Abstract

Dua buah rembesan minyak bumi diambil dari daerah Torete, Morowali, Provinsi Sulawesi Tengah. Kedua sampel rembesan telah dilakukan analisis GC (gas chromatography) dan GCMS (gas chromatography and mass spectometry). Analisis geokimia biomarker dilakukan untuk mengetahui karakter minyak bumi berupa asal material organik, lingkungan pengendapan, dan tingkat kematangan. Pada kromatogram alkana normal, kedua sampel menunjukkan satu puncak (unimodal) sebelum nC20 dengan rasio Pr/Ph 0,87 dan 0,92. Fragmentogram m/z 217 menunjukkan sedikit dominasi pada sterana C29 dibanding sterana C27 dan sedikit kehadiran dari diasterana. Fragmentogram m/z 191 menunjukkan adanya dominasi pada terpana trisiklik C23 dan terpana tetrasiklik C24 serta kehadiran terpana trisiklik C26+. Pada terpana pentasiklik menunjukkan dominasi Tm terhadap Ts, hopana C29 terhadap hopana C30, kehadiran seri norhopana C30 dan gamaserana, serta homohopana C35 yang sedikit lebih tinggi dari homohopana C34. Biomarker petunjuk tumbuhan tinggi (oleanana dan bikadinana) tidak hadir pada kedua sampel. Hal ini menunjukkan bahwa kedua sampel minyak bumi berasal dari batuan induk karbonat dengan material organik alga, plankton, radiolaria, atau diatom lingkungan pengendapan anoksik-suboksik (lingkungan transisional), dan tingkat kematangan awal matang sampai level matang. Abstract

Usia dewasa yang dianggap cakap dalam hukum masih belum tuntas diperdebatkan. Ketidak seragaman batas usia dewasa yang ada dalam banyak UU dan peraturan menjadikan perdebatan yang terus berlangsung. Secara garis besar setidaknya terdapat dalam ketentuan KUHPerdata Pasal 330 disebut dewasa ketika usia 21 tahun dan UU No. 16 Tahun 2019 tentang Pernikahan disebut dewasa dan diperbolehkan untuk menikah ketika usia 19 tahun. Untuk memecahkan masalah, pendekatan analisis hukum dijadikan sebuah metode dalam proses penyelidikan dan penafsiran hukum yang ada, didalamnya juga berusaha memecahkan masalah hukum, atau menilai kepatuhan suatu tindakan atau kebijakan terhadap peraturan hukum yang berlaku. Hasil dari penelitian ini dengan menitik beratkan pada permasalahan usia dewasa dan komparasi dengan UU No. 16 Tahun 2019 maka usia dewasa dalam banyak literaturan UU memiliki ketentuan masing-masing peyebutan orang yang sudah dianggap dewas atau bukan anak-anak, namun ketika berbicara hukum dan ketentuan mengenai usia pernihakan maka semua UU yang berkaitan dengan usia dewasa harus mengikuti UU pernikahan yakni usia 19 tahun atau sudah menikah.

Abstract

Abstract. Nusa Penida is one of the marine protected area in Bali Province. The location has a potency higher as tourist destination. Hence, the objective of the present study was to evaluate the potency and benafit of the this marine protected area as a marine ecotourism. The study was conducted in September 2012 to February 2013. The descriptive quantitative method was used in the study, the data collection was covered the percent cover of corals communities, corals mortality index, marine ecotourism sustainable index, carrying capacity of marine ecotourism. The results of this research showed that the percent cover of corals communities at Nusa Penida was categorized from good to very good ranged between 52.00% to 97.00% with corals mortality index ranged between 0.00 to 0.01 at a depth of 3 meters and between 0.00 to 0.025 at 10 meters depth. The marine protected area of Nusa Penida is suitable for diving activity snorkeling,and beach ecotourism with carrying capacity for diving was 153 people/day, snorkling 212 people/day, and beach ecotourism 122 people/day. The marine protected area of Nusa Penida gave impact on increasing of human well being of society in Nusa Penida with increasing the revenue 10%-30%. and also gave profits the Klungkung Regency. Oleh karena itu penelitian ini bertujuan untuk melihat sejauh mana manfaat kawasan ini sebagai kawasan wisata bahari. Penelitian dilaksanakan pada bulan September 2012 sampai Februari 2013. Metode yang digunakan adalah deskriptif kuantitatif dengan menggunakan analisis perhitungan persen tutupan komunitas karang, indeks mortalitas, indeks kesesuaian ekowisata bahari, daya dukung kawasan ekowisata bahari, evaluasi tingkat kesejahteraan masyarakat. Hasil penelitian menunjukkan bahwa persen tutupan karang di Nusa Penida dikategorikan dari baik sampai sangat baik yaitu berkisar antara 52,00%-97,00% dengan indeks mortalitas berkisar antara 0,00 0,01 pada kedalaman 3 meter dan 0,00-0,025 pada kedalaman 10 meter. Oleh karena itu kawasan konservasi Nusa Penida sesuai untuk aktivitas wisata selam, snorkling, dan wisata pantai dengan daya dukung kawasan untuk selam 153 orang/hari, snorkling 212 orang/hari dan ekowisata pantai sebanyak 122 orang/hari. Dari penelitian ini dapat disimpulkan bahwa kawasan konservasi Nusa Penida memberi dampak terhadap peningkatan kesejahteraan masyarakat sebagai pekerja wisata dengan bertambahnya pendapatan sebesar 10%-30% dan juga menambah pemasukan daerah Kabupaten Klungkung.Kata Kunci: Ekowisatata Bahari; Kawasan Konservasi; Manfaat; Nusa Penida

Abstract

The development of digital technology has brought significant transformations in the transaction system, including the emergence of reward systems such as Shopee Coins. Shopee Coins are official virtual currencies given to Shopee application users through various promotional activities and transactions. This phenomenon is interesting to study from the perspective of sharia economics in order to assess its suitability with Islamic principles. This research is library research with a qualitative and normative approach, using primary data from the books Fiqih Muamalah by Subairi and Fiqih Muamalah Maliyah by Jaih and Hasanudin. Secondary data were also obtained from the results of interviews and analyzed to obtain descriptive conclusions. The results of the study show: first, the mechanism of obtaining Shopee Coins includes purchase transactions, participation in promotions and events, and the completion of certain missions. The system adopts gamification and loyalty to increase user engagement. Second, from the point of view of sharia economics, this system is permissible (halal) as long as it does not contain prohibited elements, such as riba, gharar (ambiguity), and maysir (gambling). Third, this system can be assessed in accordance with sharia if it is transparent and fair. Fourth, potential problems arise if there is speculation about rewards or unclear coin values. As an alternative solution, the reward system can be developed with akad ju'alah (promise of reward for a result) or tabarru' (grant) with sharia supervision, to ensure conformity with the principles of justice and ethics in Islamic muamalah.

Abstract

Indonesia's cultural richness, especially Javanese traditions, demands sustainable preservation. One of the traditions that is still strongly adhered to is the calculation of weton as a reference in marriage. This study aims to analyze the practice of calculating weton in Singa Gembara Village from the perspective of Islamic law, as well as identify problems and solutions that can be applied. The research method used is qualitative descriptive with a field study approach, through observation and interviews with the local Javanese community. The results of the study show that people are still very attached to the weton tradition in determining the compatibility of couples and the good day of the wedding, although the calculation methods vary. In the view of Islamic law, this practice is acceptable as 'urf as long as it is not believed to be the absolute determinant of fate or to associate with Allah. However, excessive dependence on weton can cause problems such as marriage annulment, family conflicts, and the potential erosion of faith. Therefore, it is necessary to strengthen religious education about destiny, develop Islamic-based premarital guidance, a balanced cultural approach, and counseling services. This study recommends the integration of local cultural preservation and sharia obedience as a path to a harmonious marriage and according to Islamic guidance.

Abstract

Guidance from God to humans in living life in order to be safe in this world and the hereafter is implemented in the form of sharia. The purpose of the implementation of the Shari'a is for the benefit of humans in order to provide benefits and also so that humans avoid damage (mafsadah) in the world and the hereafter. The shari'a that Allah has given to humans is in the form of sharia in worship and also muamalah. Sharia in muamalah, among others, is in the form of sharia in buying and selling, leasing, accounts payable and others. In the debt law, which in Arabic is called dain, it is contained in Q.S. Al-Baqarah (2) verses 280, 282 and 283. Verses 282-283, which is the longest verse in the Al-Qur'an, contain the concept or procedure for recording accounts payable. In this paragraph there is a sentence amr or an order to record accounts payable in any non-cash transaction, whether it is a non-existent transaction or a transaction of large value. The sentence amr in this verse is interpreted differently by the commentators. There are commentators who state that the sentence amr in the verse indicates an obligatory commandment. However, according to the mufufasir, it states that the amr in the verse shows a mandatory meaning, but only shows the meaning of circumcision or recommendation, which is written in the book by Imam Fahrurrazi, namely Tafsir Kabir Mafatikhul Ghaib.

Abstract

Perbedaan pendapat ulama tentang pencatatan hutang terdapat pada kalimat perintah “Faktubuuhu” dalam Q.S. Al-Baqarah ayat 282. Imam Fakhrurrazi berpendapat sebagian besar umat Islam di seluruh negara Islam ketika melakukan transaksi jual beli tanpa uang tunai tidak mencatatnya dan juga tidak menggunakan saksi. Menurut Imam Fahrurrazi, ini merupakan ijma' sukuti (perjanjian) dari tidak mewajibkan pencatatan piutang. Argumen kedua adalah bahwa meskipun teks dhohir ayat tersebut menyatakan perintah untuk mencatat orang yang melakukan transaksi utang dan kredit, masalahnya tidak semua orang memiliki keterampilan menulis. Dalil ketiga, jika pencatatan utang piutang dan saksi-saksi diperlukan dalam setiap transaksi utang, maka hal ini akan memberatkan umat Islam. Imam Fahrurrozi juga memperkuat pendapatnya dengan mengutip pendapat ulama lain seperti Imam Hasan Basyri, Imam Sya'bi, Imam Hikam, dan Ibnu Uyainah yang berpendapat bahwa lafadz "Factubuuhu" dalam ayat tersebut adalah wajib tetapi kemudian diriwayatkan oleh ayat berikutnya 283.

Abstract

The profession of zakat is a type of maal zakat that emerged in this era. Regardless of the controversy over whether profession zakat is mandatory, it is imposed on every professional income that has reached its nisab. This study aims to determine how analogical reasoning (qiyas) is applied in the expenditure and calculation of professional zakat. This study is a type of library research. From the literature review found that there are two models of qiyas reasoning for profession zakat in determining its nisab and rate. First, profession zakat is analogized with the nisab of gold, which is 77.58 grams of gold, and its rate of 2.5% is paid after a year. Second, professional zakat is analogized with the nisab of agricultural zakat, which is 1323.132 kg of wheat or 815.758 kg of rice, and its rate of 5% is paid at harvest without waiting for a year. The 5% rate is determined assuming that all types of professions incur expenses during their operation.
