Abstract

State of lawhas thesovereignauthoritytodetermineandregulatetheir ownaffairs for free. State of law teaches that all government action must be based on legislation drafted by the competent institution. Practice anomaly state in Indonesia, on the one hand have a sovereign law-making but on the other hand welcomed the intervention of other parties. The Conditions of legislators who still easily bought and intervention is one of the reasons. Impact the state is ineffective to protect the native land of Indonesia from foreign exploitation. Whereas the agrarian constitution of Indonesia sincerely as developing states have been prepared in line with the International Covenant on Economic, Social and Cultural Rights to set access restrictions by foreign agrarian resources.Legislation that opens wide agrarian access to foreign resources is a infringement of Human Rights, which should be corrected (judicial), hence it does not make pretending law states.Ostensiblyto protect thehomeland of Indonesia, althoughsoldto foreigners. Institutions authorized to make corrections to the laws that are discrepant with the constitution of agrarian is the Constitutional Court. This research subject points is to analyze legislation in the field of agrarian resources that have been corrected and the legal considerations.The study was conducted using the document approach. Such legal materials through library and internet access. Legal materials were examined using a prescriptive-analytical method.Until the beginning of2015there wereninelegislationrelated tothe field ofagrarian resourcesthat have beensuccessfullycorrected, andotherwisecontrary to theconstitution. So the Court's performance should be held up and requires awareness together in finding the national identity, became sovereign over agrarian resources and no intervention from other parties.

Abstract

Generally the infrastructural development needs space and land. In its process, the role of a private sector may not beneglected as this frequently does not take care of the people’s rights on land. The society, as a subject of the development, shouldhave got a prospeorus living condition. Yet, they were marginalized and regarded as an object of the development. KonsepTheconcept of infrastructural development ,which does not grab people’s right on land, takes care of the living resources, andmaintains the sustainable living situation, would be one of the solutions.Key words: land acquisition, infrastructural development.

Abstract

Abstract: Compensation often arises in land acquisition. The purpose of this study is to determine the existence of an appraisal institution in providing an assessment of the land and/or objects that are on it, as a basis for providing reasonable compensation. The study method used in this study is normative juridical approach. The data was critically analyzed using content analysis. The results of the study indicate that the Government has established an independent institution, namely the Land Appraisal Agency, as the basis for providing compensation. The existence of an independent institution was first regulated in Presidential Regulation No. 36 of 2005. In 2012, the Land Appraisal Agency obtained a perfect regulation in a law. However, it is not automatically the only institution that has authority in valuing land prices. The government is still being halfhearted. The Land Appraisal Institution received full position in the land acquisition after the Ministerial Regulation of Agrarian & Spatial Planning/Head of National Land Agency No. 6 of 2015 was made. Intisari: Ganti rugi sering muncul dalam pengadaan tanah. Tujuan kajian ini, untuk mengetahui eksistensi lembaga penilai dalam memberikan penilaian terhadap tanah dan/atau benda-benda yang ada di atasnya, sebagai dasar memberikan ganti rugi yang wajar. Metode kajian menggunakan pendekatan yuridis normatif. Analisis data secara kritis menggunakan konten analisis. Hasil kajian menunjukkan, bahwa Pemerintah telah membentuk lembaga independen yaitu lembaga penilai pertanahan, sebagai dasar memberikan ganti rugi.  Keberadaan lembaga independen pertama kali diatur dalam Peraturan Presiden No. 36 tahun 2005. Pada tahun 2012, lembaga penilai  pertanahan mendapatkan pengaturan yang sempurna dalam sebuah undang-undang. Meskipun, tidak otomatis menjadi satu-satunya lembaga yang memiliki kewenangan dalam penilaian harga tanah. Pemerintah masih bersikap setengah hati. Lembaga penilai pertanahan mendapatkan kedudukan secara penuh dalam pengadaan tanah setelah adanya Peraturan Menteri Agraria & Tata Ruang/Kepala Badan Pertanahan Nasional No. 6 Tahun 2015.

Abstract

Penyelenggaraan pelayanan kesehatan di puskesmas memerlukan SDM kesehatan sebagai penggerak utama. Kurangnya jumlah SDM kesehatan di puskesmas disebabkan sistem perencanaan, pengadaan dan penempatan masih perlu diperbaiki. Permasalahan: 1) Bagaimanakah perencanaan, pengadaan dan penempatan SDM kesehatan di Puskesmas Kota Metro menurut peraturan perundang-undangan yang berlaku? 2) Bagaimanakah implementasi peraturan tentang SDM kesehatan di Puskesmas Kota Metro dalam upaya meningkatkan derajat kesehatan masyarakat? Penelitian ini menggunakan pendekatan normatif dan pendekatan empiris untuk mengkaji pelaksanaan perencanaan, pengadaan dan penempatan SDM kesehatan puskesmas. Hasil penelitian menunjukkan bahwa regulasi perencanaan, pengadaan dan penempatan SDM kesehatan tidak memberikan arahan secara jelas dan lengkap, sehingga proses penempatan SDM kesehatan tidak sesuai dengan perencanaan SDM kesehatan dan tenaga non kesehatan. Pengadaan dan penempatan SDM di Kota Metro belum sesuai pemanfaatan dan pengembangan tenaga kesehatan pada Pasal 24 UU No.36 Tahun 2014. Kebutuhan SDM kesehatan Puskesmas Kota Metro dicukupi dengan meningkatkan sarana kesehatan puskesmas, meningkatkan kompetensi dengan pendidikan dan pelatihan (Pasal 9 Ayat (1) UU No.36 Tahun 2014), merancang peraturan daerah, menempatkan SDM kesehatan top down planning dan botom up planning. Kendala: kurang dukungan dalam pengembangan SDM kesehatan, jumlah SDM kesehatan kurang dari standar, kurang sinkron antara perencanaan, pengadaan dan penempatan SDM kesehatan. Kata Kunci: Peraturan, Perencanaan, Pengadaan, Penempatan, SDM Kesehatan.

Abstract

Cases that arise related to financial reports audited by public accountants cannot be separated from how a public accountant provides his services. The overlap between the services provided by Public Accountants and Practicing Accountants can lead to conflicts of interest, efforts to minimize conflicts of interest do not yet have comprehensive regulations in place to anticipate since applying for permits to anticipate conflicts of interest, currently new conflict of interest limits are from the side of only one public accountant, this legal vacuum needs to be it becomes a thought for policy makers to make regulations that Public Accountants and Practicing Accountants must choose one if they want to apply for a license, they are prohibited from applying for both permits at once but choose only one permit

Abstract

The financial report is a product of management’s responsibility to shareholders. As a report prepared by management, an independent party must conduct an examination and provide a fair opinion on the financial report. In Indonesia, based on Law No. 5 of 2011 concerning Public Accountants, the only party authorized by the state through the Ministry of Finance to audit financial statements is a public accountant under the auspices of a public accounting firm. The audit carried out by the Public Accountant did not fully exercise its authority, as can be seen from the many scandals over the audited financial statements. For this scandal, regulations and laws have determined what sanctions can be given, both in the form of administrative sanctions and legal sanctions, both civil and civil. as well as punishment for responsible parties, including Public Accountants who provide guarantees for the fairness of the Financial Statements. Apart from that, other problems also emerged; the auditees used many fake audit reports, either those made by the auditees themselves by falsifying the names and signatures of the Public Accountants or those carried out by persons who claimed to be from a Public Accounting Firm while not a party with a Public Accountant license.

Abstract

ABSTRAK: Desa atau yang dikenal dengan istilah lain merupakan satuan pemerintahan terkecil yang memiliki kewenangan otonom untuk mengatur dan mengurus pemerintahannya sendiri. Sebagai satuan pemerintahan terkecil yang berada di daerah, banyak persoalan pemerintahan terkait penataan desa yang dihadapi seperti: efektifitas penyelenggaraan pemerintahan, peningkatan kualitas pelayanan publik dan kesejahteraan masyarakat, yang tentu saja membutuhkan peranan aktif pemerintah daerah melalui regulasi yang mendukung pembangunan desa. Tulisan ini bertujuan memberikan algoritma/formula Peraturan Daerah Penataan Desa yang mampu mewujudkan desa yang maju dan berdaya saing. Dengan menggunakan pendekatan socio legal dan teori perundang-undangan serta konsep hukum pengayoman dan hukum progresif, dihasilkan algoritma peraturan daerah sebagai berikut: Peraturan Daerah Penataan Desa harus beranjak dari persoalan riil yang secara umum terjadi di suatu daerah dengan melandaskan pembentukannya pada aspek filosofi, sosiologis dan yuridis; peranan pemerintah daerah harus ditegaskan sampai pada aspek pendanaan hingga pengawasan dan evaluasi; memberikan ruang akses yang seluas-luasnya bagi desa untuk mengembangkan potensinya terkait pemekaran maupun perubahan status. Dengan demikian, diharapkan desa yang maju dan berdaya saing dapat terwujud melalui Peraturan Daerah Penataan Desa. Local Regulation Algorithm of Village Arrangement Toward A Visible and Competitive Village ABSTRACT: The village or other known term is the smallest unit of government with autonomous authority to regulate and administer its own government. As the smallest government unit in the region, many governance issues related to village arrangement are faced such as the effectiveness of government administration, improvement of public service quality and community welfare, which of course require active role of local government through local regulation that supporting village development. This paper aims to provide an algorithm/formulation of Local Regulation Village Arrangement that is able to realize a visible and competitive village. By using socio legal approach and the theory of legislation as well as the concept of hukum pengayoman and hukum progresif, the result of local regulation algorithm as follows: Local Regulation of Village Arrangement must be moved from real problem which generally occur in a region by based its formation on philosophy, sociology and juridical aspect; The role of local government should be emphasized to funding aspects up to monitoring and evaluation; Provide the widest possible access space for villages to develop their potential for division and status change. Thus, it is expected that visible and competitive villages can be realized through the Local Regulation of Village Arrangement.

Abstract

Provisions of Law no. 41 of 2009 concerning the Protection of Sustainable Food Agricultural Land (UU PLP2B) is basically intended to classify a certain area of land that is allowed for appropriate food agriculture activities. This research is to examine the problems of sustainable agricultural land protection after the Job Creation Act and find a solution. The research method is a normative research method with a statute approach and uses content analysis. The findings of this study are changes in agricultural land protection regulations that can cause significant shrinkage of agricultural land and threaten farmer groups for investment. The abolition of the obligation to provide replacement land for affected farmers is not profitable for the farmer, because he will lose his agricultural land. The solution is that the government in determining the location of development projects must avoid the use of fertile/productive agricultural land.
