Abstract

The crime of violent theft is the act of a person to injure the victim with the aim that the goods taken remain in the victim's power. Batam State Prosecutor is an agency engaged in law enforcement under the mandate of the "Prosecutorof the Republic of Indonesia" which gives orders and authorities in responding to prosecutions, implementing court rulings, and other authorities. The purpose of this writing will be to understand the role of prosecutors in handling cases of "violenttheft study number: 578 / Pid.B / 2021 / PN" Btm. The author uses primair data and secondary data with observation and interview methods in conducting this study. Prosecutors are guided by standard operating procedures (SOP) "Attorney GeneralRegulation No: PER-036-A / JA / 09/11" in accordance with positive law applicable in Indonesia in examining the case file of common criminal acts, especially violent theft.

Abstract

At this time it is not uncommon for people to commit criminal acts, someone committing a criminal act must have certain reasons, for example economic factors accompanied by an element of compulsion. Of the various crimes that occur in society, one of them is the crime of counterfeiting, even today it is often found the crime of counterfeiting in various forms and developments that show the intellectual level of counterfeiting crimes that are increasingly complex. Here the author wants to make how the law enforcement process against criminal cases of falsification of letters, explain what the role of the prosecutor in enforcing the law against the criminal falsification of letters and what the author did during his internship in the batam state prosecutor's office. The author in working on this writing the author uses observation methods that are carried out systematically. In this case, the author visits the observation site to observe various things or conditions that exist at the scene. At the time of the internship in the batam state prosecutor's office, the author can learn how the prosecutors act in resolving the case reported by investigators until the trial process even until the case is broken.

Abstract

Every business basically has to be legally licensed. Not only for large-scale businesses, but also for micro, small and medium enterprises. To establish Micro, Small and Medium Enterprises (MSMEs), entrepreneurs must have a license. The licensing that must be taken is adjusted to the types of MSMEs that you want to establish. The application for an industrial business license cannot be separated from the licensing system that applies in a government. The convoluted licensing system not only makes it difficult for applicants but also illustrates how badly the current system is. Licensing management using a bad system will have a negative impact both in administrative and technical terms. The purpose of this problem was raised into a writing, namely, to be able to provide an explanation and understanding of the importance of legal understanding for prospective entrepreneurs who want to make legality in Batam City because of the importance of an acknowledgment or legality from the Government in order to illustrate legal certainty. The benefits of having this activity carried out are, the author himself hopes that entrepreneurs in Batam City can understand the various ways in which the application process for making food MSME business permits online. This research is a legal research (juridical research) which has a method that is different from other research. The legal research method is a systematic way of conducting a research. The results of the output design are in the form of a Business License, NIB Letter (Business Registration Number) and Business Permit Attachments. Where in the business license it contains "the provisions of Article 31 of Government Regulation Number 24 of 2018 concerning Electronically Integrated Business Licensing Services.

Abstract

Rapid technological developments have brought changes, especially in the judiciary. Online case registration are using e-court services in which its services is issued by the Supreme Court in accordance with the provisions of Supreme Court Regulation Number 3 of 2018 Regarding of Cases Administration. The purpose of establishing an e-court is to realize the principles of justice in a simple, fast, and low-cost manner. Besides being able to do case registration online, e-courts are capable to summon litigants online get an up-front assessment of court fees directly, pay down-payment fees online by getting a SKUM (payment statement letter) and a Virtual Account Bank. The purpose of writing this article is to find out how to register a divorce lawsuit using e-court services within the Religious Courts and find out what obstacles occur when registering cases through e-court services. The implementation method used by the author is normative juridical with the identification of problems that occur in a comprehensive integrative manner, the data analysis used is qualitative analysis with secondary data studies. The results of this study will show how the procedure for registering cases through e-court services at the Religious Courts Batam Class 1-A

Abstract

This study was conducted to analyze the determination of the Batam District Court Number 245/Pdt.P/2021/PN.BTM regarding the guardianship of minors in buying and selling houses carried out by the heirs. The problem used in writing this article is about the implementation and accountability of guardianship in buying and selling houses due to inheritance, the judge's basic considerations in determining the guardianship of minors in the process of buying and selling houses because it is to finance the life and education of the applicant's child. The research method used by the author in this study is an empirical juridical approach, this juridical approach is carried out to examine various laws and regulations related to the determination of child guardianship on the responsibility of parents in buying and selling houses due to inheritance. An empirical approach is carried out to see the implementation of parents representing minors for legal actions inside and outside the court

Abstract

The Batam Religious Court Class 1-A is a religious court of the first level which has the authority in certain civil cases for Muslims, one of which is the case for applying for a marriage dispensation. Dispensation is an exception for the prospective bride and groom who are underage to get married. Article 7 paragraph (1) of Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage limits the age of marriage, namely the prospective bride and groom must be 19 years old. However, the fact is that early marriage is a phenomenon that occurs in society. The Office of Religious Affairs (KUA) will reject marriage if the prospective bride and groom are not of the specified age, so the parents of the prospective bride and groom must apply for a marriage dispensation in order to get a court product in the form of a stipulation as a permit for a marriage to take place. The implementation method uses observation techniques, namely by obtaining data in the field, carried out by interviews and collecting library data. The results and outcomes achieved are participation and contribution in the work environment of the Batam Religious Court, knowing and understanding procedures related to the requirements for submitting a marriage dispensation application, being able to serve people who want to have litigation, as well as providing insightful knowledge to the community with the existence of educational posters related to the Marriage Dispensation.

Abstract

The crime of forgery of letters is a crime that essentially contains the essence of untruth or false status of an object. Either that looks from the outside as if it is true when in fact it is very contrary to the real thing or to the truth. The crime of forgery of letters develops in line with things that are happening in the world today, especially during the Covid-19 Pandemic. The reason behind why people want to make a COVID-19 vaccine certificate is that many people want to get the vaccine certificate but don't want to be injected with the vaccine. A COVID-19 vaccine certificate if falsified is very dangerous, it can harm many people, those who have received a COVID-19 vaccine certificate are a sign that they have resistance to the virus. this spreads to a crime on the Vaccine Certificate which is in fact an important thing during the current Pandemic. There are irresponsible parties who commit crimes in the form of issuing Counterfeit Vaccine Certificates in order to benefit themselves but can indirectly harm other people, this is in line with Article 263 of the Criminal Code. In carrying out this research, the author uses a normative juridical method based on a qualitative approach. The author conducts an analysis related to the Juridical Impact of the existence of the Counterfeit Vaccine Certificate by taking into account the Decision of the Panel of Judges in Decision Number: 543/Pid.B/2021/PN Btm. The purpose and benefits of this problem are raised into a writing, namely in order to provide an explanation and understanding of the importance of understanding the law and the author hopes that everyone can understand the crime of this fake letter.
