 Tahun 2019 untuk mendukung hilirisasi atau industri pengolahan dalam negeri, yang kemudian digugat oleh Uni Eropa ke WTO karena dianggap melanggar pasal Xl:1 General Agreement on Tariffs and Trade (GATT) 19994. Pasal tersebut menilai bahwa kebijakan Indonesia dalam membatasi ekspor merupakan bentuk pelanggaran dan tidak sesuai dengan ketentuan WTO. Metode yang digunakan dalam penelitian ini adalah Yuridis Normatif, yang mengkaji, menganalisis ketentuan hukum yang relavan, dan menelaah putusan Dispute Settlement Body (DSB), serta dampaknya terhadap kebijakan perdagangan Indonesia. Hasil dari penelitian ini menunjukkan bahwa WTO berperan sebagai mediator dan penegak aturan perdagangan dalam sengketa ini, meskipun WTO telah memutuskan bahwa kebijakan Indonesia dalam membatasi ekspor bijih nikel melanggar aturan perdagangan internasional, Indonesia tetap mempertahankan kebijakan hilirisasi dengan mengajukan banding. Indonesia menghadapi tantangan yang berpotensi mempengaruhi kebijakan ekspor di masa depan, maka dari itu penulis berharap dapat memberikan wawasan bagi masyarakat dan dasar perbaikan strategi yang lebih adaptif dalam menghadapi regulasi perdagangan global.

Abstract

Motorized vehicles are currently one of the means of transportation used by Indonesian people. With the large number of motorbikes used, there are also many traffic violations occurring on the roads. Therefore, the government issued statutory regulations for road users, namely Law Number 22 of 2009. In this provision, motorbike users must have a driving license, which is stated in Article 77 paragraph (1) of the LLAJ Law. The fact is that there are still people who are still disobedient and do not have a driving license. Actions given to violators are carried out by repressive law enforcement, giving punishments in the form of tickets and fines given by law enforcers, sometimes not based on Article 281 of the LLAJ Law. This research aims to find out how law enforcement and the sanctions given are by those stated in the LLAJ Law. The method used is a qualitative method with an empirical juridical approach.
