Abstract

The School Operational Assistance (BOS) program aims to free up tuition fees for underprivileged students and provide relief for other students, so that they can get better quality basic education services until they are completed in order to complete 9 years of basic education compulsory education. Through BOS, the level of primary education students will be freed from all kinds of school operational costs. The purpose of this study was to find out the Management of the School Operational Assistance Fund (BOS) in improving the learning process in State MTs 1 and Al-Arkom MTs Palembang. The technical analysis used in this study is a qualitative data analysis technique. While the data collection techniques used are interviews, documentation and observation. The results showed that the effectiveness of the management of Operational Assistance funds in the process of improving the learning process in Palembang 1 MTSN had been running effectively in accordance with the 2007 School Operational Aid published by the Indonesian Ministry of Religion. As for the effective ones, namely the need for the availability of funds, facilities and infrastructure to support teaching and learning activities, human resources, planning activities or programs and the amount of funds that will be used for these activities or programs, activities to use school operational assistance funds to meet school needs, coordination between the school and the KOMITE, oversight of the use of the School Operational Assistance Fund (BOS), the improvement of the quality of education, the achievement of the objectives of the use of BOS funds and the achievement of the main objectives of the BOS funds program. Whereas in MTS Al-Arkom, the management of BOS funds has not been implemented effectively, namely the need for the availability of funds, facilities and infrastructure to support teaching and learning activities, human resources, planning activities or programs and the amount of funds to be used for these activities or programs. the school with the school KOMITE. Abstract

Wali dalam pernikahan yaitu seseorang yang bertindak atas nama mempelai perempuan dalam suatu akad nikah. wali itu ada yang umum dan ada yang khusus. Yang khusus adalah yang berkenan dengan manusia dan benda hartanya. Yang dibicarakan disini wali tetap manusia, yaitu tentang perwalian dalam pernikahan. Keberadaan seorang wali dalam akad nikah adalah suatu hal yang mesti dan tidak sah akad pernikahannya yang tidak dilakukan oleh wali. Kemudian artikel ini mengkaji tentang konsep wali nikah dalam Undang-Undang Perkawinan Nomor 1 tahun 1974 dan menurut pandangan ulama’ hanafiyan dan syafi’iyah tentang konsep wali nikah dalam Undang-Undang Perkawinan Nomor 1 tahun 1974. Penelitian ini merupakan penelitian pustaka (Library research). Metode yang digunakan adalah kualitatif yaitu melalui tahapan editing, pengorganisasian dan analisa data. Jenis penelitian yang digunakan dalam penelitian ini adalah studi komparatif. Hasil penelitian dapat disimpulkan bahwa wali nikah menjadi syarat dan rukun dalam perkawinan. Menurut ulama’ hanafiyah dan ulama’ syafi’iyah, wali dalam pernikahan menjadi syarat sahnya perkawinan, persamaan pendapat itu terletak pada syarat sahnya perkawinan. Adapun perbedaan wali dalam pernikahan yang mana Ulama’ syafi’i memberikan makna yang kuat, tidak sah perkawinan tanpa adanya wali baik itu gadis ataupun janda. tapi ulama’ hanafiyah lebih menyandarkan pada rasionalitas dalam membuat keputusan hukumnya rukun dan syarat perkawinan ada pada ijab dan Qabul.

Abstract

Zakat is giving a portion of the wealth that has reached the nisab, without any constraints that are not given to it. But the problem is that after it is collected and will be given to the rightful 8 asnaf (QS.: 9: 60) including certain criteria of people who are not directly mentioned by the verse above. This is evident when the wealth is given to school dropouts who want to continue with economic reasons that do not support, so everything fails in the middle of the road (Not realized). The form of the problem above is how the views of the Shafi'i and Hanafi madhhabs on the use of zakat for scholarships and where are the points of similarity and difference in the opinions of the two madhhabs. This research uses a Library Research approach (library research) After the data is collected, data analysis is continued, by checking the data (editing), marking the data (systematizing) and systematizing the data (systematizing). The type of research used in this research uses comparative studies. From the discussion above, it can be concluded that the use of zakat assets for scholarships (education costs) is permitted according to the Shafi'i madzhab and the Hanfi madzhab, as an expansion of the meaning of sabilillah or ibnu sabil, the similarity of opinion lies in the permissibility of zakat assets for education costs for those in need. The clear difference is shown by the interpretation of the meaning of sabilillah and lilfuqara' which the Shafi'i madhhab gives a broad meaning, and the use of zakat treasures for educational expenses is for those who have achievements only, but the Hanafi madhhab is more restrictive on the existence of ownership (attached to a person) about his state of lack or need of wealth.

Abstract

It was originally proposed that the presidential threshold of 20% be used to support the presidential system. As stated in Article 6A paragraph (2) of the Constitution of the Republic of Indonesia, the constitutional design of the presidential threshold is an additional provision about arrangements on the requirements for the candidacy of the President and Vice President. Because political configuration is so crucial to the creation of legal products, political law presidential threshold policymaking occurs when there is political configuration. What is the history of the presidential threshold policy of 20%? is the first of two problem formulations in this study. Second, how does the presidential threshold of 20% in Law No. 7 of 2017 stand in terms of legal politics? Along with legal and intellectual techniques, the research takes a normative perspective. First, the study's findings show that Indonesia's presidential threshold was first established in Law Number 23 of 2003 concerning the General Election of the President and Vice President. From the 2004 Presidential Election to the 2019 Presidential Election, Indonesia's threshold provisions were the first to be put into practice, with the presidential threshold's amount changing. The legal politics of the presidential threshold have the traits of an authoritarian law, and the legal foundation has changed to Law Number 7 of 2017 concerning the Second General Election. This is so that the ruler can protect his or her political interest in keeping the ruling party in power. Because a presidential threshold with a percentage of up to 20% creates a divide in political rights or democratic rights between parties with majority votes and parties with minority votes, the legal politics of determining the presidential threshold runs counter to the principle of the purpose of an effective and proportional election.

Abstract

Penelitian tersebut mendeskripsikan mengenai strategi inkuiri learning, Dalam kegiatan belajar mengajar, motivasi sangat penting karena dapat menumbuhkan kegairahan untuk belajar dan sebaliknya kurangnya dorongan akan mematikan semangat tersebut. Jika siswa terdorong untuk belajar, maka yang lain juga akan demikian. Untuk mengidentifikasi penerapan strategi inkuiri learning guru dalam membangkitkan motivasi belajar siswa MI Miftahul Huda Liprak kidul. Tantangannya, masih ada siswa tertentu yang tidak patuh pada perintah guru, suka mengacau di kelas, tidak mau menyuarakan pendapatnya, tidak mau menulis, dan tidak mau menaati peraturan karena perbedaan kepribadian anak-anak tersebut. Tujuan penelitian ini yaitu untuk mengetahui bagaimana strategi guru dan kendala guru dalam memotivasi belajar pada siswa. Metode penelitian adalah penelitian kualitatif dengan model penelitian lapangan. Pengumpulan data dilakukan melalui observasi, wawancara. Hasil penelitian ialah degan menggukan strategi Inkuiri learning guru telah memiliki strategi dalam memotivasi belajar siswa berupa penjelasan pencapaian tujuan, pembangkitan terhadap minat, menciptakan suasana senang dalam belajar, memberikan pujian atas keberhasilan, dan memberikan nilai tambahan selama proses pembelajaran. Analisis efektivitas guru dalam meningkatkan motivasi belajar siswa, agar siswa memiliki motivasi yang tinggi, maka motivasi yang diberikan oleh guru akan selalu mendorong mereka untuk mencapai tujuan belajarnya. Siswa saat ini harus mengembangkan sejumlah kemampuan, termasuk kemampuan berpikir kritis. Agar siswa lebih termotivasi, sangat penting untuk memiliki metode pembelajaran yang inovatif. Salah satu pembelajaran yang dianggap dapat meningkatkan kemampuan siswa dan yang bisa menigkatkan motivasi siswa dalam mengembangkan kemampuan berpikir kritis adalah metode inkuiri. Kata kunci : Strategi guru, Motivasi belajar, Metode inkuiri.

Abstract

In a crime problem, there will be many processes that will be faced by both law enforcement and the parties involved in the crime, one of the processes that really requires a very large level of energy is the inspection process. In this examination process there will be many stages that must be passed from examining case files, examining witnesses, expert witnesses, defendants to supporting documents as evidence of the crime which will eventually end in a judge's decision and how legal remedies are taken by the parties. -the parties involved where in this legal effort there will be many stages that will be passed to get justice from the start of appeal, cassation, clemency to the last is review and ends with the implementation of the judge's decision which has been determined whether the original decision or the decision after filing a legal remedy the. This study uses a research method with descriptive analysis by conducting data analysis by conducting interviews with related parties. The purpose of this research is for readers to understand more about the stages of examining criminal cases and how to deal with them.

Abstract

Artikel ini mengkaji tafsir ayat-ayat Al-Qur'an yang berkaitan dengan kewajiban nafkah bagi perempuan yang bekerja, dengan fokus pada QS. An-Nisa: 32 dan 34. Dalam tradisi Islam, kewajiban nafkah umumnya dibebankan kepada laki-laki, namun dengan semakin meningkatnya partisipasi perempuan dalam dunia kerja, muncul pertanyaan mengenai relevansi aturan tersebut di era modern. Melalui pendekatan historis, antropologis, dan sosiologis, penelitian ini menelusuri konteks asal turunnya ayat, dinamika sosial pada masa Nabi, serta perubahan peran perempuan dalam berbagai masyarakat di dunia Islam. Hasil kajian ini menunjukkan bahwa pembagian tanggung jawab nafkah bersifat dinamis dan dapat diadaptasi sesuai dengan perkembangan zaman, selama tidak melanggar prinsip-prinsip dasar keadilan dalam Islam. Pemahaman yang lebih inklusif dan kontekstual terhadap ayat-ayat ini diharapkan dapat memberikan solusi yang relevan terhadap isu perempuan bekerja dan kewajiban nafkah dalam keluarga.

Abstract

Penelitian ini mengulas secara sistematis literatur terkait manajemen pengetahuan dalamorganisasi global, dengan fokus pada tantangan, praktik, dan strategi efektif. Menggunakan pendekatan Systematic Literature Review (SLR) berdasarkan protokol PRISMA, sebanyak 99.424 artikel awal diidentifikasi melalui pencarian database, yang disaring menjadi 10 artikel relevan untuk analisis mendalam. Hasil menunjukkan bahwa manajemen pengetahuan di organisasi global menghadapi tantangan signifikan seperti perbedaan budaya, geografis, dan teknologi. Sistem berbasis teknologi informasi digunakan untuk mengatasi hambatan ini, memfasilitasi transfer pengetahuan eksplisit dan tacit antar cabang. Selain itu, penelitian ini mengidentifikasi enam kelompok motivasi akademisipraktis, bisnis, instrumental, pematuh, teoretis, dan fasilitator hubunganyang memengaruhi dinamika manajemen pengetahuan. Temuan menunjukkan perlunya kebijakan institusional yang mendukung beragam motivasi untuk menciptakan lingkungan kolaboratif dan produktif. Penelitian ini memberikan wawasan tentang bagaimana manajemen pengetahuan dapat meningkatkan kinerja, inovasi, dan adaptasi organisasi global dalam menghadapi perubahan lingkungan bisnis yang dinamis.Kata Kunci : Manajemen pengetahuan, Organisasi global, Systematic literatur review

Abstract

This study examines the Constitutional Court's authority in resolving regional head election disputes, focusing on its role in ensuring substantive justice and the implications of the vote threshold in Article 158 of the Regional Head Election Law on candidates' constitutional rights. The research employs a normative legal method, utilizing a statutory approach to analyze the Court’s jurisdiction, a case approach to assess key decisions, and a conceptual approach to evaluate the principles of substantive justice in electoral disputes. Primary legal sources include the 1945 Indonesian Constitution and Constitutional Court rulings, while secondary sources consist of scholarly literature, legal commentaries, and tertiary legal references. The findings reveal that the Constitutional Court has played a pivotal role in upholding democratic principles by setting aside formalistic constraints such as the vote threshold when structured, systematic, and massive violations significantly impact election outcomes. However, this approach raises concerns regarding the consistency of judicial rulings and legal certainty. Additionally, the study highlights that Article 158 often limits candidates’ access to legal remedies, restricting their ability to contest elections despite substantial evidence of electoral fraud. The study contributes to the academic discourse on electoral justice by demonstrating how legal formalism can undermine substantive justice in democratic processes. It recommends revising Article 158 to introduce an exception mechanism that balances procedural efficiency with fairness, thereby enhancing the legitimacy and integrity of regional head elections. This reform is essential to ensure a more equitable electoral dispute resolution system that safeguards both democratic accountability and legal certainty.
