Abstract

Law enforcement against violations of similar trademark rights by business actors is an important issue in the protection of Intellectual Property Rights in Indonesia. Trademarks function as a special identity for products or services offered by business actors. However, there are still many trademark violations that occur, which are detrimental to registered trademark owners and disrupt healthy business competition. This study aims to identify the forms of trademark infringement that are essentially the same in trademark cases in Indonesia. This study is a descriptive study. Using a normative legal approach method. Conducted by means of literature study. The results of the study show that violations often occur in the form of using names, logos, or displays that resemble registered brands, including invisible brands and three-dimensional brands, which can cause confusion in the community. To overcome this, concrete steps are needed such as improving legal regulations, strengthening the role of law enforcement officers, and providing education to the community and business actors about the importance of brand protection. In addition, the implementation of a digital system in brand registration and supervision can also help improve transparency and efficiency. With a more targeted approach and cooperation between parties, brand rights protection is expected to be stronger, so that it can support healthy business competition and provide legal certainty for brand owners.

Abstract

Penelitian ini bertujuan mengkaji integrasi kewajiban adat dalam perspektif hukum adat Batak dengan sistem hukum pidana Indonesia, khususnya dalam penanganan anak yang berkonflik dengan hukum. Penelitian ini menggunakan metode sosiologis/empiris dengan pendekatan kualitatif untuk menelaah penerapan kewajiban adat sebagai pidana tambahan dalam praktik sosial masyarakat Batak serta relevansinya dengan prinsip keadilan restoratif. Hasil penelitian menunjukkan bahwa pidana tambahan berupa pemenuhan kewajiban adat hanya dapat dijatuhkan dengan mempertimbangkan asas kepentingan terbaik bagi anak, proporsionalitas, dan nondiskriminasi. Anak harus diperlakukan sebagai individu yang sedang tumbuh dan berkembang, sehingga membutuhkan pendekatan korektif dan restoratif. Dalam konteks hukum adat Batak, praktik seperti mangampu, marhata sinamot, dan pemberian tudu-tudu sipanganon mencerminkan penerapan keadilan restoratif yang menekankan pemulihan sosial dan kesadaran moral. Relevansi kewajiban adat sebagai pidana tambahan sangat tinggi karena selaras dengan nilai partisipasi komunitas, dialog, dan penghindaran stigma. Namun, belum adanya kerangka hukum nasional yang komprehensif mengenai pelaksanaan sanksi adat menjadi tantangan dalam implementasinya, sehingga diperlukan harmonisasi antara pranata hukum adat dan hukum negara agar kewajiban adat dapat diinstitusionalisasikan sebagai instrumen hukum yang humanis dan berkeadilan.

Abstract

Penelitian ini mengkaji perlindungan hukum bagi Aparatur Sipil Negara (ASN) yang mengalami mutasi tidak adil, dengan studi kasus Putusan Nomor 4/G/2024/PTUN.PBR. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan studi kasus. Hasil penelitian menunjukkan bahwa mutasi yang melanggar asas-asas umum pemerintahan yang baik, seperti asas keadilan, kepastian hukum, dan kecermatan, dapat dibatalkan oleh pengadilan tata usaha negara dan ASN yang bersangkutan dikembalikan ke posisi semula. Penelitian ini menekankan pentingnya prinsip keadilan, transparansi, dan mekanisme pengawasan dalam pelaksanaan mutasi ASN, serta peran pengadilan sebagai kontrol yudisial terhadap keputusan pejabat administrasi. Perlindungan hukum ini tidak hanya melindungi hak individual ASN tetapi juga mendorong terciptanya sistem kepegawaian yang profesional, objektif, dan bebas dari praktik merugikan, sehingga kebijakan mutasi dapat dijalankan secara adil dan akuntabel.

Abstract

This study examines the legal protection of the executorial rights of separatist creditors as holders of security rights in credit agreements when the debtor is declared bankrupt. As separatist creditors possess preferential rights over certain collateral objects, the implementation of their executorial rights often faces legal and procedural challenges in bankruptcy proceedings. The research analyzes the legal framework provided by Indonesian bankruptcy law, particularly concerning the position and priority rights of secured creditors. It also evaluates judicial practices and obstacles encountered during the execution of collateral. The findings highlight the importance of strengthening legal certainty and protection for secured creditors to ensure the fair enforcement of their rights without undermining the principles of bankruptcy distribution and debtor rehabilitation. Recommendations are proposed to harmonize the execution process with creditor protection mechanisms in insolvency law.

Abstract

The digital economy era has brought significant transformations in the business world, including in the aspect of corporate debt management. In the context of bankruptcy, the traditional approach that tends to focus on the liquidation of corporate assets has begun to be replaced by the peace model through debt restructuring. This approach aims to provide an opportunity for companies experiencing financial difficulties to recover and contribute to the economy. This study aims to analyze the legal aspects of bankruptcy peace through corporate debt restructuring, especially in the digital economy era. The main focus is to identify the applicable legal framework, challenges faced, and opportunities offered by digital technology in the debt restructuring process. The research method used is normative juridical with a conceptual approach and analysis of relevant regulations, including the Bankruptcy and Suspension of Debt Payment Obligations Law (PKPU) in Indonesia. The results of the study indicate that the peace mechanism through debt restructuring has great potential to increase the efficiency and effectiveness of bankruptcy dispute resolution. In the digital era, technologies such as blockchain and digital platforms can be used to increase transparency, accountability, and speed of the restructuring process. However, the implementation of this technology faces challenges, including a lack of specific regulations, data security risks, and resistance from traditional stakeholders.

Abstract

This type of research is analytical descriptive, which aims to describe legal phenomena related to bankruptcy peace and debt restructuring in the digital economy era, then analyze them based on legal theory and practice in the field. Bankruptcy is regulated in Law no. 37 of 2004 concerning Bankruptcy and Postponement of Debt Payment Obligations (PKPU). In this framework, peace is one solution to avoid total liquidation of company assets, with a focus on debt restructuring and paying off obligations to creditors. Based on a literature review, peace is considered more effective than liquidation because it gives the company the opportunity to recover and continue operating. The legal aspects of bankruptcy peace through debt restructuring are very relevant in the digital economy era. However, to answer the new challenges faced by companies and creditors, Indonesia needs a legal framework that is more adaptive, dynamic and responsive to technological developments. A collaborative approach between regulators, business players and other stakeholders is the key to creating a legal ecosystem that supports the sustainability of the digital economy.
