Abstract

This paper is aimed at exploring the epistemological aspect of the science of Islamic Law, that is, its methods and procedures of analysis. For this purpose, the paper makes use of the deductive-coherency method, inductive-correspondence method, scientific method, phenolmenological method, and functional as well structural method. The paper argues that procedures in studying Islamic Law consists of there levels of analysis, namely taxonomy analysis, competence analysis and information processing. In reading Islamic Law in this way, it is hoped that this science may be developed along side with other social sciences and humanities.

Abstract

Almost all Muslims agree that an authentic prophetic tradition (Ḥadîth) is that which comes directly from the Prophet. A tradition such as this like the Qurân is reliable in terms of its chain of narration and message. Hence, it brings legal and moral implication for the Muslims to apply in their daily life. In the science of prophetic tradition, such tradition is called darûrî, literally means compulsory in the sense that it necessitates Muslims to comply. Different sort of view however, is being introduced by an orientalist named G.H.A. Juynboll. He comes up with an entirely different view concerning an authentic prophetic tradition both in terms of its category and definition. He reckons that there is no such thing as an authentic prophetic tradition. Every prophetic tradition is vague, and falls therefore under the category of being inauthentic. This paper is interested in dealing critically with this controversial view by giving particular attention to four main issues; the issue of definition, criteria, the number of narrators, and the rationale of a prophetic tradition to be deemed authentic.

Abstract

In his study of Qur’anic structure, Michel Cuypers applied Semitic Rhetoric that has been used to analyze Biblical structure. Despite having received positive responses from Gabriel Said Reynolds and others, Cuypers’ method was criticized by Nicolai Sinai for ignoring rhyme in the Qur’an and overdoing in maintaining the existence of the ring structure in the Qur’an. This paper, then, attempts to examine this analytic method from the perspective of the Qur’anic sciences’ (‘ulu>m al-Qur’a>n). This study aims to determine proportionally the characteristics of the method and the effect it produces by using descriptive-analytic and comparative research methods. This paper argues that there are subjectivity and inconsistency in dividing the text and determining the structure of its composition, as in the study of surah al-Qa>ri‘ah by Cuypers, and an ignorance of the information about reasons for the revelations (asba>b al-nuzu>l) and Prophet’s explanation about verses. However, the application of this method can lead to a new interpretation of the Qur’an, namely by using the information in the Qur’an itself, indicators of wording around it (siya>q), and verse correlation (muna>saba>t). On the other hand, this method supports the authenticity and coherence of the Qur’anic text, which has become a debate among the Orientalists.

Abstract

Abstrak: Pemahaman dan penetapan hukum dalam fikih tidak dapat dipisahkan dari teks-teks sumber ajaran Islam seperti Al-Qur’an dan Hadits Nabi juga konteks yang berupa fakta empiris dalam kehidupan masyarakat muslim. Kedua aspek ini menjadi konsiderasi meskipun posisi dan porsinya tidak mesti sama. Sebagai ajaran samawi tentu teks lebih dikedepankan daripada konteks, tetapi melupakan konteks sama sekali bukanlah tindakan yang benar karena pada dasarnya hukum Islam diturunkan untuk kepentingan manusia agar mereka bahagia di dunia dan akhirat. Teks atau dalil-dalil hukum Islam sifatnya terbatas, sementara persoalan-persoalan hukum dalam masyarakat tidak terbatas. Budaya dan kehidupan sosial masyarakat senantiasa berkembang. Terlebih pada zaman globalisasi sekarang ini yang menuntut adanya cara pendekatan tertentu dalam penetapan hukum Islam kontemporer.Tulisan ini mencoba untuk memper-kenalkan metodologi filosofis dalam kajian fikih yang berkenaan dengan budaya dan sosial. Setidaknya ada tiga pendekatan filosofis terhadap fikih budaya dan sosial. Pertama, pendekatan historis, yaitu hukum Islam yang sudah dipraktikkan umat Islam dalam sejarah, bukan semata-mata sebagai aturan hukum syariat. Kedua, mempertimbangkan prinsip-prinsip hukum Islam yang bersifat absolut dan universial dalam menetapkan fikih sosial dan budaya. Ketiga, melakukan pemahaman yang seimbang antara pendekatan tekstual dan kontekstual. Abstract: The understandingand establishmentof law inIslamic jurisprudencecan not beseparatedfrom thetextsof Islamicsource such asthe Qur'an and Traditions of the Prophet as well as the context which are the empirical factsin the life of Muslim community. The two aspects become considerationalthough their positionandportions are notnecessarily the same. Certainly, as thedivineteachings, the text is moreadvancedthanthe context, but forgetting thecontextis not the correct actionbecause basicallyIslamic lawrevealedto mankindso thatthey are happyin this world and hereafter. Texts ofIslamic law are limited, while thelegalissuesin the communityare endless and unlimited.Culturalandsocial life ofthe communityare constantly evolvingespecially in theeraof globalization,demands aparticularapproachin setting the contemporaryIslamic law.This paper attemptstointroduce aphilosophicalmethodologyin the study ofIslamicjurisprudencewith regard toculturaland social issues.There are at leastthreephilosophicalapproachtosocial and cultural jurisprudence. Abstract

Setiap Muslim percaya bahwa al-Qur’ân secara wurûdbersifat qath’î, karena ia dikumpulkan dan ditulis padamasa Nabi serta ditransmisikan secara mutawâtir. Namuntidak demikian dengan Hadîts. Ia tidak semuanya ditulispada masa Nabi. Karenanya, para ulamâ’ berupayamengkaji Hadîts berikut rantai transmisinya untukmenentukan validitas (ke-shahîh-an) sebuah Hadîts melaluikritik transmisi Hadîts. Artikel ini akan menyorotipersoalan tersebut, sehingga akan memberikan pemahamantentang makna dan syarat-syarat kritik Hadîts sertahubungan antara kritik Hadîts dengan validitas danpengujiannya. Validitas Hadîts tidak hanya bergantungpada Hadîts itu sendiri, tetapi ditentukan melaluiinvestigasi historis dan pendekatan metodologis. Dalamkaitan ini, kemampuan personal dan kualitas intelektualpara perawi Hadîts memiliki peran signifikan dalammenentukan apakah sebuah Hadîts itu diterima atau tidak.Untuk itu, ktirik Hadîts tidak hanya bertujuan untukmenilai dan mengetahui validitas sebuah Hadîts danprofesionalitas perawinya, tetapi juga untukmengakomodasi kebergunaannya sebagai sumber hukumIslam kedua.

Abstract

The historical account of hadith literatures clarifies that there are different methods among Muslim scholars in search of the authenticity of hadith. The dispute lies on the variance methods used by hadith and sufi scholars. Sufi scholars tend to have their own methods in establishing the reliability of hadith narration by liqâ’ al-Nabî and kashf. This method suggests that Sufiwith high ranking of spiritualitycould meet Prophet directly by dreams. By this way, Sufi scholar might acquire the original Islamic teachings from Prophet, including hadith. In this, they argue for the authenticity of hadiths narrated by such a way. On the other hand, the methods used by sufi are not accommodated by hadith scholars. It is said that every hadith narrated by dream or kashf is unrecognized and considered as false (maw?û‘). Addressing these differences, this article tries to examine some problems related to the method of authenticity of hadith narration, the account of hadith on the convergence to the Prophet by dream, kashf as a source of Islamic teaching, the status of mysterious hadiths transmission, and the validation of knowledge based on kashf.

Abstract

The Qur'an has proven to have inspired and produced many tafseer books with various approaches, methods and interpretive tendencies. The book of Shafwah Al-Tafasir is a contemporary tafseer hwo has written by Ali Al-Shabuni which has a unique and distinctive methodology. Because of this, this article aims to examine the exegetical methodology applied by Ali Al-Shabuni in interpreting surah Al-Rahman and to find out the advantages and weaknesses of its methodology. The results of this study indicate that the uniqueness of the methodology applied by Al-Shabuni in interpreting surah Al-Rahman is combine the riwayah and dirayah approaches and the tahlili and ijmali methods. In addition, it also use the tendency of al-adabi al-ijtima’i and the systematic, and contemporary interpretive techniques with additional footnotes to make it easier for readers to refer to the original source. As well as, the Ali Al-Shabuni’s methodology in the Book’s Shafwah Al-Tafasir has the advantages and the weaknesses. Abstract

Sufism is a spiritual exercise dimension that is often done irationally in one hand. On the other hand, rationalism is a faculty of mind based totally on rational dimension. So, in fact, it is almost impossible to elaborate both of them in one bowl of life. However, Harun Nasution’s (HN) thought had blended both of them become a couple of wings to envision Indonesian muslim way of thinking and to aggregate his life both spiritually and ascetically.  The root of his thought genealogically can be traced in four steps. Firstly, HN’s literate religious family nurtured his childhood. Secondly, his further adventure dealing with rationalism idea surely affected his progressive thought. His work: The Place of Reason in Abduh’s Theology, Its Impact on His Theological System and Views articulates his strong point on rationalism in Islamic studies. Moreover, it became direct correction to school of Ash’aria theology. Thirdly, sufism aspect of  HN demonstrated himself as a consistent figure who do spiritual exercise (riyadhoh) for himself by enriching zikr and praying. Finally, his rational Islamic thought has influenced the Indonesian Islamic thought constellation within Indonesia muslim scholars until recently. In spite of many critics addressed to him, many appreciations also come to him. To analyze his faculty of thought, this paper aims at exploring datas on him based on historical phenomenological theory. It is to constitute the presence of subject (HN) in his historical life. His intentional consciousness with regards to his Islamic rationalism and sufism is a factor for rational sufism in the line of Indonesia’s Islamic thought constellation.

Abstract

This study aims to reveal the failure of the state to use its authority to ensure the fulfilment of religious freedom for all its citizens maximally and adequately because, in practice, the state sometimes takes refuge behind the slogan of neutrality when it sees the majority group committing violent practices against minority groups. This study uses a discourse analysis method with a phenomenological approach to understanding the meaning of various events and human interactions. Meanwhile, the data was collected through literature study, media study, and observation using content analysis and discourse analysis methods in processing the data. Then this research results in the finding that opening the state accommodation gap to the demands of the majority religious group will provide space for them to take advantage of the similarities in their religious ideology with state actors and then attempt to dictate state policy. The inability of the state to be neutral in solving the problems of its people, at the same time, has given rise to the impression that a handful of certain social classes have controlled the state. Even this research results also show that tendencies of intolerance and discrimination arise in the community.

Abstract

Sufism is a spiritual exercise dimension often carried out irrationally. Meanwhile, rationalism is a faculty of mind based on rational dimension, thus, it is almost impossible to elaborate both. Harun Nasution’s thought blended them to be the Indonesian Muslims’ way of thinking and live his life both spiritually and ascetically. His rational Islamic thought influenced the Indonesian thinkers profoundly until today. Analyzing his thought, this paper explores the data about him using Edmunds Husserl’s Phenomenology Theory. The phenomenological historical approach aims at understanding the text about Harun Nasution and his thought from the way the text says about it. In other words, this paper attempts to apprehend his rational sufism based on his works, namely Islam Rasional and Mistisisme dalam Islam. His intentional consciousness with regard to his Islamic rationalism blended with sufism is a factor in accordance with the trend within Indonesia’s intellectuals’ Islamic thought. It particularly influenced his students in the academic and activist world. As a study reflection on his thought and the intellectual influence academically, Islam should be presented as a historical religion that is expected to answer and explore real problems in the society. Islam should be studied with a holistic, multidisciplinary, and interdisciplinary approach.
