Abstract

ABSTRACT Tania Yosefin Agustina Silalahi * Dr. Sutiarnoto, SH. M.Hum ** Prof. Dr. Suhaidi, SH. M.H *** The international community for the first time raised the agenda in international relations which was marked by the holding of the United Nations (UN) convention in 1972 in Stock Holm, Sweden as an early milestone in saving the environment globally. The Montrea Protocol Convention; 1987 was formed due to the industrial revolution that occurred on a large scale, especially in European countries. In its agreement the Montreal Protocol has been revised 7 times, including in 1990 in London, 1991 in Nairobi, 1992 in Copenhagen, 1993 in Bangkok, 1995 in Vienna, 1997 in Montreal and 1999 in Beijing. It is believed by the international community that layers of ozone are expected to recover by 2050. Some of the ozone-depleting substances controlled by this agreement include CFC (Cholorofluorocarbon), Hallon, Tetrachlorite, Methyl Chlorofome, Hydro, Cholorofluorocarbon (HFC) and Methyl Bromide. The aim of this agreement is to realize that emissions worldwide can significantly deplete and reduce the ozone layer which impacts on human health and the environment, determined to protect the ozone layer by taking precautions to control global emissions. This agreement has been ratified by the Republic of Indonesia since 1992 with Presidential Decree No. 23 of 1992. In this case the Montreal protocol is one of the agreements responsible for the recovery of the ozone layer. This research is a normative legal research. To obtain accurate and in-depth data as desired by referring to the nature of the assessment developed in this research, data collection techniques are used through literature study where the data is collected through books, journals or writings or scientific articles. The results of this study indicate that around the 1970s environmental issues were considered and for the first time were raised as an agenda in international relations which was marked by the convening of the United Nations Conference (UN) in 1972 in Stockholm Sweden which was the first milestone in saving the environment globally. The 1987 Montreal Protocol has been revised seven times and has been ratified by 196 countries. The position of the 1987 Montreal Protocol in this agreement was made as a bulwark in controlling ozone depleting substances and replacing them with safer materials. This agreement is designed to implement climate change which aims to stabilize the concentration of greenhouse gases that are expected to tackle the greenhouse effect in preventing, depletion of the ozone layer which is expected to be better. Indonesian prospects after implementing the Montreal 1987 Protocol will bring many opportunities for Indonesia, in terms of environment, the ozone layer will increasingly recover and the side effects of ozone layer depletion such as UV-B rays will be reduced, not only in terms of the environment, good prospects will arise in terms of the economy where local companies switch to environmentally friendly technology or green industry will be more many innovations to be able to compete in the market Keywords: Ozone, Greenhouse Effect and Ozone Layer Depletion * University of North Sumatra University Faculty of Law students ** First Advisor of the Faculty of Law, University of North Sumatra *** Supervisor II of the Faculty of Law, University of North Sumatra

Abstract

PERAN INTERNATIONAL ORGANIZATION FOR MIGRATION (IOM) DALAM MENGATASI PERDAGANGAN MANUSIA DI INDONESIA Vira Dwi Utami ABSTRAKSI Penelitian ini bertujuan untuk mengetahui peran yang dilakukan oleh organisasi internasional yaitu International Organization for Migration (IOM) dalam mengatasi perdagangan manusia di Indonesia. Selanjutnya untuk mengetahui bagaimana kondisi perdagangan manusia di Indonesia dan upaya perlindungan hukum yang diberikan kepada korban perdagangan manusia ditinjau dalam hukum nasional Indonesia. Sedangkan kegunaan dari penelitian ini adalah untuk menambah wawasan bagi pembaca mengenai kejahatan perdagangan manusia yang banyak terjadi di wilayah Asia Tenggara khususnya Indonesia. Perdagangan manusia merupakan kejahatan serius yang harus ditangani. Indonesia yang wilayahnya berbatasan langsung dengan negara tetangga, baik jalur darat maupun jalur laut menyebabkan kejahatan seperti perdagangan manusia terjadi di banyak daerah. Hal ini disebabkan karena pelaku perdagangan manusia tidak mendapat kesulitan atau hambatan untuk masuk dan keluar dari negara tersebut ke satu negara lain untuk melakukan kejahatan. Metode penelitian yang digunakan adalah yuridis normatif dengan dilakukan penelitian kepustakaan guna memperoleh data-data sekunder yang dibutuhkan yang meliputi bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier yang dibutuhkan dalam penelitian ini. Hasil penelitian ini disajikan secara deskriptif juga memperoleh penjelasan dari masalah yang dibahas. Hasil penelitian menunjukkan bahwa IOM merupakan subjek hukum internasional yaitu organisasi internasional di bawah PBB dan merupakan bagian dari organisasi internasional antar pemerintah yang bersifat semi otonom dan memiliki badan pengatur sendiri. Perkembangan IOM di Indonesia juga berjalan dengan baik ditunjukkan dengan kerjasama yang dilakukan IOM dengan Indonesia dimulai pada tahun 1979 saat penanganan migran Vietnam yang tiba di pelabuhan Tanjung Pinang. Namun peran IOM dalam mengatasi perdagangan manusia di Indonesia dinilai masih kurang efektif. Hal ini disebabkan karena peran IOM tidak secara langsung mengatasi inti dari masalah perdagangan manusia. IOM hanya bertindak sebagai kemitraan dengan pemerintah Indonesia dengan membantu para korban perdagangan manusia melalui pengembalian para korban, pemulihan dan Pendidikan.   Kata Kunci: IOM, Peran IOM, Perdagangan Manusia

Abstract

The purpose of this paper is to review and analyze legal provisions in the case of a decision on a debtor's bankruptcy statement against creditors, to review and analyze legal remedies that can be taken by creditors in the event that the debtor's asset value has not been able to pay off debts to creditors and To review and analyze the legal consequences of bankruptcy statements by debtors in the Decision of the Commercial Court of the Central Jakarta District Court Number 12 / PAILIT / 2012 in conjunction with the Decision of the Supreme Court No.443K / Pdt. Sus / 2012. This type of research is normative legal research. Data analysis is the process of organizing and sorting data into categories and basic description units, so that themes are found and work hypotheses can be formulated, as suggested by the data. The data analysis was done qualitatively. With associated research objectives. The results showed that the legal provisions in the stipulation of a decision on a debtor bankruptcy statement against creditors are regulated in Law Number 37 of 2004, namely in article 2 paragraph (1), which explains that the requirements for filing a bankruptcy application are two or more creditors and have not paid off the minimum debt. against one creditor and the debt is due. Legal remedies that can be taken by creditors in the event that the value of the debtor's assets has not been able to pay off the debt to the creditor is to bankrupt the new business of the debtor if the debtor is still in default and does not pay off the debt even though it has been collected properly before.

Abstract

Tujuan penelitian ini adalah untuk mengkaji dan menganalisis pengaturan Praperadilan di dalam KUHAP dan pengaturan Praperadilan berdasarkan Putusan Mahkamah Konstitusi. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif yaitu penelitian yang mengacu kepada norma-norma dan asas-asas hukum yang terdapat dalam peraturan perundang-undangan dan putusan pengadilan. Hasil penelitian menunjukkan bahwa Wewenang Praperadilan dalam sejumlah ketentuan KUHAP hanya disediakan oleh Undang-undang untuk menguji “sebagian” kewenangan Penyidik dalam melakukan Penyidikan dan “sebagian” kewenangan Penuntut Umum dalam melakukan penuntutan, yaitu penangkapan, penahanan, penggeledahan, penyitaan, penghentian Penyidikan, penutupan perkara demi hukum, dan penghentian penuntutanBerdasarkan Peraturan Praperadilan di dalam KUHAP berdasarkan Pasal 77 sampai dengan Pasal 83 KUHAP mempunyai unsur-unsur yang mengatur tentang kewenangan atau objek Praperadilan adalah: 1) kewenangan pengadilan negeri untuk memeriksa dan memutuskan sah atau tidaknya penangkapan, penahanan, penghentian, Penyidikan atau penghentian penuntutan; dan ganti kerugian atau rehabilitasi bagi seseorang yang perkara pidananya dihentikan pada tingkat Penyidikan atau penuntutan.

Abstract

ABSTRAK The peace process in the various Arab countries is still the world spotlight until now. Usually the conflict that often occurs between Arab countries is to end the leadership of an authoritarian state because it has served for decades, one of which is Libya (Muammar Gaddafi as head of state for 43 years). NATO as an international organization in the field of security played a role in the settlement of the conflict in Libya. The participation of NATO towards peace mediator Arab countries, it has many other important missions for the internal purposes of NATO. Israel (pro-Western) has always been the core issue of the state (pro-Arab) others. However, Gaddafi who issued an ultimatum to attack the U.S. and its allies to make Libya a target attack western countries (Article V of the NATO Treaty). NATO attacked Libya on grounds of violation of human rights in accordance with the UN Security Council. 1970 and 1973 Articles 39, 41 and 42 which further aggravate the situation. Article 33, which contains about 2 ways of resolving disputes should be taken by NATO. Libya is now having problems after the incident that Gaddafi elections, minimize violence and promoting human rights in order to build a democratic state and national unity.

Abstract

ABSTRACT This study entitled "Study on cooperation Internastional Criminal Police Organization (ICPO-INTERPOL) with the police in capturing criminals who escaped out of the country". The problem to be answered in this study is how the position of ICPO-INTERPOL in International Law and how its authority to cooperate with the POLRI, and then to understand why the return of escaped criminals out of the country often run into obstacles. The issue is expected to be answered by using the method of normative research which refers to the legal norms contained in legislation and court decisions and legal norms in society. The main data used are secondary data collected through the study of literature methods or documents. While the primary data collected from the Convention and legislation relating to the object of research. The data that has been obtained is qualitative data will be analyzed and the analysis of primary data and secondary data from a qualitative point of view of jurisprudence. Through the techniques of data collection and data analysis of this study is expected to achieve the desired goal, which is to determine the position of ICPO-INTERPOL in international law, ICPO-INTERPOL knowing authority in cooperation with the police and understand why the return of criminals fleeing abroad often experience barriers.

Abstract

Abstract The writing is on the backs by setting the legal protection and responsibilities of civil passenger aircraft accident within the scope of international law, the problem is how the civil aviation, legal protection of civilian passengers, airline liability for passenger aircraft accidents. It is necessary to set up an arrangement of the flight. Abstract

ABSTRACT The trans-national criminal that passes the national border only can be caught by authorized law officer and one of them is Interpol. ICPO-Interpol as organization of Police in the world has a National Central Bureau (NCB) in each state as member. The existence of NCB or its representative in each state will enable the police performance in seek, and arrest the international fugitive. The method of this research is a descriptive analytic method and applies the normative law approach refer to the law norm, especially the international law norm and described into the general section to the specific section based on the primary law, secondary law material and tertiary law material. The data was collected by library study. In seek and arrest the transnational criminal needs a mutual cooperation between polices in any nations. The mutual cooperation between Indonesian Interpol and Malaysia in eradicate the transnational crime enforced in three agreements. First, the extradition contract between Republic of indonesia and Government of Malaysia that validated in Act No. 9 of 1974. Second, is a mutual agreement in criminal code or that known as Mutual Legal Assistance in Criminal Matters (MLA). Third, it is a Memorandum of Understanding between the Government of Republic of Indonesia and Malaysia about the narcotic. Although a mutual cooperation between Interpol of Indonesia and Malaysia had enforced in an agreement, but the agreement is not yet effective, because there are many weakness on the agreement. Therefore, an effective cooperation between both of nations is an informal cooperation through diplomatic relations. Keywords : Interpol, Mutual cooperation , Interpol of Indonesia

Abstract

ABSTRAK The development of technology and knowledge is one of the essential factor that gives a big impact to the development of international law. Just like the two edges blade, every development of each aspect have it: technology and knowledge or the international law it self have negative and positive impact. As we know the development of air law as one of the branch of international law study already gain enormous attention. Air law become one of the great development of international law, just like the law of sea. The existence of each states is beyond imagination before the air law was exist, with the presence of air law every states have a clear rights on airspace beyond theirs land it self. With the help of technology development, the control of air space is rely on radar technology (Radio Detection and Ranging). Radar system is using the electromagnetic pulse to detect, measure the distance and mapping the object such as aircraft position, land vehicle shape and the climate/weather changes information. As far as we can see radar technology is used as the detector to possibly illegal infiltrator aircraft to a state air space. But the development of technology aircraft give a born to a new technology, this new technology will be the antigen or opposing side of radar technology. This new technology is: Stealth Fighter system, Stealth fighter is one of the best development of military technology. Stealth fighter have ability to disappear from the detection of radar. Stealth fighter very ideal when it’s used to infiltrate an area of the state without noticeable. The presents of this technology give a threat to the air space jurisdiction of the state. In order to keep the existence of airlaw, must be there a regulation about stealth fighter it self.

Abstract

ABSTRACT A country needs to make contact with each other based on the national interests of each country are related to each other, among others, include the economic, social, cultural, legal, political, and so forth. With an association constant and continuous between the nations of the world, is one of the conditions of the existence of the international community. One form of cooperation between the countries in the world is in the form of international relations by putting diplomatic representatives in various countries. These representatives have the right diplomatic immunity and privileges of diplomatic immunity to the law of the jurisdiction of the receiving country as well as both civil and criminal immunity to witnesses. Thesis writing, entitled Review of International Law Against Diplomat Conducting Illegal Actions Associated with Diplomatic Immunity elaborated on how the law on abuse of diplomatic immunity, how the actions of a country against the abuse of diplomatic immunity and how the analysis of several cases of abuse of diplomatic immunity. To answer the problems that used normative law through the use of secondary data, such as books, legislation, books on financing agreements, and research results related to this research topic. Based on the results of the study explained that cases of violation of diplomatic relations that occurred in the period 1961 until now is the number of violations were related to the personal immunity of diplomatic missions and diplomatic representatives of the building violations. Some cases such as wiretap News Agency of the Republic of Indonesia (Embassy) in Myanmar and the case of slavery which made the German Ambassador to Indonesia citizens in Saudi Arabia became a serious concern. The existence of diplomatic immunity is considered as a protection to the perpetrators go unpunished. Action against abuse of diplomatic immunity recipient country can do eviction or persona non grata on diplomatic missions, in which it set in the Vienna Convention in 1961. Actions taken by one country against the abuse of diplomatic immunity is a form of action against the self-expulsion of the foreign diplomatic representatives. This is because of the immunity rights inherent in every foreign diplomatic representatives.
