Abstract

Post-tsunami disaster in Aceh, legal issues on land are regulated by the Government Regulation in Lieu of Law Number 2 of 2007, which regulates among others on land that does not exist and/or unknown its owners and their heirs. The land is being taken care as  a religious treasure by Baitul Mal  with an order the Syariyah Court. This study applies juridical normative and sociological normative methods. From the field research it was found that the Government did not have data of lands with unknown owners and their heirs. It was known from decision of the Syariyah Court  of Banda Aceh which revealed that the fact was originated from the construction of the drainage where the land procurement committee did not know where to hand over the land acquisition fund.Key words: tsunami, land, Aceh

Abstract

Traditional fishermen feel the impact of the damage of marine ecosystems and fisheries. The damage is not only caused by the consumption aspect, but also due to the government policy. Although it has great potential, but most of the traditional fishing communities are poor. This study seeks to answer three questions, namely: how to protect traditional fishermen in Aceh in connection with the consumption of fishery resources? What factors cause justice to be important in the context of the protection of traditional fishermen? How does the development of the law is supposed to do to protect traditional fishing? This study examines the law in non-doctrinal perspective with socio-legal approach. The third source of information is the Bureau of Maritime Affairs and Fisheries, FAO staff, the community of fishermen, fishery-environmental NGOs, and academics marine, fisheries, and the customary law of the sea. Protection of traditional fishermen is very important undertaken by the country in the consumption of fishery resources due to the presence of traditional fishermen in exploiting fisheries resources not only as an economic activity, but also related to culture. Fairness factor in the protection of traditional fishermen need to be explored to remember a few things, namely poverty, access, utilization, ease of access to markets, and access management. Development protection laws in connection with the issue of fishermen should be the most important principle, which is to bring the state in providing basic rights as outlined in the Constitution. Access restrictions or lack of interest will basically lead a traditional fishing in marginal conditions either political, social, cultural, or economic. This study suggests that in order to restore the traditional fishermen, it is important to conduct study on the various legislations, ranging from legal to technical regulations, to find a map of the position of traditional fishermen in Indonesia. Based on these maps, traditional fishing is authorized with the participation of various sectors of the program provided for the fishing communities.

Abstract

Corruption has been an acute crime. It spreads into various lines. Impact of the corrupt behaviors is very complex. Corruption is not only impacting economy and well-being of people but also mentality. Such condition must be repaired and morality bases of people should be strengthened. This article used viewpoint of law as reality. Law does not start from perspective of norms. Seeing the law in its perspective of reality, the writing was made inductively and analyzed qualitatively. As a part of caretakers of theoretical law, higher education has been most potentially able to raise and to ingrain anticorruption morality as well as to fight against corrupt behaviors. The greatest challenge is the corrupt behaviors have been committed by educated individuals. The corruptors knew that corrupt behavior is forbidden, but they are not able to avoid of doing it. With the logic, careless and powerless of a person to reject corrupt behavior is not caused by education level but anticorruption behavior.

Abstract

Abstract: The state of law in Indonesia concept has changed after amendments to the Constitution of the Republic of Indonesia 1945. After the amendment, the state of law in Indonesia concept is no longer rechtsstaat or rule of law, but the supreme State Law Indonesia. The intent of this assertion has very important significance, particularly if associated with the existing legal system in the world. The concept of state law rechtsstaat and the rule of law is very influential to Indonesian law states. Therefore, the assertion the supreme State Law Indonesia is not simple given the very strong influence of the legal system of the law of Indonesia from the first until now -especially from Europe. The question arises will contain any Indonesian legal concepts relating to the supreme State Law Indonesia. How the history and development of what is called Indonesia's law? To search for Indonesian law that could umbrella various legal possibilities in one room, consider how important the conceptualization and need reconceptualization against the law. In the legal assessment it is important to sit validly legal position of Indonesia in the development of legal science. Abstrak: Konsep negara hukum di Indonesia sudah berubah setelah dilakukan amandemen Undang-Undang Dasar Tahun 1945. Setelah amandemen, konsep negara hukum di Indonesia bukan lagi rechtsstaat atau rule of law, melainkan Negara Hukum Indonesia. Maksud penegasan ini memiliki makna sangat penting, terutama jika dikaitkan dengan sistem hukum yang sudah ada di dunia. Konsep negara hukum rechtsstaat dan rule of law sangat berpengaruh bagi negara hukum Indonesia. Oleh karena itu, penegasan Negara Hukum Indonesia tidak sederhana mengingat pengaruh yang sangat kuat dari sistem hukum yang ada terhadap hukum Indonesia dari dahulu hingga sekarang –terutama dari Eropa. Muncul pertanyaan akan berisikan apa saja konsep hukum Indonesia terkait dengan Negara Hukum Indonesia. Bagaimanakah sejarah dan perkembangan apa yang dinamakan dengan hukum Indonesia itu? Untuk mencari hukum Indonesia yang bisa memayungi berbagai kemungkinan hukum dalam satu ruang, penting dikaji bagaimana konseptualisasi dan perlukan rekonseptualisasi terhadap hukum tersebut. Dalam kajian hukum penting untuk mendudukkan secara sahih posisi hukum Indonesia dalam perkembangan ilmu hukum.

Abstract

Abstrak: Penelitian ini ingin memahami bagaimana hukum negara memandang hukum adat selama ini. Berdasarkan cara pandang tersebut, ditawarkan reposisi dalam memandang hukum adat. Konsep penulisan ini berbasis pada hukum perspektif realitas. Perspektif kajian hukum demikian, tidak berangkat konsep hukum dalam peraturan perundang-undangan. Dari penulisan ini ditemukan bahwa dari awal cara memandang adat sebagai hukum sudah diperdebatkan. Ketika pada ahli hukum kolonial merumuskan nama hukum yang pas terkait dengan hukum pribumi. Ada proses yang dilalui sehingga adat mencapai derajat kategori hukum (adat). Perdebatan ini berlangsung hingga usai merdeka. Penulisan ini ingin menegaskan pentingnya hukum negara mengubah cara pandangnya terkait keberadaan hukum adat dan masyarakat hukum adat. Hukum adat harus dilihat sebagai bagian dari tubuh bangsa sendiri.

Abstract

Perkembangan teori hukum tidak bisa dilepaskan dari lingkungan zamannya. Upaya memahami hukum harus dimulai dengan mamahami tatanan sosial lingkungannya. Tatanan sosial tersebut pada dasarnya mewakili cara berfikir manusia terhadap lingkungan sosialnya, yang selalu terikat dengan ruang dan waktu. Artikel ini ingin menjawab masalah utama yakni: apa saja pemikiran hukum Satjipto Rahardjo dalam kerangka ilmu hukum? Bagaimana kerangka pemikiran berbasis teori hukum dari Satjipto Rahardjo terkait dengan pembangunan hukum dalam konsep hukum progresif? Pemikiran hukum progresif dari Satjipto Rahardjo, lahir karena keadaan Indonesia pada masa lalu, berkaitan dengan usaha dari pemikir hukum untuk menawarkan gagasannya agar persoalan hukum di negeri ini tidak menemui ?jalan buntu?. Namun demikian konsep pembangunan hukum, konsep hukum progresif berperan penting di dalamnya.

Abstract

This article aims to find out the legal position, authority, and structure of adat(customary) court in Aceh. This study used juridical methods. Data were obtained through literacy studies by examining such as the rule of laws, books, and journals. Data were analyzed using a qualitative descriptive approach. The results of the study showed that adat court in Aceh has a significant position in the legislative system. The authority of the adat court in Aceh is able to resolve small disputes that occur in society. The structure of adat court in Aceh is divided into land and sea areas. Adat court in the land territory consists of the village and the mukim adat court, and the sea territory consists of lhok and district adat court.

Abstract

Trawling is used by most of the local fishermen in Indonesia, in addition to unlawful state and local laws, as well as more serious impact on the function of the environment. This paper would like to address three main issues: what make local communities using trawling? What steps should the government do in combating trawling? How the ideal interaction of state law and local law in the response to trawling? The paper concludes that the use of trawl conscious process impact, can not be separated from the process of modernization, the trawl rationalized will accelerate economic improvement fishermen. District Government is already taking action to give birth responsive policy in order to control the impact of emerging, but the policy was born due to the community itself. The ideal interaction openness state law and local to interact in the context of complement each other. Keywords: Interaction law, customary law, state law, trawling.

Abstract

Two things become an important part of studies in Indonesian law related to energy management. The first, related to the management of natural resources. Second, the energy sector is also related to other sectors, that is forestry, water resources, marine and fisheries, agriculture and plantations, as well as land. Ideally, all of the energy management law must reflect the state ideology, as natural resources energy must be managed for the greater prosperity of the people. Energy should not be administered arbitrarily because, in addition to the utilization, the existence of natural resources should not be separated from the philosophical orientation of Indonesian legislation, Pancasila, and The 1945 Constitution. However, the reality of energy legislation indicates of the authority competes between sectors and alignments to society which is not optimal. It is due to the legal nature of the energy sector which is liberal and still-exploitation oriented and pro-capitalist. By using a socio-legal approach, this paper describes the reconstruction of law-oriented to the Indonesian legal system in energy management based on Pancasila and the 1945 Constitution as the foundation and soul of the energy sector law. Keywords: Reconstruction of Law, Energy Management, the Indonesian Legal System.

Abstract

Hareuta peunulang is a grant of immovable property from parents to their daughters before marriage in Pidie Regency, Aceh Province. Disputes are resolved through customary court, but the settlement that should have been settled at the mukim level was brought to the Mahkamah Shar'iyyah. Therefore, this study aimed to identify the causes of the hareuta peunulang practice disputes and find an effective and efficient model for resolving them through customary courts. Empirical juridical methods were used with data collected data through observation and interviews and analyzed using a qualitative descriptive approach. The results showed that disputes are caused by the lack of deliberation in the hareuta peunulang process. The social plurality of laws makes the dispute resolution model through customary courts ineffective and inefficient. Therefore, the role of the village head (keuchick) and head of mukim (imuem mukim) is needed to educate the community regarding customary justice procedures that should to conducted at the village (gampong) and mukim levels.
