Abstract

Salah satu bagian dari pembangunan hukum dapat dilakukan dengan jalan  peningkatan dan penyempurnaan pembinaan hukum nasional dengan antara lain mengadakan pembaharuan, kodifikasi serta unifikasi hukum di bidang-bidang tertentu.  Undang-Undang  Nomor.40 Tahun 2007 tentang Perseroan Terbatas (UUPT) merupakan salah satu contoh usaha pembaharuan hukum tersebut . Pembaharuan hukum Perseroan Terbatas melalui UU Nomot 40 Tahun 2007 tentang Perseroan Terbatas  harus diarahkan bukan hanya pembaharuan substansi hukumnya, melainkan juga memungkinkan hukum itu bekerja sebagaimana diharapkan oleh pelaku pasar. Pembaharuan ekonomi dilakukan bukan sekedar memperbaharui hukum materiilnya, melainkan juga bagaimana hukum itu dapat bekerja, bagaimana pelaku ekonomi dapat mengakses hukum itu Pembaharuan hukum tersebut  harus tetap mencakup tiga komponen besar yaitu : pengembangan hukum, perbaikan pendidikan hukum, dan penyempurnaan system informasi hukum. Dengan demikian bekerjanya ketiga komponen  tersebut secara kait mengait diharapkan dapat memberi jawaban tantangan dan sasaran pembangunan ekonomi.

Abstract

the ideology of the Indonesian nation, is considered to have been neglected in the formation of legislation. As is known, Pancasila, as the source of all sources of state law, is interpreted as the principles or foundation for thinking and acting in the formation and enforcement of legislation. Empirically, the values of Pancasila have been forgotten as principles, both in abstracto and in concreto, leading to deviations, disharmony, and inconsistency in the formation of legislation. This study is a qualitative research using a normative juridical approach, which will explore and analyze these issues using secondary data and purposive random sampling. The analysis results show that three factors influence the neglect of Pancasila values as "principles" and the inconsistency in the use of "principles" provisions in the formation of legislation: the fluctuating disintegration of the Pancasila curriculum, the unclear and non-explicit regulation of Pancasila values as "principles" in Law No. 12 of 2011 juncto Law No. 13 of 2022 and its implementing regulations, and the inconsistency in the use of "principles" provisions in legislation. Based on these issues, it is necessary to strengthen the Pancasila curriculum, amend Article 2 by adding the phrase "Pancasila values as the principles of the content of legislation," and require the political will of the government and legislature to strengthen the curriculum and regulations for the formation of legislation.

Abstract

Latar belakang: Kesehatan merupakan salah satu kebutuhan dasar umat manusia. Salah satu cara meningkatkan dan mempertahankan kesehatan melalui penyelenggaraan pelayanan kesehatan yang baik. Pemerintah berupaya memberikan layanan kesehatan yang merata guna terciptanya pelayanan publik yang baik, salah satunya dengan membentuk badan penyelenggara jaminan kesehatan (BPJS). Pelayanan publik termasuk didalamnya pelayanan kesehatan harus diselenggarakan dengan prinsip asas persamaan perlakuan (tidak diskriminatif). Permasalahan yang muncul akhir-akhir ini banyak pasien BPJS yang mengeluh diperlakukan tidak sama dengan pasien umum pada saat mereka berobat di fasilitas layanan kesehatan. Rumusan masalah: Bagaimana dasar hukum pelayanan publik di Indonesia? Bagaimana asas persamaan dan tidak diskriminasi pada pelayanan kesehatan badan penyelenggara jaminan kesehatan sosial di Indonesia? Metode: metode yang digunakan adalah library research, atau penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka hukum sebagai bahan primer. Hasil: Pelayanan publik diatur didalam Undang-Undang Nomor 25 Tahun 2009 tentang Pelayanan Publik. Kesehatan merupakan salah satu kebutuhan hidup manusia yang berperan penting dalam kemajuan suatu bangsa dan negara. Adanya jaminan pemberian perlakuan yang sama (tidak diskriminatif) pada pasien yang berobat dengan menggunakan layanan BPJS mencerminkan berhasilnya indikator pelayanan publik yang baik pada suatu negara.

Abstract

Pertumbuhan ekonomi suatu bangsa akan dinilai dari pertumbuhan ekonominya. Pertumbuhan ekonomi membutuhkan modal, karena modal adalah faktor utama untuk melakukan kegiatan dalam berusaha, disamping juga diperlukan managemen dalam pengelolaannya. Salah satu sumber modal dalam pengembangann usaha diperoleh dari adanya penanaman modal melalui kegiatan investasi, terutama penanaman modal asing. Iklim berusaha yabngb sejuk,  nyaman dan aman akan sangat bgerpengaruh terhadap keberhasilan negara dalam menarik investor untuk datang menanamkan modalnya di Indoinesia. Namun ada beberapa kendala yang menjadi hambatan terhadap kepercayaan investor asing. Diantara hambatan tersebut adalah regulasi, SDM, birokrasi dan juga faktor sosial budaya dari masyarakat Indonesia. Oleh karena itulah maka diperlukan adanya kepastian hukum agar tercipta iklim berusaha yang kondusif yang bisa memberikan kenyaman investor khususnya investor asing ketika datang untuk menanamkan modalnya di Indonesia. Investasi yang berhasil akan menjadi promosi untuk menarik investor asing lainnya ke Indonesia, sehinngga hilirisasinya akan memberikan kesejahteraan masya

Abstract

Medical tourism is a new form of tourism and medical services by getting health services according to expectations to a certain area. In an effort to develop the health system and competition as well as the impact of health globalization, it is possible that medical tourism will lead to intense competition between hospitals in providing quality services and superior service products provided by these hospitals in attracting patients to come for treatment. Assessing the potential for the development of medical tourism in Indonesia and analyzing government regulations on the development of a medical tourism strategy in Indonesia. The method used is normative juridical, or legal research conducted by examining legal literature as primary material. Some things that must be considered in developing hospitals in Indonesia that have the potential to develop medical tourism services are tariffs, service quality, hospital accreditation, marketing, access to treatment from the aspect of transportation, availability of health workers and types of treatment. The central government, the ministry of health and local governments as policy or regulatory makers in terms of medical tourism in Indonesia play an important role. There needs to be regulations or policies that regulate matters related to medical tourism so that it is not just a discourse.

Abstract

The collective management system regulated by Law Number 28 of 2014 concerning Copyright, Government Regulation Number 56 of 2021, and various ministerial regulations is designed to protect the economic rights of creators, related rights owners, and users of musical works through a royalty collection and distribution mechanism. However, its implementation has given rise to various normative issues, ranging from overlapping authority between LMK and LMKN, unclear licensing mechanisms, and minimal transparency in royalty distribution. This culminated in a number of creators filing judicial review lawsuits against PP 56/2021 and Permenkumham 27/2025, objecting to the system's inconsistency with copyright protection principles. This study aims to legally examine the implementation of the collective music royalty management system in Indonesia and assess its compliance with the principles of justice, legal certainty, and transparency. This study uses a normative legal approach supported by philosophical and conceptual analysis. The results of this study found that the implementation of the collective royalty management system still faces various ineffectiveness, including potential conflicts of interest, administrative burdens, and a lack of institutional accountability. This situation indicates the need for regulatory reformulation and strengthening of institutional governance so that the royalty management system can operate fairly, transparently, and sustainably to support the national music industry ecosystem.

Abstract

The 2009 ASEAN Comprehensive Investment Agreement (ACIA) itself is one of the elements in supporting the establishment of the ASEAN Economic Community in 2015. This ACIA applies to investments that have existed on the effective date of this Agreement and investments made after the entry into force of this Agreement. The implementation of the ASEAN Comprehensive Investment Agreement (ACIA) provisions requires that all ASEAN member countries ratify this instrument. Indonesia ratified ACIA through Presidential Regulation of the Republic of Indonesia Number 49 of 2011 concerning Ratification of the ASEAN Comprehensive Investment Agreement, so it must commit to wide open the door to liberalization in the investment sector based on the ASEAN Comprehensive Investment Agreement. The approach method used in this research is a normative juridical approach. The approach used in this research is a juridical analysis. The juridical analysis approach method is intended to study the meaning and purpose of various legal rules and regulations. The results of this study show that the ASEAN Comprehensive Investment Agreement is one of the important pillars in the effort to realize the ASEAN Economic Community, which aims to increase investment activities among ASEAN member countries and make the ASEAN region competitive so that it becomes one of the destinations for investors in the world. National investment policy in the context of implementing the ASEAN Comprehensive Investment Agreement is carried out by issuing Presidential Regulation of the Republic of Indonesia Number 49 of 2011 concerning Ratification of the ASEAN Comprehensive Investment Agreement.

Abstract

The outsourcing work system is expected to provide legal protection for workers. The status of the employment relationship between the worker and the employer is stated in the Employment Agreement (SPK). The purpose of this study is to determine the advantages of implementing an outsourcing work contract model for companies, legal protection for workers with an outsourcing work contract model, and the efforts that the government has made in anticipating the emergence of industrial relations disputes between outsourced workers and labor supply companies and employers' companies. The method used is normative juridical, using secondary data as the primary data as supporting data. Secondary data was obtained by conducting a literature study through literature and legislation. The analysis was carried out qualitatively. The results of this study found that for companies to cost of production efficiency (cost of production), the government hopes to provide benefits to develop and encourage community economic growth and national economic growth. In the practice of outsourcing, wage discrimination often occurs between permanent workers who work for the principal company (employer company) and outsourcing workers (contract workers), continuing work with a contract work system. Protection for workers is provided by the existence of labor law because, by law, it means that there is a state guarantee to provide decent work to protect it in the workplace, such as health, work safety, and living wages. Apart from that, it is also up to the provision of social security after retirement, through trade unions or labor unions, providing legal assistance in case of problems, both in terms of non-judicial legal remedies and judicial legal efforts.

Abstract

The Universal Health Coverage (UHC) program in Indonesia aims to provide welfare in the health sector to the community as a whole. The state, as a provider and guarantor of health welfare, assumes responsibility for the development and care of children throughout Indonesia, without exception, including children with disabilities. This study aims to understand more about the future welfare of children with disabilities and the implementation of existing legal regulations in Indonesia in responding to the program. The research method used in this study involves normative legal research, where the method seeks a legal basis, by analyzing legislation related to child welfare. The results of the study show that the government has made great efforts in implementing legal regulations for the welfare of children with disabilities. However, there are still several obstacles and shortcomings in practice, including lack of socialization, limited data, budget constraints faced by the government, limited accessibility for children with disabilities, and inadequate health related to human resources and facilities. The purpose of establishing legal regulations and implementing them is to realize equal rights and opportunities for the health of people with disabilities towards Universal Health Coverage
