Abstract

Mekanisme Gugatan Warga Negara (Citizen Lawsuit) belum diatur secara khusus dalam peraturan perundang-undangan di Indonesia. Penulis akan membahas dan menganalisis lebih lanjut tentang mekanisme gugatan warga negara (Citizen Lawsuit) di Indonesia serta apa yang menjadi dasar pertimbangan Perbuatan melanggar hukum yang didalilkan dalam gugatan warga negara (Citizen Lawsuit). Dalam penulisan penelitian ini penulis menggunakan jenis penelitian yuridis normatif dengan metode pendekatan konseptual dan pendekatan perundang-undangan. Konsep Mekanisme Citizen Lawsuit dalam praktik peradilan perdata di Indonesia mengacu pada yurisprudensi kasus-kasus Citizen Lawsuit ditahun sebelumnya. Perbuatan melanggar hukum yang didalilkan dalam gugatan warga negara (Citizen Lawsuit) mengacu pada ketentuan Pasal 1365 Kitab Undang-Undang Hukum Perdata yang unsur-unsurnya harus memenuhi adanya suatu perbuatan, perbuatan tersebut harus melanggar hukum, adanya kerugian bagi korban, dan adanya hubungan kausal antara perbuatan dengan kerugian.

Abstract

Seiring perkembangan zaman, uang yang sebelumnya berupa logam dan uang kertas konvensial kini berkembang menjadi sistem pembayaran elektronik atau non tunai. Adanya perkembangan pembayaran non-tunai seperti ini tidak jarang ditemui masalah yang terjadi dalam masyarakat, baik itu berupa rusaknya kartu, hilangnya saldo tanpa disadari pengguna e-money. Dalam penelitian ini adapun permasalahan yang akan diangkat adalah pengaturan e-money sebagai alat pembayaran di Indonesia dan tanggung-jawab penerbit terhadap hilangnya saldo e-money. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan meneliti bahan pustaka yang ada, baik itu peraturan perundang-undangan maupun buku-buku, yang disusun secara sistematis dalam rangka menemukan suatu kebenaran berdasarkan logika keilmuan hukum dari sisi normatifnya. Adapun kesimpulan penelitian ini yaitu pengaturan uang elektronik sebagai alat pembayaran non tunai di Indonesia berdasarkan Peraturan Bank Indonesia Nomor 20/6/PBI/2018 tentang uang elektronik, belum ada undang-undang yang mengatur secara khusus mengenai uang elektronik. Tanggung jawab penerbit dalam penyelenggaraan uang elektronik dapat dibagi menjadi tiga yaitu tanggung jawab produk, tanggung jawab terkait informasi produk, dan tanggung jawab atas keamanan produk.

Abstract

Money laundering is a special class of crimes and is classified as a major crime regulated in Law Number 8 of 2010 concerning the Prevention and Eradication of Anti-Trafficking Drugs. Has the potential to damage economic, security, and social consequences. The strategy to eradicate money laundering requires the advocate profession to participate in efforts to eradicate money laundering as stipulated in Government Regulation Number 43 of 2015. The birth of this Government Regulation poses obstacles for professionals. In this Government Regulation one of them is the advocate profession which is classified as a reporting party who is obliged to submit suspicious financial transaction reports to PPATK. On the one hand, Article 19 paragraph (1) of the Advocate Law also states that an advocate is obliged to keep everything secret obtained from his client because of his professional relationship, unless specified by law. In writing this study, a type of normative juridical study is used with a conceptual approach also a legislative approach. The regulation regulated in Government Regulation No. 43 of 2015 is because the advocate profession is vulnerable to being used by money laundering perpetrators. With the obligation, it will circumstantial avoid them from using advocates with their immunity rights to do the crimes.

Abstract

Money laundering is a complex follow-up crime with significant impacts on the economy, national security, and social stability. In Indonesia, Law No. 8 of 2010 on the Prevention and Eradication of Money Laundering (PPTPPU Law) serves as the primary legal framework to combat this crime, designating advocates as reporting parties under Article 17(2) and Government Regulation No. 43 of 2015. Advocates are required to report suspicious financial transactions, such as asset management or establishment of legal entities, with exemptions for tasks related to determining a client's legal position or handling cases, as stipulated in Article 8(2) of the Regulation, in line with the confidentiality principle under Article 16 of Law No. 18 of 2003 on Advocates. However, implementation faces ethical dilemmas, lack of socialization, and inconsistent reporting standards, undermining system effectiveness. Comprehensive training and coordination are needed to strengthen advocates role in safeguarding financial system integrity without compromising professionalism.

Abstract

The regulation of success fee agreements in Indonesia remains largely interpretative, characterized by the predominance of contractual freedom and the absence of explicit normative limits. This study examines the policies and challenges surrounding success fee arrangements between advocates and clients, focusing on the interplay between legal certainty, ethical boundaries, and professional standards. Using a normative juridical method that integrates statutory, conceptual, and comparative approaches, the research explores the disharmony between the Indonesian Advocates Law, the Indonesian Advocates Code of Ethics, and the professional guidelines issued by PERADI. The findings reveal that, while success fees provide flexibility and proportional compensation based on case outcomes, the lack of uniform quantitative standards and the blurred distinction between lawful success fees and prohibited quota litis practices have created legal uncertainty. Furthermore, the ethical prohibition against remuneration solely based on case results limits the enforceability of such agreements. A comparative analysis with the English system, particularly its Conditional Fee Agreements and Damages Based Agreements, highlights the importance of transparent regulation, proportional limits, and ethical oversight to balance professional autonomy with client protection. Accordingly, this study recommends a reformulation of Indonesia’s policy framework to harmonize ethical norms and positive law, ensuring that success fee agreements promote fairness, professionalism, and legal certainty within the advocacy practice.

Abstract

Tourism sector development contributes to regional income growth. One example is Gianyar Regency, which has various tourist destinations, including the Ceking Terrace Tourist Attraction. This destination is famous for its terraced views located in Kedisan Traditional Village, Tegallalang District. This research discusses the regulation and implementation of the profit-sharing agreement in the management of the Ceking Terrace Tourist Attraction. The method used is empirical legal research. The results of the study show that the legal regulation regarding the profit-sharing in the management of this tourist attraction is governed by the Gianyar Regency Regional Regulation No. 10 of 2013. This regulation stipulates that traditional villages and traditional institutions have rights within the profit-sharing system for managing this tourist attraction. The profit-sharing agreement includes the rights and obligations of the involved parties, including the management body of the Ceking Terrace Tourist Attraction, which is entitled to guarantees as per the agreed contract. The management body is also obligated to ensure the smooth operation of the management. Additionally, landowners are entitled to compensation for the rice fields used as tourist attractions, with the obligation to maintain its beauty in accordance with the agreement
