Abstract

Komisi Pengawas Persaingan Usaha (KPPU) merupakan suatu organisasikhusus yang mempunyai tugas ganda selain menciptakan ketertiban dalam persainganusaha juga berperan untuk menciptakan dan memelihara iklim persaingan usaha yangkondusif.Penelitian ini bertujuan untuk mengetahui kewenangan KPPU dalammenjatuhkan sanksi serta mengetahui tujuan dari Undang-undang Nomor 5 Tahun 1999tentang larangan praktek monopoli dan persaingan usaha tidak sehat. Metodologi yangdigunakan dalam penelitian ini adalah metode kepustakaan (Library Research).Berdasarkan penelitan diperoleh dua kesimpulan yaitu: 1). Bahwa KPPUmerupakan lembaga yang independen yang terlepas dari pengaruh pemerintah dan pihaklain, yang berwenang melakukan pengawasan terhadap persaingan usaha agarmenumbuhkan iklim usaha yang kondusif melalui terciptanya persaingan usaha yangsehat, dan mencegah praktek-praktek monopoli; 2). Hukum persaingan usahamerupakan hukum yang mengatur segala sesuatu yang berkaitan dengan kegiatanekonomi dan bisnis dalam berinvestasi yang bertujuan untuk menjamin terlaksananyapasar yang optimal, khususnya biaya produksi terendah, harga dan tingkat keuntunganyang wajar, kemajuan teknologi, dan pengembangan produk dan menjadi payunghukum yang sama bagi setiap pelaku usaha atau sekelompok pelaku usaha dalammenjalankan usahanya.

Abstract

The Main Role Of The Proofment In The Process Of ExaminationIn The Crime Count. The legal material of proofment is at the tool ofproofment which content of value and being considered by the corectjudge in the frame of charming the conviction to the only aim to makepunishment (vonis) of criminal core. In the judge court concerned is anaction to state of the event through the facts of the material provementsuggested. The facts found concerned are arranged to be a criminalmaterial which happed really (materiele waarheid) are will be dependedon the accuracy of the facts got and the material proofment.The writing of the law science in order to know the role of theproofment and the consideration of the judge in … decide the sentence thecorrect of crime. The kind of the method is the juridicial normative and thefollowing is the analysis in the descriptive kualitatif. The results orconviction has the important role in finishing the condernation which is tobe proved of material manly the real right based on the crime actionhappened. The judge may not make decision criminal sentence to someonebut if in the minimum to legal proofment tools. The gets the conviction thatthe criminal action has really been happened and the defendant is wrongto do based in the article 183 of the criminal book of crime.

Abstract

Legal protection is an activity to maintain or maintain relationships in thecommunity in order to achieve justice. An upright law is guaranteeingjustice without justice can be said to be not law, therefore rely on the ruleof law in order to bring about justice for all people.Legal norms are the most dominant rules that are enforced with powerand for their violations subject to certain sanctions established by thestate.The existence of various fields of legal system in society gives rise tocertain legal systems which are also the structure and process of the law.The legal system covers various legal subsystems which then greatlyinfluences the ongoing process of various fields of law.The nature of the law covers the entire legal system wcihc is an activity toimplement and apply justice and take legal action against any violationsor deviations of law committed by legal subjects either through judicialprocedures or through non judicial procedures.

Abstract

Tindak pidana korupsi sebagai perbuatan pidana yang dapat dikategorikan sebagai kejahatan yang luar biasa (extra ordinary crime).Unsur menyalah gunakan kewenangan karena jabatannya ataukedudukannya sebagai penyelenggara negara serta menguntungkan dirisendiri atau orang lain atau suatu badan, yang sangat menghambatpertumbuhan perekonomian Negara, merusak sendi-sendi kehidupanbermasyarakat, berbangsa dan bernegara, timbulnya krisis di berbagaibidang pembangunan serta membahayakan eksistensi Negara.Penyelenggara Negara mempunyai peranan yang sangat menentukanmewujudkan masyarakat yang adil dan makmur. Dalam menjalankantugas dan fungsinya penyelenggara Negara harus secara sungguh-sungguhdan penuh tanggung jawab, perlu diletakkan asas-asas penyelenggaraanNegara yang bersih dan bebas korupsi. Peran serta masyarakat bermaksuduntuk memberdayakan masyarakat dalam rangka mewujudkanpenyelenggaraan negara yang bersih dari korupsi. Dengan hak dankewajiban yang dimiliki, diharapkan masyarakat lebih bersemangat untukmelaksanakan kontrol sosial secara optimal terhadap penyelenggaraanNegara dengan tetap mentaati aturan-aturan yang berlaku.Metode penulisan jurnal ilmu hukum ini menggunakan metodenormatif, tujuan penulisan untuk mengkaji praktek-praktek korupsi yangdapat dikategorikan sebagai kejahatan yang luar biasa yangmenyalahgunakan kekuasannya atau jabatan ataupun kedudukannyaselaku penyelenggara Negara. Peran serta masyarakat dalam rangkamewujudkan penyelenggaraan Negara yang bersih dan bebas dari korupsidengan memperhatikan hak dan kewajiban sesuai dengan peraturan hukumyang berlaku.

Abstract

The environment on earth as regulated in Law No. 32 of 2009concerning Environmental Protection and Management, thatenvironmental management consists of the natural environment inaccordance with the understanding of ecosystem life and socialenvironment that is illustrated by the existence of human groups both insociety and in families and refers to the understanding of humanity(humanism), so that includes understanding about between nations,interregion and the built environment (originally thought to be man-made;man-made environment).Development needs to pay attention to environmental conditionsthat exist from the physical side (soil, water, air), biotics (flora, fauna),and culture (culture, interactions between people). Environmental qualityconditions will tend to continue to decline if not balanced with the conceptof sustainable development planning in an effort to preserve the existingenvironmental functions.The implementation of environmentally sound development and thecontrolled use of natural resources wisely is the main objective ofenvironmental management. Sustainable development is very closelyrelated to environmental management programs and policies.The nature of environmental law enforcement in sustainabledevelopment covers all environmental law systems with the aim ofprotecting and properly managing the environment and is an activity toimplement and apply just environmental laws and take legal actionagainst any violations or deviations of law committed by legal subjectseither through judicial procedures or through non-judicial procedures.Legal norms are the most dominant rules that are enforced with powerand for their violations subject to certain sanctions that have beenestablished by the State.

Abstract

Bantuan hukum merupakan suatu hak yang harus diperoleh tersangkaatau tersangka sebagai suatu implementasi Negara hukum untuk menjaminhak asasi warga negaranya dalam mencapai suatu keadilan dan bantuanhukum merupakan hal fundamental yang harus di dapatkan oleh tersangkaatau terdakwa melihat banyaknya realitas ketimpangan hukum bagiseorang tersangka/terdakwa untuk memperoleh haknya.Penulisan jurnal hukum ini bertujuan untuk menganalisis bagaimanaperan advokat selaku penasehat hukum didalam perkara pidana yangancaman hukumannya berdasarkan Pasal 56 ayat 1 KUHAP, danmenganalisis akibat hukumnya jika tidak didampingi oleh advokat selakupenasehat hukum tersangka/terdakwa. Sehingga dapat dikaji sejauhmanapenerapan hukum Pasal 56 KUHAP bisa diterapkan kepada tersangka atauterdakwa dalam proses pemeriksaan perkara tindak pidana. Penulisanjurnal hukum ini penulis menggunakan metode penelitian yuridisnormatif.Kebutuhan akan jasa hukum (bantuan hukum) dari advokat antara lainkonsultasi hukum, legal audit, pendampingan, pembelaan, mewakili baikdi luar maupun di dalam proses pengadilan. Bantuan Hukum yangdiperlukan oleh tersangka/terdakwa atas dasar Pasal 56 ayat (1) KUHAP,merupakan suatu implementasi dari Hak Asasi Manusia dalammemperoleh bantuan hukum dalam proses perkara pidana. Berdasarkanketentuan Pasa1 56 ayat (1) KUHAP mengadopsi pedoman Miranda Ruleatau Miranda Principle, tentang formalistic legal thinking, dapat tercapaidengan kehadiran penasehat hukum yang bersifat imperative dan dapatmenjadikan hak asasi tersangka/terdakwa tetap diperhatikan, danterjaminnya pemeriksaan yang fair dan manusiawi padatersangka/terdakwa, sehingga bila diabaikan akan mengakibatkan hasilpemeriksaan atau hasil di tingkat penyidikan itu menjadi tidak sah (illegal)atau batal demi hukum (null and void). Maka untuk proses selanjutnyapunjuga menjadi tidak sah.
