Abstract

Penelitian ini termasuk penelitian Deskriptif Kualitatif. Tujannya adalah (1) Untuk mengetahui strategi hakim mediator dalam menyelesaikan kasus perceraian melalui mediasi di Pengadilan Agama Kelas 1.A Makassar (2) Untuk mengetahui pandangan masyarakat tentang keberadaan mediasi sebagai jalan mencegah terjadinya perceraian (3) Untuk mengetahui bagaimana efektifitas proses mediasi dalam menangani kasus perceraian di Pengadilan Agama Kelas 1.A Makassar. Variabel penelitian ini adalah Peran Hakim Mediator dalam Mediasi Kasus Perceraian. Populasi penelitian ini adalah berjumlah 23 orang, sampel penelitian ini adalah 3 (tiga) orang sebagai informan sebab hanya 3 (tiga) orang informan dapat dijangkau. Untuk masyarakat yang sedang berperkara, 3 (tiga) orang yang dijadikan sampel yang sedang berada dalam lingkungan Pengadilan Agama Kelas 1.A Makassar. Teknik pengumpulan data yang digunakan adalah teknik wawancara dan dokumentasi. Teknik analisis data yang digunakan adalah teknik analisa data deskriptif kualitatif dimana data yang diperoleh diolah dengan analisa prosentasi. Hasil penelitian ini menunjukkan bahwa. (1) Strategi hakim mediator dalam mediasi kasus perceraian adalah memaksimalkan proses mediasi dengan cara memberikan nasihat serta pertimbangan jika nantinya pasangan suami istri berakhir dengan cerai yang dimana sebelumnya dilakukan kaukus atau penejelasan kepada setiap pihak secara bergantian tentang mediasi itu sendiri. (2) Pandangan masyarakat tentang keberadaan mediasi yakni menanggapnya adalah hal yang baik sebab memberikan pendidikan berupa nasehat dan mengajarkan kerukunan serta masyarakat juga menilai bahwa mediasi di Pengadilan Agama harus tetap ada. (3) efektifitas mediasi di Pengadilan Agama Kelas 1.A Makassar yaitu sangat tidak efektif karena jumlah yang gagal di Mediasi lebih banyak dibanding yang berhasil mediasi.Kata Kunci : Peran Hakim, Mediasi, Perceraian This research was qualitative descriptive. Tujannya is (1) To determine the strategy of judges mediators in settling divorce cases through mediation in the Religious Makassar Class 1A (2) To know the views of people about the existence of mediation as a way to prevent divorce (3) To find out how the effectiveness of the mediation process in handling divorce cases in the Religious Makassar Class 1A. The variables of this research is the role of the Judge Mediator Mediation Divorce Case. The study population was numbered 23 people, samples of this study is three (3) people as informants for only 3 (three) the informant can be reached. For people who are litigants, 3 (three) as the samples which are in Class 1A neighborhood Religious Courts Makassar. Data collection techniques used were interview and documentation. Data analysis technique used is descriptive qualitative data analysis technique where the data obtained is processed by the analysis percentage. The results of this study indicate that. (1) Strategy judge mediator in case of divorce mediation is to maximize the mediation process by providing advice and consideration if later married couples end up with divorce where previously done caucus or penejelasan to each party alternately on mediation itself. (2) The view of the public about the existence of the menanggapnya mediation is a good thing because it provides education in the form of advice and teach harmony and the community is also considered that mediation in the Religious should stay there. (3) the effectiveness of mediation in the Religious Makassar Class 1A which is not very effective because the number that failed in mediation more than a successful mediation.Keywords: Role of Judges, Mediation, Divorce

Abstract

The commitment to Pancasila is being tested again in the midst of the development of science and technology and Society 5.0. The tendency of behavior and the rush of alternative cultures that are not in line with Pancasila must be balanced with efforts to strengthen Pancasila itself. The education sector, especially Pancasila education, is at the forefront of optimizing and preparing participatory human resources, namely graduates who are capable of maintaining national development and maintaining the resilience of the nation's ideology. The current reality shows that Pancasila education is not fully optimal in creating participatory citizens in challenging times. This research was conducted as an effort to strengthen Pancasila depreciation which is more contextual in the curricular domain through project-based learning in Pancasila courses. The type of project-based learning model that is applied is the project citizen model initiated by the Center for Civic Education (2008). This research uses a qualitative approach with a descriptive study design. The research subjects were students of Elementary School Teacher Education Study Program, Faculty of Education, State University of Gorontalo. The determination of research subjects is by purposive sampling technique. Data collection was carried out through observation, literature study, and questionnaires in the form of student response rubrics. The results of the study show that the application of Project Based Learning in Pancasila courses is able to strengthen student sociability as indicated by: (1) stimulating student sensitivity to social and national issues as well as problem solving abilities from class studies (2) students gain experience in Pancasila that is more contextual through direct field visits and carrying out impactful activities; and (3) habituation of research-based learning and research methodology as a form of implementing the Merdeka Belajar Kampus Merdeka (MBKM) education policy.

Abstract

As social beings, humans need morals to organize their lives for the better. Morals can be shaped through parental upbringing and education at school. The formation of morals in each individual is not merely a rational act, but aims to develop human behavior that is conscious of ethics, empathy, and wisdom. One way to shape morals is through moral education aimed at the general public and academics. To develop such morality, Pancasila is used as a foundation. The implementation of moral education based on Pancasila, as emphasized in this study, is achieved through various means such as curriculum, extracurricular activities, learning models, teacher role modeling, and parental role modeling. The values of Pancasila serve as a strong foundation in shaping the morality of the younger generation in today's digital era. Referring to the literature, this article is expected to serve as a reference for universities, schools, and organizations discussing moral education in line with the practice of Pancasila values. For universities, moral education based on Pancasila serves as a platform for developing noble character. For schools, moral education based on Pancasila helps students develop the ability to process emotions and thoughts to distinguish between what is good and what is bad. For organizations, moral education based on Pancasila strengthens understanding of integrity, ethics, and good governance within an organizational context.
