Abstract

Qiyas is one way to resolve various legal cases whose arguments are not clearly stated in the ur'anqand Hadith. Imam Syafi'i is one of the initiators of the concept of iyas who holds the view that various legal cases that exist in Muslim society which are not yet clearly regulated in the ur'an and hadith can be resolved through iyas, either in the form of iyas aulawi, iyas musawi or qiyas adn . One case that is not yet clear is the type of staple food that is issued as zakat fitrah in Indonesia. The zakat fitrah issued which was the staple food of the Prophet Muhammad saw and the Arabs in ancient times was wheat, dates, cheese, and others. In fact, the majority of Muslims in Indonesia who adhere to the Shafi'i school of thought pay zakat fitrah in the form of staple foods that are commonly consumed, namely rice, corn, sago, etc. Zakat fitrah which must be paid by every Muslim who is still alive in the month of Ramadan and has excess staple food for the night and Eid al-Fitr, if rice is used is 2.5 kg or 3.5 liters per person

Abstract

Law is a social rule or norm that cannot be separated from the social norms that exist in society. The family is an important part of society which has a big role in conveying good teachings and values ​​to its members in living life in society. One of the problems that often arises in the family context is related to the transfer of inheritance or assets from parents to children. The gift method is often used by parents with the aim of avoiding conflicts regarding the distribution of inheritance in the future. In this journal, researchers use the statue approach method and by studying the Civil Code (KUH Per) and the Compilation of Islamic Law (KHI) as well as the sources of Islamic law, the Qur'an and Hadith. The formulation of the problem discussed in this journal is the granting of grants and the position of grant deeds. By using the Normative juridical method, this research aims to provide an in-depth understanding of the provisions for granting gifts and distribution of inheritance according to the Compilation of Islamic Law (KHI) and the Civil Code (KUHPer). Thus, it is hoped that this research will provide significant benefits for scientific development in the legal field, as well as provide a contribution in the form of deeper thinking and understanding regarding the procedures for granting grants and the things that can cancel them. Through a normative juridical approach, this research will likely examine in detail the articles related to granting and distribution of inheritance in the Compilation of Islamic Law (KHI) and the Civil Code (KUHPer). The research will also likely identify the principles underlying inheritance law in the two pieces of legislation, as well as compare the similarities and differences between the two. Thus, it is hoped that the results of this research will provide writers and readers with a more comprehensive understanding regarding the procedures for granting gifts and dividing inheritance from the perspective of Islamic law and civil law, as well as highlighting things that can invalidate grant giving. Apart from that, this research can also provide new views or recommendations related to increasing effectiveness and fairness in the application of the law

Abstract

Marriage according to Customary Law is not only a very important event for those who are still alive, but marriage is also a very meaningful event and one that receives full attention and is attended by the spirits of the ancestors of both parties. Customary law does not regulate absolutely the age limit for a person's marriage, that is, there are no provisions regarding the minimum and maximum age limits for entering into marriage. One of these things is that the Outer Baduy community is allowed to marry at a young age. Thus, this research will examine the meaning of marriage, marriage in the outer Baduy community and legal sanctions for foreign Baduy customary marriages towards the marriage of underage children. The discussion method in this research is qualitative with the type of research namely the Normative legal approach (normative juridical) and Empirical Law (empirical juridical) or known as normative-empirical research. Meanwhile, the definition of an empirical juridical approach is carried out by looking at the realities that exist in practice in the field. The results and conclusions of this research are the foreign Baduy marriage process, if the legal conditions for the marriage are not met, then according to law number 1 of 1974 in conjunction with law number 16 of 2019 concerning marriage, it is explained that a marriage can only be said to be a valid marriage if it fulfills the following requirements. marriage requirements and carried out according to the laws of each religion and recorded according to statutory regulations. Then there are legal sanctions if there is a violation of underage marriage as regulated in Law no. 1 of 1974 in conjunction with Law no. 16 of 2019 concerning marriage, namely if there is an element of coercion in marrying a minor for any reason, criminal penalties can be imposed. Islamic law does not prohibit someone from entering into a marriage on condition that they have reached maturity and are able to provide a living, both physical and spiritual. The Baduy traditional community all obeys the rules made by Pu'un. In customary law there are also sanctions if there is a violation. The lightness or severity of the sanctions depends on the type of error or violation

Abstract

The purpose of this research is to analyze in depth about the position of Ijma' Sukuti as the basis of something based on the views of Imam an-Nawawi al-Dimasqy and Imam an-Nabhani. This research is a qualitative research with a normative approach with the type of library study (Library Research), which is included in normative research. The sources of this research are various books, journal articles and other literature on Ijma' Sukuti. The method used in this research is descriptive qualitative with a juridical normative approach. To obtain the validity of the data in this study, the author uses the triangulation technique. The results of the study state that Imam An-Nawawi al-Dimasqy rejected Ijma' Sukuti this is because at one time some of the mujtahids expressed their opinions clearly regarding a case, either through a fatwa or a legal decision, and the rest of them did not respond to it, either an approval of the opinion that had been expressed or opposing the opinion to be a legal proposition.ABSTRAKTujuan Penelitian ini adalah untuk menganalisis secara mendalam tentang kedudukan Ijma’ Sukuti sebagai dasar hukum sesuatu berdasarkan pandangan Imam an-Nawawi al-Dimasqy dan Imam an-Nabhani. Penelitian ini adalah penelitian kualitatif dengan pendekatan normative dengan jenis studi pustaka (Library Research), yang termasuk ke dalam penelitian normatif. Adapun sumber penelitian ini adalah berbagai buku, artikel jurnal dan literatur lain tentang Ijma’ Sukuti. Metode yang digunakan dalam penelitian ini adalah deskriptif kualitatif dengan pendekatan normative yuridis. Untuk memperoleh keabsahan data dalam penelitian ini, penulis menggunakan teknik triangulasi Hasil Penelitian menyatakan bahwa Imam An- Nawawi al-Dimasqy menolak Ijma’ sukuti hal ini karena suatu masa  sebagian dari mujtahid mengemukakan pendapat mereka dengan jelas mengenai suatu kasus, baik melalui fatwa atau suatu putusan hukum, dan sisa dari mereka tidak memberikan tanggapan terhadap hal tersebut, baik merupakan persetujuan terhadap pendapat yang telah dikemukakan atau menentang pendapat itu menjadi dalil hukum.

Abstract

Artikel ini mengkaji tafsir ayat-ayat Al-Qur'an yang berkaitan dengan kewajiban nafkah bagi perempuan yang bekerja, dengan fokus pada QS. An-Nisa: 32 dan 34. Dalam tradisi Islam, kewajiban nafkah umumnya dibebankan kepada laki-laki, namun dengan semakin meningkatnya partisipasi perempuan dalam dunia kerja, muncul pertanyaan mengenai relevansi aturan tersebut di era modern. Melalui pendekatan historis, antropologis, dan sosiologis, penelitian ini menelusuri konteks asal turunnya ayat, dinamika sosial pada masa Nabi, serta perubahan peran perempuan dalam berbagai masyarakat di dunia Islam. Hasil kajian ini menunjukkan bahwa pembagian tanggung jawab nafkah bersifat dinamis dan dapat diadaptasi sesuai dengan perkembangan zaman, selama tidak melanggar prinsip-prinsip dasar keadilan dalam Islam. Pemahaman yang lebih inklusif dan kontekstual terhadap ayat-ayat ini diharapkan dapat memberikan solusi yang relevan terhadap isu perempuan bekerja dan kewajiban nafkah dalam keluarga.

Abstract

The purpose of this study is to analyze betrothal (peminangan) and prenuptial agreements (perjanjian perkawinan) with reference to the Qur’an, Surah Al-Baqarah verse 235. This research employs a qualitative method with a descriptive approach. The data sources consist of books, dissertations, and articles, while data collection was carried out through online searches. The data were analyzed using a literature review technique. The findings indicate that betrothal represents an effort toward forming a marital bond between a man and a woman. In essence, betrothal, or proposal (melamar), etymologically means asking a woman to become a wife, either for oneself or on behalf of another. Betrothal is strongly encouraged in order for the prospective bride and groom to know each other, thus providing more benefits than disadvantages. The study also shows that all aspects of human life, including betrothal, are clearly regulated in the Qur’an and Hadith, as explicitly mentioned in Surah Al-Baqarah verse 235. Furthermore, a prenuptial agreement is a form of contract and, therefore, must fulfill the general requirements of validity as stipulated in Article 1320 of the Indonesian Civil Code, except where otherwise specifically regulated. Contribution: This study contributes to Islamic family law scholarship by offering a comprehensive interpretation of betrothal and prenuptial agreements from both Islamic sources (Qur’an and Hadith) and Indonesian civil law. It highlights the harmony and interaction between religious principles and national legal provisions, thereby providing a deeper understanding for academics, practitioners, and policymakers in strengthening legal certainty and religious compliance in marital practices

Abstract

Penelitian ini bertujuan untuk menganalisis tafsir ayat-ayat Al-Qur'an tentang kewarisan menggunakan pendekatan sosiologis, teologis, dan historis. Pendekatan ini digunakan untuk memahami penerapan hukum kewarisan Islam dalam konteks masyarakat modern, khususnya dalam kaitannya dengan prinsip keadilan substantif dan dinamika sosial-budaya. Hasil penelitian menunjukkan tiga temuan utama. Pertama, tafsir kontemporer membuka ruang interpretasi yang lebih fleksibel terhadap hukum kewarisan Islam, dengan mempertimbangkan peran perempuan sebagai pencari nafkah. Hal ini memungkinkan pembagian warisan yang tidak hanya berlandaskan pada teks, tetapi juga pada kondisi sosial dan ekonomi keluarga. Kedua, konflik antara hukum adat dan hukum Islam dalam pembagian warisan sering terjadi karena perbedaan norma, namun harmonisasi tercapai di beberapa daerah melalui kompromi, seperti pembagian harta adat untuk perempuan dan harta pribadi sesuai hukum Islam. Ketiga, globalisasi dan feminisme telah mendorong masyarakat untuk mempertanyakan prinsip kewarisan berbasis gender. Hal ini menuntut reinterpretasi hukum kewarisan Islam agar lebih relevan dengan nilai-nilai kesetaraan gender dan keadilan universal. Penelitian ini menawarkan perspektif baru dalam memahami hukum kewarisan Islam secara adaptif, kontekstual, dan inklusif terhadap perubahan sosial.
