Abstract

Anak berkebutuhan khusus di kecamatan wera oleh sebagian masyarakatnya di anggap sebagai anak yang berkekurangan baik dari fisik maupun keterbelakangan mentalnya, sehingga menimbulkan perlakuan yang tidak adil terhadap anak berkebutuhan khusus terlebih dari segi warisan, anak berkebutuhan khusus tetap mendapatkan warisan peninggalan orang tuanya tetapi tidak diberikan sesuai dengan bagian yang seharusnya sesuai dengan syariat islam. Jenis penelitian ini adalah penelitian Hukum Empiris yaitu penelitian yang dilakukan langsung dengan instrumen penelitian berbentuk wawancara terhadap para orang tua serta wali dari anak berkebutuhan khusus, tujuan peneliti melakukan penelitian ini agar peneliti memahami dan mengetahui sepenuhnya bagaimana perlakuan orang tua atau wali anak berkebutuhan khusus dalam memenuhi serta memberikan hak yang harus di dapatkan oleh anak berkebutuhan khusus. Di Kecamatan Wera Kabupaten Bima orang tua dan wali dari anak berkebutuhan khusus masih memiliki pemahaman yang minim mengenai anak berkebutuhan khusus, sehingga dalam pembagian warisannya tidak diberikan dengan adil walau seperti itu dalam proses pengelolaan harta warisan dari anak berkebutuhan khusus tetap diterapkan sesuai dengan ketentuan dalam islam, yaitu menggunakan warisan itu untuk keperluan anak berkebutuhan khusus.

Abstract

Jenis penelitian dalam penelitian ini adalah penelitian lapangan yang dilakukan dengan pengamatan langsung dilokasi penelitian dan objek yang diteliti.Peneliti menggunakan metode empiris karena ingin mengkaji dari segi kejadian dilapangan. Selain itu penelitian ini menggunakan pendekatan yuridis normatif yaitu pendekatan yang dilakukan berdasarkan bahan hukum utama dengan cara menelah teori, konsep, asas hukum serta peraturan perundang-undangan yang berhubungan dengan kasus ini. Penelitian ini tidak hanya bergantung pada teori atau doktrin hukum, tetapi juga pada fakta-fakta yang ada dalam situasi nyata. Implikasi hukum terhadap hak anak dalam pemalsuan kartu keluarga bahwa perbuatan mengubah/menambah/mengurangi isi dokumen dalam kartu keluarga(KK) dapat dikategorikan sebagai tindak pidana pemalsuan surat. Dalam KUHP baru yaitu UU 1/2023 pasal 391, setiap orang yang membuat secara tidak benar atau memalsu surat jika penggunaan surat tersebut dapat menimbulkan kerugian karena pemalsuan surat, maka dengan pidana penjara paling lama 6 tahun atau pidana denda paling banyak 2 miliar.

Abstract

The number of MSME players who market their products using traditional methods and MSME players in sila are still lacking in integrating Islamic economic principles in implementing digital marketing such as honesty, social justice, and gharar in online transactions which make it difficult for MSME players to reach a wider market. So this research aims to find out the Implementation of Digital Marketing as a Marketing Strategy to Increase the Competitiveness of Fashion MSMEs in Sila Islamic Economic Perspective. This research will be conducted in Sila, Bima Regency, West Nusa Tenggara. This research uses Qualitative Research with a Descriptive Approach. Data Collection Techniques are Observation, Interview and Documentation. Data Analysis Techniques are Data Reduction, Data Presentation and Conclusion Drawing. Based on the results of this study, Digital marketing has proven to be an effective tool to increase the competitiveness of fashion MSMEs in Sila, both in terms of increasing sales, brand awareness, and market reach.

Abstract

In addition to exploring the impact of Islamic family culture on the societal phenomena of underage marriage, this research seeks to ascertain the legal ramifications of making underage marriages lawful.  This research takes a descriptive qualitative tack, gathering information by methods such as participant observation, in-depth interviews, and document reviews.  The study's findings show that underage marriage in PAI Village, Wera District, Bima Regency, is a multi-faceted issue affected by many economic, social, cultural, and legal viewpoints. This practice has multidimensional impacts, including the breakdown of education, economic hardship, and health risks for mothers and babies. A holistic approach that integrates economic empowerment, religious education, and changes in social norms is needed to address this issue and build a sakinah family.

Abstract

This study aims to analyze the understanding and practices of the Sambori community in inheritance distribution and dispute resolution, with a particular focus on the interaction between Islamic law and customary law. Using a qualitative empirical approach, data were collected through observation, in-depth interviews with religious leaders, community leaders, and village officials, as well as documentation. The findings reveal that although many members of the Sambori community are familiar with Islamic inheritance principles, they tend to adopt customary practices in distribution, as these are considered more flexible and capable of preserving family harmony. Inheritance disputes are typically resolved through family deliberation and mediation by religious or traditional leaders before resorting to the religious court. Customary law, transmitted across generations, continues to dominate the inheritance process, although there is a growing tendency, particularly among the younger generation, to adopt Islamic law. These findings highlight a dynamic interplay between religious norms and local cultural values, leading to a hybrid inheritance model within the Sambori community. It can be concluded that inheritance distribution in Sambori is not merely a legal matter but also a reflection of the community’s social, cultural, and religious values.

the lack of public knowledge about Islamic banks so that many experience misperceptions in the sharia values that exist in these Islamic banks.... So this research aims to find out the Public Perception of Islamic Banking (Case Study in Mbawa Village, Donggo District, Bima Regency). This research will be conducted in Mbawa Village, Donggo District, Bima Regency, West Nusa Tenggara. This research uses Qualitative Research with a Case Study Approach. Data Collection Techniques are Observation, Interview and Documentation. Data Analysis Techniques are Data Reduction, Data Presentation and Conclusion Drawing. Based on the results of the study, it can be concluded that this research shows that the perception of the Mbawa Village community towards Islamic banking is still at the initial stage of understanding, where most people have a positive view of the existence of Islamic banks, although they do not fully understand the underlying principles. Basic concepts such as the prohibition of usury, the profit-sharing system, and contracts in financial transactions have not been fully understood in depth.

Abstract

This study will examine the impact of broken home families on children's behaviour. The effect of a broken home family condition can be analysed by observing a person's patterns and attitudes in daily activities. The observation procedure used is library research, using sources such as journals, books, and e-books relevant to this article's topic. In the analysis process, data is reviewed through the stages of review, sorting, grouping, and categorising to understand the impact of broken home families on children in increasing criminal cases in the community. The results showed that there are impacts of broken home families, including psychological effects that affect children's social life, children's knowledge of the criminal world, and spiritual effects that affect their religious behaviour.
