Abstract

Tujuan penelitian ini adalah untuk mengetahui bagaimana proses penyelesaian sengketa hak atas tanah melalui mediasi dan apa saja hambatan proses penyelesaian sengketa hak atas tanah melalui mediasi di Kantor Pertanahan Kota Padangsidimpuan. Dengan menggunakan metode penelitian yuridis empiris, yaitu suatu penilitian disamping melihat aspek hukum positif juga melihat pada penerapannya atau praktek dilapangan dalam hal ini pendekatan tersebut digunakan untuk menganalisis secara kualitatif tentang penyelesaian sengketa hak atas tanah melalui mediasi di Kantor Pertanahan Kota Padangsidimpuan. Dari hasil penelitian dan pembahasan diperoleh kesimpulan bahwa prosedur atau tata cara penyelesaikan sengketa yang dilakukan oleh Kantor Pertanahan meliputi tahap (1) pra mediasi, (2) mediasi. Dalam penyelesaian sengketa hak atas tanah di Kantor Pertanahan Kota Padangsidimpuan memiliki beberapa hambatan-hambatan, yaitu (1) adanya kendala dari pihak yang bersengketa seperti, ketidakhadiran para pihak untuk memenuhi undangan untuk melakukan mediasi (2) tidak ada iktikad baik dari masing-masing pihak (3) perbedaan kemampuan dan pendidikan di antara para pihak (4) aturan yang dianggap memperlambat proses penyelesaian sengketa (5) pengadu sering kali tidak mengetahui persyaratan dan prosedur penyelesaian sengketa di Kantor Pertanahan Kota Padangsidimpuan.

Abstract

This study aims to examine the obstacles and role of the Village Government in the mediation process of family inheritance disputes in Sitampa Simatoras Village, Batang Angkola District, South Tapanuli Regency. Land inheritance disputes often cause internal family conflicts that disturb public peace. This study uses a normative and qualitative approach with primary data through interviews and secondary data from literature and laws and regulations. The results of the study show that the Village Head has an important role as a mediator in resolving disputes, but faces various obstacles. The main obstacles include the emotional attitude of the parties to the dispute, the lack of written evidence and witnesses, the low legal knowledge of the village government, and the lack of standard guidelines on mediation mechanisms at the village level. Even so, the Village Head still tries to carry out his role by bringing together the parties and involving traditional leaders to reach a peace agreement. If mediation fails, then the Village Head suggests a settlement through legal channels. This research emphasizes the importance of strengthening the legal capacity of village governments and the need for clearer regulations regarding the implementation of mediation at the village level as a preventive effort to resolve family-based agrarian conflicts.

Abstract

This study aims to examine the practice of elopement (kawin lari) and its legal consequences from the perspective of Batak Angkola customary law, as well as its relation to Law Number 1 of 1974 on Marriage. The research was conducted in Sibangkua Village, Angkola Barat District, South Tapanuli Regency. The method used is an empirical legal approach, with data collected through observation and interviews with traditional leaders, religious figures, village officials, and individuals involved in elopement. The findings reveal that elopement frequently occurs in Batak Angkola society, mainly due to high dowry demands, disapproval of arranged partners, or violations of social and religious norms. The resolution process is carried out through customary stages such as mandokon ulang agoan, marsapa adat, and patibal sere. Although the national marriage law does not explicitly regulate elopement, it is recognized within Batak Angkola custom and has a structured resolution mechanism. Nevertheless, socially, elopement is often viewed negatively and may damage the family’s honor.
