Abstract

The emergence of the term Transgender in Indonesia first appeared in 1860 and underwent development in the 1990s. In 1986 the term Wadam (Female Adam) emerged, but changed into a transsexual (Male Female). The amendment was based on the objection of several parties because of the use of the name of Adam's Woman. It was considered impolite because the name of the Prophet Adam as.In the Universal Declaration of Human Right, there is indeed no mention of sexual orientation, it must be of the opposite sex, what is concerned about human rights to marry and build families, namely article 16 which is then used as a basis by transgender people to justify deviant sexual behavior they are through same-sex marriage. On the other hand, in the Universal Declaration of Human Right there is also article 18 which guarantees the right of everyone to believe in the teachings of his religion and practice his religious teachings well. While we all know there is no religious teaching in this world that allows sexual behavior to deviate, even the most tolerant religion.

Abstract

Abstrak Pokok masalah penelitian ini adalah bagaimana Tinjauan hukum Islam Terhadap Sistem Pemasaran Afiliasi pada Taqychan Saffron. Jenis penelitian adalah penelitian kualitatif pustaka dengan pendekatan teologis normatif dan pendekatan antropologi. Adapun sumber primer (kumpulan data) dan sekunder (jurnal, buku, dll). Teknik pengolahan data dan analisis data dilakukan tiga tahapan, yaitu: klarifikasi data, reduksi data dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa sistem pemasaran afiliasi yang dijalankan oleh Taqychan Saffron tidak bertentangan dengan prinsip-prinsip muamalah dalam Islam. Pemasaran afiliasi ini termasuk kepada pembahasan akad ju’ālah, yaitu mekanisme pemberian upah kerja berdasarkan pada keberhasilan pekerjaan. Adapun sistem pemasaran menurut hukum Islam yang menggunakan platform media sosial yang digunakan sebagai media pasar. Hal ini dibolehkan dalam bermuamalah selama tidak adanya penyimpangan. Dan ini termasuk kepada pembahasan akad as-salam. Implikasi dari penelitian ini adalah: 1) Mengenai pelaksaan kegiatan jual beli maupun kegiatan kerja sama, seharusnya mencari tahu terlebih dahulu tentang hukum atas perbuatan yang hendak dilakukan. 2) Pemasaran melalui media digital atau internet, kita harus mempelajari terlebih dahulu tentang perkembangan ilmu pengetahuan dan teknologi, baik itu dari segi nilai-nilai akhlak, etika dan moral, serta iman. Agar terhindar dari penyimpangan syariat Islam. Kata Kunci: Afiliasi, Hukum Islam, Sistem Pemasaran. Abstract The main problem of this research is how to review Islamic law on the affiliate marketing system in Taqychan Saffron. This type of research is a qualitative literature research with a normative theological approach and an anthropological approach. The primary sources (data collection) and secondary (journals, books, etc.). Data processing techniques and data analysis were carried out in three stages, namely: data clarification, data reduction and drawing conclusions. The results show that the affiliate marketing system run by Taqychan Saffron does not conflict with the principles of muamalah in Islam. Affiliate marketing is included in the discussion of the ju'ālah contract, which is the mechanism for providing work wages based on job success. The marketing system according to Islamic law uses social media platforms that are used as market media. This is permissible in muamalah as long as there are no deviations. And this includes the discussion of the contract as-salam. The implications of this research are: 1) Regarding the implementation of buying and selling activities and cooperative activities, one should first find out about the law for the actions to be carried out. 2) Marketing through digital media or the internet, we must first learn about the development of science and technology, both in terms of moral values, ethics and morals, as well as faith. Abstract

Abstrak Pokok masalah dalam penelitian ini adalah bagaimana tinjauan hukum Islam terhadap strategi pemasaran Funding Office Pada Bank Syariah Indonesia (Studi Kasus PT. BSI Tbk KC Makassar Veteran). Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian lapangan (field Research) yaitu salah satu penelitian kualitatif, dimana peneliti turun langsung untuk mengumpulkan data, dengan pendekatan penelitian yang digunakan adalah: Yuridis dan Empiris. Selanjutnya metode pengumpulan data yang digunakan adalah observasi, wawancara, dan dokumentasi. Sedangkan tehnik pengelolaan dan analisis data yang dilakukan adalah dengan 1 kali tahap, yaitu pengelolaan data, analisa data penarikan kesimpulan. Hasil penelitian menunjukkan, Pertama, Pemasaran Funding Officer pada PT. BSI Tbk KC Makassar Veteran terdiri dari dua cara yakni pertama menggunakan strategi pemasaran melalui STP (Segmentasi, Target, dan Pasar) kedua menggunakan strategi yang dilihat dari segi konsep bauran pemasarannya yakni produk, promosi, lokasi, dan harga sesuai dengan kebutuhan kebutuhan nasabah. Kedua, Tinjauan Hukum Islam telah sesuai dengan fatwa DSN-MUI No.115 tahun 2017, dalam hal ini akad yang dilakukan oleh nasabah antara lain mudharabah dan wadiah. Implikasi penelitian ini adalah kedua belah pihak harus lebih memahami akad, agar sistem pemasaran dalam Funding Office Jauh lebih berjalan sesuai dengan yang di inginkan. Kata Kunci: Hukum Islam, Pemasaran, Petugas Pendanaan. Abstract The main problem in this study is how to review Islamic law on the Funding Office marketing strategy at Indonesian Islamic Banks (Case Study of PT. BSI Tbk KC Makassar Veteran). The type of research used in this research is field research, which is a qualitative research, where researchers go directly to collect data, with the research approaches used are: juridical and empirical. Furthermore, the data collection methods used were observation, interviews, and documentation. Meanwhile, the data management and analysis technique is carried out in one step, namely data management, data analysis, drawing conclusions. The results showed, First, the Marketing Funding Officer at PT BSI Tbk KC Makassar Veteran consisted of two ways, namely the first using a marketing strategy through STP (Segmentation, Target, and Market) the second using a strategy that was seen in terms of the concept of the marketing mix namely product, promotion, location, and price according to customer needs. Second, the Islamic Law Review is in accordance with the DSN-MUI fatwa No.115 of 2017, in this case the contracts made by customers include mudharabah and wadiah. The implication of this research is that both parties must understand the contract better, so that the marketing system in the Funding Office is much more effective as desired. Abstract

Abstrak Penyelesaian sengketa tanah warisan melalui jalur non litigasi di Kelurahan Salaka dilakukan di luar Pengadilan dengan menggunakan mediator sebagai pihak penengah yang dipilih berdasarkan kesepakatan para pihak. Dalam hal ini, mediator berusaha membangun komunikasi sehingga dapat mempertemukan keinginan para pihak. Proses penyelesaian sengketa secara litigasi (di pengadilan) yang menganut asas sederhana, cepat, dan biaya ringan pada realitasnya sering mengalami kendala, seperti banyaknya jumlah perkara yang masuk tidak sebanding dengan jumlah tenaga hakim sehingga berdampak pada masyarakat selaku pencari keadilan merasa kesulitan untuk berperkara di pengadilan guna mendapatkan haknya secara cepat. Selain itu, faktor biaya ringan dan waktu yang efisien serta kerahasiaan dari penyelesaian sengketa secara non litigasi (di luar pengadilan) juga menjadi faktor yang membuat masyarakat lebih memilih penyelesaian sengketa di luar pengadilan. Berdasarkan masalah tersebut, maka penulis tertarik untuk meneliti lebih lanjut mengenai penyelesian sengketa tanah warisan melalui jalur non litigasi khususnya di Kelurahan Salaka. Hukum dan keadilan merupakan dua aspek yang tidak dapat dipisahkan. Hal tersebut dikarenakan bahwa tujuan dari hukum semata-mata untuk keadilan sebagaimana menurut Geny dalam bukunya Ahmad Ali. Selanjutnya, hal tersebut dirumuskan menjadi karya ilmiah dengan mengambil judul “Tinjauan Hukum Islam Terhadap Penyelesaian Sengketa Tanah Warisan Melalui Jalur Non Litigasi (Studi Kasus di Kelurahan Salaka, Kecamatan Pattallassang, Kabupaten Takalar).” Kata Kunci: Penyelesaian Sengketa, Tanah Warisan, Non Litigasi Abstract Settlement of inheritance land disputes through non-litigation channels in Salaka village is carried out outside the court by using a mediator as a mediator who is selected based on the agreement of the parties. In this case, the mediator tries to build communication so that it can bring together the wishes of the parties. The process of litigation dispute resolution (in court) which adheres to the principles of simple, fast dam low cost in reality often experiences problems, such as the large number of cases that are entered not proportional to the number of judges so that it has an impact on the community as justice seekers find it difficult to take cases in court in order to get it right quickly. In addition, the low cost factor and efficient time and confidentiality of non-litigation (outside court) dispute resolution are also factors that make people prefer to settle disputes out of court. Based on these problems, the authors are interested in researching further regarding the settlement of inheritance land disputes through non-litigation channels, especially in the Salaka village. Law and justice are two aspects that cannot be separated. This is because the purpose of the law is solely for justice as according to Geny in Ahmad Ali book’s. furthermore, it was formulated into a scientific paper with the title “Overview Of Islamic Law On The Settlement Of Inheritance Land Disputes Through Non Litigation Channels (Case study in Salaka Vilage, Pattallassang District, Takalar Regency)”. Abstract

Abstrak Pokok masalah penelitian ini adalah Bagaimana Implementasi Badan Penyelenggara Jaminan Produk Halal (BPJPH) Terhadap Pelaksanaan Sertifikasi Halal Di Kota Makassar? Pokok masalah tersebut selanjutnya di jabarkan ke dalam beberapa sub masalah, yaitu: 1). Bagaimana pelaksanaan sertifikasi halal Badan Penyelenggara Jaminan Produk Halal (BPJPH) terhadap perusahaan yang belum memiliki sertifikasi halal di Kota Makassar? 2). Apa kendala yang dihadapi oleh Badan Penyelenggara Jaminan Produk Halal (BPJPH) dalam melakukan sertifikasi halal?. Jenis penelitian ini tergolong kualitatif dengan pendekatan penelitian yang digunakan adalah: pendekatan normatif dan empiris. Adapun sumber data penelitian ini bersumber dari wawancara kepada petugas dari Lembaga Pengkajian Pangan, Obat-obatan, dan Kosmetika (LPPOM) dan Majelis Ulama Indonesia (MUI) Sulawesi Selatan. Selanjutnya metode pengumpulan data yang digunakan adalah observasi, wawancara, dan dokumentasi. Berdasarkan hasil penelitian menunjukkan bahwa pelaksanaan sertifikasi halal di Kota Makassar masih tergolong rendah, meskipun telah ada regulasi yang mewajibkan seluruh produk yang beredar, dan diperdagangkan di wilayah Indonesia wajib bersertifikat halal. Rendahnya angka sertifikasi ini disebabkan oleh minimnya kesadaran pelaku usaha mengenai pentingnya sertifikasi halal. Banyak diantara mereka yang belum memahami manfaat sertifikasi, baik untuk meningkatkan kepercayaan konsumen maupun untuk memperluas pasar. Kendala utama yang dihadapi BPJPH meliputi kurangnya sumber daya manusia yang kompeten, keterbatasan anggaran untuk sosialisasi dan pelatihan, serta kompleksitas proses pengajuan sertifikasi halal. Tantangan juga muncul dalam meningkatkan kesadaran masyarakat mengenai pentingnya sertifikasi halal, dan juga terkait biaya pengajuan sertifikasi halal melibatkan biaya yang tidak sedikit dan menjadi beban bagi perusahaan kecil dan menengah untuk mengajukan sertifikasi halal. Kata Kunci: Sertifikasi Halal, BPJPH, Pelaku Usaha.     Abstract The main problem of this research is how is the Implementation of the Halal Product Assurance Agency (BPJPH) towards the implementation of halal certification in Makassar City? The main problem is further described into several sub-problems, namely: 1). How is the implementation of halal certification by the Halal Product Assurance Agency (BPJPH) for companies that do not have halal certification in Makassar City? 2). What are the obstacles faced by the Halal Product Assurance Agency (BPJPH) in conducting halal certification? This type of research is classified as qualitative with the research approaches used are: normative and empirical approaches. The source of data for this research is sourced from interviews with officers from the Institute for the Assessment of Food, Drugs, and Cosmetics (LPPOM) and the Indonesian Ulema Council (MUI) of South Sulawesi. Furthermore, the data collection methods used are observation, interviews, and documentation. Based on the results of the study, the implementation of halal certification in Makassar City is still relatively low, even though there are regulations that require all products in circulation and traded in Indonesian territory to be halal certified. The low number of certifications is caused by the lack of awareness of business actors regarding the importance of halal certification. Many of them do not understand the benefits of certification, both to increase consumer confidence and to expand the market. The main obstacles faced by BPJPH include a lack of competent human resources, limited budgets for socialization and training, and the complexity of the halal certification application process. Challenges also arise in increasing public awareness of the importance of halal certification, and also related to the cost of applying for halal certification involves a lot of costs and is a burden for small and medium companies to apply for halal certification.
