Abstract

Kontrak dalam sekala internasional selalu dihadapkan pada dua sistem hukum antara dua negara yang berbeda. Dalam penerapannya harus ada pilihan hukum secara tegas (choice of law) dari para pihak untuk menentukan hukum mana yang dipakai (applicable law) dalam rangka mengatur cara-cara penyelesaian sengketa. Urgensi pilihan hukum ini berguna bagi para pihak antara lain untuk menghindari dan mengantisipasi kesulitan di kemudian hari serta menentukan hukum apa yang akan digunakan serta menghindari ketidakpastian hukum yang berlaku terhadap kontrak selama pelaksanaan kewajiban-kewajiban kontraktual para pihak. Selain itu, pilihan hukum berfungsi pula sebagai sumber hukum manakala kontrak tidak mengatur sesuatu hal. Pilihan hukum sendiri merupakan pancaran kehendak bebas dalam kontrak yang diakui secara universal. Namun demikian penggunaan kehendak bebas dalam penentuan pilihan hukum itu dibatasi oleh faham ketertiban umum dan tidak boleh ditujukan untuk penyelundupan hukum.

Abstract

This research with the title Principles of Caution for Officials Making Temporary Land Deeds in Making Sale and Purchase Deeds. PPAT While carrying out legal action, you must always act carefully before making a deed. This research has three problem formulations, namely first, whether the Temporary Land Deed Making Official has complied with the precautionary principle in making the sale and purchase deed, secondly what form of responsibility the Temporary Land Deed Making Official has for deeds that have been canceled by the Court and thirdly what are the future arrangements related to preparation of a sale and purchase deed made by the Temporary Land Deed Official to comply with the precautionary principle. The method used in this research uses normative research methods. The conclusion of this research is that there are still many cases that occur due to the negligence of the Temporary PPAT in issuing authentic deeds. The precautionary principle in Temporary PPAT must be carried out correctly. So that the authentic deed issued by the Temporary PPAT is not invalidated by the Court. Apart from that, the concept of future arrangements should be changed so that the Temporary PPAT can be even better.

Abstract

This research aims to examine the principles of caution used by notaries when storing minutes of notarial deeds. A notary is a public official who has the authority to make deed minutes and save them in the form of a notarial protocol. So far, notaries legally store deeds only in the form of notary protocols, there are no rules that clearly regulate the layout of storing deeds in the notary's office safely and with confidentiality maintained. Apart from that, the Notary must be able to guarantee legal certainty for the parties entering into a deed agreement by being given a copy of the deed and storing the minutes of the deed (original deed) safely. Notaries are expected to apply the principle of prudence with the deeds they make, the authority and obligations they have as a Notary. Bearing in mind the importance of Article 16 paragraph (1) letter b, which is the obligation of a Notary to make a deed and save it in a Notary Protocol. This research uses normative juridical research with data collection techniques from literature consisting of primary legal and secondary legal materials.

Abstract

Tujuan penelitian ini untuk mengetahui apakah pengaturan pemberian hak tanggunagn secara elektronik bagi Pejabat Pembuat Akta Tanah telah memenuhi asas kepastian hukum, mengetahui apakah Pejabat Pembuat Akta Tanah bertanggung jawab atas penyimpanan asli lembar kedua APHT setalah berlakunya pendaftaran HT-el dan mengetahui bagaimana konsep pengaturan kedepan mengenai pembuatan dan penyimpanan asli lembar kedua dalam pendaftaran HT-el. Metode penelitan yang digunakan yakni yuridis normatif (legal research). Pendekatan masalah yang digunakan dalam penelitan ini yaitu pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach) dan pendekatan analisis (analytical approach). Sumber bahan hukum yang digunakan ialah bahan hukum primer, sekunder dan non hukum. Pengaturan pemberian hak tanggungan secara elektronik berdasarkan ketentuan UUHT, PP Jabatan PPAT dan Permen ATR/BPN No. 5 Tahun 2020 tentang Pelayanan HT-el dalam aturannya menunjukkan asas kepastian hukum yang mana dalan pertauran perundang-undangan tersebut PPAT memiliki peran penting dalam pemberian hak tanggungan baiks secara manual dan elektronik. Baik sebelum maupun sesudah berlakunya Permen ATR/BPN No. 5 Tahun 2020 PPAT dalam melaksanakan jabatannya bertangung jawab atas segala tugas yang dijalankannya. Akan tetapi setelah diundangkannya pengaturan terkait pelayanan HT-el PPAT memiliki tanggung jawab baru yakni dapat menyimpan asli lembar kedua APHT di kantornya sebagai warkah. UUHT dalam hirakie peraturan perundanga-undangan memiliki posisi tertinggi dibandingkan dengan Permen ATR/BPN. Maka dengan digunakananya asas lex superior derogat lex inferior dalam pemberian dan penyimpanan asli lembar kedua APHT berpedoman pada UUHT, sehingga Permen ATR/BPN No. 5 Tahun 2020 dapat dikesampingkan.

Abstract

On the muamalah side, Islamic law has changed due to social changes. Muamalah activities that consist of cooperation in experiencing changes in line with the needs of the time and place where it was inhabited by a group of humans. In cooperation, especially in the form of syirkah wujuh, from the beginning the main capital in this cooperation consists of “trust” as stated in Article 140 paragraph (1) compilation of Sharia Economic Law (KHES). In the development of parties that include Trust Capital there is a tendency to dominate other parties that include capital assets or goods. For this reason, it modifies by repositioning parties that include “Trust” Capital with the aim of realizing justice, namely balance in terms of profits and losses. This research method is in the form of Juridical-normative which emphasizes literature review (lebrari research) with a legislative and conceptual approach. The results of this study concluded that the party with the Capital “Trust” is positioned as a guarantor of cooperation dalan management of agricultural products. The repositioning is allowed in muamalah activities in accordance with the rules of jurisprudence made by fuqaha: “the change of fatwa due to changes in time, place, circumstances (intention) and Customs.” By repositioning, Islamic law becomes dynamic within the scope of muamalah, and is able to adapt, so that Islamic law is op tu date in accordance with the Times and needs of the community.

Abstract

This research is based on the fact that injustice is experienced by motorcycle drivers working as couriers for online food delivery (OFD) services. Restaurants and OFD drivers hold very weak positions and are exploited by OFD companies through mechanisms such as the rating system, fake orders, and unfair profit sharing. In this study, the author aims to explore the characteristics of al-‘uqūd al-murakkabah (composite contracts) in online food delivery services. Several characteristics of OFD services based on al-‘uqūd al-murakkabah found in this research are as follows: 1) The contract subjects are the consumers and the service providers, 2) The three service providers are united in a syirkah abdān (partnership of labor), 3) The involved contracts include syirkah abdān, sales (bayʿ), agency (wakālah), and lease (ijārah), 4) Profit distribution is conducted through a revenue-sharing system.

Abstract

  The rapid evolution of information technology has catalyzed a paradigm shift in notarial services through the emergence of the cyber notary concept. Nevertheless, its integration into the Indonesian legal system remains obstructed by concerns over legal certainty and the stringent demands of the notary's duty of care or prudential principle. The objective of this research is to evaluate the regulatory framework of cyber notary in Indonesia, scrutinizing its execution through the lens of legal certainty and the adherence to the prudential principle in electronic notarial acts. Adopting a normative juridical methodology, this study utilizes statutory, conceptual, and comparative perspectives, supported by a qualitative analytical framework. The results indicate that the regulation of cyber notary in Indonesia remains incomplete and creates ambiguity concerning the validity and evidentiary strength of electronic notarial deeds. Furthermore, the prudential principle of notaries has expanded in the digital context, encompassing electronic identity verification, system security, and data protection. Therefore, regulatory reform, harmonization of laws, and enhancement of notarial competencies are necessary to ensure the proper implementation of cyber notary, providing legal certainty and adequate protection for all parties involved.   ABSTRAK Perkembangan teknologi informasi telah mendorong transformasi dalam praktik kenotariatan melalui konsep cyber notary. Namun, implementasi konsep ini di Indonesia masih menghadapi berbagai permasalahan, terutama terkait kepastian hukum dan penerapan asas kehati-hatian notaris. Penelitian ini bertujuan untuk menganalisis pengaturan cyber notary dalam sistem hukum Indonesia, mengkaji implementasinya dari perspektif kepastian hukum, serta menelaah penerapan asas kehati-hatian notaris dalam praktik digital. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan, serta dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa pengaturan cyber notary di Indonesia masih belum komprehensif dan menimbulkan ketidakjelasan terkait keabsahan serta kekuatan pembuktian akta elektronik. Di sisi lain, asas kehati-hatian notaris mengalami perluasan makna dalam konteks digital, yang mencakup verifikasi identitas elektronik, keamanan sistem, serta perlindungan data. Oleh karena itu, diperlukan reformasi regulasi, harmonisasi peraturan perundang-undangan, serta peningkatan kompetensi notaris guna mewujudkan implementasi cyber notary yang menjamin kepastian hukum dan perlindungan bagi para pihak.
